On the occasion of the Last Generation’s protest actions, the political categories of civil disobedience and civil resistance have been discussed increasingly within criminal law. These discussions are rarely linked to Émile Durkheims theorem of necessary deviation from social rules. Durkheim describes deviation as a phenomenon that is to a certain extent necessary in a functioning society because it enables the natural development of society and the collective change of ideas. Similarly, public sanctioning of norm-breaking is to some extent necessary (...) and serves to reinforce the collective self-definition and understanding. Looking at the actions of the Last Generation, this essay raises the question of whether and to what extent it is possible to identify useful or aesthetic norm violations and whether there are adequate means of social reaction below the threshold of criminal sanctions. It argues that bringing back to mind Durkheim’s premise of necessary breach of norms can help to set a new focus within criminal law discourse: to redirect the discussion away from the individual criminal liability of activists towards the aesthetics of their actions and the effectiveness of communicating their concerns. This paper highlights an important distinction underlying the possibility of inquiry, between first _identifying the subject of inquiry and ultimately _explaining it: that the former can be achieved before and without the latter is a presupposition of inquiry. I believe Aristotle is keenly aware of this in _Posterior Analytics, II.8, where he shows how a scientific demonstration can "manifest" a definition. I argue that such a demonstration consists of two sorts of syllogisms, one identifying the definiendum, the other explaining it. (...) Can world peace come about through a world federation of governments? Is growing agreement and appreciation for, throughout the world, the doctrine of equal human rights inevitable? Such questions are raised by Mortimer Adler in How to Think about War and Peace. Adler argues in this book that both are possible, and in doing so he argues that the insights of liberal contract thinkers, particularly Immanuel Kant, are essentially true. Kant argues that each person has the capacity to discover within (...) himself the foundation for human rights because they are self-evident. It follows that over time inequalities and prejudices will disappear, and people will gain the freedom to advance the cause of peace. About this account of the possibility of world peace I ask the question: is it indeed reasonable? For if it is reasonable, it is not reasonable for the reasons that would have been advanced by Aristotle or Plato or their medieval followers. In older political philosophy it is agreement about the unchanging truth of things that can bring peace. To seek the unchanging truth of things, philosophical speculation about God and things divine, is the highest human activity. It is that end to which life in this world is directed, and upon which human flourishing depends. Freedom depends upon our openness to unchanging eternal truth, even more than self-evident rights; the exercise of speculative reasoning allows for political discourse and an open society. (shrink)

It may have been prepared for a session of Cassirer's (...) seminar at Yale for that spring on Aesthetics: Symbolic Forms, the second half of a yearlong course. 1 The text begins with discussion of the Platonic quarrel with the poets and moves through views of various thinkers, especially Croce and Collingwood. Cassirer had planned to have a volume on art included in The Philosophy of Symbolic Forms, in addition to those on Language,Mythical Thought, and The Phenomenology of Knowledge. 2 In these three volumes he often mentions the triad of language, myth, and art, but he says little of art as such.In May 1942 in a letter to Paul Schilpp, the American philosopher and editor of the volume of critical essays on Cassirer's work in the Library of Living Philosophers series, Cassirer wrote that he had intended to produce a volume on art but the disfavor (Ungunst) of the times caused him to put it off again and again. 3 The principal sources of Cassirer's aesthetics are his chapter on art in An Essay on Man 4 and two lectures on the educational value of art called "Language and Art I & II," 5 which parallel his earlier small study, Language and Myth. 6 Cassirer's conception of art as a symbolic form is derived from his conception of human culture as a systematic structure of symbolic forms that has as its main components myth and religion, language, art, history, and science (the chapter titles of the second part of An Essay on Man). Little has been written directly on Cassirer's conception of art relative to the frequency with which his name is mentioned in general discussions of aesthetics. 8 Cassirer's conception of education is a nearly unexamined subject. 9The Platonic Quarrel: MimesisCassirer says: "Of all the problems that we have to study in a philosophy of education, the problem of the educational value of art is one of the most difficult ones." 10 He claims that this problem goes back to the beginning of philosophy itself and that at present we are still very far from a generally accepted solution. Plato's famous quarrel with the poets in the tenth book of the Republic is important not simply for an understanding of ancient aesthetics but also for philosophy's conception of itself.The basic tenets of this quarrel are well known. This is a new translation of Cassirer's Zur Logik der Kulturwissenschaften: Fünf Studien. It replaces the earlier one by Clarence Smith Howe with the title The Logic (...) of the Humanities (Yale University Press, 1961) that has been out of print for many years. Howe's volume includes a translation of Cassirer's essay "Naturalistic and Humanistic Philosophies of Culture" which does not appear in the new volume.Considered as part of his system of symbolic forms, this volume is the counterpart to Cassirer's conception of mathematical and scientific thought of the third volume of the Philosophy of Symbolic Forms. The pivotal study in Cassirer's five closely related analyses of the cultural sciences is that concerning "Naturbegriffe und Kulturbegriffe." [End Page 451] Cassirer contrasts the way in which concepts function in natural scientific thought with the way in which concepts function in cultural thought. In the natural sciences all of the individual "properties" of a thing can be reduced to numerical determinations. The particular can be subordinated to the universal. Thus gold as a specific metal is gold if and only if it exhibits specific numerically expressed properties, e.g., possesses a specific weight, electrical conductivity, coefficient of expansion, etc.Cultural concepts do not subordinate the particular to the universal in this determinate manner. Rather, they coordinate the particular with the universal. Thus it is possible to arrange the various figures of the Renaissance such as Leonardo da Vinci, Machiavelli, Michelangelo, and Cesare Borgia under Jakob Burckhardt's conception of "Man of the Renaissance," but each only approximates this standard. Although each is not given a determinate place in relation to the others, they all can be comprehended in a meaningful set of interrelationships.There is a problem of how to render Cassirer's key terms, Naturbegriffe and Kulturbegriffe. Howe expresses them literally as "nature-concepts" and "culture-concepts." Lofts states them as "concepts of nature" and "concepts of culture." Lofts's rendering has the difficulty of suggesting that Cassirer's discussion concerns a comparison or criticism of various concepts of nature and culture rather than a theory of concept-formation showing the type of thinking distinctive to the natural sciences in contrast to the cultural sciences.The last study in the volume concerns "The Tragedy of Culture" in which Cassirer criticizes Georg Simmel's conception of culture as alienation of the human spirit from itself. Against Simmel's negative view, Cassirer advances his view of culture as a positive achievement of the development of spirit (Geist) from life (Leben). Cassirer's position in this study forecasts his view as developed later in An Essay on Man (1944) that human culture as it arises through its various symbolic forms of myth and religion, language, art, history, and science is a process of "progressive self-liberation." Culture for Cassirer is not alienation, but self-knowledge.Central to this last study is Cassirer's discussion of how the "I" does not originally exist in a fixed state of separation between "I" and "world" and between "I" and other human beings. The Ich, Cassirer says, develops itself in relation to the Du in the formation of culture. The difference between the two is not simply given. Lofts follows Howe in translating Ich and Du as "I" and "you" (Howe, 188-90; Lofts, 107-8). Cassirer's use of the second person familiar (Du) is intended to emphasize the "I-thou" relationship, the sense in which the other in this development of the self is originally an alter ego, not an impersonal other (Sie). Cassirer's discussion here echoes his discussion of the "thou" in the chapter on the "Phenomenon of Expression" (Ausdrucksphänomen) in the third volume of the Philosophy of Symbolic Forms. Studies of local knowledge and farmer participatory research tend to focus on raising crops and livestock. Little attention is given to processing and marketing farm products, an important source of income for rural households, particularly women.This article presents the case of an investigation into processing and marketing of milk products by agropastoral Fulani women, which revealed how the women under stand local market forces and recognize important social and even local political functions of their marketing activities. However, it also revealed (...) the limits of their knowledge about how the local economy interlinks with national and international economies.Reasons are examined why the study did not lead to local technical and institutional development in dairying. Differentiation is made between two types of research: “extractive” research to provide information for development planners and academics; and participatory or “enriching” research, in which data collection, analysis, and reporting are done with rural people, to use in their own problem-solving. It is argued that “enriching” research should be aimed at increasing rural people's present knowledge, so that they can better understand and cope with external influences on their activities. They could then better defend their own interests against the macroplanning State.Finally, the ethics of documenting the research results are questioned. Documentation of conventional research is primarily for empowerment and enrichment of the extractive economic and academic systems. But there is also a danger that wider dissemination of results of participatory research and local knowledge will not benefit the rural participants but rather strengthen the information base of planners, so that they can better manipulate local economies. Edited by Katerina Ierodiakonou, with a postface by Jonathan Barnes. Oxford: Oxford University Press, 2022. Pp. 256. Hardback, $80.00.From the 1970s until his tragic death in 2007, Michael Frede was one of the most prominent scholars in ancient Greek philosophy, with landmark contributions to the study of Aristotle and of Hellenistic thought in particular. This (...) volume contains his theoretical reflections on the work of historians of philosophy. The main part of the book reproduces with minor corrections the previously unpublished text of the Nellie Wallace Lectures that Frede gave in 1989–90 in Oxford (1–135). Then come three papers that he published on pretty much the same topic between 1987 and 1992 (137–88). Jonathan Barnes's postface, finally, launches an exciting discussion of Frede's proposals by raising a number of questions and critical remarks about them (189–230).Frede's main claim throughout the book is that there is, and should be, a distinctively historical approach to the history of philosophy that has not yet been sufficiently recognized as such in the academic world. This is not to say that he considers more philosophical approaches to be illegitimate. His point is that we have to be clear about the distinction and what it involves in terms of requirements and methods. What Frede calls the "historical history of philosophy" is thus contrasted by him with two varieties of philosophical approaches. One of them he identifies as the "philosophical history of philosophy." It consists in retrospectively studying the past of philosophy as a kind of maturation toward some more recent doctrinal stage, as Aristotle or Hegel saliently did with their respective predecessors. Frede takes this to be "a perfectly intelligible and legitimate, though perhaps not particularly interesting or fruitful, enterprise" (41). Most of the time, he thinks, it would be led by its own philosophical presuppositions to be too selective and to provide a badly distorted picture of past philosophy.Frede is much more sympathetic to the other philosophical approach to the history of philosophy he acknowledges, the one he calls "doxography." This is the study of past philosophers with the aim of finding something of interest in them for ongoing philosophical discussions—a familiar practice, indeed, in the philosophical discipline as we know it. There is an inevitable amount of anachronism in such endeavors, according to Frede, insofar as the commentators will have to reformulate the old views in contemporary terms to a certain extent and to look at them in connection with the questions that are currently debated in the field. But Frede deems this kind of anachronism acceptable as long as sufficient care is taken to correctly identify the views of the past we are interested in and to report them in the best available way. He strongly insists, however, that there are inherent risks of distortion in this approach. This might not be a problem if we are prepared to deal, as philosophers, with views that were not exactly those of the past; but we then run the risk of leaving out something of great philosophical interest, even to us, since "as a rule the philosopher subjected to doxographical treatment was a much better philosopher than the doxographer" (34). If we turn to the past for philosophical inspiration, we should also do it seriously, and this presupposes a historical study of past authors that is pursued for its own sake. [End Page 317]The latter is what Frede is really interested in, and he wants this historical approach to be "as independent as possible from philosophy and not just an ancilla to philosophy" (60). Its practitioners must have a strong philosophical training, of course, in order to understand the views they study and the arguments that were adduced in support of them, but Frede insists that they nevertheless are historians first and foremost: they strive to provide a correct account of "the actual, historical evolution of these views and positions" (14) and of how new doctrines actually grew out of previous ones given the historical context.
