Este artículo tiene por objeto dar una versión diferente y más breve del poema que contiene una demanda morisca de ayuda al Imperio Otomano, poema estudiado por James Monroe en Al-Andalus XXXI, 281-303. Esta versión indica que había habido otra demanda similar por parte de los moriscos al sultán mameluco de El Cairo, y que ésta era la original. El artículo contiene: 1) un análisis comparativo de las versiones de la casida dirigidas a los mamelucos y a los otomanos, 2) (...) el marco histórico de las relaciones entre los reinos cristianos y musulmanes de la Península Ibérica por un lado y los territorios mameluco y otomano por otro, y 3) una discusión de la fecha de las dos versiones de la casida, así como su autoría. Parece probable que el autor de la casida perteneciera a círculos de musulmanes granadinos que habían formado parte de las clases dirigentes de Granada y que luego habían aceptado puestos en la administración cristiana de la ciudad, como son, por ejemplo, varios miembros de la familia al-Baqannī, algunos de los cuales habían emigrado con Ibn al-Azraq al Norte de África, pero regresaron para integrarse en los grupos dirigentes mudéjares. El trabajo expone, analiza, y evalúa los datos de una nueva fuente sobre las visiones jurídicas de los ‛ulamā’ con respecto al estatuto islámico de las comunidades islámicas bajo dominio cristiano en la Península Ibérica desde el siglo XII hasta el siglo XVI. Se trata de una fetua desconocida e inédita del sabio andalusí Ibn Rabī‛ y fetuas desconocidas de los principales cadíes de los cuatro madhabs sunníes en El Cairo hacia 1510 A.D. Muy probablemente, hay que relacionar la primera (...) fetua con los acontecimientos en Murcia tras la sublevación mudejar de 1265 y la reconquista cristiana de la ciudad en 1266. El muftí subraya que los musulmanes que viven bajo dominio cristiano están imperativamente obligados a emigrar a territorio islámico. Los principales cadíes de los cuatro madhabs sunníes en El Cairo al principio del siglo XVI, sin embargo, defienden un modo de ver mucho más pragmático. Probablemente, las preguntas fueron planteadas por mudejares de Valencia, que estaban en El Cairo camino de la peregrinación. Finalmente, los autores plantean que hay que distinguir dos tipos coexistentes de visiones con respecto al estatuto del Islam bajo dominio cristiano en la Península Ibérica desde principios del siglo xii; una visión pragmática, equivalente a un reconocimiento de facto del Islam bajo dominio cristiano, y una visión «de rechazo», que asume la obligación de emigrar de la España cristiana a Dār al-Islām. El impacto variable de estas visiones jurídicas merece un estudio más profundo dentro del ambiente histórico de las complejas y cambiantes relaciones políticas entre Islam y Cristiandad en esa época. Este artículo está dedicado al famoso pergamino encontrado en 1588 en el antiguo minarete de la que había sido mezquita aljama de Granada, con textos en árabe, latín y castellano. Junto con los libros plúmbeos descubiertos en diversas cuevas a las afueras de la ciudad entre 1595 y 1600, el pergamino está en los orígenes de un importante culto nacional. El artículo presenta un análisis de la composición y escritura del pergamino y pasa revista a las trascripciones y traducciones que (...) se hicieron por testigos cristianos y musulmanes . Éstas se comparan críticamente con los principales elementos del pergamino y se discuten los comentarios paleográfícos hechos por estos testigos contemporáneos . Como conclusión, los autores mantienen que el documento transferido desde el Vaticano en el año 2000, es el original encontrado en 1588 a pesar de lo incomprensible de los textos árabes y de la corrupción de los textos castellano y latino Según los autores, no hay base para considerar al pergamino como documento proto-islámico, puesto que se trata de un mensaje católico romano anunciando la destrucción del islam. Al mismo tiempo, el documento incluye un mensaje simbólico al mostrar que los cristianos granadinos del siglo I, incluyendo a Cecilius, escribían árabe y castellano, lo mismo que hacían los moriscos. Así, aunque el Islam había de ser extirpado, la lengua árabe se podía armonizar con una vida genuinamente cristiana. (shrink)

This paper addresses Peter Sloterdijk’s optimistic ‘attitude’. I show that it is a philosophical posture based on pragmatic speculation and spiritual exercise. By situating it in a tradition that passes from Leibniz’s meliorism to Whitehead’s ecology of propositions, I argue that optimism is an essential component of a public use of reason of which the finality is no longer the good sense of critique but of the care for common sense. At stake is the cosmological and cosmopolitical care for (...) the possibility of rationalization processes in a ‘monstruous world’ of ever denser feedback mechanisms. (shrink)

Business Ethics: A European Review, EarlyView.

Following Manne (1966, Insider Trading and the Stock Market (New York, Free Press)) we introduce a distinction between insider trading and market manipulation on the one hand and corporate insiders versus misappropriators on the other hand. This gives rise to four types of alleged inside transactions. We argue that the literature on insider trading has often targeted inside transactions type II, III and IV but that these arguments do not necessarily hold for type I transactions. We look for consequentionalist as (...) well as non-consequentionalist arguments against type I transactions and demonstrate that these are hard to find. Throughout the article we refer extensively to the economic literature on insider trading in order to overcome a relative divide between the economic, legal, and philosophical discussion on insider trading. In his lectures from 1987, Deleuze draws an analogy between Michelangelo's figures and Leibnizian substances by claiming that neither are essences but rather sources of modifications or manners of being. The best way to explore this analogy, I argue, is by focusing on Michelangelo's preference for serpentine shapes. By putting key passages from The Logic of Sensation, The Fold: Leibniz and the Baroque and What is Philosophy? in resonance with the Leibnizian accounts of corporeal aggregates and possible worlds on the (...) one hand and art history on the other, I will try to develop a Deleuzian concept for the typically Mannerist ideal of the serpentine figure. Although Deleuze usually prefers to speak in musical terms of refrains and counterpoints by which various blocs of sensation resonate with each other, in the visual arts it is the serpentine figure that renders visible sensory becoming as a rhythmic counter-positioning of possible worlds within a single body without organs. The text of the tract De arcubus similibus was published for the first time by M. Curtze in 1887. However, after examining some more Latin manuscripts and the Arabic MS Oxford, Bodleian Library, Marsh 663 it appeared, that Curtze's edition was rather an adaptation. Also Curtze's suggestion that Jordanus Nemorarius was the author was very probably wrong. The author of the tract was the Egyptian mathematician Ahmed ibn Jusuf as appears from the Latin manuscripts, and its translator, very probably, Gerard (...) of Cremona. In the tract Ahmed tried to prove, that the assertion ‘similar arcs are also equal arcs’ was wrong . His starting points were the propositions Euclid III, 20 and 21. Consequently, the tract can be looked upon as a commentary on the third book of the Elements. (shrink)

The disaggregation and geographic dispersion of global value chains (GVCs) have expanded the responsibility of international buyers from firm-level corporate social responsibility (CSR) towards social sustainability of their emerging country suppliers. We theorize, in this paper, that the effectiveness of lead firms’ GVC governance strategies for social sustainability—which can be audit-based or cooperation-based—depends on the local institutional context of the supplier. Supplier country institutions exert legal and civil society pressures for social sustainability, which shape suppliers’ attitude and receptiveness towards lead (...) firm requests. Using unique primary data from 356 garment and footwear suppliers in 11 emerging countries, which supply to Western European or North American buyers, we show that GVC governance strategies are particularly effective for suppliers’ social sustainability implementation when there is ‘contextual fit’ with local institutional pressures for social sustainability in the supplier country. Our study identifies the boundary conditions of GVC governance modes, and demonstrates a complementary relationship between organizational arrangements and their institutional-level counterparts in the context of social sustainability. In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

Robert Coles' sentiment characterizes well the moral tenor of medical education today. Indeed, medical educators are frequently “seized by spasms of genuine moral awareness,” as they try to cope with the massive social and economic problems that face medical schools and teaching hospitals. The perception among educators that we currently fail to adequately teach several core aspects of doctoring, including professional values and behavior, constitutes one such spasm. In this case, the proposed remedy has generated considerable enthusiasm, but whether the (...) “core competencies” curriculum will make a difference, or simply “accommodate to the prevailing rhythms of the world we inhabit,” remains to be seen. In this paper we report on our experiences with using network analysis to discern and analyse ethical issues in research into, and the development of, a new wastewater treatment technology. Using network analysis, we preliminarily interpreted some of our observations in a Group Decision Room session where we invited important stakeholders to think about the risks of this new technology. We show how a network approach is useful for understanding the observations, and suggests some relevant ethical issues. We argue that (...) a network approach is also useful for ethical analysis of issues in other fields of research and development. The abandoning of the overarching rationality assumption, which is central to network approaches, does not have to lead to ethical relativism. (shrink)

In this article, we develop an approach for the moral assessment of research and development networks on the basis of the reflective equilibrium approach proposed by Rawls and Daniels. The reflective equilibrium approach aims at coherence between moral judgments, principles, and background theories. We use this approach because it takes seriously the moral judgments of the actors involved in R & D, whereas it also leaves room for critical reflection about these judgments. It is shown that two norms, namely reflective (...) learning and openness and inclusiveness, which are used in the literature on policy and technological networks, contribute to achieving a justified overlapping consensus. We apply the approach to a case study about the development of an innovative sewage treatment technology and show how in this case the two norms are or could be instrumental in achieving a justified overlapping consensus on relevant moral issues. Engineering ethics and science and technology studies have until now developed as separate enterprises. The authors argue that they can learn a lot from each other. STS insights can help make engineering ethics open the black box of technology and help discern ethical issues in engineering design. Engineering ethics, on the other hand, might help STS to overcome its normative sterility. The contributions in this special issue show in various ways how the gap between STS and engineering ethics might be (...) overcome. In this editorial introduction, the authors discuss the various contributions briefly and delve into the way the various authors conceptualize the engineering design process and the consequences of those conceptualizations for what ethical issues become visible. The foreskin is a complex structure that protects and moisturizes the head of the penis, and, being the most densely innervated and sensitive portion of the penis, is essential to providing the complete sexual response. Circumcision—the removal of this structure—is non-therapeutic, painful, irreversible surgery that also risks serious physical injury, psychological sequelae, and death. Men rarely volunteer for it, and increasingly circumcised men are expressing their resentment about it.Circumcision is usually performed for religious, cultural and personal reasons. Early claims about (...) its medical benefits have been proven false. The American Academy of Pediatrics and the Centers for Disease Prevention and Control have made many scientifically untenable claims promoting circumcision that run counter to the consensus of Western medical organizations.Circumcision violates the cardinal principles of medical ethics, to respect autonomy, to do good, to do no harm, and to be just. Without a clear medical indication, circumcision must be deferred until the child can provide his own fully informed consent.In 2012, a German court held that circumcision constitutes criminal assault. Under existing United States law and international human rights declarations as well, circumcision already violates boys› absolute rights to equal protection, bodily integrity, autonomy, and freedom to choose their own religion. A physician has a legal duty to protect children from unnecessary interventions. Physicians who obtain parental permission through spurious claims or omissions, or rely on the American Academy of Pediatrics' position, also risk liability for misleading parents about circumcision. My initial task in this essay is to identify precisely the original philosophical import of philosophical renections about religion. Next I outline their changing natures and interrelations in the works of exemplary figures from the history of Western religious thought. Finally I argue that the relative desuetude of the traditional forms of apology and speculalion is emblemalic of the present faring of philosophy as a form of cultural discourse.

Some philosophers argue that a commitment to religious pluralism precludes the affirmation and encouragement of religious conversions on the grounds that decisions to convert are rationally unwarranted and, thus, their encouragement is ethically suspect. I challenge this view; furthermore, I contend that a proper understanding of religious conversion from a Christian and pluralistic point of view requires instead the identification of pluralism’s multiple meanings, i.e., as a descriptive category, a philosophical position, and an ideological construct.

Discusses the incompatibility of the concepts of free will and determinism and argues that moral responsibility needs the doctrine of free will.

In this paper I shall define a thesis I shall call ' determinism ', and argue that it is incompatible with the thesis that we are able to act otherwise than we do. Other theses, some of them very different from what I shall call ' determinism ', have at least an equal right to this name, and, therefore, I do not claim to show that every thesis that could be called ' determinism ' without historical impropriety is incompatible with (...) free will. I shall, however, assume without argument that what I call ' determinism ' is legitimately so called. In Part I, I shall explain what I mean by ' determinism '. In Part II, I shall make some remarks about 'can'. In Part III, I shall argue that free will and determinism are incompatible. In Part IV, I shall examine some possible objections to the argument of Part III. I shall not attempt to establish the truth or falsity of determinism, or the existence or nonexistence of free will. In this essay I present what is, I contend, the free-will problem properly thought through, or at least presented in a form in which it is possible to think about it without being constantly led astray by bad terminology and confused ideas. Bad terminology and confused ideas are not uncommon in current discussions of the problem. The worst such pieces of terminology are "libertarian free will" and "compatibilist free will." The essay consists partly of a defense of the thesis that (...) the use of these phrases by writers on the problem of free will can only generate conceptual confusion and partly of a formulation of the problem that does not make use of them. I contend that this formulation is neutral with respect to the historically important positions on free will (e. g., compatibilism and incompatibilism). (shrink)

This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. After explaining how rhetorical insight can be instrumental in (...) deepening and justifying a dialectical analysis, an integrated analysis is made of the rhetorical strategies that are brought to bear in an advertorial published by the oil company Shell. When many people are involved in an activity, it is often difficult, if not impossible, to pinpoint who is morally responsible for what, a phenomenon known as the ‘problem of many hands.’ This term is increasingly used to describe problems with attributing individual responsibility in collective settings in such diverse areas as public administration, corporate management, law and regulation, technological development and innovation, healthcare, and finance. This volume provides an in-depth philosophical analysis of this problem, examining the notion of moral (...) responsibility and distinguishing between different normative meanings of responsibility, both backward-looking and forward-looking. Drawing on the relevant philosophical literature, the authors develop a coherent conceptualization of the problem of many hands, taking into account the relationship, and possible tension, between individual and collective responsibility. This systematic inquiry into the problem of many hands pertains to discussions about moral responsibility in a variety of applied settings. (shrink)
