In this paper, I will describe how Brentano was able to integrate descriptive philosophy and logical analysis fruitfully by pointing out Brentano’s concept of philosophy as a rigorous science. First I will clarify how Brentano attempted to turn philosophy into a rigorous descriptive science by applying scientific methods to philosophical questions. After spelling out the implications of such a descriptive understanding of philosophy, I will contrast this descriptive view of philosophy with a semantic-analytic understanding of philosophy as proposed by Frege. After having thus set the stage I will argue that the current separation of philosophy into the seemingly antithetical strands of phenomenology and analytic philosophy may be seen as a consequence of how the term ‘rigorous science’ in ‘philosophy as a rigorous science’ is interpreted: Does a rigorous science grasp its object with as much exactitude as possible? Or is a science rigorous when its theories are expressed unambiguously, and their implications are drawn with precision? In the course of this investigation I will also point out how Brentano’s integrative use of descriptive philosophy and analysis can provide a suitable starting point for an equally successful integration of these methods in contemporary philosophy. The theory of visual perception that Irvin Rock develops and supports in this book with numerous original experiments, views perception as the outcome of a process of unconscious inference, problem solving, and the building of structural descriptions of the external world.

Hilary Putnam has argued that computational functionalism cannot serve as a foundation for the study of the mind, as every ordinary open physical system implements every finite-state automaton. I argue that Putnam's argument fails, but that it points out the need for a better understanding of the bridge between the theory of computation and the theory of physical systems: the relation of implementation. It also raises questions about the class of automata that can serve as a basis for understanding the (...) mind. I develop an account of implementation, linked to an appropriate class of automata, such that the requirement that a system implement a given automaton places a very strong constraint on the system. This clears the way for computation to play a central role in the analysis of mind. (shrink)

Surveying job segmentation within nursing, this article analyzes attempts by professional registered nurses and nursing educators to resist the deskilling of nursing. In so doing, they have reinforced race and class segmentation within nursing. The article concludes with a discussion of class, race, and gender stratification and suggests that resistance to deskilling may reinforce inequalities among women.

At the turn of the 21st century, a collection of donors created the Alliance for a Green Revolution in Africa (AGRA) to spark a “new” Green Revolution on the African continent. Since its inception, AGRA’s mission has revolved around a series of interventions designed around the idea of making agriculture a “business.” In this paper, I ask how AGRA puts such discourses into practice with a particular focus in Ghana. To do so, I draw on a television show produced by (...) AGRA called Kuapa, organizational literature, and to a lesser extent, interviews, to assess how AGRA materializes its goals in Ghana. Ultimately, I argue that a focus on discourse not only provides insight into how AGRA conceptualizes agricultural transformation, but also how AGRA pursues agronomic, political, and social changes in the countries in which it intervenes. Since the 1990s, glycated haemoglobin (HbA1C) has been the gold standard for monitoring glycaemic control in people diagnosed as having either type 1 diabetes mellitus (T1DM) or type 2 diabetes mellitus (T2DM). Discussions are underway about diagnosing diabetes mellitus on the basis of HbA1C titres and using HbA1C tests to screen for T2DM. These discussions have focused on the relative benefits for individual patients, with some attention directed towards reduced costs to healthcare systems and benefits to society. We argue that (...) there are strong ethical reasons for adopting HbA1C-based diagnosis and T2DM screening that have not yet been articulated. The rationale includes the differential impact of HbA1C-based diabetic testing on disadvantaged groups, and what we are beginning to learn about HbA1C vis-à-vis population health. Although it is arguable that screening must primarily benefit the individual, using HbA1C to diagnose and screen for T2DM may promote a more just distribution of health resources and lead to advances in investigating, monitoring and tackling the social determinants of health. This paper explores the financial reporting scandals of the past decade and the resulting U.S. legislative attempts to impose ethical behavior and control the incidence of new reporting problems via the Sarbanes-Oxley legislation. We begin with a brief historical perspective followed by assertions of ethical consequences of legislation with discussions of key recent corporate scandals, the motives for the frauds, and the consequences. Ethics related provisions of the Sarbanes-Oxley Act are discussed with the potential impact of the legislation on the (...) likelihood of similar future frauds and accompanying prognosis for future corporate ethical behavior. Within the field of medical ethics, discussions related to public health have mainly concentrated on issues that are closely tied to research and practice involving technologies and professional services, including vaccination, screening, and insurance coverage. Broader determinants of population health have received less attention, although this situation is rapidly changing. Against this backdrop, our specific contribution to the literature on ethics and law vis-à-vis promoting population health is to open up the ubiquitous presence of pets within cities and towns for (...) further discussion. An expanding body of research suggests that pet animals are deeply relevant to people’s health (negatively and positively). Pet bylaws adopted by town and city councils have largely escaped notice, yet they are meaningful to consider in relation to everyday practices, social norms, and cultural values, and thus in relation to population health. Nevertheless, not least because they pivot on defining pets as private property belonging to individual people, pet bylaws raise emotionally charged ethical issues that have yet to be tackled in any of the health research on pet ownership. The literature in moral philosophy on animals is vast, and we do not claim to advance this field here. Rather, we pragmatically seek to reconcile philosophical objections to pet ownership with both animal welfare and public health. In doing so, we foreground theorizations of personhood and property from sociocultural anthropology. (shrink)

Heart Robot was a public engagement project funded by the Engineering and Physical Sciences Research Council. The aim of the project was to challenge cultural perceptions of robots, and to stimulate thought and debate in members of the general public around research in the field of social and emotional robotics. Fusing the traditions of Bunraku puppetry, the technology of animatronics and the field of artificial emotion and social intelligence, Heart Robot presented a series of entertaining, thought-provoking, and moving performances at (...) fourteen events in the south-west region of the UK between May and December 2008. Based on a creative use of the phenomenological method, we argue that a close examination of the temporality of objects reveals the future as genuinely open. Without aiming to decide the matter of phenomenological realism, we suggest that this method can be used to investigate the mode of being of objects in their own temporality. By bracketing the anticipatory structure of experience, one can get a sense of objects’ temporality as independent of consciousness. This contributes to the current Realism versus (...) Idealism debates, but it does so without taking sides. The starting point is neither an analysis of pure consciousness, nor attempts to describe objects in-themselves, but the idea that things can be phenomenologically grasped through the difference between their temporality and our own. By being methodically “open to the future,” one can become aware of the sui generis temporality of objects as different from the temporality shaped by our anticipation. (shrink)

Professor Needham tells me that I have misunderstood him, and I am sure he is right that I need to work harder to understand his arguments more fully and more precisely. But he has also misunderstood me, as well—no doubt because I have not expressed myself as carefully as I ought to have done. He writes that I have “clearly” argued that “the only possibility of representing nineteenth-century chemistry as a theoretical pursuit” is based on chemical atomism. I do not (...) believe that. For instance, Lavoisien antiphlogistic theory at the beginning of the century, and chemical thermodynamics and certain aspects of reaction dynamics a few decades later, did not depend on an atomistic view of nature.I do plead guilty to the claim that “at the heart of the theoretical achievement” of nineteenth-century chemistry stood “atomic and molecular theory”. Is reality static, or dynamic and relational? This book dives into the complexities of this question to reveal a new view of the relationship between thinking and being. Philosophy has traditionally considered reality as a set of static objects. This book transcends this understanding to explore the depths of relational and dynamic ontology. These explorations can be both complex and problematic as it attempts to understand and conceptualize becoming. To navigate this level of understanding, this book takes a novel path (...) into dynamic realism that is both temporal and relational, without dismissing the epistemological implications. It combines phenomenology and process ontology in a way that is neither naive nor reductive. With an appetite to challenge ways of thinking that can be argued as outdated in our rapid, interconnected world, this book will provide insight, inspiration and lead to further questioning as to the depths our understanding can go to. My contribution takes up a set of methodological and philosophical issues in linguistics that have recently occupied the work of Devitt and Rey. Devitt construes the theories of generative linguistics as being about an external linguistic reality of utterances, inscriptions, etc.; that is, Devitt rejects the ‘psychologistic’ construal of linguistics. On Rey’s conception, linguistics concerns the mental contents of speaker / hearers; there are no external linguistic items at all. I reject both views. Against Devitt, I argue that the philosophical (...) issues in linguistics should be framed in terms of the theories themselves, not pre-theoretical conceptions front either philosophy or commonsense as to what linguistics is about or what a language is. In this light, I suggest that Devitt’s key arguments (concerning parameter setting, psychological reality, and the role of intuitions) do not make sense of current linguistic inquiry and so do not offer an adequate philosophical basis of that work. To this extent, I agree with Rey. Ourdifferences emerge over the putative role of content in linguistic inquiry and how the concept of computation ought to be understood. Following the lead of Chomsky’s recent philosophical remarks, I argue that a theory of the language faculty should be understood as an abstract specification of the function that pairs ‘sound’ with ‘meaning’ rather than as a specification of the content the mind represents. But doesn’t ‘computation’ presuppose ‘representation’? I argue for a negative answer, at least if ‘representation’ is read intentionally. A ‘representation’ can be construed as brain structure that, at the present stage of inquiry, can only be picked out via the abstract concepts of linguistic theory. We are entitled to posit such structures insofar as they earn their explanatory keep over the output of the faculty. The linguistic function is a way of setting the boundary conditions on what the brain must be doing such that humans get to be competent speaker / hearers, although we do not therefore take the function to be a story of the causal spring of linguistic performance. In a publication of 1831 later seen as a milestone in the development of chemistry, Justus Liebig announced a new apparatus for the analysis of organic compounds and provided analytical results for fifteen substances. In this paper we used the detailed descriptions published by Liebig in 1837 to reconstruct his apparatus and methods for hydrogen, carbon and nitrogen analysis. Our replications of his analyses of racemic acid, cinchonine, narcotine, and urea reveal that his two pieces of apparatus give excellent results (...) for carbon and hydrogen content, but erratic results for nitrogen. The results corroborate the assessments of Liebig and his contemporaries, and show that the analytical method for carbon and hydrogen analysis was remarkably accurate. We offer this case, with its convincing replicability, not only to clarify the nature of Liebig's innovations, but also as a new model for understanding broader contested issues in the philosophy and sociology of science. Our analysis suggests that the great shift in science from gentlemanly avocation to professional vocation was tightly linked to laboratory practice, and not just to social networks and context. It also provides the basis for a critique of H. M. Collins's theory of the 'experimenters' regress'. (shrink)

It is a puzzling fact that the Greek term for Nature ‘physis’ could be used to refer to i) reality as a whole, ii) the nature of something, iii) to individual material beings or materiality and iv) all things that are self-generating. In order to understand and tie together this wide array of possible meanings, I will consider the thesis that ‘physis’ was in fact used as a concept of being, a term naming the fundamental property of all of reality (...) in the early pre-Socratics, poets and scientists before 500 BCE. Investigating ‘physis’ in this way can give us a way of thinking about Nature as a dynamic and creative but material process that goes far beyond the classical understanding of Nature as the sum of things that self-generate or the modern mathematical understanding of Nature born with Galileo, dominant to this day. In this contribution, I will argue for an ontological understanding of time as temporality. This, however, implies that in a certain sense being is temporality, by which I mean that on an ontological level temporality is nothing but the process of change, i.e. the dynamic aspect of being in its becoming, changing, and perishing, and that concrete beings are not merely in time, but they are temporal. This leads to the conclusion that actual time is the process of change that (...) becoming beings are, as well as the conclusion that reality is fundamentally temporal as argued by process metaphysicians like Alfred North Whitehead, Henri Bergson, Martin Heidegger, and Gilles Deleuze. The investigation begins with first establishing the methodological difficulties involved in thinking temporality as an ontological feature. In a second step, dynamic ontologies are introduced as the conceptual background best suited to think ontological temporality and their difference to event-ontologies is explained. Finally, the distinction between temporality and linear time is clarified. This introduction of temporality ends with some arguments for the existence of temporality that are inspired by Aristotle’s famous investigations into the nature of time. After having thus introduced temporality as an ontological feature and argued for the existence and relevance of it, its implications for our understanding of the dimensions of time and especially for anticipation are discussed. Although Kant is often considered the philosopher who ended the reign of metaphysical dogmatism, the situation is not quite so clear. On the one hand, this analysis must bear in mind that Kant himself had a great interest in metaphysics, insofar as it was not dogmatic – Kant himself considered his Critique to be just a reform of metaphysics. On the other hand, the Critique of Pure Reason itself is a result of certain metaphysical-dogmatic preliminary decisions. In order to show (...) how one-sided the idea is that Kant simply did away with metaphysics, I will draw attention to the metaphysical presuppositions that shape the Critique of Pure Reason. The first thinker who attempted to explicate the metaphysical basis of the Critique was Kant’s friend and colleague Johann Georg Hamann. With Hamann’s guidance I will argue that even his Critique of Pure Reason was based on metaphysical presuppositions and that such an influence by metaphysical preliminary decisions is inevitable – even for such a sharp critic of metaphysical dogmatism as Kant. At the same time this text provides an introduction to Hamann’s thought, a thinker ahead of his times. (shrink)

For centuries most ontological systems have been based on the presupposition that the paradigmatic type of being is the kind of being things like stones and houses have. But if one looks at the beginning of Philosophy, at the emergence of philosophic thought, this choice was not obvious. For the pre-Socratics and even for Plato and Aristotle it was not obvious that reality is composed out of static and distinct elements. In this paper I investigate this relationship between a static (...) and a dynamic account of reality both in its historic as well as systematic dimension. I argue that ontologies are ultimately based on an analysis of predication and that dynamic ontologies are mainly based on an empirical or phenomenological investigation of singular and concrete reality. Starting from the metaphor of “playing chamber music at a rock festival” used by Peter L. Berger in 1992 to describe the impact of The Social Construction of Reality on US sociology, this article works out how the book’s somewhat puzzling legacy as a bestseller and a classic with remarkably rare direct follow-ups in the US discourse can indeed be conceived. I argue that one needs to take into account the theoretical-historical context in which Berger and Luckmann developed their ideas, (...) including the specific forms of knowledge production in US sociology at the time, the institutional background of the book’s emergence at the New School for Social Research and the author’s biographical trajectories. On this basis, on can explain why Berger and Luckmann’s reformulation of the sociology of knowledge both perfectly met the 1960s Zeitgeist and at the same time remained theoretically marginal. Are animals moral agents? In this article, a theologian and an anthropologist unite to bring the resources of each field to bear on this question. Alas, not all interdisciplinary conversations end harmoniously, and after much discussion the two authors find themselves in substantial disagreement over the answer. The article is therefore presented in two halves, one for each side of the argument. As well as presenting two different positions, our hope is that this article clarifies the different understandings of morality (...) in our respective fields and will help to offset confusion in interdisciplinary dialogue. In what follows, we each present our case. In the first section, Adam Willows argues that moral activity necessarily involves the use of reason, symbolic thought, and language and is on that basis an exclusively human affair. In the second, Marcus Baynes-Rock discusses his experience of relationality with other creatures; a relationality which, he argues, creates a shared understanding of obligations which are characteristically moral. Over the last half century, United States debates about abortion focused at first on the question whether the fetus is a person with rights and later on whether involuntary conception—for instance, as a consequence of sexual assault—might mitigate a woman’s responsibilities toward the fetus she carries. This article argues that, whatever one’s position on these two questions, a third, morally salient dimension of most US women’s experiences of unwanted pregnancy deserves more attention: both abortion and birth burden women with their (...) inevitable moral failure to fulfill their responsibilities to persons who frequently have de facto last‐resort and unavoidable claims on them. Using Lisa Tessman’s work on moral failure and Pope Francis’s interventions on abortion and mercy, I argue that this moral anguish is not a simple emotional remainder. Structural evil, not necessity, is the primary driver of forced pregnancy choices that injure women and their children both materially and morally. Consequently, whether they abort or carry to term, women with unwanted pregnancies need mercy or forgiveness. But they also need compassionate solidarity: prophetic, active efforts to transform the social structures that make material harm and moral failure, and consequent moral anguish and moral injury, inevitable for many pregnant women. How does a country achieve a public capital market in which firms can raise capital from investors? In seeking clues and hypotheses, this article looks back to the dawn of the public corporation in the United States. The battles for control of the Erie Railroad, known as the "Scarlet Woman of Wall Street," a reference to its ill repute, stand at the symbolic center of these developments. The battles for control, which waxed and waned between 1868 and 1872, involved: the (...) titan of the transportation age, Cornelius Vanderbilt; the brilliant and notorious stock market manipulator and takeover entrepreneur, Jay Gould; the largest and most powerful railroad of the era, the Pennsylvania; control over rail transportation to New York City; and the politics and courts of New York, Pennsylvania, and Ohio. It was played out in the securities markets, the courts, the legislatures, and the newspapers and attracted the attention, and condemnation, of some of the leading commentators of the day. Rereading this history from the vantage point of the end of the twentieth century, several features are striking. First, the battles are remarkably familiar: they are recognizably modern battles for control over a widely-held corporation. Second, many of the tactics utilized are now illegal. Finally, surprising connections emerge between antitrust, federalism, and the emergence of public capital markets. (shrink)

Black and Gilson have argued that “venture capital can flourish especially – and perhaps only – if the venture capitalist can exit from a successful portfolio company through an initial public offering, which requires an active stock market.” But nothing in the Black and Gilson analysis requires that the exit option be a domestic capital market. In this article, I use the phenomenon of Israeli hi-tech companies going public on the Nasdaq as a case study to explore the connection between (...) a venture capital industry and domestic capital markets in a world of global capital and product markets. Palliative care and medical-legal partnership are complementary disciplines dedicated to integrating care to treat the whole patient and intervening before a legal or medical issue is at a crisis point. In this paper, we discuss the founding and operations of the Yale Palliative Medical Legal Partnership, give examples of typical cases, explain special considerations in this area of law, and propose areas for further research.
