Executive compensation has long been a prominent topic in the management literature. A main question that is also given substantial attention in the business ethics literature—even more so in the wake of the recent financial crisis—is whether increasing levels of executive compensation can be justified from an ethical point of view. Also, the relationship of executive compensation to instances of unethical behavior or outcomes has received considerable attention. The purpose of this paper is to explore the social, ecological, and existential (...) costs of economic incentives, by discussing how relying on increasing levels of executive compensation may have an adverse effect on managerial performance in a broad sense. Specifically, we argue that one-dimensional economic incentives may destroy existential, social, and systemic values that influence the manager’s commitment to ensure responsible business conduct, and have negative spillover effects that may reduce the manager’s performance. There are well-documented findings that demonstrate that reliance on sources of extrinsic motivation (such as economic incentives) may displace intrinsic motivation. Our perspective is a holistic one, in the sense that we will explore the influence of sources of extrinsic motivation on the manager’s intrinsic commitment to different types of values. We will in particular investigate how it may influence the manager’s ethical reflection and behavior or lack thereof. (shrink)

In this study we argue that there is an interconnection between; the mechanistic worldview and competition, and the organic worldview and cooperation. To illustrate our main thesis we introduce two cases; first, Max Havelaar, a paradigmatic case of how business might function in an economy based upon solidarity and sustainability. Second, TINE, a Norwegian grocery corporation engaged in collusion in order to force a small competitor out of the market. On the one hand, in order to encourage market behaviour that (...) integrates economic, societal and environmental values we find that transparent cooperation within a context of an organic worldview takes care of important intrinsic as well as instrumental values. On the other hand, we find evidence for asserting that cooperation based upon a mechanistic worldview, typically leads to group egotistical consequences undermining the long term common good. Departing from frequent use of moral conflict cases in business ethics teaching and research, the paper suggests an elaboration of a moral conflict approach within business ethics, both conceptually and philosophically. The conceptual elaboration borrows from social science conflict research terminology, while the philosophical elaboration presents casuistry as a kind of practical, inductive argumentation with a focus on paradigmatic examples.

Researchers sometimes engage in various forms of dishonesty and unethical behavior, which has led to regulatory efforts to ensure that they work according to acceptable standards. Such regulation is a difficult task, as research is a diverse and dynamic endeavor. Researchers can disagree about what counts as good and acceptable standards, and these standards are constantly developing. This paper presents and discusses recent changes in research integrity and ethics regulation in Norway, Denmark, and Sweden. Recognizing that research norms are developed (...) through practice and are therefore unsuited for comprehensive national regulation, the Scandinavian countries focus on empowering the research community to regulate itself instead, except for the most severe cases of misconduct. This empowerment takes the form of giving research institutions tools and investigatory powers while also holding them responsible for ensuring that both the institution and individual researchers are up to date on relevant norms. In this way, the Scandinavian governments seek to avoid some of the challenges found in more legalistic approaches, which risk lagging behind the continuous development of research norms and can be insensitive to the fact that different disciplines have different norms. While the new approach in Scandinavian has several potential benefits, it also involves potential trade-offs and limitations. The new laws can create confusion about what researchers are allowed to do. Another issue is that it only addresses the fundamental drivers of misconduct to a limited extent. (shrink)

Research integrity is fundamental to the validity and reliability of scientific findings, and for ethical conduct of research. As part of PRINTEGER (Promoting Integrity as an Integral Dimension of Excellence in Research), this study explores the views of researchers, research managers, administrators, and governance advisors in Estonia, Italy, Norway and UK, focusing specifically on their understanding of institutional and organisational influences on research integrity.A total of 16 focus groups were conducted. Thematic analysis of the data revealed that competition is pervasive (...) and appeared in most themes relating to integrity. The structural frameworks for research such as funding, evaluation and publication were thought to both protect and, more commonly, undermine integrity. In addition, institutional systems, including workload and research governance, shaped participants’ day-to-day work environment, also affecting research integrity. Participants also provided ideas for promoting research integrity, including training, and creating conditions that would be supportive of research integrity.These findings support a shift away from individual blame and towards the need for structural and institutional changes, including organisations in the wider research environment, for example funding bodies and publishing companies. Familial clustering of a disease is defined as the occurrence of the disease within some families in excess of what would be expected from the occurrence in the population. It has been demonstrated for several cancer types, ranging from rare cancers as the adenomatosis-coli-associated colon cancer or the Li-Fraumeni syndrome to more common cancers as breast cancer and colon cancer. Familial clustering, however, is merely an epidemiological pattern, and it does not tell whether genetic or environmental causes or both in (...) combination are responsible for the familial clustering. Familial clustering may be due to genetic predisposition to the disease, but exposure to environmental factors — shared by members of some families, but not by members of other families — may also cause familial clustering and hence mimic genetic inheritance in the study of nuclear families. Based on assumptions regarding the individual steps in the biological process starting with exposure to carcinogens and ending with death from disseminated cancer we suggest that genetic and environmental factors may both be involved in most of these steps. The present paper focuses on research methodologies necessary to discriminate between the effect of genes and family environment in the development of cancer. (shrink)

This article is concerned with the role of experientia in medieval law. This could take a number of forms, three of which are treated by way of example. In the first part of the essay, the author discusses how experience first came to serve as a source for the creation and legitimisation of new law since Late Antiquity. Henceforth, it became an important principle within Canon Law that served not only to create legal regulations supplementary to traditional law but also (...) to overwrite and replace it. The second part of the essay is concerned with the role of expert reports (consilia) by men learned in the ius commune which were requested to help rule cases under local law. Being dispersed in collections after their use in court, consilia made a significant impact on common and local law. In the final section the author discusses the use of expert witnesses (from areas as diverse as medicine, agriculture, the arts and crafts etc.). Expert opinions were recognised by court as high-value evidence. (shrink)

ZUSAMMENFASSUNG›Reinheit‹ ist ein Grundbegriff der Religionswissenschaft. Kaum eine Religion kommt ohne ein Konzept von Reinheit aus. Lange Zeit hindurch war dieser Begriff auch in der Philosophie angesehen, bis Johann Georg Hamann das bekannteste Buch, welches Reinheit im Titel führt, nämlich die Kritik der reinen Vernunft Immanuel Kants, einer Metakritik unterzog. In seiner Metakritik führt Hamann den Nachweis, dass eine sich mit Emphase auf die Reinheit des Denkens berufende Philosophie sich wie eine Religion mit entsprechendem normativem Anspruch verhält. Gegen die kritische (...) Philosophie Kants setzt Hamann ein bewusst unreines, auf Sinnlichkeit, Leidenschaft und Geschichte basierendes Denken, welches sich im Gegensatz zum sich selbst sterilisierenden reinen Denken als fruchtbar und zukunftsfähig erweist. So mobilisiert er die Würde des Schmutzes gegen die kryptoreligiöse Selbstkorrumpierung der Vernunft.SUMMARY‘Purity’ is a key term of religious studies. Very few religions get along without some concept of purity. For a long time this concept had some reputation in philosophy as well until Johann Georg Hamann launched his meta-critique against the most famous book with contains purity in its title: Kant's Critique of Pure Reason. In his critique Hamann shows that philosophical thinking which emphatically insists on purity behaves like a religion with a strong normative attitude. Hamann opposes Kant's critical philosophy with a deliberately impure thinking, which is based upon senses, emotion and history. In contrast to the self-sterilizing pure thinking, this way of philosophizing proves to be fertile and future-compliant. In this way he mobilizes the dignity of filth against the crypto-religious self-corruption of reason. (shrink)

Philosophische Begriffsbestimmungen bleiben ihm unbefriedigend und abstrakt, denn der philosophische Begriff als sprachliche Handlung ist nicht definierbar, sondern vielmehr Anzeige eines Geschehens, in dem der Mensch sich etwas sagen lässt. Die Antwort auf die Frage nach der Wahrheit ist die Ankunft des den Einzelnen erschließenden Wortes. Ausgehend von dieser ontologisch-soziologischen Basis wendet sich Hamann gegen den Ideenhimmel der selbstgenügsamen reinen Vernunft im Philosophieren und beschreibt (...) das Wahrheitsgeschehen als einen dynamischen Prozess aus sprachlicher Geologie, erfahrener Ästhetik und tradiertem Formular.Für diese dynamische Wahrheitskonzeption betont Hamann in seiner Geologie die Gebundenheit des Menschen an das Konkrete als Feld seines Wirkens, in dessen Fruchtbarkeit sich sein Tun bewährt, in seiner Ästhetik die sinnliche Wahrnehmung Gottes als Grundlage der menschlichen Existenz und die Bewahrung des menschlichen Lebens im biblischen Text in seinem Formularismus. Ein solches triadisches Wahrheitsgeschehen ist in konkreter Individualität Dichtung des göttlichen Autors.SummaryJohann Georg Hamann responds to the philosophical question ‘What is truth?’ with a phenomenology of philosophical concepts. For him, philosophical definitions remain abstract and insufficient because philosophical concepts as speech-acts are not definable but indications of events where man allows that something is said to him. The answer to the question of truth is the arrival of the Word which reveals the individual. Starting from this ontological and sociological assumption Hamann rejects the realm of self-sufficient reason in philosophizing and describes a dynamic process of truth consisting of linguistic geology, experienced aesthetics and traditional formula instead. His geology therefore emphasizes the confinement of man to concrete things as the field of his work, whose fertility proves his actions. His aesthetics stresses the sensual perception of God as the basis of human existence and his use of formula the safekeeping of human life in biblical texts. Der vorliegende Band versammelt Studien zum Denken Johann Georg Hamanns, die ich seit 2004 angefertigt habe. Ein wesentlicher Auslöser für mein Interesse an diesem im Wortsinne merkwürdigen Autor waren die HamannSeminare meines philosophischen Lehrers Jürgen Frese vom Wintersemester 2001/2002 und Sommersemester 2002 in der Abteilung für Philosophie an der Universität Bielefeld. Mit der Hamann-Forschung kam ich durch einen im Rahmen dieses Seminars durchgeführten Besuch auf dem achten internationalen Hamann-Kolloquium die Gegenwärtigkeit Johann Georg Hamanns 2002 in Halle-Wittenberg in Kontakt. Die hier (...) und auf den folgenden Kolloquien vorherrschende interdisziplinäre Atmosphäre ist mir in meiner Hamann-Beschäftigung wegweisend geworden.--Vorwort. (shrink)

Die vorliegende Arbeit untersucht Möglichkeiten und Grenzen der Verwendung von einfachen konnektionistischen Systemen als Modelle für den Erwerb und die Repräsentation von Wissen über zeitdiskrete lineare dynamische Systeme in der Kognitionspsychologie. Ein ausgewähltes dynamisches System namens SINUS wird in Form eines „pattern associators“ repräsentiert und dessen Lernverhalten untersucht. Es wird versucht, daraus Annahmen über den Wissenserwerb von Probanden im Umgang mit solchen dynamischen Systemen abzuleiten, um insbesondere Hinweise darauf zu erhalten, was „gute“ von „schlechten“ Probanden unterscheidet. Ein weiterer hier betrachteter (...) Aspekt ist die Steuerung eines dynamischen Systems in einen vorgegebenen Zielzustand, der unter Beibehaltung des konnektionistischen Modells durch einen variierten Lernalgorithmus modelliert wird. Die abschließende Diskussion geht auf die Bedeutung der Modellierung für die kognitionspsychologische Theorienbildung ein. (shrink)

The present volume contains the lectures and papers given at the 1994 international conference on hermeneutics in Halle (Germany). The conference aimed at a state of the art in the light of recent developments in science and humanities. The place in which the conference was held is renowned for its centuries-old tradition in hermeneutics and among the lectures there are indeed some devoted to this history. For the most part, however, the papers concentrate on present-day problems in fields as different (...) as comparative literature, religious studies, bible exegesis, esthetics, social sciences, intercultural dialogue. The theme of the conference, "strangeness and familiarity", reflects the tension in which any interpretation process is situated and that any theory of interpretation has to account for. Heinz Robert Schlettes skeptische Religionsphilosophie - bereits in ihrer Entstehungszeit quer zum Mainstream - hat in besonders intensiver Weise fundamentale Infragestellungen der Religion durch die Moderne einbezogen. Im Stichwort Empörung hat sie den humanen Gehalt der Religions-kritik aufgenommen - und sowohl religions-philosophisch identifiziert als auch für eine heute noch rechtfertigbare religiöse Haltung reklamiert. Schlettes Ansatz heute in die veränderten Konstellationen einer globalisierten Säkularisierungsdynamik und neuen Religionspräsenz wie eine Sonde einzuführen, verspricht erhellend aufklärerische Wirkung.
