KeatingA historically conversant reader interested in the current state of discourse regarding Catholicism and American politics will find a good amount of familiar discord. He will discover, for example, that the life issues continue to bedevil. Can a Catholic vote in good conscience for an abortion-rights candidate over a pro-life competitor if that candidate is more supportive of (...) other policies in line with Catholic Social Teaching? This issue has, of course, been with the American Church for some time now, even if it has taken on renewed urgency given the coincidence of the overturning of Roe v. Wade with the presidency of Joseph Biden, the second Roman Catholic to hold that office and a recent convert to pro-choice stridency. The action of the Supreme Court and the battles within the various states will ensure that abortion remains at the political heart of American Catholicism for years to come. One can say something similar about other issues, such as immigration, gun control, and economic justice. None of this will be found to be particularly surprising. The same cannot be said, however, of the return of a more fundamental question, one thought to have been settled since the mid-1960s. That question is whether Roman Catholicism and American liberal democracy are incompatible to the extent that Catholics ought to seek, if possible, another constitutional arrangement, one more friendly to the Catholic cause.Our reader would be familiar with the standard narrative that, while the existence of a medieval Church in a modern polity that upholds religious freedom had been a matter of concern since the dawn of the Republic, it [End Page 991] became serious only in the first half of the twentieth century as the number of Catholics and their influence grew. Until that time, American bishops, such as Archbishop John Ireland (1815–1918), made a special point of speaking publicly on the benefits of American freedom for the Church, just as they made clear that Catholics could be as patriotic as any other citizen. If there were tensions, they came primarily from anti-Catholic bigotry and governmental overreach. Things changed, however, when the point at issue was no longer primarily a religious one of Catholic believers infecting their Protestant neighbors with erroneous doctrine, but rather the threat so many Catholics posed to the fate of American freedom itself. In a postwar America concerned with the spread of Soviet communism, Paul Blanshard found a ready audience for his scholarly anti-Catholic diatribes, American Freedom and Catholic Power (1949) and Communism, Democracy, and Catholic Power (1951).1 Without much difficultly, he pointed to various statements of Gregory XVI and Pius IX condemning the separation of Church and state, the freedom of religious conscience, and democracy as the best governmental form. To top things off, he had Leo XIII's Testem Benevolentiae, an 1899 letter to the Cardinal Archbishop James Gibbons of Baltimore, warning him and his fellow bishops not to speak of the constitutional arrangement of the United States as a political ideal. While Leo had positive things to say about the American system, his admonition followed the traditional line: while constitutional protections of religious freedom are necessary when Catholics are in the minority, the ideal situation is a state that officially confesses and supports the Catholic religion. Of more recent vintage, Blanshard could quote the response of America's best-known Catholic theologian, Monsignor John A. Ryan, to the question of whether non-Catholics would be permitted to practice their religion in this ideal state:If these are carried on within the family, or in such inconspicuous manner as to be an occasion neither of scandal nor of perversion to the faithful, they may be properly tolerated by the State,... Quite distinct from the performance of false religious worship and preaching to the members of the erring sects, is the propagation of the false doctrine among Catholics. Branding has long been seen as an effective means of marketing products. The use of brand-based marketing campaigns, however, has come under intense scrutiny over the past 10 years for its power to facilitate deception and emotional manipulation. As a way of proceeding through the many differing moral assessments, this paper turns for insight to the tradition of writing on social ethical issues within the Roman Catholic Church. The author suggests that Catholic Social Teaching offers a distinctive approach to advertising (...) ethics that charts a middle course between the two poles of the debate on branding. This article introduces readers to the approach to advertising developed within Vatican documents on media, highlighting the basic values at stake and the particular moral norms for advertising that are articulated. The article then applies these values and norms to the case of brandbased advertising, ultimately suggesting that advertisers approach their work through the virtue of solidarity. (shrink)

From time immemorial people of all tribes and cultures have marked a sharp distinction between those individuals deemed qualified by age, expertise, or status to choose or write the rules, and those other, lesser individuals who are (...) obliged merely to obey those rules. This is the traditional difference between a person, on the one hand, and a utensil, on the other: persona est sui iuris; servus non est persona ("A person chooses its own laws; a slave is not a person"). Persons, but not utensils such as shoes, have, and deserve, good will. To a person, a culture is a means of creating a sustainable humane environment. To a culture, a person is a means for the culture to replicate itself. Placing culture first is a tradition we can no longer afford to maintain, because it makes enduring peace impossible. The purposes utensils can be made to serve have become too terrible (and, with the advent of global communication, too obvious) for the human race to endure, and the capacity of the voiceless to express themselves violently is increasing without limit. Hence we must create new traditions in which we teach all our children reflective thought, with which rules are pragmatically justified rather than unquestionable. To that end I propose to distinguish random, routine, and reflective thought and action. Each of these three levels of thought and action has its costs and its benefits; together they contain the entire range of human possibility. Childress (bio)A quarter of a century ago, in my second year of teaching at the University of Virginia, I began to explore the emerging field of biomedical ethics through a seminar on “Artificial and Transplanted Organs,” which included both faculty and students from law, medicine, and the humanities. My paper for the seminar was entitled “Who Shall Live When Not (...) All Can Live?” This experience drew me into biomedical ethics, because of the complex mix of ethical, legal, and medical issues and the fruitfulness of interdisciplinary and interprofessional dialogue.Several of the major problems confronting that seminar have persisted, often in altered form. In the area of organ transplantation, two significant issues continue to require society’s attention: (1) how can the organ supply be increased, and (2) how should the available organs be allocated? I want to make a few points about ethical criteria in the allocation of donated organs, as a way to indicate some directions for organ allocation policies in the twenty-first century. I will focus on the second question because I believe that a tremendous and ever-widening gap will persist between the need for transplantable organs and the supply of human cadaveric organs.Community Ownership of Donated Organs and Public ParticipationSince the mid-1980s, the operative conception of the ownership of donated organs has shifted, with major implications for the procedures used to formulate policies for organ allocation. As vice-chair of the federal Task Force on Organ Transplantation in the mid-1980s, I did not immediately realize that debates about allocation policies often reflected different conceptions of the ownership of donated organs. More specifically, organ allocation policies largely presupposed that donated organs belonged to, or were under the dispositional authority of, transplant surgeons, with only limited public accountability. However, the Task Force (1986) held that donated organs belong to the community, and that transplant professionals are only trustees and stewards of those organs for the [End Page 397] community’s welfare. This conception of ownership implies that the public should participate in setting the criteria for organ allocation.According to Jeffrey Prottas (1994), another member of the Task Force, these shifts represent the “socialization” of organ transplantation. Although professional dominance, through knowledge and power, continues in the United Network for Organ Sharing (UNOS)—the national organ procurement and transplantation network that was established in the late 1980s—that dominance is now more circumscribed and accountable, particularly because UNOS, in developing any allocation policy, has to respond “to public criticisms with public answers.” Not only is organ allocation policy now in the public domain—and thus a matter of public ethics rather than medical ethics—the terms of the debate have changed, as Prottas further notes, so that equity must be considered along with efficiency.Balancing Several Ethical Principles or ValuesThe main ethical criteria for organ allocation express principles that are prominent in the major competing theories of justice, particularly libertarian, egalitarian, utilitarian, and communitarian theories. The principles of liberty, equality, utility, and community all play important roles, and organ allocation policies often seek to balance these competing principles, which frequently are specified or circumscribed—for instance, utility is specified as medical utility. Just or equitable policies are found in the process of balancing.UNOS (1994) attempts to develop an equitable organ allocation system in light of a “set of basic principles” and “specific measurable objectives” that have been derived from these principles. It uses the metaphor of “balance” for its efforts to relate these different principles and objectives. For instance, it holds that balancing requires that “equal consideration” be given to both medical utility and to justice, so that neither can be ranked a priori over the other. Howard S. Cohen and Michael Feldberg, Power and Restraint: The Moral Dimension of Police Work, New York Praeger, 1991; xvii + 166 pp.

In this paper I consider three necessary conditions for a proposition counting as a theory: that the proposition be posited for its explanatory power; that it derive its feasibility from the extent to which it provides such explanatory power; and that it be empirically falsifiable. I then argue that some propositions might fail as theories because they do not satisfy the first two conditions, yet still satisfy the third condition. Such propositions I label falsifiable non-theories. I offer folk psychology (the (...) proposition that beliefs, desires, and other intentional phenomena exist and play essential motivational and causal roles in many human actions) as a paradigm example of a falsifiable non-theory. I then argue that theism is in an analogous position. Like folk psychology, it fails to satisfy the first two conditions above for most theists. However, the empirical implications that theism has do make it susceptible to falsification. I demonstrate such falsifiability by an extreme scenario from Keith Yandell. Then I argue that recent work by Paul Draper demonstrates how a well articulated empirical argument from evil might threaten just such falsification. (shrink)

We investigated spectral resting-state EEG in persons with chronic stroke-induced aphasia to determine its reliability, sensitivity, and relationship to functional behaviors. Resting-state EEG has not yet been characterized in this population and was selected given the demonstrated potential of resting-state investigations using other neuroimaging techniques to guide clinical decision-making. Controls and persons with chronic stroke-induced aphasia completed two EEG recording sessions, separated by approximately 1 month, as well as behavioral assessments of language, sensorimotor, and cognitive domains. Power in the classic (...) frequency bands was examined via spectral analysis of resting-state EEG data. Results suggest that power in the theta, alpha, and beta bands is reliable for use as a repeated measure. Significantly greater theta and lower beta power was observed in persons with aphasia than controls. Finally, in PWAs theta power negatively correlated with performance on a discourse informativeness measure, while alpha and beta power positively correlated with performance on the same measure. This indicates that spectral rsEEG slowing observed in PWAs in the chronic stage is pathological and suggests a possible avenue for directly altering brain activation to improve behavioral function. Taken together, these results suggest that spectral resting-state EEG holds promise for sensitive measurement of functioning and change in persons with chronic aphasia. Future studies investigating the utility of these measures as biomarkers of frank or latent aphasic deficits and treatment response in chronic stroke-induced aphasia are warranted. (shrink)

A wide-ranging and interdisciplinary set of fifteen essays, Peacebuilding not only brings (...) to the fore the unique ways that Roman Catholic theology and practice has contributed to the global work of peacebuilding, but it also makes the case that the Catholic Church needs to develop a more robust theology of peacebuilding to complement and strengthen traditional Catholic approaches to the ethics of war and peace. The two most bold proposals along these lines are Daniel Philpott’s call for a papal encyclical on peacebuilding (92, 120) and Maryann Cusimano Love’s proposal of “just peace” criteria for guiding peacebuilding work in a fashion similar to the way “just war” criteria have guided the conduct of war (82, 425–27).Peacebuilding is organized into two main sections. The first documents and theorizes the work of Catholic actors and organizations in peacebuilding work. In one of the most helpful essays in this section, John Paul Lederach describes how the “ubiquitous presence” of the Catholic Church in a society is, in fact, one of the most unique contributions the Church has to make to global peacebuilding. Lederach uses the phrase “ubiquitous presence” to describe the unique role Catholic “actors” play within the “pyramid approach” to peacebuilding that he develops elsewhere (see Lederach, The Moral Imagination: The Art and Soul of Peacebuilding [New York: Oxford University Press, 2005], 79). Because of its hierarchical structure, the Catholic Church—especially in Catholic-majority countries—has the potential to cultivate peacebuilding allies among different sectors of a society: the elite, “midlevel” actors, and at the grassroots level. Many other peacebuilding actors—politicians, civil society activists, and the historic peace churches, for instance—do not have such a ubiquitous presence. While Lederach has previously emphasized the importance of midlevel actors in peacebuilding, in this essay he argues that the “ubiquitous presence” of the Catholic Church [End Page 213] in a society provides a basis for making connections for peacebuilding work among a range of sectors within a society. Several of the other contributors to this book draw on this observation and demonstrate its usefulness to a variety of settings. From Bishop Wilberforce in the 1860s to the advocates of "creation science" today, defenders of traditional mores have condemned Darwin's theory of evolution as a threat to society's values. Darwin's defenders, like Stephen Jay Gould, have usually replied that there is no conflict between science and religion--that values and biological facts occupy separate realms. But as James Rachels points out in this thought-provoking study, Darwin himself would disagree with Gould. Darwin, who had once planned on being a clergyman, was (...) convinced that natural selection overthrew our age-old religious beliefs. Created from Animals offers a provocative look at how Darwinian evolution undermines many tenets of traditional philosophy and religion. James Rachels begins by examining Darwin's own life and work, presenting an astonishingly vivid and compressed biography. We see Darwin's studies of the psychological links in evolution (such as emotions in dogs, and the "mental powers" of worms), and how he addressed the moral implications of his work, especially in his concern for the welfare of animals. This paper contrasts two information-theoretic approaches to statistical explanation: namely, (1) an analysis, which originated in my earlier research on problems of testing stochastic models of learning, based on an entropy-like measure of expected transmitted-information (and here referred to as the Expected-Information Model), and (2) the analysis, which was proposed by James Greeno (and which is closely related to Wesley Salmon's Statistical Relevance Model), based on the information-transmitted-by-a-system. The substantial differences between these analyses can be traced to the following (...) basic difference. On Greeno's view, the essence of explanation lies in the relevance relations expressed by the conditional probabilities that relate the explanans variables to the explanandum variables; on my view, in contrast, the essence of explanation lies in theories viewed as hypothetical structures which deductively entail conditional probability distributions linking the explanans variables and the explanandum variables. The explanatory power of a stochastic theory is identified with information (regarding the values of explanandum variables) which is "absorbed from" the explanans variables. While other information which is "absorbed from" the explanandum variables (through the process of parameter estimation, for example) reflects descriptive power of the theory. I prove that Greeno's measure of transmitted information is a limiting special case of the E-I model, but that the former, unlike the latter, makes no distinction between explanatory power and descriptive power. Given the portion of his life spent at military schools, it is striking that Ender and his peers apparently never study military ethics. The ethical lessons Ender and his peers might have learned are so obviously relevant to operations against the buggers that you cannot help but ask how the I.F.'s leadership could have failed to teach military ethics at all. This chapter presents some highlights of Western thinking on the ethics of war and analyzes Ender's education and actions in (...) light of those moral traditions. Ender's Game teaches powerful lessons for students of just war theory and the just war tradition because it asks questions that matter to everyone, from national decision‐makers all the way down to individual soldiers. William James catalogued an amazing diversity of religious experiences. Yet even the pluralistic James was able to find a nucleus, consisting of an uneasiness and its solution, ‘1. The uneasiness, reduced to its simplest terms, is a sense that there is something wrong about us as we naturally stand. 2. The solution is a sense that we are saved from the wrongness by making proper connection with the higher powers.’ But by stressing the moral factor, James seems (...) to exclude those who stress rather the sense of mystery stemming from man's theoretical limitations. Einstein, for example, writes: ‘The most beautiful thing we can experience is the mysterious side of life. It is the deep feeling which is at the cradle of all true art and science. A wide-ranging and interdisciplinary set of fifteen essays, Peacebuilding not only brings (...) to the fore the unique ways that Roman Catholic theology and practice has contributed to the global work of peacebuilding, but it also makes the case that the Catholic Church needs to develop a more robust theology of peacebuilding to complement and strengthen traditional Catholic approaches to the ethics of war and peace. The two most bold proposals along these lines are Daniel Philpott’s call for a papal encyclical on peacebuilding (92, 120) and Maryann Cusimano Love’s proposal of “just peace” criteria for guiding peacebuilding work in a fashion similar to the way “just war” criteria have guided the conduct of war (82, 425–27).Peacebuilding is organized into two main sections. The first documents and theorizes the work of Catholic actors and organizations in peacebuilding work. In one of the most helpful essays in this section, John Paul Lederach describes how the “ubiquitous presence” of the Catholic Church in a society is, in fact, one of the most unique contributions the Church has to make to global peacebuilding. Lederach uses the phrase “ubiquitous presence” to describe the unique role Catholic “actors” play within the “pyramid approach” to peacebuilding that he develops elsewhere (see Lederach, The Moral Imagination: The Art and Soul of Peacebuilding [New York: Oxford University Press, 2005], 79). Because of its hierarchical structure, the Catholic Church—especially in Catholic-majority countries—has the potential to cultivate peacebuilding allies among different sectors of a society: the elite, “midlevel” actors, and at the grassroots level. Many other peacebuilding actors—politicians, civil society activists, and the historic peace churches, for instance—do not have such a ubiquitous presence. While Lederach has previously emphasized the importance of midlevel actors in peacebuilding, in this essay he argues that the “ubiquitous presence” of the Catholic Church [End Page 213] in a society provides a basis for making connections for peacebuilding work among a range of sectors within a society. Several of the other contributors to this book draw on this observation and demonstrate its usefulness to a variety of settings. In my estimation, this is the most important contribution of the volume.The second section consists of six essays that both expand upon existing Catholic moral theology and make the case that Catholic theology needs to develop a more robust theology of peacebuilding. Here we find a range of arguments—from Robert Schreiter’s proposal for a practical theology of reconciliation and Peter Phan’s outline of a fourfold Catholic understanding of interreligious dialogue to Kenneth Himes’s discussion of the ways peacebuilding theory challenges and complements contemporary Catholic social teaching. Himes, in particular, claims that the current acceptance of a Catholic “presumption against war” requires a more robust Catholic approach to conflict transformation; in making his case, he draws on resonances between contemporary peacebuilding theory and recent reflections on jus post bellum (justice after war) as a new category of just war thinking.As in nearly every edited collection, the quality of the essays in Peacebuilding varies. I found the essays in the first section to be the most stimulating. Not only do they highlight the peacebuilding work the Catholic Church is currently doing around the world, they also ground their proposals for how we should understand and do peacebuilding from a Catholic perspective in relevant historical examples.Indeed, the varied nature of the essays in Peacebuilding is precisely what makes it a valuable resource for both researchers and teachers of peacebuilding. On the one hand, it includes essays that break new ground and move forward our understanding of the unique nature of Catholic peacebuilding. Woodward's long awaited book is an attempt to construct a comprehensive account of causation explanation that applies to a wide variety of causal and explanatory claims in different areas of science and everyday life. The book engages some of the relevant literature from other disciplines, as Woodward weaves together examples, counterexamples, criticisms, defenses, objections, and replies into a convincing defense of the core of his theory, which is that we can analyze causation by appeal to the notion of manipulation.

James C. Scott’s book The Art of Not Being Governed is offered, in this essay review, as the latest evidence of the high value of Scott’s transdisciplinary research into how ordinary people resist state power. Scott’s critics have found his work methodologically deficient, suggesting that his approach is more a matter of art than of science. In this defense of methodological pluralism, Scott’s approach is shown to be vindicated by his insights into how the peoples of Zomia evolved ways (...) to evade incorporation, over a period of centuries, into any of the states of Southeast Asia. Scott’s book is examined as a prime example of how the study of politics can and should help to effect political change — and its insights on anarchism as a way of life are applied to the Occupy Wall Street movement. In elementary logic textbooks, Venn diagrams are used to analyze and evaluate the validity of syllogistic arguments. Although the method of Venn diagrams is shown to be a powerful analytical tool in these textbooks, it still has limitations. On the one hand, such method fails to represent singular statements of the form, “a is F.” On other hand, it also fails to represent identity statements of the form, “a is b.” Because of this, it also fails to give an account (...) of the validity of some obviously valid arguments that contain these types of statements as constituents. In this paper, owing to the developments in the literature on Venn diagrams, we offer a way of supplementing the rules of the Venn diagram found in textbooks, and show how this retooled Venn diagram technique could account for the problem cases. If theism is true, then there exists a being to which we appropriately refer with the term ‘God’. This point is analytic. Any object to which we appropriately refer with the term ‘God’ bears certain properties – e.g. omniscience, omnipotence and moral perfection. While the analyticity of this point may be a matter of debate, I find no problem granting its necessary truth , at least for the purposes of this paper. There are properties essential to the appropriate wearing of (...) the title ‘God’. Does it follow from these claims that the object to which we appropriately apply the term ‘God’ bears the properties in question – omniscience, omnipotence, etc. – essentially? Is God essentially God? Or is it possible that the being to whom we refer with ‘God’ exist but not be God? Many would assume that the answers to these questions are obvious – that God is God essentially, or not at all. However, I wish to argue that there may be properties essential to Godhood, but not essential to the being that is God. (shrink)

This book explores, in rich and rigorous ways, the possibilities and limitations of “thick” autonomy in light of contemporary debates in philosophy, ethics, and bioethics. Many standard ethical theories and practices, particularly in domains such as biomedical ethics, incorporate minimal, formal, procedural concepts of personal autonomy and autonomous decisions and actions. Over the last three decades, concerns about the problems and limitations of these “thin” concepts have led to the formulation of “thick” concepts that highlight the mental, corporeal, biographical and (...) social conditions of what it means to be a human person and that enrich concepts of autonomy, with direct implications for the ethical requirement to respect autonomy. The chapters in this book offer a wide range of perspectives on both the elements of and the relations between “thin” and “thick” concepts of autonomy as well as their relative roles and importance in ethics and bioethics. This book offers valuable and illuminating examinations of autonomy and respect for autonomy, relevant for audiences in philosophy, ethics, and bioethics. (shrink)

After briefly sketching common-morality principlism, as presented in Principles of Biomedical Ethics, this paper responds to two recent sets of challenges to this framework. The first challenge claims that medical ethics is autonomous and unique and thus not a form of, or justified or guided by, a common morality or by any external morality or moral theory. The second challenge denies that there is a common morality and insists that futile efforts to develop common-morality approaches to bioethics limit diversity and (...) prevent needed moral change. This paper argues that these two critiques fundamentally fail because they significantly misunderstand their target and because their proposed alternatives have major deficiencies and encounter insurmountable problems. This paper provides a restatement and defense of the data/ phenomena distinction introduced by Jim Bogen and me several decades ago (e.g., Bogen and Woodward, The Philosophical Review, 303–352, 1988). Additional motivation for the distinction is introduced, ideas surrounding the distinction are clarified, and an attempt is made to respond to several criticisms.

Focusing mainly on respect for autonomy, particularly autonomous choices and actions in bioethical decisions, I examine several complexities of enacting this respect through the case of a fourteen-year-old boy who died after being allowed to refuse a necessary blood transfusion on religious grounds. I argue that thicker concepts of autonomy, closely connected with relational autonomy, direct our attention to aspects of respect for autonomy that are often neglected or underappreciated in much bioethical theory and practice. In particular, they illuminate the (...) interpretive complexity of respecting autonomous choices by focusing attention on the relational context of individuals’ decisions, on respect for individuals’ social-cultural beliefs and values, and on the temporality of selves, as expressed in their past consent or future consent as well as in—and sometimes in contradiction to—their present consent or dissent. However, it is important not to convert the illuminating and valuable insights from theories of relational autonomy into necessary conditions of autonomous choices and actions and hence of respect for autonomy. If the contemporary rebirth of the ontological argument had its conception in Norman Malcolm's discovery of a second Anselmian argument it had its full-term delivery as a healthy philosophical progeny with Alvin Plantinga's sophisticated modal version presented in the tenth chapter of The Nature of Necessity. This latter argument has been the centre of a huge body of literature over the last fifteen years, and deservedly so. This paper argues that Wittgenstein, both early and late, rejects the idea that the logically simpler and more fundamental case is that of "the mere sign" and that what a meaningful symbol is can be explained through the elaboration of an appropriately supplemented conception of the sign: the sign plus something. Rather the sign, in the logically fundamental case of its mode of occurrence, is an internal aspect of the symbol. The Tractatus puts this point as follows: “The sign is (...) that in the symbol which is perceptible by the senses.” Conversely, this means that it is essential to a symbol – to what a symbol is – that it have an essentially perceptible aspect. For Wittgenstein there is no privileged direction of explanatory priority between symbol and sign here: without signs there are no symbols and without some sort of relation to symbols there are no signs. This paper explores some issues concerning the nature and structure of causal explanation in psychiatry and psychology from the point of view of the “interventionist” theory defended in my book, Making Things Happen. Among the issues is explored is the extent to which candidate causal explanations involving “upper level” or relatively coarse-grained or macroscopic variables such as mental/psychological states (e.g. highly self critical beliefs or low self esteem) or environmental factors (e.g. parental abuse) compete with explanations that instead appeal to (...) underlying, “lower level” or more fine gained neural, genetic, or biochemical mechanisms. "Public Bioethics collects the most influential essays and articles of James F. Childress, a leading figure in the field of contemporary bioethics.
