Due to improvements in medicine, the figures of patients with disorders of consciousness (DoC) are increasing. Diagnostics of DoC and prognostication of rehabilitation outcome is challenging but necessary to evaluate recovery potential and to decide on treatment options. Such decisions should be made by doctors and patients’ surrogates based on medico-ethical principles. Meeting information needs and communicating effectively with caregivers as the patients´ most common surrogate-decision makers is crucial, and challenging when novel tech-nologies are introduced. This qualitative study aims to (...) explore information needs of informal DoC caregivers, how they manage the obtained information and their perceptions and experiences with caregiver-physician communication in facilities that implemented innovative neurodiagnostics studies. In 2021, we conducted semi-structured interviews with nine caregivers of clinically stable DoC patients in two rehabilitation centers in Italy and Germany. Participants were selected based on consecutive purposeful sampling. Caregivers were recruited at the facilities after written informed consent. All interviews were recorded, transcribed verbatim and translated. For analysis, we used reflexive thematic analysis according to Braun & Clarke (2006). Caregivers experienced the conversations emotionally, generally based on the value of the information provided. They reported to seek positive information, comfort and empathy with-in the communication of results of examinations. They needed detailed information to gain a deep understanding and a clear picture of their loved-one’s condition. The results suggest a mismatch between the perspectives of caregivers and the perspectives of medical profession-als, and stress the need for more elaborate approaches to the communication of results of neu-rodiagnostics studies. Introducción: Se presenta un análisis cualitativo del acompañamiento psicosocial a jóvenes en condiciones de vulnerabilidad desde la ecología humana durante 12 meses entre 2010 a 2011; utilizando técnicas pedagógicas evaluativas participativas. Éstas, son una alternativa para crear espacios reflexivos con el propósito de potenciar la resiliencia en las relaciones comunicativas y formar en el respeto. Objetivo: Generar bienestar, prevenir la farmacodependencia y contribuir a la promoción de la salud. Material y Métodos: Se revisaron los antecedentes temáticos, fueron seleccionados 100 estudiantes (...) entre 11 y 19 años de dos instituciones educativas públicas en condiciones vulnerables;se desarrollaron cuatro talleres reflexivos y cuatro prácticas lúdicas y se realizaron tres grupos focales con estudiantes, profesores y padres de familia. Resultados y Discusión: El contexto social de la población intervenida, revela problemas de abuso sexual, violencia intrafamiliar y eventos violentos en el vecindario por grupos armados ilegales, entre otros, que constituyen factores de riesgo importantes para la farmacodependencia. Conclusión: Se infiere que lo psicosocial incide en la farmacodependencia, afectando la convivencia de la población estudiada por múltiples causas del orden psicoafectivo, sociocultural, económico y político que van desde el consumo cultural hasta la seguridad alimentaria. Introduction: A qualitative analysis of the psycho-social support to young people in situations of vulnerability from human ecology is presented for 12 months between 2010 to 2011; using participatory evaluative pedagogical techniques. These are an alternative to create reflective spaces with the purpose of enhancing resilience in communicative relationships and working in respect. Objective: to generate well-being, prevent drug abuse and contribute to the health promotion. Material aids and methods: the thematic background was reviewed, 100 students between 11 and 19 years of two public schools in vulnerable conditionswere selected; four reflective workshops and four playful practices were developed and three focus groups with students, teachers and parentswere conducted. Results and discussion: the social context of the manipulated population reveals sexual abuse problems, domestic violence and violent events in the neighborhood by illegal armed groups, among others, which constitutemajor risk factors for drug abuse. Conclusion: It can be inferred that the psychosocial factors impact on drug dependence, affecting the coexistence of the population studied by multiple causes of the psychological, socio-cultural, economic and political order, ranging from cultural consumption to food security. In recent years, the publication of the studies on the transmissibility in mammals of the H5N1 influenza virus and synthetic genomes has triggered heated and concerned debate within the community of scientists on biological dual-use research; these papers have raised the awareness that, in some cases, fundamental research could be directed to harmful experiments, with the purpose of developing a weapon that could be used by a bioterrorist. Here is presented an overview regarding the dual-use concept and its related international (...) agreements which underlines the work of the Australia Group Export Control Regime. It is hoped that the principles and activities of the AG, that focuses on export control of chemical and biological dual-use materials, will spread and become well known to academic researchers in different countries, as they exchange biological materials and scientific papers. To this extent, and with the aim of drawing the attention of the scientific community that works with yeast to the so called Dual-Use Research of Concern, this article reports case studies on biological dual-use research and discusses a synthetic biology applied to the yeast Saccharomyces cerevisiae, namely the construction of the first eukaryotic synthetic chromosome of yeast and the use of yeast cells as a factory to produce opiates. Since this organism is considered harmless and is not included in any list of biological agents, yeast researchers should take simple actions in the future to avoid the sharing of strains and advanced technology with suspicious individuals. In lieu of an abstract, here is a brief excerpt of the content:Human Rights and Women's RightsAngela KnobelMainstream feminists insist, with a degree of unanimity that is sometimes surprising, that access to abortion is an essential precondition of female equality. That feminism, which is in other respects so flexible, inclusive, and uncategorizable, should be so unyielding with respect to this particular issue seems surprising to many. It is especially surprising to those who, while sympathetic to other feminist goals, also oppose (...) abortion.1 Why is access to abortion so important? Why must one's views about the equality of women stand or fall on one's views about the value of unborn human life? If feminism has to have a flagship issue, why must that issue be abortion? In this paper, I will propose that Pierre Manent's Natural Law and Human Rights offers a possible answer to this question. I will argue that, to the extent that mainstream feminism assumes the truth of what Manent calls the "philosophy of human rights," it cannot not advocate abortion access. Similarly, I will argue that pro-life feminist attempts to defend the contrary position—namely, that abortion is antithetical to feminism—invariably assume the natural law that the philosophy of human rights rejects. My argument, if correct, suggests the pivot point in discussions of abortion and feminism occurs much further back than many acknowledge: in our very understanding of ourselves and our place in the world.In what follows I will first briefly summarize Manent's account of what he calls the "philosophy of human rights." With this background in place, [End Page 275] I will consider the mainstream feminist claim that access to abortion is a necessary precondition of female equality. When "equality" is understood through the lens of the philosophy of human rights, I argue, the mainstream feminist insistence on access to abortion becomes coherent: a feminism that assumes the truth of the philosophy of human rights cannot not insist on access to abortion. The pro-life feminist reply that abortion harms and oppresses women, by contrast, is coherent only to the extent one assumes the framework of natural law.2Natural Law or Human Rights?To believe in natural law is to believe that nature itself sets the standard for human life. What the "law" commands is simply action necessary for the realization of the potential implicit in our nature. Under such a framework, Manent notes, "natural inclinations and natural differences, if they exist, constitute a kind of language of nature."3 The fact that human beings are naturally rational or naturally social, or that biological males are (typically) attracted to biological women, helps provide insight into nature's "law": "Natural law issued commands in the name of a teaching implicit in human nature, in a tendency of human nature to society and to knowledge, or in a natural difference among ages, sexes, and capacities, a tendency or difference that reason once made explicit and on the basis of which it founded its commandments and recommendations."4 Nature's laws can be and frequently are violated: cultures or individuals can choose to live up to nature's laws or not. For this reason, Manent says that, under the traditional framework of natural law, human beings are "free under the law."5 Natural law is something we freely choose to follow or freely choose to reject, but because it stems from our human nature, it does not cease to bind even those who reject it.The philosophy of human rights, by contrast, accepts the notion of freedom but rejects the notion of any overarching "law" against which our free choices are to be measured. While the philosophy of natural law is rooted in the language of nature, and thus sees human beings as free "under the law" of nature, the philosophy of human rights puts freedom prior to [End Page 276] law and recognizes law only as a means of preserving freedom.6 While the philosophy of natural law understands individual human beings in terms of their human nature, and thus in terms of their natural inclinations and natural differences, the philosophy of human rights rejects the language of "nature" in favor of an "impoverished common denominator," namely equality... Opponents of abortion have traditionally responded to Judith Thomson’s “A Defense of Abortion” by denying that her example of the unconscious violinist is analogous to a pregnancy that results from rape. In this article, I argue that this strategy does not work. Although there are differences between Thomson’s violinist and pregnancies that result from rape, the differences are not morally relevant. The appropriate strategy for the opponent of abortion, I argue, is to simply bite the bullet: the opponent of abortion (...) should simply reply that Thomson’s innocent victim is not free to unplug himself from the violinist. The most distinctive features of public goods are usually understood to be the difficulty of excluding potential beneficiaries and the fact that one appropriator’s benefits do not diminish the amount of benefits left for others. Yet, because of these properties (non-excludability and non-rivalry), public goods cause market failures and contribute to problems of collective action. This article aims to portray public goods in a different light. Following a recent reassessment of public goods in political philosophy, this contribution argues that public (...) goods are particularly suitable for sustaining a well-ordered society. Public goods contribute to social inclusion, they support the generation of the public, and they strengthen a shared sense of citizenship. This article scrutinizes these functions of public goods and offers a discussion of the interventionist thesis which states that governments should sustain public goods. (shrink)

This article examines moral change, primarily through the lens of Summa Theologiae I-II 49–50. I argue that the specific difference Aquinas asserts between habits and dispositions allows for the possibility that virtuous habits can sometimes exist alongside problematic bodily dispositions. While in the typical case the actions that bring about a habit also bring about appropriate bodily dispositions, it is my contention that the cultivation of a habit need not eliminate all contrary bodily dispositions. This implies that one's past, whether (...) it be one's pre-rational conditioning or past choices, can create bodily obstacles to the cultivation of virtue that later moral reformation may never entirely eliminate. Riassunto : Il fenomeno delle “near-death experiences”, esperienze soggettive intense e profonde, è caratterizzato dalla percezione di essere in una dimensione diversa da quella ordinaria, di aver abbandonato il proprio corpo e, con esso, la dimensione spazio-temporale del mondo fisico. Il termine NDE è utilizzato per indicare esperienze simili occorse in condizioni cliniche molto diverse, ad esempio l’arresto cardiaco, il coma, lo svenimento o l’assunzione di sostanze psicotrope. In questo lavoro si considerano esclusivamente quelle esperienze sperimentate in condizioni di prossimità (...) alla morte. Il fenomeno viene discusso confrontando gli elementi più comunemente presenti nelle NDE di soggetti occidentali con quelli riportati da soggetti di altre culture. Le varie esperienze pre-morte sono discusse in funzione dei contenuti riportati e delle modalità con cui si sono verificate. Infine, lo stato di coma è stato valutato come condizione di “near-death” nell’ottica di considerare la morte come un processo. In discussing water justice, this paper distinguishes four concepts of water justice: Distributive justice claims a fair share of water, ecological justice focuses on the integrity of water as a vulnerable resource, cultural justice addresses values attached to water reservoirs, and procedural justice explicates fair procedures in negotiating water conflicts. After having given an overview over recent contributions to the various meanings of water justice, the paper tries to answer the question of how standards of justice can be integrated into (...) an approach that overcomes the alleged tragedies of the commons. Although scholars agree that Aquinas believed the pagan could possess “true but imperfect” virtues, there is deep disagreement over the question of how these “true but imperfect” virtues should be understood. Some scholars argue that Aquinas believed the pagan’s imperfect virtues are nonetheless ordered to a genuinely good end (his natural good) and are connected by acquired prudence. Other scholars argue that Aquinas believed that any virtues that the pagan possesses are considerably more limited: they are more akin to dispositions (...) than habits, and they are not connected. This paper argues that this latter position is incoherent. If one is willing to concede that the pagan can perform genuinely good actions, then one must concede that the pagan can possess genuine (albeit imperfect) virtues that are connected by acquired prudence. Although it is well known that Aquinas holds that infused versions of prudence and the other acquired virtues are bestowed on man along with habitual grace, there is no uniform and widely accepted account of how the infused and acquired virtues are related: some scholars interpret Aquinas to mean that the acquired virtues are ‘taken up’ into the infused virtues, while others credit him with the view that the infused and acquired virtues somehow coexist. This paper explores one common way (...) of maintaining that the Christian’s infused and acquired virtues ‘coexist’. I argue that while such an interpretation is able to accommodate some of Aquinas’s most fundamental claims about the infused and acquired virtues, it is also problematic in important respects. Si tratta di un processo vitale dagli apparenti salti qualitativi, i quali si volgono all'ascolto di un medesimo nucleo identitario. Questa viva "formazione di sé" ha condotto Edith Stein a una "donazione di sé", culminata nell'Olocausto. Il (...) Diario di Edith si sovrappone ai pensieri di Angela Ales Bello, in veste di narratrice d'eccezione. Con la sentita partecipazione della narratrice, e insieme mantenendo il distacco critico della studiosa, viene scoperta la storia di un'anima. Le emozioni e le conquiste intellettuali trovano una sintesi grazie al peculiare approccio ai "fenomeni" che Edith Stein aveva appreso alla scuola di Edmund Husserl, di Tommaso d'Aquino e di Teresa D'Avila. Así, la moralidad -como posibilidad de realización de distinciones morales, de aprobar o censurar desde el punto devista del espectador- se articula y afina en el flujo incesante decontaminación y contagio de afecciones. Neste texto analisamos blogs da Internet como espaços educativos nos quais se produzem/constroem as identidades juvenis de indivíduos que buscam se inserir no grupo cultural conhecido como nerd/geek. Inseridos nos Estudos Culturais, na sua vertente pós-moderna e pós-estruturalista, valemo-nos da noção de Representação Cultural para analisar como as identidades são constituídas com a escrita/leitura de blogs disponibilizados na web. Destacamos que a forma como se dá o agrupamento dos jovens que escrevem/leem os blogs é efêmera e espontânea, baseada no prazer (...) de estar junto, no consumo de alguns itens e no estabelecimento de alguns laços afetivos momentâneos. Tal compartilhamento tem semelhança com outras “tribos” urbanas deste início de século XXI. Destacamos, também, que não estamos associando a juventude a uma faixa etária particular, mas, isto sim, a um estilo de vida fortemente ligado ao lazer e ao consumo. Os blogs analisados, ao colocarem em circulação representações de identidades nerd/geek, contribuem para a produção discursiva dessas mesmas identidades em função dos modos como os/as integrantes desse grupo partilham formas de apropriar-se de saberes diversos, de utilizar equipamentos tecnológicos, de consumir produtos comerciais e textos midiáticos. Nonetheless, science requires idealization to function—if we are to attempt to understand the world, we have to find ways to reduce its complexity. Idealization and the Aims of Science shows just how crucial idealization is to science and why it matters. Beginning with the acknowledgment of our status as limited human agents trying to make sense of an exceedingly complex world, Angela Potochnik moves on to (...) explain how science aims to depict and make use of causal patterns—a project that makes essential use of idealization. She offers case studies from a number of branches of science to demonstrate the ubiquity of idealization, shows how causal patterns are used to develop scientific explanations, and describes how the necessarily imperfect connection between science and truth leads to researchers’ values influencing their findings. The review focuses basically on Leader’s paper "Toleration without Liberal Foundations". First, the author makes some semantic remarks about the uses of the word “toleration”; second, he offers some criticisms of Leader’s paper; and, finally, he puts forward the outline of a modest proposal.

The purpose of Aarnio and Peczenik is very ambitious: on the one hand, providing an explanatory picture of social interaction; on the other hand, offering a comprehensive conception of the best arrangement we can get of the so called Democratic Rule-of-Law State. In the paper, Comanducci first outlines some of the most important aspects of Aarnio and Peczenik work, mainly stressing the conclusions he agrees with, at the three different levels in which the authors’ discourse places itself— namely, at (...) the meta-ethical, ethical and explanatory levels. Secondly, Comanducci advances some critical remarks regarding each of the three levels, with the aim of bringing to light a few minor deficiencies of Aarnio and Peczenik’s approach and, consequently, with the aim of strengthening their position. This paper considers certain aspects of Aarnio’s theory of legal reasoning. Criticism is limited to the notion of legal certainty and to the related notions of the justification and reasonable acceptability of interpretative standpoints.

The essay briefly review the intellectual bonds between Alchourrón and Bulygin and Italian legal thought. Alchourrón and Bulygin’s seminal work is widely read in Italy; and by now is considered essential groundwork by a growing generation of young legal scholars.

This book interrogates the relation between film spectatorship and film theory in order to criticise some of the disciplinary and authoritarian assumptions of 1970s apparatus theory, without dismissing its core political concerns. Theory, in this perspective, should not be seen as a practice distinct from spectatorship but rather as an integral aspect of the spectator’s gaze. Combining Jacques Rancière’s emancipated spectator with Judith Butler’s queer theory of subjectivity, Spectatorship and Film Theory foregrounds the contingent, embodied and dialogic aspects of our (...) experience of film. Erratic and always a step beyond the grasp of disciplinary discourse, this singular work rejects the notion of the spectator as a fixed position, and instead presents it as a field of tensions—a “wayward” history of encounters. Some mental states seem to be "of" or "about" things, or to "say" something. For example, a thought might represent that grass is green, and a visual experience might represent a blue cup. This is intentionality. The aim of this book is to explain this phenomenon. -/- Once we understand intentionality as a phenomenon to be explained, rather than a posit in a theory explaining something else, we can see that there are glaring empirical and in principle difficulties with currently (...) popular tracking and functional role theories of intentionality, which aim to account for intentionality in terms of tracking relations and functional roles. -/- This book develops an alternative theory, the phenomenal intentionality theory (PIT), on which the source of intentionality is none other than phenomenal consciousness, the subjective, felt, or qualitative aspect of mental life. While PIT avoids the problems that plague tracking and functional role theories, it faces its own challenges in accounting for the rich and complex contents of thoughts and the contents of nonconscious states. In responding to these challenges, this book proposes a novel version of PIT, on which all intentionality is phenomenal intentionality, though we in some sense represent many non-phenomenal contents by ascribing them to ourselves. This book further argues that phenomenal consciousness is an intrinsic feature of mental life, resulting in a view that is radically internalistic in spirit: Our phenomenally represented contents are literally in our heads, and any non-phenomenal contents we in some sense represent are expressly targeted by us. There is increasing attention to the centrality of idealization in science. One common view is that models and other idealized representations are important to science, but that they fall short in one or more ways. On this view, there must be an intermediary step between idealized representation and the traditional aims of science, including truth, explanation, and prediction. Here I develop an alternative interpretation of the relationship between idealized representation and the aims of science. In my view, continuing, widespread idealization (...) calls into question the idea that science aims for truth. I argue that understanding must replace truth as the ultimate epistemic aim of science. Additionally, science has a wide variety aims, epistemic and non-epistemic, and these aims motivate different kinds of scientific products. Finally, I show how these diverse aims---all rather distant from truth---result in the expanded influence of social values on science. (shrink)

It is a live possibility that certain of our experiences reliably misrepresent the world around us. I argue that tracking theories of mental representation have difficulty allowing for this possibility, and that this is a major consideration against them.

Moods and emotions are sometimes thought to be counterexamples to intentionalism, the view that a mental state's phenomenal features are exhausted by its representational features. The problem is that moods and emotions are accompanied by phenomenal experiences that do not seem to be adequately accounted for by any of their plausibly represented contents. This paper develops and defends an intentionalist view of the phenomenal character of moods and emotions on which emotions and some moods represent intentional objects as having sui (...) generis affective properties, which happen to be uninstantiated, and at least some moods represent affective properties not bound to any objects.
