The Surprise Exam Paradox continues to perplex and torment despite the many solutions that have been offered. This paper proposes to end the intrigue once and for all by refuting one of the central pillars of the Surprise Exam Paradox, the 'No Friday Argument,' which concludes that an exam given on the last day of the testing period cannot be a surprise. This refutation consists of three arguments, all of which are borrowed from the literature: the 'Unprojectible Announcement Argument,' the (...) 'Wright & Sudbury Argument,' and the 'Epistemic Blindspot Argument.' The reason that the Surprise Exam Paradox has persisted this long is not because any of these arguments is problematic. On the contrary, each of them is correct. The reason that it has persisted so long is because each argument is only part of the solution. The correct solution requires all three of them to be combined together. Once they are, we may see exactly why the No Friday Argument fails and therefore why we have a solution to the Surprise Exam Paradox that should stick. (shrink)

There is an epistemological skepticism that I might be dreaming now, or I might be a brain in a vat (BIV). There is also a demonstration that derives the skeptical conclusion about knowledge of the external world from the premise C1, i.e., I do not know “I am not dreaming (not a BIV) now.” Pessimistic critics (e.g., F. Strawson, B. Stroud) consider that the refutation of C1 is impossible, whereas others have attempted the direct refutation of C1 (e.g., G. E. (...) Moore, H. Putnam, C. Wright), and some (e.g., F. Dretske, R. Nozick) have attempted to refute the closure principle of knowledge used in the demonstration while permitting the validity of C1. Another scholar, M. Williams, maintains that the skeptical demonstration is true only if we presuppose the epistemological premise that we choose to accept or reject at will. It seems that most critics tend to adopt a strategy that allows them to effectively avoid the skeptical consequence, thereby conceding the validity of C1. However, it is difficult to say whether their attempts succeeded, and in my opinion, they are indeed unsuccessful. This is because their concession to Descartes’ argument is insufficient. Their lack of success could also stem from the incompletion of Descartes’ own methodological doubt. The somewhat paradoxical‐sounding aim of this thesis is to show that the skeptical paradox about knowledge can be dissolved only if the Cartesian skepticism is extended far beyond the endpoint of his attempt. My first meeting with Kenneth I nada was in 1964, when I passed through Hawai‘i, on my way back from India, at the invitation of Charlie Moore, Editor of Philosophy East and West and Director of that summer’s East-West Philosophers’ Conference. : Any precise version of H-D needs to handle various problems, most notably, the problem of selective confirmation: Precise formulations of H-D should not have the consequence that where S confirms T, for any T', S confirms T&T'. It is the perceived failure of H-D to solve such problems that has lead John Earman to recently conclude that H-D is "very nearly a dead horse". This suggests the following state of play: H-D is an intuitively plausible idea that breaks down (...) in the attempt to give it a precise formulation. Indeed I think that fairly captures the view among specialists in the field of confirmation theory. Here I argue that the truth about H-D is largely the reverse: H-D can be given a precise formulation that avoids the longstanding technical problems, however, it relies on a fundamentally unsound philosophical intuition. The bulk of this paper involves reviewing the problems affecting previous attempts at giving precise formulations of H-D and displaying some recent versions that can handle these problems. It then briefly explains why the basic intuition behind H-D is itself unsound, namely, because H-D involves a tacit assumption of inductive scepticism. Finally, the historical relation between H-D and the positivists' quest for a criterion of empirical significance will be reconsidered with the surprising result that having glossed H-D as fundamentally unsound it is concluded that a sound version of the criterion of empirical significance is now available. The demarcation criterion, the positivists' philosopher's stone that serves to separate claims with empirical significance from claims lacking empirical significance having finally been found, it is argued that we should regard empirical significance as just one among a variety of virtues and not follow the positivists in taking it to be a sin qua non for all meaningful statements. At the time of this writing, a widely publicized, waived-consent trial is underway. Sponsored by Northfield Laboratories, Inc. (Evanston, IL) the trial is intended to evaluate the emergency use of PolyHeme®, an oxygen-carrying resuscitative fluid that might prevent deaths from uncontrolled bleeding. The protocol allows patients in hemorrhagic shock to be randomized between PolyHeme® and saline in the field and, still without consent, randomized between PolyHeme® and blood after arrival at an emergency department. The Federal regulations that govern the waiver (...) of consent restrict its applicability to circumstances where proven, satisfactory treatments are unavailable. Blood - the standard treatment for hemorrhagic shock - is not available in ambulances but is available in hospitals. The authors argue that the in-hospital stage of the study fails to meet ethical and regulatory standards. (shrink)

An extensive data search among various types of developmental and evolutionary sequences yielded a ‘four quadrant’ model of consciousness and its development . Each of these dimensions was found to unfold in a sequence of at least a dozen major stages or levels. Combining the four quadrants with the dozen or so major levels in each quadrant yields an integral theory of consciousness that is quite comprehensive in its nature and scope. This model is used to indicate how a general (...) synthesis and integration of twelve of the most influential schools of consciousness studies can be effected, and to highlight some of the most significant areas of future research. The conclusion is that an ‘all-quadrant, all-level’ approach is the minimum degree of sophistication that we need into order to secure anything resembling a genuinely integral theory of consciousness. This paper contrasts the normative foundations of the stakeholder and shareholder theories of the firm. It demonstrates how the shareholder theory of the firm appears to have at least as much normative support as stakeholder theory and suggests that a way forward may be for a variant of pure shareholder theory to emerge.

Criteria of ineffability are presented which, it is claimed, preclude the possibility of truths that are ineffable, but not the possibility of other things that are ineffable—not even the possibility of other things that are non-trivially ineffable. Specifically, they do not preclude the possibility of states of understanding that are ineffable. This, it is argued, allows for a reappraisal of the dispute between those who adopt a traditional reading of Wittgenstein’s Tractatus and those who adopt the new reading recently championed (...) by Cora Diamond, James Conant, and others. By maintaining that what the nonsense in the Tractatus is supposed to convey is ineffable understanding, rather than ineffable truth, we can do considerable justice to each of these readings. Although the path-integral formalism is known to be equivalent to conventional quantum mechanics, it is not generally obvious how to implement path-based calculations for multi-qubit entangled states. Whether one takes the formal view of entangled states as entities in a high-dimensional Hilbert space, or the intuitive view of these states as a connection between distant spatial configurations, it may not even be obvious that a path-based calculation can be achieved using only paths in ordinary space and time. Previous work has (...) shown how to do this for certain special states; this paper extends those results to all pure two-qubit states, where each qubit can be measured in an arbitrary basis. Certain three-qubit states are also developed, and path integrals again reproduce the usual correlations. These results should allow for a substantial amount of conventional quantum analysis to be translated over into a path-integral perspective, simplifying certain calculations, and more generally informing research in quantum foundations. In this paper, I consider Michael Fried’s recent contribution to the debate around the experience of video art, made in relation to the work of Douglas Gordon. Fried speculates that issues of antitheatricality may in fact be key to specifying the medium of video installation. While Fried’s position offers a useful way of framing the relation with the beholder in video art, in a way that pointedly moves beyond tautological notions of activating spectatorship, I question how theatricality is to be (...) thus defined. Referencing the beholding of painting, I distinguish the implicit beholder from the literal spectator, and claim that the distinction has relevance for video art. However, I welcome what seems to be an explicit acknowledgment from Fried that the position of the spectator is a contributory factor in what he terms empathic projection. I argue that video art as a spatial practice offers a distinct mode of reception by positioning the spectator in relation to two-dimensional figurative space to which she is excluded. (shrink)

This paper investigates how the reader of prose fiction fills in the blanks regarding a fictional character’s membership category, action, and reason for the action. Aligning with an ethnomethodological approach to texts and appropriating membership categorization analysis (MCA), we analyze how the readers of J. D. Salinger, an author whose works are well known for their ambiguity and ambivalence, would grasp the unwritten identities of characters and the meanings of their actions. Our analysis specifies two types of methods deployed for (...) the reader to understand the fictional texts. First, in an at-a-glance way, the reader can supply the missing categories and sequence of actions by turning to the commonsense knowledge and social norms regarding the association between the category and the activity. Second, the reader can construct various interpretations regarding the recognizably ambiguous scenes of the text by turning to the conceptual knowledge of the relevant social phenomena, the maxims specific to the act of storytelling, and the writer’s techniques peculiar to the fictional texts. The findings demonstrate the vast applicability of an MCA approach to the analysis of the work of reading prose fiction and shed light on the detailed operations of the author’s maxims and techniques in the textual configuration of prose fiction, thereby indicating the possibility of ethnomethodological analysis including the interwoven consideration of the reader’s activity and the textual organization. I interpret Mill?s view on logic as the instrumentalist view that logical inferences, complex statements, and logical operators are not necessary for reasoning itself, but are useful only for our remembering and communicating the results of the reasoning. To defend this view, I first show that we can transform all the complex statements in the language of classical first-order logic into what I call material inference rules and reduce logical inferences to inferences which involve only atomic statements and the material (...) inference rules. Then I explain why we introduce logical operators and logical inference rules into a system of the latter kind. In the end I determine what kind of negation is justified from this point of view. “How is society possible?” posed by Georg Simmel has been one of the fundamental problems in sociology. Although various attempts have been made to solve it, I conceive that “society” in the problem remains to be articulated. Simmel provides us with two concepts of society—“society as interaction” and “society as unity”—to be distinguished. Some research traditions in sociology have been concerned with the former, others have dealt with the latter. On the other hand, Simmel maintains continuity between them. In this (...) sense, his concept of “society” has “ambiguous” characteristics. It seems to me that in the ambiguous style Simmel had intended to reveal the secret of “society,” but in the end could not have got to it. In my opinion, in order to unveil the secret, it is required that, drawing on Schutzian phenomenologically oriented sociology, sociologists or social scientists make a differentiation between the society which is realized or brought about by partners with no need of an observer, “the social,” and the society which an observer recognizes by use of the concept. In this article, from a Schutzian point of view, I wish to articulate “society” and to indicate four phases of “society.” These investigations lead to a reformulation of the problem of “how is society possible?” and sociology (or the social sciences) which makes possible the deeper understanding of society. It is now 110 years since the first reported medical use of donor insemination. Despite its somewhat doubtful beginnings and its chequered history, especially up until the 1970s, DI has become a well accepted and utilised part of most infertility treatment services. An American survey in 1988 reported that approximately 80,000 women a year undergo the procedure, and that over 30,000 children are born each year. The only figures from the United Kingdom cover a 5-month period between August 1 and (...) December 31, 1991, and show that 4,260 patients were treated with DI during this period. This paper describes the situation of philosophy in Japan with respect to the question of internationalism. For more than a hundred years, Japan took Western culture as its model and European philosophy as the authentic philosophy. This tendency was paradoxically strengthened by the post‐war humanism. It gave us Japanese philosophers a clear discipline to work in but cut us off from our own native culture, history, and philosophical traditions. In wishing to recover this loss, I argue that it is necessary (...) to distinguish between two forms of internationalism: humanistic and merely fashionable. In American, the terms “schism,” “heresy,” “sect,” and “cult” have been used to describe splinter groups as they distinguish themselves from the majority religion. The term cult has been used in two different senses. Within the Roman Catholic Church a group’s devotion to a particular saint may earn them the title “Cult of” that particular saint. However, among contemporary American Protestants the term cult has come to be applied to religious groups that split from mainstream Christianity with regard to their (...) beliefs and behavior to the degree that the groups are considered dangerous to themselves and society. When it comes to defining what a cult is, only about ten percent of the attention is placed on a cult’s beliefs and ninety percent is placed on a cult’s behavior. In fact, there seems to be a general squeamishness about using the term cult in the first place. There are several reasons for this malaise toward the term, but this article will argue that the term cult can and should be used in general and scholarly contexts. (shrink)

One of the central debates amongst U. S. constitutional theorists for more than a generation has been between (conservative) ‘originalists’ arguing that, in interpreting and applying the Constitution, judges are duty bound to adhere to the original understandings at the time of the Constitution’s adoption and (liberal/progressive) ‘living constitutionalists’ arguing rather that, when appropriate, judges should read the Constitution in light of contemporary needs and moral aspirations. While acknowledging the significance and legitimacy of the originalist call for fidelity to history (...) and newly incorporating elements of their arguments into his theory, Fleming, in Fidelity to Our Imperfect Constitution, re-affirms moral aspirationalism as the ultimate foundation of the interpretive project. I argue here, as against Fleming, that the opposition that he (and other American constitutional theorists) have drawn between originalism’s historicism and living constitutionalism’s moral aspirationalism is a false binary – the contingent product of a developmental succession of political battles between American conservatives and progressive/liberals over the course of the twentieth century. I argue here, contra Fleming, that in both theory and practice, in the U. S. at least, history and moral aspiration are and have always been inextricably intertwined —inseparable— and that, going forward, U. S. constitutional historians and theorists would do better by forthrightly acknowledging and accounting for this fact, and dynamic. (shrink)

Might architecture be reconceived as a form of performance? I draw upon Nelson Goodman’s writing on architecture—including his account of architectural notation—and David Davies’s performance theory, which claims that artworks should be considered not as products made by generative performances, but rather as the performances themselves. I tie the exemplification that Goodman identifies as the primary way architectural works ‘mean’ to the role of the architectural ‘score’, recast not as a mere ‘constraint’ but as integral to the creative processes by (...) which architecture establishes an ‘artistic statement’ and a distinctive ‘virtual’ realm. In so doing, I reconcile such a position with an aesthetics of reception, whereby the situated encounter with the physical building is seen as essential to the critical retrieval of any given architectural performance. I test this position against a late work by Sigurd Lewerentz, completed when he was in his eighties, and examine the extraordinary lengths necessitated by his idiosyncratic imperative not to cut any bricks, thereby articulating an artwork every bit as radical as contemporaneous works by conceptual artists. Although we use randomness when we don’t know any better, a principle of indifference cannot be used to explain anything interesting or fundamental. For example, in thermodynamics it can be shown that the real explanatory work is being done by the Second Law, not the equal a priori probability postulate. But to explain the interesting Second Law, many physicists try to retreat to a “random explanation,” which fails. Looking at this problem from a different perspective reveals a natural solution: boundary-based (...) explanations that arguably should be viewed as no less fundamental than other physical laws.
