I shall introduce at the beginning of the paper a characterization of strong ontological emergence. According to it, roughly, something strongly emerges from some other thing iff the former depends in some respect on the latter and it some independent of it in some other respect. Afterwards, I shall present my own formulation of strong emergence, which is based on the distinction between the mere possession and the activation of a causal power. Causal powers are the entities to be (...) primarily taken as emergent. Emergent causal powers depend for their possession on their emergence bases, but they are also independent of the latter for their activation. This claim will be defended within some more general assumptions about the metaphysics of powers. Finally, I shall compare the power-based formulation of emergence with other formulations. I shall try to demonstrate that the power-based formulation is metaphysically less controversial than the other formulations. For the power-based formulation does not need to defend the additional thesis that the emergents can depend in some relevant respect on their bases and be independent of the latter in some other relevant respect. Indeed, the distinction between the mere possession and the activation of a power is inscribed in the nature of powers themselves. (shrink)

Democratic countries, such as Australia, face the dilemma of preserving public and national security without sacrificing fundamental freedoms. In the context where the rule of law is an underlying assumption of the constitutional framework, Emergency Powers in Australia provides a succinct analysis of the sorts of emergency which have been experienced in Australia and an evaluation of the legal weapons available to the authorities to cope with these emergencies. Hylomorphism is the Aristotelian theory according to which substances are composites of matter and form. If my house is a substance, then its matter would be a collection of bricks and timbers and its form something like a structure that unites those bricks and timbers into a single substance. Contemporary hylomorphists are divided on how to understand forms best, but a prominent group of theorists argue that forms are emergent powers. According to such views, when material components are arranged (...) appropriately, a novel substance emerges with the power to impose unity on its components through time. I argue that these accounts of form fall prey to a bootstrapping problem, and so, suffer from issues of redundancy, given plausible assumptions about inherence. In their place, I suggest an ontologically minimalist conception of forms as collective manifestations of the powers of matter. (shrink)

This paper investigates the Turkish Constitutional Court (TCC)’s treatment of legal challenges brought against Turkey’s legal responses to the COVID-19 pandemic. Drawing on a detailed examination of the TCC’s institutional features, political origins and jurisprudential trajectory, and taking three politically salient judgments of the TCC concerning Turkey’s executive-dominated pandemic control as the point of departure, the paper argues that the TCC chose to exercise judicial restraint both in protecting fundamental rights and reviewing pandemic policies of the executive. It also argues (...) that the TCC’s judicial restraint during the pandemic was simply the re-manifestation of its ‘play-it-safe’ strategy — a judicial stance the TCC willingly adopted in the aftermath of the 2016 attempted coup despite possessing strong constitutional powers of judicial review, and its established attitude of assertive scrutiny in the past. From a more theoretical perspective, the analysis also explores how the passive role to which the TCC is consigned in an increasingly authoritarian regime since the 2016 failed coup relates to the global phenomenon of judicialization of authoritarian politics. This article argues that Machiavelli’s chapters on the Decemvirate ( D 1.35, 1.40-45) advance an internal critique of the juridical discourse of sovereignty. I first contextualize these chapters in relation to several of Machiavelli’s potential sources, including Livy’s Ab urbe condita, Dionysius of Halicarnassus’s Roman Antiquities, and the antiquarian writings of Andrea Fiocchi and Giulio Pomponio Leto. I then analyze Machiavelli’s claim that the decemvirs held “absolute authority” ( autorità assoluta)—an authority that was unconstrained by either laws or countervailing magistrates. (...) I proceed to argue that Machiavelli’s account of the decemvirs’ election contains a web of allusions to the lex regia, the “royal law” by which the Roman people were thought to have conveyed their sovereign power to an emperor. By modeling the decemvirs’ election on the lex regia, Machiavelli reveals the political limitations of the doctrine of popular sovereignty; moreover, he illustrates that even free and fair elections can easily give rise to tyranny. Research on the `meaning of work', especially concerning the Global South, is scarce. This paper aims to reduce this scarcity by applying critical realist meta-theory to the work and life history interviews of workers in Sri Lanka. A key discovery is that finding meaning in life through work is a personal emergent power and that, as such, it explains the way that individuals consciously manoeuvre their life-journeys towards a desired end - a modus vivendi - in a dialectic which involves (...) both emergent structural change (morphogenesis) and agency. This paper also reveals that Margaret Archer's theory of reflexivity, based on interviews with Western individuals, cannot be transferred rigidly to the reflexivity of Global South individuals, and therefore more work on reflexivity within this context is required. This paper therefore makes a theoretical contribution to the existing meaning of work scholarship, and it extends existing understandings of the concepts of reflexivity and emergence. (shrink)

This argument aims to provide an overview of the historical context and main factors shaping the relation between left-wing radical politics and emergency powers in interwar Europe. It also brings to the fore how left-wing radical movements fuelled, reacted to and were connected with the multiple crises of the time span between the two world wars. The abuse of emergency powers led to a normalisation of political violence and worked as a corrosive force against the liberal order in several European countries during the interwar period. The ArgumentThis introductory essay describes some intellectual intersections between the history and sociology of science and the history and sociology of accounting. These intersections suggest a potential field of inquiry that concerns itself explicitly with science and economic calculation, a potential that is partly realized in the essays that follow. It is possible to describe a broad shift from concerns for the scientific credentials of accounting to a recognition of the constitutive role that accounting plays for science. In other words (...) the so-called cultural hegemony of the scientist is giving way to that of the accountant. This shift has a number of loosely related but complementary elements. The first is to be found in some recent historical work that links ideals of scientific objectivity to administrative and political values. A second element is a body of work that is critical of theorydominant approaches to experiment and concerns itself with laboratory practice in social context. A third element is an emerging interest in the economics of science. I argue that such a program is weak where it abstracts from processes of economic calculation, and this suggests the fourth element: a contextual approach to economic calculation to be found in sociologically informed accounting research. In the light of these four elements, the essay concludes by considering directly the implications of accounting for science, particularly given recent initiatives to make science more accountable. Two studies explored individual differences in appraisal of minor, potentially stressful events. Previous research on appraisal has focused on one or two appraisal dimensions within specific situations rather than on the full range of appraisals or on the stability of appraisal across situations. Goals of the present studies were: (1) to explore stability of individual differences in appraisal across situations; (2) to identify individual differences in general appraisal styles; and (3) to examine how appraisal styles are related to personality constructs. (...) Appraisal was moderately stable across situations and individual differences in appraisal style were related to relevant personality constructs. Primary threat appraisals and secondary appraisals of blame and manageability emerged as particularly important in distinguishing the appraisal styles. Habermas's transcendentalism in Knowledge and Human Interests ( KHI) deserves to be reappraised for a number of reasons. Prevailing conceptions of strong transcendental arguments, which inform many of his critics, cannot be sustained. The analytic reception of Kant suggests a more modest role for them that is remarkably similar to Habermas's claims for the paradigm of rational reconstruction. Hence a reinterpretation of transcendentalism provides a new basis for establishing a continuity between his early and later work. Habermas's underlying argument structure (...) owes much, albeit unconsciously, to Kant's concept of a regulative idea. Only the "as if" status of regulative ideas allows one to make sense of the metacritical structure of KHI and Habermas's transcendental arguments emerge as deeply hermeneutic in character rather than logical in any formal sense. New biotechnologies have the potential to both dramatically improve human well-being and dramatically widen inequalities in well-being. This paper addresses a question that lies squarely on the fault line of these two claims: When as a matter of justice are societies obligated to include a new biotechnology in a national healthcare system? This question is approached from the standpoint of a twin aim theory of justice, in which social structures, including nation-states, have double-barreled theoretical objectives with regard to human well-being. (...) The first aim is to achieve a sufficient level of well-being in each of six core dimensions. In the special case of healthcare systems, this aim is focally but not exclusively attentive to achieving health sufficiency as one of the core dimensions. The second aim is to combat the emergence and persistence of densely woven patterns of systematic disadvantage that tend to undermine the achievement of a sufficient level of health and the other core elements of well-being of some persons and groups. Judgments about entitlements to health related resources, including new biotechnologies, are made in light of a threshold notion of health sufficiency. What is enough or sufficient health? The answer that is defended here is that sufficient health is enough health for a decent human life, understood as enough health to live a full life course without preventable, significant functional disability or decrement in health, or treatable pain or suffering. When a state must include a new biotechnology in its national healthcare system is also influenced by ancillary concerns about the connection between health and other core dimensions of well-being. What counts as a significant functional impairment or health decrement is thus explicated, in part, in relation to the theory’s sufficiency aim for the other essential dimensions of well-being, and thus for a decent life, overall. Those elements of health that play a critical role in the experience of sufficient reasoning, affiliation, security, respect and self determination are especially important; any loss of health function or capacity that threatens the individual’s prospects for sufficiency in these other dimensions, including the relational egalitiarian concerns they entail, constitutes a significant functional impairment. Within national borders, individuals are thus entitled to those health-related goods and services that are essential for a sufficiency of each of the dimensions of well-being; with regard to self determination and respect, what is sufficient by way of guaranteed access to specific goods and services is going to depend on the implications of such access for where an individual stands in relation to her co-nationals. The content of any entitlement to health-related goods and services is also necessarily dynamic. What can be done for health and the other core dimensions of well-being as a function of technological innovation and diffusion is in constant flux. The paper concludes by considering the implications of this analysis for the conditions under which states are obligated to include access in their healthcare systems to one biotechnology, deep brain stimulation. Background Cardiopulmonary resuscitation and subsequent care are subject to various ethical and legal issues. Few studies have addressed ethical and legal issues in post-resuscitation care. Objective To explore nurses’ experiences of ethical and legal issues in post-resuscitation care. Research design This qualitative study adopted an exploratory descriptive qualitative design using conventional content analysis. Participants and research context In-depth, semi-structured interviews were conducted in three educational hospital centers in northwestern Iran. Using purposive sampling, 17 nurses participated. Data were analyzed by conventional (...) content analysis. Ethical considerations The study was approved by Research Ethics Committees at Tabriz University of Medical Sciences. Participation was voluntary and written informed consent was obtained. For each interview, the ethical principles including data confidentiality and social distance were respected. Findings Five main categories emerged: Pressure to provide unprincipled care, unprofessional interactions, ignoring the patient, falsifying documents, and specific ethical challenges. Pressures in the post-resuscitation period can cause nurses to provide care that is not consistent with guidelines, and to avoid communicating with physicians, patients and their families. Patients can also be labeled negatively, with early judgments made about their condition. Medical records can be written in a way to indicate that all necessary care has been provided. Disclosure, withdrawing, and withholding of therapy were also specific important ethical challenges in the field of post-resuscitation care. Conclusion There are many ethical and legal issues in post-resuscitation care. Developing evidence-based guidelines and training staff to provide ethical care can help to reduce these challenges. ABSTRACTResistance to austerity in Ireland has until recently been largely muted. In 2013 domestic water charges were introduced and throughout 2014 a series of protests against the charges emerged, culminating in over 90 separate marches on November 1. In this paper we examine the discourses which are produced and circulated by politicians and the mainstream media about this protest movement, and offer a brief insight into the contemporary Irish context of austerity and crisis. We analyse the role of the phrase (...) ‘sinister fringe’ as a discursive device, and unpick the ways in which it has been used to explain the water charges protests to the Irish public. Our conclusions speak to the currency of the protest paradigm as a means of understanding news media reporting of protest. Ultimately we raise concerns regarding the effects of this dominant frame on deliberative democracy. (shrink)

The problem of structure and agency has been the subject of intense debate in the social sciences for over 100 years. This book offers a solution. Using a critical realist version of the theory of emergence, Dave Elder-Vass argues that, instead of ascribing causal significance to an abstract notion of social structure or a monolithic concept of society, we must recognise that it is specific groups of people that have social structural power. Some of these groups are entities with emergent (...) causal powers, distinct from those of human individuals. Yet these powers also depend on the contributions of human individuals, and this book examines the mechanisms through which interactions between human individuals generate the causal powers of some types of social structures. In this paper, we make explicit the changing configurations of power relations that currently characterize the Brazilian Emergency Care System (SAMU) team in Belo Horizonte, Brazil. The SAMU is a recent innovation in Brazilian healthcare service delivery. A qualitative case study methodology was used to explore SAMU’s current organizational arrangements, specifically the power relations that have developed and that demonstrate internal team struggles over space and defense of particular occupational interests. The argument advanced in this paper is that these (...) professionals are developing their work in conditions of exposure, that is, they are always being observed by someone, and that such observational exposure provides the conditions whereby everyday emergency care practices are enacted such that practice is shaped by, as well as shapes, particular, yet recognizable power relationships. Data were collected through the observation of the SAMU’s work processes and through semi‐structured interviews. Research materials were analyzed using discourse analysis. In the emergency care process of work, visibility is actually embedded in the disciplinary context and can thus be analyzed as a technique applied to produce disciplined individuals through the simple mechanisms elaborated by Foucault such as hierarchical surveillance, normalizing judgment, and the examination. One recently popular way to characterise strong emergence is to say that emergent entities possess novel causal powers. However, there is little agreement concerning the nature of powers. One controversy involves whether powers are single- or multi-track; that is, whether each power has only one manifestation type, or whether a single power can be directed towards a number of distinct manifestations. Another concerns how powers operate: whether a lone power manifests when triggered by the presence of (...) a suitable stimulus, or whether powers operate mutually such that several powers must ‘work together’ to bring about a particular manifestation. This paper examines how these distinctions—which can be cross-combined to frame four distinct accounts of the nature of powers—bear on the debate between emergentists and reductionists. (shrink)

This essay calls attention to robust synergies between Roy Bhaskar’s philosophy of dialectical critical realism and Terrence W. Deacon’s recent investigation of the geo-historical emergence of ententional or teleological phenomena, as well as important differences. Deacon has independently arrived at an understanding of absence as causally efficacious in the emergence of life and consciousness, and deploys a range of other concepts that resonate with DCR. He develops a critique both of eliminativist and monovalent approaches to ententionality, on the one hand, (...) and their panpsychist foil, on the other, and elaborates a polyvalent scientific alternative – the theory of emergent dynamics. Though this theory is not without problems, as its immanent critique reveals – and indeed in part because of these – it opens up the prospect of a mutually illuminating dialogue between DCR and metaRealism, on the one hand, and the life sciences, on the other, in which DCR/mr underlabours for these sciences, which in turn feed back into DCR/mr philosophy and social theory, thereby helping to actualize the possibility of non-positivist naturalism. The emergence of new technologies regularly involves comparisons with previous innovations. For instance, analogies with asbestos and genetically modified organisms have played a crucial role in the early societal debate about nanotechnology. This article explores the power of analogies in such debates and how they could be effectively and responsibly employed for imagining and governing emerging technologies in general and nanotechnology in particular. First, the concept of analogical imagination is developed to capture the explorative and anticipatory potential of analogies. Yet (...) analogies do not simply stimulate imagination, they also restrict it by framing emerging technologies in specific ways. Thus, second, the article argues that tracing the rhetorical and persuasive power of analogical arguments is essential for understanding how analogies are constructed to legitimise assessments, funding policies, and governance approaches. Third, the article addresses factors that account for the persuasiveness of analogies in debates about emerging technologies. The article concludes with reflections on how analogical imagination and an enhanced analogical sensibility for framing and persuasive effects can foster responsible research and innovation. This paper argues that emergent conscious properties can't bestow emergent causal powers. It supports this conclusion by way of a dilemma. Necessarily, an emergent conscious property brings about its effects actively or other than actively. If actively, then, the paper argues, the emergent conscious property can't have causal powers at all. And if other than actively, then, the paper argues, the emergentist finds himself committed to incompatible accounts of causation.

This paper argues that the non-reductive monist need not be concerned about the ‘problem’ of mental causation; one can accept both the irreducibility of mental properties to physical properties and the causal closure of the physical. More precisely, it is argued that instances of mental properties can be causally efficacious, and that there is no special barrier to seeing mental properties whose instances are causally efficacious as being causally relevant to the effects they help to bring about. It is then (...) shown that the causal relevance of mental properties is consistent with there being no downward causation, so the dilemma of ‘epiphenomenalism or reduction’ can be avoided. The recent terrorist attacks and ongoing state of emergency in France have brought questions of police surveillance into the public spotlight, making it increasingly important to understand how police attain data from citizens. Since 2005, the French police have been using IBM’s computer program, i2 Analyst’s Notebook, to aggregate information and craft criminal narratives. This technology serves to quickly connect suspects with crimes, looking for as many associations as possible, ranking and visualizing them based on level of importance. Recently, (...) surveillance and state power have been theorized as having shifted to a posthegemonic, order. Drawing from literature on power, surveillance, and identity, this paper considers the various ways that algorithms can impact policing under a state of emergency by comparing the technical protocol of i2 Analyst’s Notebook with the administrative protocol of the French state. Using i2 Analyst’s Notebook as an example, this paper argues that posthegemonic theories of power have their place in determining how algorithms can be used for surveillance, but that they cannot completely explain their use under the state of emergency. Indecent Theology has provided both Feminist Theology and Liberation Theology with new contours for rethinking bodies, power, dominance, and submission. With regard to the logic of dominance that radically pushes the margins of the margins into a form of inexistent living, I suggest a material turn to rethink the contours that are evoked with Indecent Theology. Materialism has long stood as a philosophy opposing the overwhelming dominance of language and the poststructuralist emphasis that has emerged as the ‘linguistic turn’. Considering (...) ‘new materialism’ as a theoretical platform to reread Indecent Theology provides theologies and ethics an opportunity to re-imagine indecent methodologies through indecency, a sort of ethical perversion. I suggest an indecent turn in mobilizing materialism and kink as theories to reread indecent theology for a productive queer materialist sexual theology. The feminist liberation theology of Marcella Althaus-Reid pushes both feminism and liberation into new contours of power and submission and initiates new contours of queer sexuality into the discourse. When analysing Althaus-Reid’s work, we are brought to attention to the margins of the margins, an awareness of the struggle for power and control by those deemed less than. There are contours of power at and in the margins of the margins, those who occupy ‘bottom space’. From a kink/bdsm orientation, I propose to reread Alrhaus-Read’s feminist liberation theology as decolonial erotics that helps to generate a productive materialist queer sexuality. The overarching methodology of this article is a quasi-auto ethnographic investigation into the ways in which the contours of race, class, gender, sex, sexuality, and ability affect power and submission and in turn reframes both queer theology and queer sexuality that is rooted in the living out of a very particular theology and ethics, which is rooted in queer relating. Theology can neither materialize in a vacuum nor in isolation. An indecent turn to a queer sexual theology that is rooted in a queer relationality demands attention to the interdependence of queer relating that is materialized through the interdependency of the growing queer desires of bodies, power, dominance, and submission. ABSTRACT Lewtas [2017] recently articulated an argument claiming that emergent conscious causal powers are impossible. In developing his argument, Lewtas makes several assumptions about emergence, phenomenal consciousness, categorical properties, and causation. We argue that there are plausible alternatives to these assumptions. Thus, the proponent of emergent conscious causal powers can escape Lewtas’s challenge.

"Powers and Capacities in Philosophy" is designed to stake out an emerging, discipline-spanning neo-Aristotelian framework grounded in realism about causal powers. The volume brings together for the first time original essays by leading philosophers working on powers in relation to metaphysics, philosophy of natural and social science, philosophy of mind and action, epistemology, ethics and social and political philosophy. In each area, the concern is to show how a commitment to real causal powers affects discussion at (...) the level in question. In metaphysics, for example, realism about powers is now recognized as providing an alternative to orthodox accounts of causation, modality, properties and laws. Dispositional realist philosophers of science, meanwhile, argue that a powers ontology allows for a proper account of the nature of scientific explanation. In the philosophy of mind there is the suggestion that agency is best understood in terms of the distinctive powers of human beings. Those who take virtue theoretic approaches in epistemology and ethics have long been interested in the powers that allow for knowledge and/or moral excellence. In social and political philosophy, finally, powers theorists are interested in the powers of sociological phenomena such as collectivities, institutions, roles and/or social relations, but also in the conditions of possibility for the cultivation of the powers of individuals. Are the special sciences autonomous from physics? Those who say they are need to explain how dependent special science properties could feature in irreducible causal explanations, but that’s no easy task. The demands of a broadly physicalist worldview require that such properties are not only dependent on the physical, but also physically realized. Realized properties are derivative, so it’s natural to suppose that they have derivative causal powers. Correspondingly, philosophical orthodoxy has it that if we want special science properties (...) to bestow genuinely new causal powers, we must reject physical realization and embrace a form of emergentism, in which such properties arise from the physical by mysterious brute determination. In this paper, I argue that contrary to this orthodoxy, there are physically realized properties that bestow new causal powers in relation to their realizers. The key to my proposal is to reject causal-functional accounts of realization and embrace a broader account that allows for the realization of shapes and patterns. Unlike functional properties, such properties are defined by qualitative, non-causal specifications, so realizing them does not consist in bestowing causal powers. This, I argue, allows for causal novelty of the strongest kind. I argue that the molecular geometry of H2O—a qualitative, multiply realizable property—plays an irreducible role in explaining its dipole moment, and thereby bestows novel powers. On my proposal, special science properties can have the kind of causal novelty traditionally associated with strong emergence, without any of the mystery. (shrink)

Teacher emotion, an important aspect of language teacher psychology, has recently drawn growing attention in language teacher development studies. Previous research has shown that language teachers, typically pressured by heavy workloads, may face emotional challenges from multiplied sources, especially in the context of educational changes such as curriculum reform and the COVID-19 emergency. Current literature on teachers’ emotions largely centers around ordinary language teachers, with teacher leaders whose agentic actions often exert greater influence on the effectiveness of educational changes (...) rarely examined. Situated in a top-tier research university that has been promoting an English for Academic Purposes reform to enhance its science students’ multilingual competence in academic contexts, this longitudinal case study tracked the emotional trajectory of an English teacher, Lea, for 5 years. Adopting an ecological perspective, our study confirms that language teachers’ emotions vary across the reform ecosystems and extends the current inquiry by conceptualizing the intricately interrelated teacher emotion, agency, power, and identity as dynamic constructs. This study also reveals how the reform-inflected emotional changes were associated with Lea’s EAP teacher and teacher leader identity construction, with both identities reinforcing each other, which to some extent reconciled Lea’s emotional tensions. Our study bears significant implications for language teachers involved in educational reform, teacher leaders, and school administrators. (shrink)
