Hugo Grotius’s best-known work, De iure belli ac pacis, appeared in 1625 in Paris with the author’s approval. A second unauthorised version was published in 1626 in Frankfurt. In 1631 the Amsterdam publisher, Willem Janszoon Blaeu (1571–1638), issued the third edition, this one authorised by the author – and this edition featured nearly a thousand revisions by Grotius. The purpose of this report is to analyse the context behind the publication of this third edition and the copies’ provenance records. (...) Using online and card catalogues, we have located 154 copies. We examined 52 copies in person, and another three fully digitised copies online. We hope that this research note on preliminary results will generate greater interest in this unduly neglected edition, and that readers will kindly bring further copies to our attention. (shrink)

This is the fourth instalment of our census and study of the reception of the first nine editions of De iure belli ac pacis. Here we focus on the two versions that Johannes Janssonius issued in 1632, one with a copy of Mare liberum attached to it. This report outlines the place of the 1632 Janssonius edition in the context of his long-running rivalry with the printer Willem Blaeu and his firm. It then explores the typographical differences between (...) the two issues, their causes, and their significance for our understanding of the reception of the text. Finally, it provides the preliminary results of the census concerning the circulation and provenance of the fifty-three copies of this edition that we have found. We hope that this research note on the preliminary results will attract interest in this edition and that readers will kindly inform us of further copies. (shrink)

As his letters reveal, Lipsius was inconsistent in his life and unsuccessful in reconciling Stoicism with Catholic doctrine; Rubens, although at first sympathetic to the doctrines of Lipsius, is shown to have later transcended their limitations. This article presents an edition of, and commentary on, a fragment of papyrus preserved in the collection of the J. Willard Marriott Library at the University of Utah (P.Utah 280). This well-preserved piece is a rare example of Arabic papyrus with lines of poetry. The text of the verses and their attribution in the papyrus will be studied in detail and traced through later sources, leading to a discussion on textual variation and authorship as well as on the value of (...) papyrological evidence vis-à-vis the corpus of classical Arabic literature. It will be shown that lineages of text and attribution can be highly complex and therefore do not lend themselves to linear representation, e.g., in book form or simple HTML format. The article outlines the requirements for alternative means of representation for textual layers and points to existing tools in Arabic studies and other disciplines. (shrink)

Mark S. Cladis pinpoints the origins of contemporary notions of the public and private and their relationship to religion in the work of Jean-Jacques Rousseau. His thesis cuts across many fields and issues-philosophy of religion, women's studies, democratic theory, modern European history, American culture, social justice, privacy laws, and notions of solitude and community-and wholly reconsiders the political, cultural, and legal nature of modernity in relation to religion. Turning to Rousseau's Garden, its inhabitants, the Solitaires, and the question of restoration (...) and redemption that preoccupied much of Rousseau's thought, Cladis examines how Rousseau addressed the tension between the joys and moral obligations of social engagement and the desire for solitude. He was caught between two possibilities: active involvement in the creation of an enlightened and humane society or extrication from social entanglements in favor of cultivating a spiritual interior life. Yet Rousseau did not view this conflict as a desperate division. Rather, for him it was a moral struggle to be endured by those who had fallen from the Garden. For this edition Cladis has added a substantive introduction that discusses the role of religion in contemporary democratic societies, particularly in American public life. Cladis proposes four models of thinking about religion in public and champions what he calls spiritual democracy-a dynamic, culturally specific, and progressive democracy. Two challenges to the very possibility of emergence are addressed, one metaphysical and one logical. The resolution of the metaphysical challenge requires a shift to a process metaphysics, while the logical challenge highlights normative emergence, and requires a shift to more powerful logical tools -- in particular, that of implicit definition. PTSD was formalized as a diagnosis by the American Psychiatric Association in 1980 with the publication of the Diagnostic and Statistical Manual of Mental Disorders (DSM), 3rd edition. Since that time, the diagnosis has been widely utilized in the courts including the use in criminal proceedings. PTSD may play a role in the assessment of violent crimes both as a possible contributing factor in the perpetrators as well as a consequence in the victims. There are a number of ethical and (...) clinical considerations in the use of this diagnosis. Importantly, the diagnostic criteria have changed to a degree with subsequent editions of the DSM. This may have an impact on the interpretation of past legal judgments. Moreover, extensive psychiatric comorbidity may complicate the clinical picture, e.g., mood disorders, substance use disorders, or psychosis. The diagnosis of PTSD is still based on clinical, largely subjective criteria, e.g., biological markers are not yet utilized. As such, there may not be consistent agreement about the diagnosis among experts. This paper summarizes some of these relevant issues in adjudicating violent crimes. (shrink)

There are a number of considerations, including ethical and clinical or diagnostic factors, in utilizing the diagnosis of posttraumatic stress disorder in criminal proceedings. The reliability and validity of the diagnosis may be questioned. Legal precedent may consider extant diagnostic criteria for PTSD and comorbid diagnoses. However, these diagnostic criteria are often in flux considering new research findings. For example, the introduction of the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders, published by the American Psychiatric Association, (...) includes some changes in the PTSD diagnostic criteria. How will this affect interpretation of past legal judgments? Moreover, PTSD has significant psychiatric comorbidity, e.g., substance abuse, which in itself may influence violent behavior and its consequences. Some of these comorbid diagnoses also have changes in their diagnostic criteria. The introduction of biological tests in the assessment of PTSD will likely facilitate more objective diagnosis. To scholars of Western intellectual history Hegel is one of the most important of all political thinkers, but politicians and other "down-to-earth" persons see his speculative philosophy as far removed from their immediate concerns. Put off by his difficult terminology, many participants in practical politics may also believe that Hegel's idealism unduly legitimates the status quo.
