A number of companies allocate ownership rights to stakeholders different from shareholders, despite the fact that the law attributes these rights to the equity holders. This article contributes to an understanding of this evidence by developing a contingency model for the allocation of ownership rights. The model sheds light on why companies, despite pressures from the law, vary in their allocation of ownership rights. The model is based on the assumption that corporations increase their chance to survive and prosper (...) if the stakeholders supplying “critical contributions” receive the ownership rights. According to the model, “critical” contributions involve (1) contractual problems due to specific investments, long-term relationships, and low measurability; (2) the assumption of the uncertainty resting on the company; and (3) the supply of scarce and valuable resources. The model is dynamic because it also provides a basis for understanding why the allocation of ownership rights changes with time. Finally, the article presents the strategies companies can use to realize an efficient distribution of ownership rights among their stakeholders. (shrink)

This book presents a comprehensive study of Oakeshott’s conception of political activity. The author first examines Oakeshott in the contexts of liberal, conservative and Idealist thought, and then presents a detailed interpretation of the change in his conception of politics in the context of British postwar political thought. It is argued that Oakeshott’s conception of political activity shifted from a near contempt of politics towards the applauding of politics as a deliberative and reflective activity. The development is disclosed by examining (...) the change in his key concepts, such as authority and tradition. Accordingly, some rather unexpected aspects of Oakeshott’s thought, such as his close relationship to the linguistic turn, appear. The author argues that although Oakeshott cannot exactly be classified as belonging to that group of political philosophers for whom politics represents a superior human activity, his later work presents an important and original view of politics as an art of contingency. Interest in the relationship between race and the expanded reproduction of capitalism has exploded across the social sciences and humanities over the past several years. Despite this widespread appreciation and interest, profound disagreement, debate, and analytical impression persists, not least regarding the relationship between race and the necessary ‘laws of motion’ of capitalist society. This article begins by tracing the core approaches to the race and capitalism conversation, paying particular attention to their understanding of the necessity/contingency distinction. It then (...) proceeds to make the case for race as a contingent – which, emphatically, does not mean local or insignificant – relatively autonomous, and historically path-dependent terrain of struggle in capitalist society, which has largely functioned to maintain capital’s necessary disequilibrium between the value form and its value relations, but need not do so. Subjective predicates have two interpretive and distributional characteristics that have resisted a comprehensive analysis. First, the use of a subjective predicate to describe an object is in general felicitous only when the speaker has a particular kind of familiarity with relevant features of the object; characterizing an object as _tasty,_ for example, implies that the speaker has experience of its taste. Second, subjective predicates differ from objective predicates in their distribution under certain types of propositional attitude verbs. The goal of (...) this paper is to argue that these features can be explained in a uniform way and within a broadly truth-conditional approach to semantic content, given a view of subjective language as an essentially pragmatic, context-sensitive phenomenon. Specifically, we propose that what renders an issue subjective in discourse is speakers’ awareness of _counterstance contingency_: contingency relative to information states that represent alternative pragmatic stances. In the corporate social responsibility literature, the principle of voluntarism is predominant and implies that responsible business activities are discretionary and reach beyond the rule of law. This principle fails to explain that governments have a great interest in CSR and exercise influence on firms’ CSR activities. Therefore, we argue in favour of a contingency approach on voluntarism in CSR. To this end, we analyse the academic literature to demonstrate how governments are part of the CSR debate. We selected (...) 703 papers where the impact of governments is mentioned from five journals in our field in the period 1982–2011. We studied the titles and abstracts of these papers and provide an overview of: the geographical orientation of the reviewed studies; the variety of government levels involved; and the various subjects where governments appear to be involved. In addition, an in-depth reading of a subsample of 39 articles offers more details on the role of governments in the CSR literature. Hence, we offer a structured overview on the discussion of CSR and governments while stimulating a contingent understanding of the voluntarism concept in CSR. (shrink)

Humans can think about their conscious experiences using a special class of ?phenomenal? concepts. Psychophysical identity statements formulated using phenomenal concepts appear to be contingent. Kripke argued that this intuited contingency could not be explained away, in contrast to ordinary theoretical identities where it can. If the contingency is real, property dualism follows. Physicalists have attempted to answer this challenge by pointing to special features of phenomenal concepts that explain the intuition of contingency. However no physicalist account (...) of their distinguishing features has proven to be satisfactory. Leading accounts rely on there being a phenomenological difference between tokening a physical-functional concept and tokening a phenomenal concept. This paper shows that existing psychological data undermine that claim. The paper goes on to suggest that the recalcitrance of the intuition of contingency may instead by explained by the limited means people typically have for applying their phenomenal concepts. Ways of testing that suggestion empirically are proposed. (shrink)

Timothy Williamson offers a proof of the counterintuitive claim that, if an object exists, then it exists necessarily. David Wiggins argues that this result reveals the philosophical disadvantage of a first level (or ‘ticking over’) view of the very ‘exists’ and the advantage of the second level account offered by Frege and Russell. The author seeks to show how, using an idea of G. Evans but without the use of the resources of ‘free logic’, all occurrences of ‘exist’, including its (...) occurrence in true, negative existential, singular statements, can be accommodated to the Frege–Russell view and accorded the intuitively required modal status. In three experiments, each of a set colour-unrelated distracting words was presented most often in a particular target print colour . In Experiment 1, half of the participants were told the word-colour contingencies in advance and half were not . The instructed group showed a larger learning effect. This instruction effect was fully explained by increases in subjective awareness with instruction. In Experiment 2, contingency instructions were again given, but no contingencies were actually present. Although many participants claimed to (...) be aware of these contingencies, they did not produce an instructed contingency effect. In Experiment 3, half of the participants were given contingency instructions that did not correspond to the correct contingencies. Participants with these false instructions learned the actual contingencies worse than controls. Collectively, our results suggest that conscious contingency knowledge might play a moderating role in the strength of implicit learning. (shrink)

Focusing on the multi-dimensionality of interactional settings, this study analyzes how the material world is a significant factor in the sequential co-production of the video-taped doctor—patient interactions. The analysis shows how a material artifact, the patient's file, is relevant in two ways: a) as a device which is employed in the sequential organization of the interaction. The patient's file is being used in the contexts of topic development and topic change. b) The file with its specific physical and symbolic features (...) is being co-produced and contested by both actors as a knowledge reservoir. Further inspection of the interactions in concert with theoretical reflections of the role of space and materiality suggests that interactions should be interpreted as happening in spatially arranged constellations of material objects and actors. In these both rigid and flexible constellations boundaries are established, access is distributed, and meaning is solidified. (shrink)

The paper introduces a contingential language extended with a propositional constant τ axiomatized in a system named KΔτ , which receives a semantical analysis via relational models. A definition of the necessity operator in terms of Δ and τ allows proving (i) that KΔτ is equivalent to a modal system named K□τ (ii) that both KΔτ and K□τ are tableau-decidable and complete with respect to the defined relational semantics (iii) that the modal τ -free fragment of KΔτ is exactly the (...) deontic system KD. With Contingency, Irony, and Solidarity Richard Rorty tries to persuade us that a case for liberalism is better served by historical narrative than by philosophical theory. The liberal ironist is the complex protagonist of Rorty’s anti-foundationalist story. Why does Rorty think irony serves—rather than undermines—commitments to liberal democracy? I distinguish political from existential dimensions of irony, consider criticisms of Rorty’s ironist, and then draw on recent work by Lear to argue that Rorty’s ironist character nevertheless can be recast as (...) an image useful to the self-understanding of contemporary liberal democrats. The literature on antecedents of corporate social responsibility strategies of firms has been predominately content driven. Informed by the managerial sense-making process perspective, we develop a contingency theoretical framework explaining how political ideology of managers affects the choice of CSR strategy for their firms through their CSR mindset. We also explain to what extent the outcome of this process is shaped by the firm’s internal institutional arrangements and external factors impacting on the firm. We develop and test several hypotheses (...) using data collected from 129 Chinese managers. The results show that managers with a stronger socialist ideology are likely to develop a mindset favouring CSR, which induces the adoption of a proactive CSR strategy. The CSR mindset mediates the link between socialist ideology and CSR strategy. The strength of the relationship between the CSR mindset and the choice of CSR strategy is moderated by customer response to CSR, industry competition, the role of government, and CSR-related managerial incentives. Untersuchungen zu Leibniz' Theorie der Kontingenz neigen dazu, sich vor allem um eine Erfüllung der Bedingung 1 zu bemühen und die anderen unberücksichtigt zu lassen. In § 1 des Aufsatzes wird gezeigt, daß die Versuche, die Kontingenz auf die Möglichkeit der Nicht-Existenz zu gründen, entweder den Bedingungen 2 und 3 nicht genügen oder der Bedingung 4. Can we explain why some propositions are necessary? Blackburn (Fact, science, and value. Blackwell, Oxford, 1987) has presented a dilemma aimed at showing that the necessity of a proposition cannot be explained either in the case where the explanans is another necessary proposition (necessity horn) or in the case where the explanans is a contingent proposition (contingency horn). Blackburn’s dilemma is intended to show that necessary truth is an explanatorily irreducible kind of truth: there is nothing that explains why (...) propositions are necessary, nothing that makes necessary necessary truths. In this paper, I criticize the contingency horn of Blackburn’s dilemma. On the one hand, I show that the official reconstruction of the horn uses a principle that is incompatible with the notion of explanation plausibly needed to explain why propositions are necessary; on the other, I show that a simpler formulation of the horn, which does not make use of such a controversial principle, makes essential use of principles that are incompatible with the idea that possibilities can have explanatory roles. I then defend the view that possibilities can have explanatory roles, and that the explanatory role of possibilities is best represented, within possible worlds, as the existence of trans-world relations of explanation. The Gouldian argument for evolutionary contingency found in Wonderful Life can be dissected into three premises: palaeontological, macro-evolutionary, and developmental. Discussions of evolutionary contingency have revolved primarily around the developmental. However, a shift in methodological practice and new palaeontological evidence subsequent to the book’s publication appears to threaten the palaeontological premise that asserts high Cambrian disparity, or, roughly, that morphological differences between the Cambrian species were high. This presents a prima facie problem: Did the Cambrian consist of enough (...) anatomical variety to fuel a different outcome upon a replay of the tape of life? I investigate the role that disparity plays in the Gouldian argument for evolutionary contingency and conclude that the reduced disparity view does not undermine the argument, per se. As for the macro-evolutionary premise, Gould never offers any explicit justification for the idea that species sorting was indiscriminate or ‘lottery-like’ (though he certainly gestures at it). Putting aside the exegetical, I consider certain empirical avenues for underwriting the macro-evolutionary premise and argue that the most plausible route is to appeal to the special status of mass extinctions, a move that is not entirely unfamiliar to macro-evolutionists. That is, mass extinctions can be good sources of contingency due to their being ‘chancy’ in at least three respects. In sum, I update the palaeontological and macro-evolutionary premises as to reconstrue the Gouldian argument for evolutionary contingency in its strongest form. (shrink)

This article examines Richard Rorty’s much criticized figure of the ironist, and the role that it plays in liberal society. It argues that, against Rorty’s own presentation, irony might have positive social consequences. It does so by examining Rorty’s description of the ironist, arguing that it contains different ideas which emerge at different points in Contingency, Irony, and Solidarity. It takes up William Curtis’ claim that irony is a civic virtue, one closely associated with liberal ideas such as tolerance (...) and pluralism. Curtis is insightful in identifying this aspect of irony, but I argue that it might also play a further role. The ironist is concerned with self-creation, something which Rorty takes to be a private activity, but I argue that the selves ironists create might potentially benefit liberal society, with the ironist’s redescriptions calling into question received wisdom and alerting us to unnoticed forms of cruelty. I present and consider critically O'Regan and Noë's sensorimotor contingency theory, proposed as an alternative to solve the explanatory gap problem. I start with the criticism that these authors address the current conception of representation, according to which conscious experiences are representations of the external world produced by the brain. Afterward, I summarize the way the sensorimotor contingency theory addresses the problem of the explanatory gap, explaining the existence, form, and content of visual consciousness in terms of an (...) "exploratory activity" mediated by sensorimotor contingency laws. Finally, in agreement with criticisms addressed to O'Regan and Noë's solution, I propose a way to face the problem of the explanatory gap, which, recognizing the relevance of the body and the external environment to the existence, form and content of visual consciousness, but privileging the role of the brain as an organ of visual consciousness, and as an agent who uses visual consciousness as a guide to initiate and maintain embodied and situated adaptive actions in the world. Through both an historical and philosophical analysis of the concept of possibility, we show how including both potentiality and actuality as part of the real is both compatible with experience and contributes to solving key problems of fundamental process and emergence. The book is organized into four main sections that incorporate our routes to potentiality: (1) potentiality in modern science [history and philosophy; quantum physics and complexity]; (2) Relational Realism [ontological interpretation of quantum physics; philosophy and logic]; (3) Process Physics (...) [ontological interpretation of relativity theory; physics and philosophy]; (4) on speculative philosophy and physics [limitations and approximations; process philosophy]. We conclude that certain fundamental problems in modern physics require complementary analyses of certain philosophical and metaphysical issues, and that such scholarship reveals intrinsic features and limits of determinism, potentiality and emergence that enable, among others, important progress on the quantum theory of measurement problem and new understandings of emergence. During World War II, Niels Bohr realized that the nature of war had changed irrevocably due to the introduction of the atomic bomb. This, in his opinion, meant that nation states had to be open about nuclear knowledge and negotiate toward peace. The bomb presented a threat, yet at the same time, an opportunity, as Bohr would argue in his characteristic way. It is not too difficult to point to the epistemological origin of Bohr’s argument: One easily identifies resonances with (...) his ideas on “complementarity” from quantum mechanics. According to Bohr’s doctrine of complementarity, a quantum mechanical object shows certain qualities depending on the experimental perspective from which it is studied; and these qualities may be mutually exclusive. The starting point for this article is the question of the relationship between Darwinism and Christian theology. I suggest that evolutionary theory presents three broad issues of relevance to theology: the phenomena ofcontinuity, naturalism, andcontingency. In order to formulate a theological response to these issues I draw on the semiotics (theory of signs) and cosmology of the American philosopher Charles Sanders Peirce. Peirce developed a triadic theory of signs, underpinned by a threefold system of metaphysical categories. I propose a semiotic (...) model of the Trinity based on Peirce's semiotics and categories. According to this model the sign‐processes (such as the genetic “code”) that are fundamental to life may be understood as vestiges of the Trinity in creation. I use the semiotic model to develop a theology of nature that addresses the issues raised by evolutionary theory. The semiotic model amounts to a proposal for a new metaphysical framework within which to understand the relationship between God and creation and between theology and science. (shrink)
