The Swedish medico-legal concept of “science and proven experience” is both legally important and ambiguous. The conceptual uncertainty associated with it can hamper effective assessment of medical evidence in legal proceedings and encourage medical professionals to distrust legal regulation. We examine normative criteria a functioning medico-legal notion should presumably meet, e.g. clarity, acceptability and consistency with existing laws. We also survey healthcare professionals to see how they understand science and proven experience and thus determine the extent to which their understanding (...) meets the normative criteria. The survey suggests that medical professionals feel more certain about “science and proven experience” in the medical context than they do in a legal context. They still have substantial trust in the legal use of the notion, but they do not believe that legal professionals should be allowed to determine the meaning of “science and proven experience” in the legal context. With these results in mind, we argue that the best way to meet the normative criteria and resolve conceptual uncertainty is to specify sub-questions that clarify the notion. We recommend an analytical-deliberative approach that will close the gap between the medical and legal professions’ perceptions of how law and medicine relate. (shrink)

We show that the common claim that internal validity should be understood as prior to external validity has, at least, three epistemologically problematic aspects: experimental artefacts, the implications of causal relations, and how the mechanism is measured. Each aspect demonstrates how important external validity is for the internal validity of the experimental result.

We argue that the formulations and models available in the literature today are modest variations on a common theme and face very similar problems when it comes to risk analysis, which is here understood as a decision procedure comprising a factual assessment of risk, the risk assessment, and the decision what to do based on this (...) assessment, the risk management. Both the early and updated models of evidence-based clinical decisions presented in the writings of Haynes, Devereaux and Guyatt assume that EBM consists of, among other things, evidence from clinical research together with information about patients’ values and clinical expertise. On this A-view, EBM describes all that goes on in a specific justifiable medical decision. There is, however, an alternative interpretation of EBM, the B-view, in which EBM describes just one component of the decision situation and in which, together with other types of evidence, EBM leads to a justifiable clincial decision but does not describe the decision itself. This B-view is inspired by a 100-years older version of EBM, a Swedish standard requiring medical decision-making, professional risk-taking and practice to be in accordance with‘science and proven experience’. In the paper, we outline how the Swedish concept leads to an improved understanding of the way in which scientific evidence and clinical experience can and cannot be integrated in light of EBM. How scientific evidence and clinical experience is integrated influences both the way we do risk assessment and risk management. In addition, the paper sketches the as yet unexplored historical background to VBE and EBM. (shrink)

Recently the importance of addressing values in discussions of risk perception and adaptation to climate change has become manifest. Values-based approaches to climate change adaptation and the cultural cognition thesis both illustrate this trend. We argue that in the wake of this development it is necessary to take the dynamic relationship between values and beliefs seriously, to acknowledge the possibility of bi-directional relationships between values and beliefs, and to address the variety of values involved. The dynamic relationship between values and (...) beliefs, we claim, highlights the need to bring ethical considerations to bear on climate change communication. In particular, we must ask whether it is acceptable to tailor information about the risks of climate change in an effort to maximize communicative effectiveness given the values of the target group. Uncertainty, insufficient information or information of poor quality, limited cognitive capacity and time, along with value conflicts and ethical considerations, are all aspects thatmake risk managementand riskcommunication difficult. This paper provides a review of different risk concepts and describes how these influence risk management, communication and planning in relation to forest ecosystem services. Based on the review and results of empirical studies, we suggest that personal assessment of risk is decisive in the management of forest ecosystem services. The results are (...) used together with a reviewof different principles of the distribution of risk to propose an approach to risk communication that is effective aswell as ethically sound. Knowledge of heuristics and mutual information on both beliefs and desires are important in the proposed risk communication approach. Such knowledge provides an opportunity for relevant information exchange, so that gaps in personal knowledge maps can be filled in and effective risk communication can be promoted. (shrink)

The hypothesis that human reasoning and decision-making can be roughly modeled by Expected Utility Theory has been at the core of decision science. Accumulating evidence has led researchers to modify the hypothesis. One of the latest additions to the field is Dual Process theory, which attempts to explain variance between participants and tasks when it comes to deviations from Expected Utility Theory. It is argued that Dual Process theories at this point cannot replace previous theories, since they, among other things, (...) lack a firm conceptual framework, and have no means of producing independent evidence for their case. Researchers often aim to make correct inferences both about that which is actually studied and about what the results generalize to. The language of internal and external validity is not used by everyone, but many of us would agree that intuitively the distinction makes a lot of sense. Two claims are commonly made with respect to internal and external validity. The first is that internal validity is prior to external validity since there is nothing to generalize if the findings obtained (...) in, for instance, the experimental setting do not hold. The first claim is explicit in many writings. See for instance Francisco Guala’s influential book The methodology of experimental economics. And it is often implicitly relied on. The second claim is that researchers have to make a trade-off between internal and external validity. When one is increased, the other will decrease. The second claim was made already from the start by D.T Campbell in his classic Factors relevant to the validity of experiments in social settings. There is a certain tension between the first and the second claim. It has been argued before that it might be difficult to combine them. We intend to make the stronger point that both claims are misconstrued. Our hypothesis is that the relationship between internal and external validity has to be re-conceptualized, and we will briefly indicate how. (shrink)

The influence of conscience on nurses in terms of guilt has frequently been described but its impact on care has received less attention. The aim of this study was to describe nurses' conceptions of the influence of conscience on the provision of inpatient care. The study employed a phenomenographic approach and analysis method. Fifteen nurses from three hospitals in western Sweden were interviewed. The results showed that these nurses considered conscience to be an important factor in the exercise of their (...) profession, as revealed by the descriptive categories: conscience as a driving force; conscience as a restricting factor; and conscience as a source of sensitivity. They perceived that conscience played a role in nursing actions involving patients and next of kin, and was an asset that guided them in their efforts to provide high quality care. (shrink)

The Retreat of Reason brings back to philosophy the ambition of offering a broad vision of the human condition. One of the main original aims of philosophy was to give people guidance about how to live their lives. Ingmar Persson resumes this practical project, which has been largely neglected in contemporary philosophy, but his conclusions are very different from those of the ancient Greeks. They typically argued that a life led in accordance with reason, a rational life, would also (...) be the happiest or most fulfilling. By exploring the irrationality of our attitudes to time, identity, and responsibility, Persson shows that the aim of living rationally conflicts not only with the aim of leading the most fulfilling life, but also with the moral aim of promoting the maximization and just distribution of fulfilment for all. The Retreat of Reason challenges some of our most fundamental ideas about ourselves. (shrink)

This article considers two arguments that purport to show that inductive reasoning is unjustified: the argument adduced by Sextus Empiricus and the (better known and more formidable) argument given by Hume in the Treatise. While Sextus’ argument can quite easily be rebutted, a close examination of the premises of Hume’s argument shows that they are seemingly cogent. Because the sceptical claim is very unintuitive, the sceptical argument constitutes a paradox. And since attributions of justification are theoretical, and the claim that (...) they are never (or seldom) true isn’t preposterous, the correct response to the paradox may well be to admit that the sceptic has exposed our error in making them. This article examines the potential implications of the implementation of artificial intelligence in health care for both its delivery and the medical profession. To this end, the first section explores the basic features of AI and the yet theoretical concept of autonomous AI followed by an overview of current and developing AI applications. Against this background, the second section discusses the transforming roles of physicians and changes in the patient–physician relationship that could be a consequence of gradual expansion of AI (...) in health care. Subsequently, an examination of the responsibilities physicians should assume in this process is explored. The third section describes conceivable practical and ethical challenges that implementation of a single all-encompassing AI healthcare system would pose. The fourth section presents arguments for regulation of AI in health care to ensure that these applications do not violate basic ethical principles and that human control of AI will be preserved in the future. In the final section, fundamental components of a moral framework from which such regulation may be derived are brought forward, and some possible strategies for building a moral framework are discussed. abstract As history shows, some human beings are capable of acting very immorally. 1 Technological advance and consequent exponential growth in cognitive power means that even rare evil individuals can act with catastrophic effect. The advance of science makes biological, nuclear and other weapons of mass destruction easier and easier to fabricate and, thus, increases the probability that they will come into the hands of small terrorist groups and deranged individuals. Cognitive enhancement by means of drugs, implants and biological (including (...) genetic) interventions could thus accelerate the advance of science, or its application, and so increase the risk of the development or misuse of weapons of mass destruction. We argue that this is a reason which speaks against the desirability of cognitive enhancement, and the consequent speedier growth of knowledge, if it is not accompanied by an extensive moral enhancement of humankind. We review the possibilities for moral enhancement by biomedical and genetic means and conclude that, though it should be possible in principle, it is in practice probably distant. There is thus a reason not to support cognitive enhancement in the foreseeable future. However, we grant that there are also reasons in its favour, but we do not attempt to settle the balance between these reasons for and against. Rather, we conclude that if research into cognitive enhancement continues, as it is likely to, it must be accompanied by research into moral enhancement. (shrink)

A proof of the consistency of Heyting arithmetic formulated in natural deduction is given. The proof is a reduction procedure for derivations of falsity and a vector assignment, such that each reduction reduces the vector. By an interpretation of the expressions of the vectors as ordinals each derivation of falsity is assigned an ordinal less than ε 0, thus proving termination of the procedure.

Over recent decades, public participation in technology assessment has spread internationally as an attempt to overcome or prevent societal conflicts over controversial technologies. One outcome of this new surge in public consultation initiatives has been the increased use of participatory consensus conferences in a number of countries. Existing evaluations of consensus conferences tend to focus on the modes of organization, as well as the outcomes, both procedural and substantial, of the conferences they examine. Such evaluations seem to rest on the (...) assumption that this type of procedure has universally agreed goals and meanings, and that therefore consensus conferences can readily be interpreted and applied across national boundaries. This article challenges this approach to consensus conferences. The core of the article is a study of national differences in ideas about what constitutes legitimate goals for participatory arrangements. The study looks at three consensus conferences on GMOs, which took place in France, Norway, and Denmark. Drawing on this study, the article discusses the ways in which interpretations of the concept of participation; the value attributed to lay knowledge vs. technical expertise; as well as ideas about the role of the layperson, are all questions that prompt entirely different answers from country to country. Further, the article analyses these national differences within a theoretical framework of notions of democratic legitimacy. (shrink)

This book explores the ways in which the spatio-temporal contingency of human life is being conceived in different fields of research. Specifically, it looks at the relationship between the situatedness of human life, the situation or place in which human life is supposed to be situated, and the dimensions of space and time in which both situation and place are usually themselves supposed to be situated. Over the last two or three decades, the spatio-temporal contingency of human life has become (...) an important topic of research in a broad range of different disciplines including the social sciences, the cultural sciences, the cognitive sciences, and philosophy. However, this research topic is referred to in quite different ways: while some researchers refer to it in terms of “situation”, emphasizing the “situatedness” of human experience and action, others refer to it in terms of “place”, emphasizing the “power of place” and advocating a “topological” or “topographical turn” in the context of a larger “spatial turn”. Interdisciplinary exchange is so far hampered by the fact that the notions referred to and the relationships between them are usually not sufficiently questioned. This book addresses these issues by bringing together contributions on the spatio-temporal contingency of human life from different fields of research. (shrink)

Gödel’s ontological proof is by now well known based on the 1970 version, written in Gödel’s own hand, and Scott’s version of the proof. In this article new manuscript sources found in Gödel’s Nachlass are presented. Three versions of Gödel’s ontological proof have been transcribed, and completed from context as true to Gödel’s notes as possible. The discussion in this article is based on these new sources and reveals Gödel’s early intentions of a liberal comprehension principle for the higher order (...) modal logic, an explicit use of second-order Barcan schemas, as well as seemingly defining a rigidity condition for the system. None of these aspects occurs explicitly in the later 1970 version, and therefore they have long been in focus of the debate on Gödel’s ontological proof. (shrink)

This article analyses problem situations in the context of anaesthesia care. It considers what it means for nurse anaesthetists to be in problematic situations in the anaesthesia care of older patients. Benner’s interpretive phenomenological approach proved useful for this purpose. Paradigm cases are used to aid the analysis of individual nurses’ experiences. Thirty narrated problematic anaesthesia care situations derived from seven interviews were studied. These show that experienced nurse anaesthetists perceive anaesthesia care as problematic and highly demanding when involving older (...) patients. To be in problematic anaesthesia care situations means becoming morally distressed, which arises from the experience or from being prevented from acting according to one’s legal and moral duty of care. An important issue that emerged from this study was the need for an ethical forum to discuss and articulate moral issues, so that moral stress of the kind experienced by these nurse anaesthetists can be dealt with and hopefully reduced. This article explores the ethics of world heritage (WH) through a cosmopolitan lens. It proposes that cosmopolitanism provides fertile ground for the study of WH, in particular if combined with sensitivity to distinct indigenous ethical and political claims. Underpinning my article is the question of whether the politics of WH, despite its peaceful and universalist intensions, obscures local disputes and subaltern voices. The empirical emphasis is placed on the WH site of Laponia in the North of Sweden – a location (...) of Sami indigenous communities and commercial mining interests. I provide a narrative analysis of the inconsistencies between the Swedish ‘good state’ narrative defined by support for human and indigenous rights globally and the protection ambition of WH and its generally favourable attitude towards mining, despite its potentially damaging effects on the WH site of Laponia and the cultural heritage and land rights of Sami people living there. My study also provides an analysis of Sami narratives on Laponia – storylines that are rarely included in the Swedish ‘good state’ narrative. The study seeks to contribute to scholarly understandings of indigenous peoples’ ability to lay claims to the cosmopolitan protection logic that prevails in WH. (shrink)

Analyzing the transformation of climate activism in a rapidly changing political landscape, this book traces everyday renewable energy actions within a growing 'epistemic community', dispersed across organizational boundaries and domains. It will be of interest to social science scholars of business, renewable energy and sustainability transitions.

Prior research suggests that interviewers play an important role in representing their organization and in making the interview a pleasant experience for applicants. This study examined whether impression management used by interviewers (organization-enhancement and applicant-enhancement) is perceived by applicants, and how it influences applicants’ attitudes, intentions, and emotions. Adopting a signaling perspective, this article argues that applicants’ positive attitudes and intentions towards the organization increase if interviewers not only enhance the organization, but if the signals they sent (i.e., organization-enhancement) are (...) actually received by the applicant. Similarly, applicants’ positive emotions should increase if interviewers not only enhance the applicant, but if the signals they send (i.e., applicant-enhancement) are actually received by the applicant. A field study which involved video coding interviewers’ impression management behavior during 153 selection interviews and pre- and post-interview applicant surveys showed that the signals sent by interviewers during the interview were received by applicants. In addition, applicants rated the organization’s prestige and their own positive affect after the interview more positively when they perceived higher levels of organization-enhancement during the interview. Furthermore, applicants reported more positive affect and interview self-efficacy after the interview when they perceived higher levels of interviewer applicant-enhancement. We also found an indirect effect of interviewers’ organization-enhancement on organizational prestige through applicants’ perceptions of organization-enhancement as well as indirect effects of interviewers’ applicant-enhancement on applicants’ positive affect and interview self-efficacy through applicants’ perceptions of applicant-enhancement. Our findings contribute to an integrated understanding of the effects of interviewer impression management and point out both risks and chances in selling and smooth-talking towards applicants. Throughout the animal kingdom, p53 genes function to restrain mobile elements and recent observations indicate that transposons become derepressed in human cancers. Together, these emerging lines of evidence suggest that cancers driven by p53 mutations could represent “transpospoathies,” i.e. disease states linked to eruptions of mobile elements. The transposopathy hypothesis predicts that p53 acts through conserved mechanisms to contain transposon movement, and in this way, prevents tumor formation. How transposon eruptions provoke neoplasias is not well understood but, from a broader (...) perspective, this hypothesis also provides an attractive framework to explore unrestrained mobile elements as inciters of late‐onset idiopathic disease.Also see the video abstract here. Increasing concerns for climate change call for radical changes in food systems. There is a need to pay more attention to the entangled changes in technological development, food production, as well as consumption and consumer demand. Consumer and market interest in alternative meat and milk products—such as plant based milk, plant protein products and cultured meat and milk—is increasing. At the same time, statistics do not show a decrease in meat consumption. Yet alternatives have been suggested to have great transitional (...) potential, appealing to different consumer segments, diets, and identities. We review 123 social scientific journal articles on cell-based and plant-based meat and milk alternatives to understand how the positioning of alternatives as both same and different in relation to animal-based products influences their role within the protein transition. We position the existing literature into three themes: promissory narratives and tensions on markets, consumer preferences, attitudes, and behavioral change policies, and the politics and ethics of the alternatives. Based on our analysis of the literature, we suggest that more research is needed to understand the broader ethical impacts of the re-imagination of the food system inherent in meat and milk alternatives. There is also a need to direct more attention to the impacts of meat and milk alternatives to the practices of agricultural practices and food production at the farm-level. A closer examination of these research gaps can contribute to a better understanding of the transformative potential of alternatives on a systemic level. (shrink)

This article examines the concept of creating shared value as articulated by Michael Porter and Mark Kramer, in non-Western and Western contexts. We define non-Western contexts as those in so-called “developing” countries and emerging economies, whereas Western ones pertain to dominant thinking in “developed” regions. We frame our research in postcolonial theory and offer an overview of existing critiques of CSV. We conduct a critical discourse analysis of 66 articles to identify how CSV is being cited by authors, and potential (...) underlying power dynamics that affect its relevance for non-Western contexts. Our review exposes increasingly critical views about the paradoxical positioning of CSV as an instrumental concept that can offer “win-win” solutions, particularly from those working in non-Western settings. Western perspectives generally tend to be more supportive of its instrumental nature, but also recognize the increasing complexity of the business-society nexus and stakeholder engagement. We argue that the CSV framework requires further development to maintain credibility and applicability, especially in non-Western domains. (shrink)

We propose that leaders play a more important role in voters’ party sympathy in proportional representation systems than previous research has suggested. Voters, from the 2018 Swedish General Election, were in an experiment asked to describe leaders and parties with three indicative keywords. Statistical models were conducted on these text data to predict their vote choice. The results show that despite that the voters vote for a party, the descriptions of leaders predicted vote choice to a similar extent as descriptions (...) of parties. However, the order of the questions mattered, so that the first questions were more predictive than the second question. These analyses indicate that voters tend to conflate characteristics of leaders with their parties during election campaigns, and that leaders are a more important aspect of voting under PR than previous literature has suggested. Overall, this suggests that statistical analysis of words sheds new light of underlying sympathies related to voting. (shrink)

" Biosemantics " was the title of a paper on mental representation originally printed in The Journal of Philosophy in 1989. It contained a much abbreviated version of the work on mental representation in Language Thought and Other Biological Categories. There I had presented a naturalist theory of intentional signs generally, including linguistic representations, graphs, charts and diagrams, road sign symbols, animal communications, the "chemical signals" that regulate the function of glands, and so forth. But the term " biosemantics " (...) has usually been applied only to the theory of mental representation. Let me first characterize a more general class of theories called "teleological theories of mental content" of which biosemantics is an example. Then I will discuss the details that distinguish biosemantics from other naturalistic teleological theories. (shrink)

Malpractice issues in psychotherapy and psychological treatments refer to the unethical behavior of a psychologist or psychotherapist toward the patient. The current study reviewed complaints directed at psychologists and psychotherapists in Sweden with regard to possible incidents of malpractice. Eligible cases were retrieved from a database managed by the Health and Social Care Inspectorate [Inspektionen för vård och omsorg (IVO)], an administrative authority responsible for the safety and quality of healthcare and social services delivery. These cases were analyzed using thematic (...) analysis. In total, 33 complaints matched the keywords proposed by IVO, and were scrutinized in detail. The cases primarily involved psychiatric care by a psychologist in outpatient settings, although many cases comprised multiple healthcare providers responsible for the patient’s care, or targeted the healthcare unit as a whole. The results demonstrated that different forms of malpractice occur, and can be classified in two general themes, Incorrect administration and implementation and Attitude and behavior, which involve organizational aspects as well as examples of malpractice and unethical behavior. Implications for clinical practice and future research include further training in ethics and malpractice, video recording or auditing sessions, routine outcome monitoring, and providing patients with information on how to file complaints. If used as a shopping list, the world is supposed to conform to the representation: if the list does not match what is in the grocery bag, it is what is in the bag that is at fault. But if used as an inventory list, the (...) representation is supposed to conform to the world: if the list does not match what is in the bag, it is the list that is at fault. The first kind of representation, where the world is supposed to conform to the list, can be called "directive"; it represents or directs what is to be done. The second, where the list is supposed to conform to the world, can be called "descriptive"; it represents or describes what is the case. I wish to propose that there exist representations that face both these ways at once. With apologies to Dr. Doolittle, I call them pushmi-pullyu representations or PPRs. (shrink)

If we know that certain ways of making decisions are associated with real-life success, is this then how we should decide? In this paper the relationship between normative and descriptive theories of decision-making is examined. First, it is shown that the history of the decision sciences ensures that it is impossible to separate descriptive theories from normative ones. Second, recent psychological research implies new ways of arguing from the descriptive to the normative. This is a reply to Jesse Prinz and Paul Bloom’s skepticism about the moral importance of empathy. It concedes that empathy is spontaneously biased to individuals who are spatio-temporally close, as well as discriminatory in other ways, and incapable of accommodating large numbers of individuals. But it is argued that we could partly correct these shortcomings of empathy by a guidance of reason because empathy for others consists in imagining what they feel, and, importantly, such acts of imagination can be (...) voluntary – and, thus, under the influence of reflection – as well as automatic. Since empathizing with others motivates concern for their welfare, a reflectively justified empathy will lead to a likewise justified altruistic concern. In this study, we investigate the three-dot sign as a discourse marker (DM) with textual, subjective and intersubjective discourse functions. As a graphical marker that is used across languages, the three-dot sign is especially suitable for comparative studies and dynamics in language contact. Our corpus study targeting instant messages of different languages (English, German, Greek, Russian, Turkish) and speaker groups (monolinguals and bilingual heritage speakers) suggests that graphical DMs are prone to cross-linguistic influence. This depends on the specific contact situation (...) and does not seem to be a general effect of bilingualism. The societal status of a language might further influence the use of such markers in digital informal writing. Language-specific developments that relate to emerging functions indicate that functional versatility promotes frequent use of (graphical) DMs. (shrink)

Fred Feldman has argued that consequentialists can answer the well-known by replacing the utilitarian axiology with one that makes the value of receiving pleasures and pains depend on how deserved it is. It is shown that this proposal is open to three interpretations: the Fit-idea, which operates with the degree of fit between what recipients get and what they deserve; the Merit-idea, which operates with the magnitude of the recipients' desert or merit; and the Fit-Merit idea which is a combination (...) of and. It is argued that none of these ideas will do, among other things because they fail to take into account the fact that justice involves inter-personal comparisons. (shrink)

Semmelweis’s work predates the discovery of the power of randomization in medicine by almost a century. Although Semmelweis would not have consciously used a randomized controlled trial (RCT), some features of his material—the allocation of patients to the first and second clinics—did involve what was in fact a randomization, though this was not realised at the time. This article begins by explaining why Semmelweis’s methodology, nevertheless, did not amount to the use of a RCT. It then shows why it is (...) descriptively and normatively interesting to compare what he did with the modern approach using RCTs. The argumentation centres on causal inferences and the contrast between Semmelweis’s causal concept and that deployed by many advocates of RCTs. It is argued that Semmelweis’s approach has implications for matters of explanation and medical practice. (shrink)
