Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. BackgroundSevere brain injury is a leading cause of death and disability. Diagnosis and prognostication are difficult, and errors occur often. Novel neuroimaging methods can improve diagnostic and prognostic accuracy, especially in patients with prolonged disorders of consciousness (PDoC). Yet it is currently unknown how family caregivers understand this information, raising ethical concerns that disclosure of neuroimaging results could result in therapeutic misconception or false hope.MethodsTo examine these ethical concerns, we conducted semi-structured interviews with caregivers of patients with PDoC who were (...) enrolled in a concurrent neuroimaging research program designed to detect covert consciousness following severe brain injury. Caregivers held surrogate decision-making status for a patient. Interviews were conducted at two time points for each caregiver. The first interview occurred before the disclosure of neuroimaging results. The second occurred after disclosure. Descriptive analysis was applied to the data of four interview topics: (1) expectations for neuroimaging; (2) reactions to evidence of preserved cognition; (3) reactions to null results; and (4) understanding of the results and study.ResultsTwelve caregivers participated in the study; two caregivers shared surrogate decision-making status for one patient with PDoC. Twenty-one interviews were completed; one caregiver declined to participate in the post-disclosure interview. Three patients with PDoC associated with the study displayed evidence of covert consciousness. Overall, caregivers understood the neuroimaging research and results. Caregivers who received results of covert consciousness were generally pleased. However, there was some variation in expectations and reactions to these data and null results.ConclusionThis study, for the first time, reveals caregiver expectations for and reactions to neuroimaging evidence of covert consciousness in patients with PDoC. Caregivers understood the neuroimaging research and results, casting doubt on speculative ethical concerns regarding therapeutic misconception and false hope. However, disclosure of neuroimaging result could be improved. Pre-disclosure consultations might assist professionals in shaping caregiver expectations. Standardization of disclosure might also improve comprehension of the results. (shrink)

After severe brain injury, one of the key challenges for medical doctors is to determine the patient’s prognosis. Who will do well? Who will not do well? Physicians need to know this, and families need to do this too, to address choices regarding the continuation of life supporting therapies. However, current prognostication methods are insufficient to provide a reliable prognosis. -/- Functional Magnetic Resonance Imaging (MRI) holds considerable promise for improving the accuracy of prognosis in acute brain injury patients. Nonetheless, (...) research on functional MRI in the intensive care unit context is ethically challenging. These studies raise several ethical issues that have not been addressed so far. Institutional review board delays may hinder the successful completion of federally funded research in the U.S. military. When this happens, time-sensitive, mission-relevant questions go unanswered. Research participants face unnecessary burdens and risks if delays squeeze recruitment timelines, resulting in inadequate sample sizes for definitive analyses. More broadly, military members are exposed to untested or undertested interventions, implemented by well-intentioned leaders who bypass the research process altogether. To illustrate, we offer two case examples. We posit that IRB delays often appear in (...) the service of managing institutional risk, rather than protecting research participants. Regulators may see more risk associated with moving quickly than risk related to delay, choosing to err on the side of bureaucracy. It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exempli fi ed in the seventeenth century by René Descartes and in the twentieth century by Noam Chomsky. As an antidote to human exceptionalism, we turn to the account of aesthetic judgment in Charles Darwin’s Descent of Man , according to which the mental capacities of humans differ from those of lower animals only in degree, and not in kind. Thoroughgoing naturalistic explanation of these capacities is made easier by shifting away from the substance-metaphysical implications of the search for an account of mind , toward a dispositional account of the origins of mindfulness . My title is taken from the frontispiece to Ogilby's translation of Aesop ; since every Renaissance poet believed the statement to be true, let me start with my own example. John Denham's only play, The Sophy, published in August 1642, is a tale about the perils of jealousy. The good prince Mirza, after a miraculous victory over the Turks, returns in glory to his father's court, but leaves it shortly thereafter. In his absense, Haly, the evil courtier, follows a friend's (...) advice to " work on [the king's] fears, till fear hath made him cruel"1 and poisons the king's mind with jealousy against his son. Mirza returns only to be brutally blinded and killed, and the emperor soon dies stricken with remorse. Now it happens that Parliament justified all its actions in the months preceding the civil war on the grounds of the "fears and jealousies" that the king had inspired. Charles was incensed by the slogan and claimed angrily that he, if anyone, had the most cause for fears and jealousies.2 Denham obviously decided that here was the all-consuming topic around which a predominantly royalist drama could be written. He followed what I believe was the standard practice - the method that Fulke Greville said Sidney used and that Congreve repeated at the end of the century when he declared of The Double Dealer that "I design'd the Moral first, and to that Moral I invented the Fable."3 He found a plot in Thomas Herbert's Travels into Diverse Parts of Asia that recorded some terrible cruelties and catastrophes caused by jealousy, and he added the point that the emperor's mind had been wrought upon by his counselor. There is no evidence that the play was ever acted, but the most casual reader would have said to himself, "Yes, history reminds us that states destroy themselves through fears and jealousies, and we should abate our own before it is too late." · 1. In Stig Hjarvard’s characterization, mediatization studies move beyond the positivist origins of the social sciences, as they must in order to avoid the fundamental contradiction between original commitments to classical determinism vis-à-vis human agency as acknowledged within mediatization studies. In order to sustain and enhance Hjarvard’s vision of the coherence between human agency and mediatization studies as a species of social science, I first sharpen these theoretical tensions by developing a robust account of human freedom as informed by Kant and (...) virtue ethics. I then adopt precise understandings of complementarity and epistemological pluralism as initially developed in Quantum Mechanics and subsequently by Karen Barad and Judith Simon as frameworks that can coherently conjoin contemporary social science with strong accounts of human freedom. The resulting coherency—or entanglement—between ethics and science implies new ethical responsibilities for social scientists as ‘virtuous agents’. (shrink)

The volumes in the Clarendon Aristotle Series seek to meet the needs of philosophically inclined readers who do not know Greek by providing accurate translations of selected Aristotelian texts accompanied by philosophical commentaries. To these ends, Trevor Saunders’s welcome addition to the series, a treatment of the first two books of Aristotle’s Politics, provides a number of useful tools. First there is a new translation of books I and II. Saunders numbers the paragraphs of the translation and the corresponding sections (...) of the commentary to facilitate reference to the text and commentary within the discussion of each chapter, though not across chapters. Saunders provides Greek-English and English-Greek glossaries. These will be especially useful to Greek-less readers, because Saunders is often traditional in his translation of key terms and thus, for example, obscures connections that have to be made explicit. So, for example, Saunders follows the very common practice of rendering the cognates polis, politês, and politeia as ‘state’, ‘citizen’, and ‘constitution’, respectively. Each section of the commentary begins with an introduction and proceeds to discuss each paragraph in turn, often including several recommendations for where to go next in the secondary literature. The book also has a guide to the translation and commentary, a brief but helpful introduction, a short appendix on the alleged oligarchic bias in Plato’s Laws, a list of departures from Ross’s Oxford Classical Text, a bibliography of works cited, and a selective index. Sadly, but in company with most of its companions in the Clarendon Aristotle Series, it lacks an index locorum. (shrink)

Maclntyre goes on to claim that managers have substituted external measures of “winning” or “effectiveness” for any internal concept of good. He supports a return to the Aristotelian notion of virtue or “excellence.” Such a system of virtue (...) ethics depends on an interrelationship of the community, one’s roles in that community, and the virtues one needs to perform that role well. This article develops Maclntyre’s concept of virtue ethics and shows how this paradigm fits well with existing theories about organizational behavior. (shrink)

Purpose The purpose of this paper is to introduce a new collaboration between the Association of Internet Researchers and the Journal of Information, Communication and Ethics in Society. Design/methodology/approach The paper uses historical, comparative and ethics-based approaches. Findings The collaboration is catalyzed by central interests shared between AoIR and JICES, namely, in the ethical and social impacts of the internet. The collaboration accordingly aims to bring research and reflection developed for the AoIR conferences to the JICES’ readership. Originality/value The value (...) of this collaboration is considerable, as it promises extensive new cross-fertilization between the two communities. The viewpoint begins with a brief overview of the collaboration’s initiation by Prof Simon Rogerson and its logistics over the next two years. Following a general review of Information and Computing Ethics and Intercultural Information Ethics, an overview of ethical considerations fostered by AoIR is offered, focusing on the development of internet research ethics, especially its most recent expression in an IRE 3.0. Feature structures are employed in various forms in many areas of linguistics. Informally, one can picture a feature structure as a sort of tree decorated with information about constraints requiring that specific subtrees be identical (isomorphic). Here I show that this informal picture of feature structures can be used to characterize exactly the class of feature structures under their usual subsumption ordering. Furthermore, once a precise definition of tree is fixed, this characterization makes use only of standard domain-theoretic notions regarding (...) the information borne by elements in a domain, thus removing (or better, explaining) all apparentlyad hoc choices in the original definition of feature structures. In addition, I show how this characterization can be parameterized in order to yield similar characterizations of various different notions of feature structure, including acyclic structures, structures with appropriateness conditions and structures with apartness conditions (used to model path inequations). The generalizations to other notions of feature structure also emphasize that the construction given here is in fact independent of the application to feature structures. (shrink)

It is well-known that feature structures can be fruitfully viewed as forming a Scott domain. Once a linguistically motivated notion of set value in feature structures is countenanced, however, this is no longer possible inasmuch as unification of set values in general fails to yield a unique result. In Pollard and Moshier 1990 it was shown that, while falling short of forming a Scott domain, the set of feature structures possibly containing set values satisfies the weaker condition of forming a (...) 2/3 SFP domain when equipped with an appropriate notion of subsumption: that is, for any finite setS of feature structures, there is a finite setM of minimal upper bounds ofS such that any upper bound ofS is approximated by a member ofM. Unfortunately, the 2/3 SFP domains are not as pleasant to work with as Scott domains since they are not closed under all the familiar domain constructions; and the question has remained open whether the feature structure domain satisfies the added condition of profiniteness. Self-interest theories hold that rationality requires one always to choose what is best for oneself. Where these theories differ is in their accounts of what is best for one. Hedonism is a typical self-interest theory, distinguished from other versions by the claim that what is best for one is what gives one the greatest net balance of pleasure over pain. Gómez-Lobo thinks that Socrates is a self-interest theorist: Socrates believes that “a choice is rational if and only if it is (...) a choice of what is best for the agent”. Gómez-Lobo also thinks that Socrates holds that “something is good for an agent if and only if it is morally right” ; this distinguishes his theory from hedonism and other self-interest theories. Finally, Gómez-Lobo thinks that Plato defends Socrates’ in arguing at Gorgias 506c5-507a3 that “a being is good if and only if it has the order proper to it”: follows from and other Socratic principles. These three claims constitute the “foundations” of Socratic ethics mentioned in Gómez-Lobo’s title. (shrink)

The sections of the translation also correspond to the sections of Simpson’s still newer A Philosophical Commentary on the Politics of Aristotle (Chapel Hill: University of North Carolina Press, 1998); notes to the translation also sometimes point to the line of argument in the commentary. Simpson also includes a translation of the last book of the Nicomachean Ethics, which many see as an introduction or transition to the Politics, a brief discussion of the translations of certain key terms, a glossary of significant terms, and an analytical outline of the argument of the Politics. The result is a welcome and useful translation and set of tools.Two of Simpson’s decisions in preparing his translation are regrettable. First, Simpson places the discussion of the best polis in books 7 and 8 between the discussion of the nature of the polis and its kinds in book 3 and the discussion of other sorts of polis in books 4–6, thus printing the books in the order 1, 2, 3, 7, 8, 4, 5, 6. There are good reasons for believing that this is how Aristotle intended the Politics to be read. But in deciding the order in which to print the books, these reasons must be weighed against the inconvenience and confusion produced by departing from the normal, manuscript ordering of the books. In my view this is not even a close call. One can easily indicate one’s belief about the correct order of the books, as Simpson does (xvi–xx), and avoid all inconvenience by printing the books in their manuscript order.More to be regretted is Simpson’s decision (made, I imagine, for aesthetic reasons) not to follow the increasingly common and laudable practice of printing Bekker numbers in the margins of translations of Aristotle. These numbers are a great convenience to readers, for they make it easy to locate specific passages in different translations and in the Greek original. Simpson does give the Bekker number of the beginning of each of his sections, and he may think that this is enough to allow readers to locate specific passages easily (he says as much in his Commentary, xiii).
