This study investigated the link between meditation, self-reported mindfulness and cognitive flexibility as well as other attentional functions. It compared a group of meditators experienced in mindfulness meditation with a meditation-naïve control group on measures of Stroop interference and the “d2-concentration and endurance test”. Overall the results suggest that attentional performance and cognitive flexibility are positively related to meditation practice and levels of mindfulness. Meditators performed significantly better than non-meditators on all measures of attention. Furthermore, self-reported mindfulness was higher in (...) meditators than non-meditators and correlations with all attention measures were of moderate to high strength. This pattern of results suggests that mindfulness is intimately linked to improvements of attentional functions and cognitive flexibility. The relevance of these findings for mental balance and well-being are discussed. (shrink)

Using weak heirs and weak coheirs we point out some algebraic connections between the Ellis semigroups$S_{ext,G}(M)$and$S_{ext,G}(N)$. In this paper we develop a new methodology for normative theorising, which we call Directed Reflective Equilibrium. Directed Reflective Equilibrium is based on a taxonomy that distinguishes between a number of different functions of hypothetical cases, including two dimensions that we call representation and elicitation. Like its predecessor, Directed Reflective Equilibrium accepts that neither intuitions nor basic principles are immune to revision and that our commitments on various levels of philosophical enquiry should be brought into equilibrium. However, it also offers (...) guidance about how different types of cases ought to be sequenced to achieve this result. We argue that this ‘directional’ approach improves, in various ways, upon the non-directional approach of traditional Reflective Equilibrium. (shrink)

In this paper, we discuss several problems with current Big data practices which, we claim, seriously erode the role of informed consent as it pertains to the use of personal information. To illustrate these problems, we consider how the notion of informed consent has been understood and operationalised in the ethical regulation of biomedical research (and medical practices, more broadly) and compare this with current Big data practices. We do so by first discussing three types of problems that can impede (...) informed consent with respect to Big data use. First, we discuss the transparency (or explanation) problem. Second, we discuss the re-repurposed data problem. Third, we discuss the meaningful alternatives problem. In the final section of the paper, we suggest some solutions to these problems. In particular, we propose that the use of personal data for commercial and administrative objectives could be subject to a ‘soft governance’ ethical regulation, akin to the way that all projects involving human participants (e.g., social science projects, human medical data and tissue use) are regulated in Australia through the Human Research Ethics Committees (HRECs). We also consider alternatives to the standard consent forms, and privacy policies, that could make use of some of the latest research focussed on the usability of pictorial legal contracts. (shrink)

Criminologists have long acknowledged the link between a number of cognitive deficits, including low intelligence and impulsivity, and crime. A new wave of research has demonstrated that pharmacological intervention can restore or improve cognitive function, particularly executive function, and restore neural plasticity. Such restoration and improvement can allow for easier acquisition of new skills and as a result, presents significant possibilities for the criminal justice system. For example, studies have shown that supplements of Omega-3, a fatty acid commonly found in (...) food such as tuna, can decrease frequency of violent incidents in an incarcerated population. Research has also begun to explore the use of selective serotonin reuptake inhibitors to reduce impulsivity in some violent offenders. However, there are significant legal and ethical implications when moving from dietary supplements to prescription pharmaceuticals and medical devices for cognitive intervention. This paper will explore the legal and ethical issues surrounding the use of pharmacological intervention on prisoners as an effort to reduce crime and recidivism. (shrink)

Especially in this current age of 露 露 and 娜娜 (Lulu and Nana), our first officially public transgenic kindred, the question becomes, ‘who are these free-living divergences and what does it mean to be the uber-ding beyond geoengineering’s capabilities?’. We argue that Madole & Harden's distinction between shallow versus deep genetic causes can bring some clarity to causal claims arising from genome-wide association studies (GWASs). However, the authors argue that GWAS only finds shallow genetic causes, making GWAS commensurate with the environmental studies they hope to supplant. We also assess whether their distinction applies best to explanations or causes.

According to some, such as Carruthers (2009, 2010, 2011, 2015), the confabulation data (experimental data showing subjects making false psychological self-ascriptions) undermine the view that we can know our propositional attitudes by introspection. He believes that these data favour his interpretive sensory-access (ISA) theory—the view that self-knowledge of our propositional attitudes always involves self-interpretation of our sensations, behaviour, or situational cues. This paper will review some of the confabulation data and conclude that the presence and pattern of these data do (...) not substantiate the claim that we cannot introspect our propositional attitudes. As a consequence of this discussion, I conclude that the ISA theory is not well supported by the empirical data. (shrink)

I argue that on an understanding of imagination that relates it to an individual's environment rather than her mental contents imagination is essential to emotion, and brings together affective, cognitive, and representational aspects to emotion. My examples focus on morally important emotions, especially retrospective emotions such as shame, guilt, and remorse, which require that one imagine points of view on one's own actions. In a recent paper, Selim Berker develops an abductive argument against practical reasons for belief that exploits an alleged difference between epistemic and practical reasons. According to Berker, epistemic reasons for belief balance to suspension. If I have equally strong epistemic reasons to believe and disbelieve some proposition, I lack sufficient reason either to believe or disbelieve it. Rather, I have decisive reason to suspend judgment. In contrast, practical reasons balance to permission. If I have equally strong practical reasons to (...) φ or ψ, I have sufficient reason to do either. Given this difference, Berker argues that defenders of practical reasons for belief cannot offer a plausible explanation of how practical and epistemic reasons interact in order to yield all-things-considered normative verdicts. In this essay, I defend a non-interactionist “pure” form of pragmatism against Berker’s objection. I outline a pure pragmatist theory, recapitulate why Berker thinks it also falls prey to his objection, and explain why the objection fails to undermine pure pragmatism. Finally, I consider an additional reason Berker’s argument might seem persuasive and show that it depends on conflating Berker’s objection and a separate challenge to pure pragmatism. Once these distinct challenges are disambiguated, it is easier to see why Berker’s objection is not a significant concern for pure pragmatists. (shrink)

A central task of comparative constitutional law scholarship is categorization and classification of constitutions. Recent scholarship, no doubt informed by the populist tide, has sought to develop the concept of a mixed constitution. Broadly speaking, a mixed constitution is a constitution that integrates liberal and illiberal elements, elements that are usually separate and not found under the same constitution. The study of “mixed constitutions” encompasses both descriptive and normative aspects. First, an attempt to ascertain what, exactly, makes a constitution “mixed.” (...) Second, an attempt to analyze either the desirability of such a system or an attempt to figure out how to harness mixed constitutions in the service of particular normative goals, for example the protection of human rights. This article has two goals. First, an inquiry into the descriptive aspect of mixed constitutions. My aim is to show that given the seeming consensus of what constitutes a mixed constitution, the category itself might encompass many more constitutions than is often acknowledged, to the point that many constitutions are likely to be mixed to a certain extent. My second goal is to demonstrate that given this definitional consensus, what makes a constitution mixed is not necessarily because the constitution itself is mixed, but because sub-constitutional norms shape our constitutional understanding. Put differently, the meaning of a constitution is not determined exclusively through an analysis of the constitution, but also by shifts in sub-constitutional understandings. If this is correct, then it turns out that the universe of mixed constitutions is much larger than thought, which casts doubt on the utility of the category of mixed constitutions. (shrink)

This paper examines the 'taking back control' over immigration arguments offered for Brexit and for reinforcing the Southern border of the United States. According to these arguments, Brexit and increased border enforcement were needed to ensure collective self-governance for the peoples of Britain and the United States. I argue that 1. In fact these policies did little to enhance collective self-governance properly understood, and 2. They actually thwarted collective self-governance due their racially exclusionary effects on people of color in Britain (...) and the United States. (shrink)

A hypothesis on the evolutionary origin of the genetic pathway of sex determination in the nematode Caenorhabditis elegans is presented here. It is suggested that the pathway arose in steps, driven by frequency‐dependent selection for the minority sex at each step, and involving the sequential acquisition of dominant negative, neomorphic genetic switches, each one reversing the action of the previous one. A central implication is that the genetic pathway evolved in reverse order from the final step in the hierarchy up (...) to the first. The possible applicability of the model to the other well‐characterized sex determination pathway, that of Drosophila melanogaster, and to sex determination in mammals, is discussed, along with some potential implications for pathway evolution in general. Finally, the specific molecular and population genetic questions that the model raises are described and some tests are proposed. (shrink)

This article aims to contextualize a short Qurʾānic passage – Q 30:2‒5 – with reference to Jewish and Christian materials that have not hitherto been deployed for this purpose. The article builds on the findings of recent scholarship, which reads this passage eschatologically rather than historically, and argues that there are, in fact, two texts that require contextualization: 1) The Qurʾānic verses themselves (which refer only to the fate of “the Romans”); and 2) The early exegetical traditions on these verses (...) (which often add “the Persians” to the eschatological drama). Furthermore, it is argued that the Biblical book of Daniel, and its interpretation in late antiquity, contributed both to the verses themselves and to their exegesis. (shrink)

This article integrates the history of military theory – and the practical history of military campaigns and battles – within the broader history of knowledge. Challenging ideas that the new natural philosophy of the seventeenth and eighteenth centuries (the so-called Scientific Revolution) fostered attempts to make warfare mathematically calculated, it builds on work showing that seventeenth- and eighteenth-century natural philosophy was itself much more subjective than previously thought. It uses the figure of King Frederick II of Prussia (reigned 1740–1786) to (...) link theoretical with practical military knowledge, placing the military treatises read and written by the king alongside the practical example of the Prussian army’s campaign against the Russians in summer 1758 at the height of the Seven Years War (1756–1763), which culminated in the battle of Zorndorf. This article shows that both the theory and practice of war – like other branches of knowledge in the long eighteenth century – were fundamentally shaped by the contemporary search for intellectual order. The inability to achieve this in practice led to a reliance on subjective judgment and individual, local knowledge. Whereas historians have noted attempts in the eighteenth century to calculate probabilities mathematically, this article shows that war continued to be conceived as the domain of fortune, subject to incalculable chance. Answering Steven Shapin’s call to define concretely “the subjective element in knowledge-making,” the examples of Frederick and his subordinate, Lieutenant General Count Christoph zu Dohna, reveal sharply different contemporary ideas about how to respond to uncertainty in war. Whereas Dohna sought to be ready for chance events and react to them, Frederick actively embraced uncertainty and risk-taking, making chance both a rhetorical argument and a positive choice guiding strategy and tactics. According to the Transparency Method, one can know whether one believes that P by attending to a question about the world—namely, ‘Is P true?’ On this view, one can know, for instance, whether one believes that Socrates was a Greek philosopher by attending to the question ‘Was Socrates a Greek philosopher?’ While many think that TM can account for the self-knowledge we can have of such a belief—and belief in general—fewer think that TM can be generalised to account for the (...) self-knowledge we can have of other propositional attitudes, such as our desires, intentions, wishes and so on. Call this the Generality Problem. In the present paper, I contrast my own attempt to solve the Generality Problem with several recent ones. I argue that in order to extend TM beyond belief, we must look to the concepts underpinning each kind of mental state. Doing so, I argue, reveals a series of outward-directed questions that can be attended to, in order to know what one desires, intends, wishes and so on. Call this the conceptual approach to extending TM. I support the conceptual approach in the present paper by showing how it generates Moore-Paradoxical sentences that are analogous to the case of belief. (shrink)

In his excellent book *The Metaphysics of Sensory Experience* (2021), David Papineau argues against standard theories of sensory experience: the sense datum view, representationalism, naïve realism, and so on. The only view left standing is his own “qualitative view”. On Papineau’s physicalist version, all experiences are nothing but neural states, and the only features essentially involved in experience are intrinsic neural properties (29-30, 95-97). In my book *Perception* (2021), I developed an argument from spatial experience against this kind of view (...) (also Pautz 2010, 2017). This article discusses the desirability and feasibility of modeling precedents with multiple interpretations within factor-based models of precedential constraint. The main idea is that allowing multiple reasonable interpretations of cases and modeling precedential constraint as a function of what all reasonable interpretations compel may be advantageous. The article explains the potential benefits of extending the models in this way with a focus on incorporating a theory of vertical precedent in U.S. federal appellate courts. It also considers the costs of extending (...) the models in this way, such as the significant increase in the functional size of the case base and the need to provide some kind of ordering on interpretations to select a “best” interpretation. Finally, the article suggests partially incorporating multiple interpretations of dimensions as a realistic starting point for incorporating interpretations generally, and shows how doing so can help address difficulties with dimensions. The conclusion remarks on the use of interpretations to deal with inconsistent precedents. (shrink)

Proponents of strict rule-based theories of judicial reasoning in common-law systems have offered a number of criticisms of analogical alternatives. I explain these criticisms and show that at best they apply equally well to rule-based theories. Further, I show how the analogical theories explain a feature of judicial common-law reasoningthat rule-based theories ignore. Finally, I show that reason-based, analogical theories of common-law judicial reasoning, such as those offered by John Horty and Grant Lamond, offer especially strong rejoinders to the rule-theorist (...) objections and persuasive accounts of distinguishing. The article aims to frame the issue of authenticity regarding street artworks. By introducing and analyzing the concept of artification, which refers to the situation when non-art is modified by art, I argue that street art manifests its authenticity through transforming the space around particular artworks. This transformation amounts to two facts: sanctioning certain practices which change our perception of the urban environment, and creating new aesthetic objects which are art-like.

This paper elaborates on an argument in my book *Perception*. It has two parts. In the first part, I argue against what I call "basic" naive realism, on the grounds that it fails to accommodate what I call "internal dependence" and it requires an empirically implausible theory of sensible properties. Then I turn Craig French and Ian Phillips’ modified naïve realism as set out in their recent paper "Austerity and Illusion". It accommodates internal dependence. But it may retain the empirically (...) implausible theory of sensible properties. And it faces other empirical problems. Representationalism about experiences avoids those problems and is to be preferred. (shrink)

This paper focuses on the self-knowledge of emotions. I first argue that several of the leading theories of self-knowledge, including thetransparency method(see, e.g., Byrne 2018) andneo-expressivism(see, e.g., Bar-On 2004), have difficulties explaining how we authoritatively know our own emotions (even though they may plausibly account for sensation, belief, intention, and desire). I next consider Barrett’s (2017a) empirically informedtheory of constructed emotion. While I agree with her that we ‘give meaning to [our] present sensations’ (2017a, p.26), I disagree with her that (...) we construct our emotions, as this has some unwelcome implications. I then draw upon recent data from the science of emotions literature to advance a view I call partial first-person authority. According to this view, first-person authority with respect to our emotions is only partial: we can introspect and authoritatively know our own sensations, and beliefs, in ways others cannot; but we still need to interpret those sensations and beliefs, to know our emotions. Finally, I consider self-interpretational accounts of self-knowledge by Carruthers (2011) and Cassam (2014). I argue that while these accounts are implausible when applied to beliefs, desires, and intentions, they are more plausible when applied to our emotions. (shrink)

This article explores the significance of authenticity for debates about the ethics of enhancement. According to the view defended here, what lies at the heart of authenticity is a disdain for phoniness or fakery – two notions which essentially concern the way we present ourselves to others and, in turn, the way we are viewed by those others. Being authentic thus requires that we not pretend to be something or someone we are not or otherwise represent ourselves falsely to the (...) outside world. As far as authenticity is concerned, then, the primary ethical challenge to the use of enhancements is to those uses that are hidden or unacknowledged – instances in which individuals represent themselves as having achieved or become something without technological assistance when, in fact, the converse is true. One is not undermining one's authentic self when one uses technology to accomplish a particular goal or undergoes some procedure to alter oneself, even quite radically. Rather, one is only being inauthentic to the degree that one passes off oneself and one's achievements as something they are not. (shrink)

This paper proposes a philosophically informed decision-making methodology, inspired by Aristotle, that encourages constructive discussions amongst employers and employees; is directed towards shared higher-level goals; is consistent with planning frameworks already in place in many businesses; can be amended over time without disruptive disputes; and accounts for the particularities of each industry, enterprise, workplace, and job. It seeks to establish a more fundamental basis for discussions about remote vs. in-person office work: specifically, the purpose and nature of the work of (...) those affected. If these matters can be decided, then subsequent discussions might be focused more upon the shared outcomes to which stakeholders are committed and less upon individual preferences and ‘hunches.’. In a recent article in Argumentation, O’Keefe (Argumentation 21:151–163, 2007) observed that the well-known ‘framing effects’ in the social psychological literature on persuasion are akin to traditional fallacies of argumentation and reasoning and could be exploited for persuasive success in a way that conflicts with principles of responsible advocacy. Positively framed messages (“if you take aspirin, your heart will be more healthy”) differ in persuasive effect from negative frames (“if you do not take aspirin, your heart will be less healthy”), (...) despite containing ‘equivalent’ content. This poses a potential problem, because people might be unduly (and unsuspectingly) influenced by mere presentational differences. By drawing on recent cognitive psychological work on framing effects in choice and decision making paradigms, however, we show that establishing whether two arguments are substantively equivalent—and hence, whether there is any normative requirement for them to be equally persuasive—is a difficult task. Even arguments that are logically equivalent may not be information equivalent. The normative implications of this for both speakers and listeners are discussed. (shrink)

"Fans largely regard sports as an escapist pursuit-something that provides distraction from the cares and concerns of "real life". This book pushes back against the fully escapist account of sports fandom and argues that we understand the value of fandom in terms of the ability of sports to prompt fans to reflect meaningfully on the notion of the good life. Even if we are not engaged in high-level athletics ourselves, it is possible to learn a great deal from those who (...) are: about what sacrifices are required to achieve our goals; about how to persevere through failure and disappointment; and about teamwork and the rewards of accomplishing things together. Moreover, partisan fandom, which has been criticized from various quarters, can teach us valuable lessons about love and what it means to be invested in things over which we have no control. If our reflection on the efforts of individual athletes helps us reflect on our own pursuit of the good life, our attachments to teams can help us to cultivate a certain kind of humility and openness to all that life has to offer. The problem of translation confronts every English, or French-language reader of Geschlecht III, from its title page on, by way of Derrida’s decision not to translate the German noun Geschlecht. In this paper, I explore the stakes of Derrida’s refusal to translate, by situating it within the context of the 1984–5 seminar, ‘Philosophical Nationality and Nationalism’, from which the text of Geschlecht III was taken. I show that the question of translation is already at the heart of that seminar, which (...) concerns the place of the idiom in philosophy, and why approaching the difficulty posed by the untranslatability of a term like Geschlecht might be the very objective of Derrida’s reading of Heidegger on Trakl. I discuss two forms of the thesis that to have a sensation is to token a sentence in a language of thought-what I call, following Georges Rey, the sensational sentences thesis. One form of the thesis is a version of standard functionalism, while the other is a version of the increasingly popular thesis that for a sensation to have qualia is for it to have a certain kind of intentional content-that is, intentionalism. I defend the basic idea behind the sensational (...) sentences thesis, and argue that the intentionalist version is either false or collapses into the standard functionalist thesis. (shrink)

We take it that conscious acquaintance has great epistemic value. I develop a new problem for reductive physicalism concerning the epistemic value of acquaintance. The problem concerns "multiple candidate cases". (This develops a theme of my paper *The Significance Argument for the Irreducibility of Consciousness", Philosophical Perspectives 2017.).

Church's Thesis (CT) was first published by Alonzo Church in 1935. CT is a proposition that identifies two notions: an intuitive notion of an effectively computable function defined in natural numbers with the notion of a recursive function. Despite the many efforts of prominent scientists, Church's Thesis has never been disproven. There exists a vast literature concerning the thesis. The aim of this book is to provide a one volume summary of the state of research on Church's Thesis.
