I am embarrassed at being placed in the dizzying company of one of the truly great thinkers in the world. The similarities between Mill's ideas and mine partly reflect, of course, his influence on my thinking. But I also discuss some difficulties in taking Mill's whole theory without modification, since there are internal tensions within it. In a paper I published in 1967, I tried to discuss how Mill's willingness to hold on to some contrary positions depended on the nature (...) of his empirical reading of the world. I draw on that diagnosis in commenting on some of the articles here. There are some serious issues of misinterpretation in one of the articles, which I try to clarify. I also comment on Arrow's interpretation of what is involved in the idea of autonomy and on his own way of assessing freedom, and acknowledge the seriousness of the questions he raises about the value of freedom in normative political philosophy. The concept of business responsibility, usually termed as corporate social responsibility (CSR), originated in the early 1930s after the Wall Street crash of 1929 exposed corporate irresponsibility in large organisations. The understanding of CSR has evolved since then and its scope has now broadened from mere compliance to corporate laws to active alignment of internal business goals with externally set societal aspirations. Unfortunately, the significance of this multidimensional concept within the small and medium enterprise (SME) sector has continued to be (...) overshadowed by its application in large and multinational organisations. More importantly, this has led to the practice of judging SMEs, which are experiencing increasing pressure to engage in social activities, as if they are no different from their larger counterparts. This study therefore investigates CSR from the perspective of SMEs in Australia without any theoretical presumptions and then comments on the relevance and applicability of the two theories that have been commonly used to investigate business responsibility, namely, stakeholder theory (ST) and social capital theory (SCT). The research findings indicate that CSR within the SME sector is more aligned to the fundamentals of SCT, mainly owing to the unique resource and survival challenges that they face, and which are, arguably, not so pronounced in large organisations. When considering the threats to collective security in the twenty-first century outlined by the report of the High-Level Panel on Threats, Challenges and Change, two issues stand out.

This paper reports the validation of a 6-item short form of the original 35-item Servant Leadership Behavior Scale, a widely used measure of servant leadership behavior. The holistic perspective of servant leadership and the inclusion of spirituality are two distinctive features of the SLBS relative to other servant leadership measures. Psychometric properties of the SLBS-6 were examined on the basis of seven studies. In the preliminary scale development, the factor structure of the new measure was tested using a combination of (...) all samples. The subsequent seven studies were aimed at building further its construct validity relative to observed variables within the servant leadership nomological network in direct, mediating, and moderating relationships. Analyses of all datasets using MPlus with maximum-likelihood estimation provided support for the 6-item structure and demonstrated its internal consistency reliability, criterion-related validity, and construct validity. As such, the study presents the SLBS-6 as the shortest holistic measure of servant leadership to date that can be used with confidence for research and training purposes. (shrink)

The great poet and novelist Rabindranath Tagore once remarked that he was extremely sad that he was not alive when Gautama Buddha was still around. Tagore very much wished he could have had conversations with Buddha. I share that sentiment, but, like Rabindranath, I am also immensely grateful that, even now, we can enjoy—and learn from—the ideas and arguments that Buddha gave us twenty-five hundred years ago. Our world may be very different from what Buddha faced in the sixth century (...) bce, but we can still benefit greatly from the reasoned approach to ethics, politics, and social relations that Gautama Buddha brought to the world of human understanding. There is a shift in the role of business in society where societal, environmental and stakeholder value drivers could reshape the basis of economic competitive advantage. Investors are willing to pay a premium for well-governed companies because of positive perceptions of CSR. Organizations respond to the value drivers to endure and function effectively along the societal, environmental and stakeholder dimensions. In this article case analysis is performed for four international firms, chosen from USA/Europe and Asia, with distinguished records of sustainability. (...) The case studies were based on the company sustainability reports and related material published in EthicalCorp, CSRWire and Covalence online publications. Assessments were performed using publicly available information. The non-parametric correlation analysis shows that firms with better commitment to CSR respond more to societal, environmental and stakeholder drivers through strategic initiatives. This improves their competitive advantage as assessed by economic value added. (shrink)

Reverend Dr. Martin Luther King, Jr., wrote in his Letter from Birmingham Jail: “Injustice anywhere is a threat to justice everywhere.” That was in April 1963, more than a half-century ago. He had been jailed for his agitation to end injustice against non-white people in his own country, and he would be killed soon after by an assassin who hated him and his vision.

Medical migration appears to be an increasing global phenomenon, with complex contributing factors. Although it is acknowledged that such movements are inevitable, given the current globalized economy, the movement of health professionals from their country of training raises questions about equity of access and quality of care. Concerns arise if migration occurs from low- and middle-income countries to high-income countries. The actions of HICs receiving medical practitioners from LMICs are examined through the global justice theories of John Rawls and Immanuel (...) Kant. These theories were initially proposed by Pogge and Tan and, in this work, are extended to the issue of medical migration. Global justice theories propose that instead of looking at health needs and workforce issues within their national boundaries, HICs should be guided by principles of justice relevant to the needs of health systems on a global scale. Issues of individual justice are also considered within the framework of rights and social responsibilities of individual medical practitioners. Local and international policy changes are suggested based on both global justice theories and the ideals of individual justice. (shrink)

This paper addresses the doubts voiced by Wigner about the physical relevance of the concept of geometrical points by exploiting some facts known to all but honored by none: Almost all real numbers are transcendental; the explicit representation of any one will require an infinite amount of physical resources. An instrument devised to measure a continuous real variable will need a continuum of internal states to achieve perfect resolution. Consequently, a laboratory instrument for measuring a continuous variable in a finite (...) time can report only a finite number of values, each of which is constrained to be a rational number. It does not matter whether the variable is classical or quantum-mechanical. Now, in von Neumann’s measurement theory (von Neumann, Mathematical Foundations of Quantum Mechanics, Princeton University Press, Princeton, [1955]), an operator A with a continuous spectrum—which has no eigenvectors—cannot be measured, but it can be approximated by operators with discrete spectra which are measurable. The measurable approximant F(A) is not canonically determined; it has to be chosen by the experimentalist. It is argued that this operator can always be chosen in such a way that Sewell’s results (Sewell in Rep. Math. Phys. 56: 271, [2005]; Sewell, Lecture given at the J.T. Lewis Memorial Conference, Dublin, [2005]) on the measurement of a hermitian operator on a finite-dimensional vector space (described in Sect. 3.2) constitute an adequate resolution of the measurement problem in this theory. From this follows our major conclusion, which is that the notion of a geometrical point is as meaningful in nonrelativistic quantum mechanics as it is in classical physics. It is necessary to be sensitive to the fact that there is a gap between theoretical and experimental physics, which reveals itself tellingly as an error inherent in the measurement of a continuous variable. The progress of electronic health technologies and biobanks holds enormous promise for efficient research. Evidence shows that studies based on sharing and secondary use of data/samples have the potential to significantly advance medical knowledge. However, sharing of such resources for international collaboration is hampered by the lack of clarity about ethical and legal requirements for transfer of data and samples across international borders. Here, the International Clinical Trial Center Network reports the legal and ethical requirements governing data and sample exchange (...) across four continents. The most recurring requirement is ethical approval, whereas only in specific conditions approval of national health authorities is required. Informed consent is not required in all sharing situations. However, waiver of informed consent is only allowed in certain countries/regions and under certain circumstances. The current legal and ethical landscape appears to be very complex and under constant evolution. Regulations differ between countries/regions and are often incomplete, leading to uncertainty. With this work, ICN illuminates the unmet need for a single international collaborative framework to facilitate DSE. Harmonising requirements for global DSE will reduce inefficiency and waste in research. There are many challenges to realising this ambitious vision, including inconsistent terminology and definitions, and heterogeneous and dynamic legal constraints. Here, we identify areas of agreement and significant difference as a necessary first step towards facilitating international collaboration. We propose the establishment of a working group to continue the comparison across jurisdictions, create a standardised glossary and define a set of basic principles and fundamental requirements for DSE. This paper examines how employees react to their organizations’ corporate social responsibility initiatives. Drawing upon research in internal marketing and psychological contract theories, we argue that employees have multi-faceted job needs and that CSR programs comprise an important means to fulfill developmental and ideological job needs. Based on cluster analysis, we identify three heterogeneous employee segments, Idealists, Enthusiasts, and Indifferents, who vary in their multi-faceted job needs and, consequently, their demand for organizational CSR. We further find that an organization’s CSR (...) programs generate favorable employee-related outcomes, such as job satisfaction and reduction in turnover intention, by fulfilling employees’ ideological and developmental job needs. Finally, we find that CSR proximity strengthens the positive impact of CSR on employee-related outcomes. This research reveals significant employee heterogeneity in their demand for organizational CSR and sheds new light on the underlying mechanisms linking CSR to employee-related outcomes. (shrink)

This analysis investigates whether solidarity is an appropriate concept for thinking about justifications for a just distribution of bioethical goods in the international arena. This will be explored by looking at the national origins of the idea of justifying solidarity in the form of the health care that welfare states offer. Following that, ‘life’ and ‘health’ will be placed within a philosophical context by focusing on the main arguments of John Rawls and Amartya Sen and the role of solidarity in (...) these two theories of justice will be analysed. It will be shown that these theories assume that solidarity is not a prerequisite for just international structures. Finally, the possibility will be discussed, that there is a degree of uncertainty surrounding justifications for fair distribution in the international context that can result when the concepts of solidarity and justice are handled imprecisely. Amartya Sen has recently leveled a series of what he alleges to be quite serious very general objections against Rawls, Rawlsian fellow travelers, and other social contract accounts of justice. In The Idea of Justice, published in 2009, Sen specifically charges his target philosophical views with what calls transcendentalism, procedural parochialism, and with being mistakenly narrowly focused on institutions. He also thinks there is a basic incoherence—arising from a version of Derek Parfit’s Identity Problem—internal to the Rawslian theoretical apparatus. Sen (...) would have political philosophy pursue intersocietal comparisons of relative justice more directly and in the manner of social choice theory. Yet the positive argument he develops in support of this method is quite thin. That aside, Sen’s polemical strategy of inflicting death by a thousand cuts is ineffective against the Rawlsian paradigm. For, as I show herein, none of these criticisms have the force we might be led to expect. (shrink)

Comment la notion aristotelicienne de puissance s'est-elle constituee? Comment Aristote peut-il designer du meme nom de dynamis a la fois le principe du changement et l'etre en puissance en tant qu'il est distingue de l'etre en acte? L'histoire de la dynamis correspond-elle a l'effacement d'un sens primitivement intensif, qui serait celui de la force, au profit du sens aristotelicien de potentialite? Plutot que d'aborder ces questions dans les limites d'une lecture interne du Livre Theta de la Metaphysique sur (...) la puissance et l'acte, ou meme du corpus aristotelicien, la presente recherche plonge d'abord la notion de puissance dans son histoire pre-aristotelicienne, philosophique et non-philosophique. Si les termes d'energeia et d'entelekheia, par lesquels Aristote designe ce qui est en acte, sont des neologismes qui possedent la precision du vocabulaire technique, le mot dynamis appartient au grec courant et comporte une polysemie qui complique la comprehension de son usage. Ce livre veut articuler les sens philosophiques de cette notion chez Aristote a partir de son histoire depuis Homere et Hesiode, a travers Democrite, Xenophon ou encore le corpus hippocratique. Mais l'etude des principaux textes (poetiques, politiques, medicaux, mathematiques, philosophiques) est conduite selon un fil conducteur precis, dicte par l'emploi dominant de ce terme dans la clause restrictive kata dynamin (autant que je le peux). Les significations et l'histoire de la dynamis sont reevaluees a partir de ce nouveau point de depart. L'heritage platonicien est aussi pris en compte pour degager finalement le sens de la critique aristotelicienne de la puissance, qui met en lumiere son indetermination axiologique et ontologique, sans renoncer aux sens de capacite et de force. Nous ne cherchons pas a proposer une etude lexicographique, mais a situer la pensee aristotelicienne de la puissance et de l'acte dans une histoire conceptuelle, en esperant qu'elle gagnera ainsi en coherence et en clarte. This paper uses lines of argument drawn from Amartya Sen's Idea of Justice to support the notion that NGO efforts, far from being oppressive, are helpful and progressive. It cites the work of Lairap‐Fonderson and Chen, and alludes to specific projects. Contrast is made with Rawls, and the paper suggests that more formal theories of justice may not enable us to grapple with our intuitive sense that justice for the poverty stricken involves, at a minimum, both financial progress and forward (...) movement with respect to internal growth. Examples of work done by NGOs in Bangladesh and other places help us to realize that women in these areas often have their own sense of what a more just situation would require—and NGOs and others can work from these conceptions as a point of departure. Part of the conclusion here is that Sen's concept of the just is a step in the right direction. (shrink)

Proceedings of a Conference on experience in Medieval natural philosophy.

This paper intends to focus once again on the Roman legal document which is improperly called the “Edict of Milan”. The approach and arguments put forward here are not necessarily new or original. Nevertheless, it seems that this umpteenth return to this issue is useful, after several international scientific events were organised on the occasion of the supposed 1700th anniversary of the proclamation of this document by Constantine. We will see, in particular, that the title of edictum dates back to (...) an error in translating from Greek to Latin. We will also be interested in the legal nature, as well as the historical significance and interest of the text that Eusebius of Caesarea and Lactantius have given us. (shrink)

Against scepticism from thinkers including John Rawls and Thomas Nagel about the appropriateness of justice as the concept through which global ethical concerns should be approached, Amartya Sen argues that the problem lies not with the idea of justice, but with a particular approach to thinking of justice, namely a transcendental approach. In its stead Sen is determined to offer an alternative systematic theory of justice, namely a comparative approach, as a more promising foundation for a theory of ?global justice.? (...) But in the end Sen offers no such thing. He does not develop a theory of justice and this is all to the good; for if values are plural in the way Sen suggests, then justice is not a master idea but one value among many, and it should be neither the first virtue of social institutions, nor the notion that frames all our reflections on ethical and political life. This paper presents Sen's theory of agency, focusing on the role of commitment in this theory as both problematic and potentially illuminating. His account of some commitments as goal-displacing gives rise to a dilemma given the standard philosophical theory of agency.Eithercommitment-motivated actions are externally motivated, in which case they are not expressions of agency,orsuch actions are internally motivated, in which case the commitment is not goal-displacing. I resolve this dilemma and accommodate his view of commitment as motivation by developing a (...) broader descriptive theory of agency, which recognizes both agent goal-directed and goal-displacing commitments. I propose a type of goal-displacing commitment, which I call ‘tacit commitment’, that can be seen to fit between the horns. Tacit commitments regulate behaviour without being made conscious and explicit. This resolution suggests a means of bridging the normative/descriptive gap in social-scientific explanation. (shrink)

The following article is the result of a collaboration between a painter and a woman philosopher. They worked previously on an experimental documentary film about objects and art objects, which was realized at Palais de Tokyo. The painter had illustrated in black and white fictions of philosophy, written during a festival on lost films organized by UNdocumenta in South Korea, and then he made photographs of oil paintings of the English translation. This article about painting and philosophical ethics is their (...) first common text. It aims to show that there is no interdiscipline or passage known between the philosophical work and the painting. The philosopher can not imitate the recognition of the painter nor the painter to repair the philosophical non-encounter. The question then is: What can ethics in this non-symmetrical space? Rather than being a product of philosophy, it is what organizes this space between recognition and non-encounter. It is an ethics for philosophy, rather than the other way around. Ethics force to greet the other philosophers without the grudge of the loss necessary to the invention and allows the painter to know the distances that make him feel the recognition. This ethical space is unknown and can not be covered by the artist's philosophy of access or pre-nomination by indexes. Ethics is this unknown, i.e. it is a sense-without-sign, it is without rules-said but process of indexation and acceptance of the loss. (shrink)

Amartya Sen’s comparative approach to justice makes clear that notions of justice are shaped by human agency and experience, and both his focus on the ‘internal view’ of well-being that emphasizes suffering as a central feature of illness and his recognition that social and cultural factors shape perceived injustice are critical to this approach. However, Sen questionably depicts the contributions of anthropological research to this project as limited to ‘the sensory dimension of ill-health.’ Focusing on mental health in the context (...) of global justice, I argue that Sen’s treatise on justice can be refined through an ethnographic method that synchronizes attention to (1) cultural knowledge and social relations in ecological settings; (2) fundamental human needs; and (3) levels of analytic specificity involving situations, categories, and events. This method integrates analysis of internal phenomenology and external constraints of political economy and ideology. To demonstrate I discuss three cases involving students and violence in Rio de Janeiro, women and witchcraft in Ghana, and historical migration and war trauma among Vietnamese immigrants in which external conditions of insecurity and inequality contributed to deteriorating mental health conditions including depression, trauma, and debilitating anxiety. Une confrontation entre la pensée de Maurice Merleau-Ponty et celle de Paul Ricoeur ne peut faire l’économie de cette caractérisation par le second de son entrée dans le travail philosophique. Cette remarque présente toutefois l’avantage de fixer les termes d’une relation marquée par la proximité méthodologique et la distance thématique. La première semble à première vue l’emporter (...) sur la seconde. Le privilège accordé par Ricoeur à « l’ordre pratique » consonne, certes, avec l’image d’un philosophe essentiellement occupé par le phénomène de l’action. Selon ses propres dires, l’anthropologie de « l’homme capable » constitue le fil conducteur à partir duquel il devient possible de reconstituer l’unité de son oeuvre. Il reste que Merleau-Ponty n’est nullement indifférent à l’« ordre pratique » : pour ne rien dire des textes qu’il consacre expressément au politique, il suffit de rappeler que la Phénoménologie de la perception s’achève sur un chapitre consacré à la liberté. Plus profondément, les deux philosophes se retrouveront pour accorder une place centrale à la phénoménologie du « Je peux ». Pour autant, la distance thématique entre les deux auteurs n’est pas sans importance. Il s’agit moins de savoir comment Ricoeur apporte une « contrepartie » à la Phénoménologie de la perception dans l’ordre pratique, que de comprendre pourquoi son oeuvre n’a accordé qu’un intérêt somme toute secondaire à la perception. Le principal accord entre les deux auteurs réside dans le refus de toute « pensée de survol ». Non moins que Ricoeur, Merleau-Ponty renonce à « l’idéal d’un spectateur absolu » parce que cet idéal implique nécessairement de transformer la position de l’interprète en principe d’erreur. Il reste que les deux philosophes diffèrent dans la caractérisation de ce point de vue.With The Voluntary and the Involuntary, “I envisaged, not without some naïveté, to give a counterbalance, in practical order, to the Phenomenology of Perception.” A confrontation between the thought of Maurice Merleau-Ponty and that of Paul Ricoeur cannot do without this characterization by Ricoeur in his entrance into philosophical work. All the same, this remark highlights the advantage of fixing the terms of a relation marked by its methodological proximity and its thematic distance. The former, at first glance, seems to trump the latter. The privilege accorded by Ricoeur to the “practical order” resonates, certainly, with a philosophy essentially concerned with the phenomenon of action. According to its own discourse, the anthropology of the “capable human being” constitutes the guiding thread from which it becomes possible to reconstitute the unity of his oeuvre. It is clear that Merleau-Ponty is in no way indifferent to the “practical order.” Without even mentioning the texts he specifically dedicates to the political, it suffices to remember that the Phenomenology of Perception concludes in a chapter devoted to freedom. More profoundly, the two philosophers will come together in according a central place to the phenomenology of the “I can.” For all this, the thematic distance between the two philosophers is not without importance. It concerns less knowing how Ricoeur brings a “counterbalance” to the Phenomenology of Perception in the practical order than to understand why in his work he accorded ultimately only a secondary interest to perception. The principal agreement between the two philosophers resides in their refusal of all “surveying thought.” Not any less than Ricoeur, Merleau-Ponty renounces the “ideal of the absolute spectator” because this ideal necessarily implies the transformation of the position of the interpreter into a principle of error. Il principale motivo di accordo tra i due autori risiede nel rifiuto di ogni “pensiero di sorvolo”. Non meno di Ricoeur, Merleau-Ponty rinuncia “all’ideale di uno spettatore assoluto”, nella misura in cui questo ideale porterebbe inevitabilmente a trasformare la posizione dell’interprete in un principio di errore. En latence dans le texte, le sens attend d’être révélé par l’interprétation. Lorsqu’il s’agit de traduire, la difficulté que présente la traduction de certains textes juridiques tient en bonne part, outre au caractère normatif de ce type de texte, à la charge notionnelle dont il est porteur. Plus la société qui l’a produit est ancienne et développée, plus ses institutions et son langage seront complexes. Chaque terme cèle un univers reflétant la profondeur des fondations de l’édifice juridique, l’originalité et (...) le dynamisme de la culture qui l’a façonné. Le message que véhicule un texte prime dans l’interprétation qui en sera faite. Son mode d’expression—son style—n’est pas pour autant quantité négligeable. La manière de dire est porteuse de x significations possibles. Elle influe sur le sens et sa perception, en modifie parfois le cours et l’interprétation que peut en faire le traducteur ou le jurilinguiste—voire le juriste. En sursis jusqu’à son interprétation finale par les tribunaux, le sens du texte est alors fixé. Dans cette perspective, à en croire Gadamer, le traducteur est bien placé pour en distinguer les formes lorsqu’il interprètera le message du texte de départ en vue de le traduire. (shrink)

Over the last 30 years the Indian philosopher-economist Amartya Sen has developed an original normative approach to the evaluation of individual and social well-being. The foundational concern of this ‘capability approach’ is the real freedom of individuals to achieve the kind of lives they have reason to value. This freedom is analysed in terms of an individual’s ‘capability’ to achieve combinations of such intrinsically valuable ‘beings and doings’ (‘functionings’) as being sufficiently nourished and freely expressing one’s political views. In this (...) account, ‘development’ is conceived as the expansion of individuals’ capability, and thus as a concept that goes beyond the economic growth of third world countries. My thesis is a philosophical examination of Sen’s capability approach. In the first part (chapters 1-3) I present and defend my interpretation of Sen’s work. (shrink)

The Idea of Justice" summarizes and extends many of the themes Amartya Sen has been engaged with for the last quarter century: economic versus political rights, cultural relativism and the origin of notions such as human rights, and entitlements and their relation to gender equality.

A central challenge of Amartya Sen’s comparative view of justice is to bring cultural diversity to bear on conceptualizing global justice, which includes building bridges across cultures that enable effective action, and rendering compatible the most beneficent of Rawlsian (or transcendental) intentions with irreducible cultural diversity. For social scientists meeting this challenge requires, first, taking account of variation of social practices in the social construction of meaning, and second, uncovering invisible frontiers of global justice that remain hidden due to conceptual (...) or empirical oversight. The latter is especially true for contemporary International Relations (IR) theory, which assumes state actors to be the main interlocutors in the global realm, and thus precludes consideration of micro-level forms of inter-national relations (understood as interaction among all types of actors that takes place across country borders and that bears traits of national identity). Alternatively, Sen’s micro-perspectival approach offers a welcome support for pluralist approaches that both appreciate non-state access to contestation in the international arena, and account for the meaning-in-use of fundamental norms (democracy, rule of law, human rights) in different cultural and inter-national contexts. This paper examines evolving technological capabilities in developing countries. Counts of web sites indicate that some progress is being made in some of the world’s poorest countries, but the numbers show even with this progress, the gap between developed and developing countries is actually growing. So has there been progress in closing the global digital divide? The significance of web sites to provide access to necessary medical information, local cultural information, and the general visibility of the developing world is described (...) and the current environment evaluated. The moral situation created by the current status is reviewed using ethical theories proposed by Nobel laureate Amartya Sen. By reviewing one vehicle for information transfer—the web site—the author hopes to highlight the importance of this vehicle and to present a general overview of the progress that is being made around the world.
