The standard by which we apply decision-making for those unable to do so for themselves is an important practical ethical issue with substantial implications for the treatment and welfare of such individuals. The approach to proxy or surrogate decision-making based upon substituted judgement is often seen as the ideal standard to aim for but suffers from a need to provide a clear account of how to determine the validity of the proxy's judgements. Proponents have responded to this demand by providing (...) the truth-conditions for the substituted judgement in terms of counterfactual reasoning using a possible worlds semantics. In this paper, I show how these underpinnings fail to support the substituted judgement approach as a reasonable standard for decision-making. Firstly, I show how this counterfactual element has been poorly interpreted. I then explain how various accounts have failed to reflect problems and limitations associated with providing an interpretation of their truth-conditions using counterfactuals. Finally, I argue that, even when we attend to the initial problems of providing a counterfactual analysis, it still deeply problematic as a means of determining the validity of substituted judgements for two main reasons. Firstly, making determinate judgements as to the truth-value of these judgements will often not be possible and, secondly, there is a strong requirement when interpreting many counterfactual claims to charitably accede to their being true. I conclude that substituted judgements, as interpreted through counterfactual reasoning and possible worlds semantics, do not therefore provide an adequate standard for surrogate decision-making. There is no doubt that the model presented here is incomplete. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. Contemporary biologists are not agreed on the question of whether there are any human races, despite the widespread scientific consensus on the underlying genetics. For most purposes, however, we can reasonably treat this issue as terminological. What most people in most cultures ordinarily believe about the significance of “racial” difference is quite remote, I think, from what the biologists are agreed on. Every reputable biologist will agree that human genetic variability between the populations of Africa or Europe or Asia is (...) not much greater than that within those populations; though how much greater depends, in part, on the measure of genetic variability the biologist chooses. If biologists want to make interracial difference seem relatively large, they can say that “the proportion of genic variation attributable to racial differences is … 9 – 11%.”1 If they want to make it seem small, they can say that, for two people who are both Caucasoid, the chances of difference in genetic constitution at one site on a given chromosome are currently estimated at about 14.3 percent, while for any two people taken at random from the human population, they are estimated at about 14.8 percent. The statistical facts about the distribution of variant characteristics in human populations and subpopulations are the same, whichever way the matter is expressed. Apart from the visible morphological characteristics of skin, hair, and bone, by which we are inclined to assign people to the broadest racial categories—black, white, yellow—there are few genetic characteristics to be found in the population of England that are not found in similar proportions in Zaire or in China; and few too which are found in Zaire but not in similar proportions in China or in England. All this, I repeat, is part of the consensus . A more familiar part of the consensus is that the differences between peoples in language, moral affections, aesthetic attitudes, or political ideology—those differences which most deeply affect us in our dealings with each other—are not biologically determined to any significant degree.[…]In this essay, I want to discuss the way in which W. E. B. Du Bois—who called his life story the “autobiography of a race concept”—came gradually, though never completely, to assimilate the unbiological nature of races. I have made these few prefatory remarks partly because it is my experience that the biological evidence about race is not sufficiently known and appreciated but also because they are important in discussing Du Bois. Throughout his life, Du Bois was concerned not just with the meaning of race but with the truth about it. We are more inclined at present, however, not to express our understanding of the intellectual development of people and cultures as a movement toward the truth; I shall sketch some of the reasons for this at the end of the essay. I will begin, therefore, by saying what I think the rough truth is about race, because, against the stream, I am disposed to argue that this struggle toward the truth is exactly what we find in the life of Du Bois, who can claim, in my view, to have thought longer, more engagedly, and more publicly about race than any other social theorist of our century. 1. Recent legal rulings concerning the status of advance statements have raised interest in the topic but failed to provide any definitive general guidelines for their enforcement. I examine arguments used to justify the moral authority of such statements. The fundamental ethical issue I am concerned with is how accounts of personal identity underpin our account of moral authority through the connection between personal identity and autonomy. I focus on how recent Animalist accounts of personal identity initially appear to provide a (...) sound basis for extending the moral autonomy of an individual - and hence their autonomous wishes expressed through an advance directive - past the point of severe psychological decline. I argue that neither the traditional psychological account nor the more recent Animalist account of personal identity manage to provide a sufficient basis for extending our moral autonomy past the point of incapacity or incompetence. I briefly explore how analogies to similar areas in law designed to facilitate autonomous decision, such as wills and trusts, provide at best only very limited scope for an alternative justification for granting advance statements any legal or moral authority. I conclude that whilst advance statements play a useful role in formulating what treatment is in a patient’s best interests, such statements do not ultimately have sufficient moral force to take precedence over paternalistic best interest judgements concerning an individual’s care or treatment. In (...) this vastly important, widely-acclaimed volume, Kwame Anthony Appiah, a Ghanaian philosopher who now teaches at Harvard, explores, in his words, "the possibilities and pitfalls of an African identity in the late twentieth century." In the process he sheds new light on what it means to be an African-American, on the many preconceptions that have muddled discussions of race, Africa, and Afrocentrism since the end of the nineteenth century, and, in the end, to move beyond the idea of race. An ethic of the fitting: a conceptual framework for nursing practiceNurses are expected to act within an ethos of care cognisant of duty, the right, and the good. Concepts of virtue theory, utilitarianism and deontology are used to outline a conceptual ethical framework for nurses in practice. This ‘Moebius’ framework aims to locate the virtues in a symbiotic relationship with the principles of utilitarianism and deontology. Under this framework, fitting ethical responses are sought. Within an ethic of the fitting, rules (...) and principles do not guarantee the most ethically justifiable outcomes. Within the Moebius approach, the nurse ought to respond with a sense of compassion that befits the moment rather than adhere to a rule at all costs. (shrink)

Disvaluing nature—a cognitive act—usually leads quickly to devaluing it too: to real-world exploitation and destruction. Worse, in fact, nature in its devalued state can then be held up as an excuse and justification for the initial disvaluation. In this way, dismissal and destruction perpetuate themselves. I call this process “self-validating reduction.” It is crucial to recognize the cycle of self-validating reduction, both in general and specifically as it applies to nature, if we are to have any chance of reversing it.

Contemporary nonanthropocentic environmental ethics is profoundly shaped by the very anthropocentrism that it tries to transcend. New values only slowly struggle free of old contexts. Recognizing this struggle, however, opens a space for—indeed, necessitates—alternative models for contemporary environmental ethics. Rather than trying to unify or fine-tune our theories, we require more pluralistic andexploratory methods. We cannot reach theoretical finality; we can only co-evolve an ethic with transformed practices.

We might begin by trying to unsettle the apparently natural inferences that are supposed to lead us so ineluctably to recognize something called “intrinsic value”.

Ideophony is a neglected aspect of investigations of world poetic traditions. This article looks at the use of ideophony in a variety of Navajo poetic genres. Examples are given from Navajo place-names, narratives, and songs. A final example involves the use of ideophony in contemporary written Navajo poetry. Using the work of Woodbury, Friedrich, and Becker it is argued that ideophones are an example of form-dependent expression, poetic indeterminacy, and the inherent exuberances and deficiencies of translation and thus strongly resists (...) translation. This fact becomes more relevant when understood in light of the current language shift from Navajo to English. (shrink)

Parfit’s (1984) Non-Identity Problem provides a strong line of argument that we cannot be harmed by pre-conception choices or actions. I argue that we can no longer appeal to the Non-Identity problem in order to justify using pre-conception genetic screening and selection techniques as a harmless tool to determine the genetic constitution of future individuals. My criticism of the Non-Identity problem is based on a rejection of the metaphysical foundations of Parfit’s argument - Kripke’s (1980) essentialist arguments for the necessity (...) of origin. I offer an alternative account of modal harms based on counterpart theory such as that offered by David Lewis (1986). On this account, individuals can make legitimate harm claims in regard to pre-conception choices made in determining their genetic constitution by appeal to their counterparts across possible worlds. Increasing computational power and improving deep learning methods have made computer vision technologies pervasively common in urban environments. Their applications in policing, traffic management, and documenting public spaces are increasingly common (Ridgeway 2018, Coifman et al. 1998, Sun et al. 2020). Despite the often-discussed biases in the algorithms' training and unequally borne benefits (Khosla et al. 2012), almost all applications similarly reduce urban experiences to simplistic, reductive, and mechanistic measures. There is a lack of context, depth, and specificity in these (...) practices that enables semantic knowledge or analysis within urban contexts, especially within the context of using and occupying urban space. This paper will critique existing uses of artificial intelligence and computer vision in urban practices to propose a new framework for understanding people, action, and public space. This paper revisits Geertz's (1973) use of thick descriptions in generating interpretive theories of culture and activity and uses this lens to establish a framework to approach evaluating the varied uses of computer vision technologies that weigh meaning. By discussing cases of implemented examples of urban computer vision—from LinkNYC and Numina's urban measurements to the Detroit Police's use of DataWorks Plus's facial recognition technology—it proposes a framework for evaluating the thickness of the algorithm's conclusions against the computational method's complexity required to produce that outcome. Further, we discuss how the framework's positioning may differ (and conflict) between different users of the technology, from engineer to urban planner and policymaker, to citizen. This paper also discusses how the current use and training of deep learning algorithms and how this process limits semantic learning and proposes three potential methodologies toward gaining a more contextually specific, urban-semantic, description of urban space relevant to urbanists. This paper contributes to the critical conversations regarding the proliferation of artificial intelligence by challenging the current applications of these technologies in the urban environment by highlighting their failures within this context while also proposing an evolution of these algorithms that may ultimately make them sensitive and useful within this spatial and cultural milieu. The quantum-mechanical description of the world, including human observers, makes substantial use of entanglement. In order to understand this, we need to adopt concepts of truth, probability and time which are unfamiliar in modern scientific thought. There are two kinds of statements about the world: those made from inside the world, and those from outside. The conflict between contradictory statements which both appear to be true can be resolved by recognising that they are made in different perspectives. Probability, in an (...) objective sense, belongs in the internal perspective, and to statements in the future tense. Such statements obey a many-valued logic, in which the truth values are identified as probabilities. (shrink)

Based on ethnographic and linguistic analyses, this article describes the discourse-related practices and interactional role behaviours of an experienced lawyer who assumed a pivotal role in the negotiation of a Mergers-and-Acquisitions type transaction vis-a-vis a number of other legal and financial professionals. Set in an international business context, all communication took place in English and for the most part via email. Complex discursive processes facilitated close interdisciplinary engagement and, more particularly, required that a single individual assume a key interactional role (...) to oversee and advance the negotiation activities. This pivotal role entailed the strategic use of language and discourse to negotiate, account for, and justify the various stages of the negotiation. In addition to textual analyses of the negotiated contract and attendant emails, interviews were conducted with the principal lawyer and her senior partner in order to examine the textual findings grounded in the organisational context of a law firm and produce an ontology of this negotiation process. These research findings could be used to assist novice lawyers and business professionals to understand some of the discourse strategies and interactional roles that are often so critical for commercial contract negotiation activities. Creativity for Critical Thinkers is a how-to book in creative thinking, specifically orientated towards college courses in critical thinking and with a strong appeal to the general reader as well. It offers a vital but often overlooked set of thinking skills: multiplying options, brainstorming, lateral thinking, reframing problems, and many others. These skills are reinforced by applications and exercises covering a wide range of topics, from the annoyance of everyday life to the largest issues on the world stage.

In early 1927, Pascual Jordan published his version of what came to be known as the Dirac-Jordan statistical transformation theory. Later that year and partly in response to Jordan, John von Neumann published the modern Hilbert space formalism of quantum mechanics. Central to both formalisms are expressions for conditional probabilities of finding some value for one quantity given the value of another. Beyond that Jordan and von Neumann had very different views about the appropriate formulation of problems in the new (...) theory. For Jordan, unable to let go of the analogy to classical mechanics, the solution of such problems required the identification of sets of canonically conjugate variables, i.e., p’s and q’s. Jordan ran into serious difficulties when he tried to extend his approach from quantities with fully continuous spectra to those with wholly or partly discrete spectra. For von Neumann, not constrained by the analogy to classical physics and aware of the daunting mathematical difficulties facing the approach of Jordan ), the solution of a problem in the new quantum mechanics required only the identification of a maximal set of commuting operators with simultaneous eigenstates. He had no need for p’s and q’s. Related to their disagreement about the appropriate general formalism for the new theory, Jordan and von Neumann stated the characteristic new rules for probabilities in quantum mechanics somewhat differently. Jordan was the first to state those rules in full generality, von Neumann rephrased them and then sought to derive them from more basic considerations. In this paper we reconstruct the central arguments of these 1927 papers by Jordan and von Neumann and of a paper on Jordan’s approach by Hilbert, von Neumann, and Nordheim. We highlight those elements in these papers that bring out the gradual loosening of the ties between the new quantum formalism and classical mechanics. (shrink)

My text is written to answer the questions asked at the APA Meeting's presentation of the book Moral Textures: Feminist Narratives in the Public Sphere by professors María Lugones and Eduardo Mendieta. The answer seeks to clarify that Lugones's infrapolitics position is not so distant from mine. I also address Mendieta's question directed more to the aesthetic domain. There, I seek to show how my position could be taken as a creative effort to extend some of Habermas's early work on (...) the public sphere, and to develop the thesis of the important relations between the aesthetic and the moral realms.
