Recent legal developments challenge how valid the concept of mental capacity is in determining whether individuals with impairments can make decisions about their care and treatment. Kong defends a concept of mental capacity but argues that such assessments must consider how relationships and dialogue can enable or disable the decision-making abilities of these individuals. This is thoroughly investigated using an interdisciplinary approach that combines philosophy and legal analysis of the law in England and Wales, the European Court of Human (...) Rights, and the United Nations Convention on the Rights of Persons with Disabilities. By exploring key concepts underlying mental capacity, the investigation concludes that both primary relationships and capacity assessments themselves must display key competencies to ensure that autonomy skills are promoted and encouraged. This ultimately provides scope for justifiable interventions into disabling relationships and articulates the dialogical practices that help better situate, interpret, and understand the choices and actions of individuals with impairments. This article investigates the embodied identities of Hong Kong gay men in two different `sites of desire', namely London and Hong Kong. In London, Hong Kong gay men have constantly encountered the intertwining relationships between race and sexuality in the constellation of the Western construction of body/desire/masculinity. By contrast, Hong Kong gay men in Hong Kong tend to place more emphasis on issues of family and culture. The main site of struggle for Hong Kong (...) gay men in Hong Kong is the family-oriented and community-based environment. They adopt not a confrontational politics in a constitutional sense but rather derive tactics of microscopic resistance against societal and familial domination. By comparing 34 Hong Kong gay men living in London and Hong Kong, I argue the divergent constructions of being gay in these two contexts. Through the `voices' of these gay men, I criticize the `Western' construction of identity/the body and offer new insights into the discussion of gay identities. (shrink)

By integrating conservation of resources and social comparison perspectives, we seek to investigate how employees’ own i-deals, independently from and jointly with their coworker’s i-deals, determine their emotional exhaustion and subsequent deviant behaviors. We conducted a field study focusing on task i-deals, and used Actor–Partner Interdependence Model and polynomial regression to test the hypotheses. We found that emotional exhaustion not only mediated the negative relationship between employees’ own task i-deals and deviant behaviors, but also mediated the positive relationship between upward (...) social comparison of task i-deals and deviant behaviors. These results demonstrated the intra- and interpersonal implications of task i-deals for emotional exhaustion and subsequent deviant behaviors. The current research not only shifts the attention from a predominantly positive view on i-deals to a more balanced and nuanced view on i-deals’ implications, but also sheds light on the interpersonal nature of i-deals and the emotional exhaustion implication of upward social comparison. This paper develops an account of intersectional feminist theory by critically examining the notion of identity implicitly assumed in major critiques of intersectionality. Critics take intersectionality to fragment women along the lines of identity categories such as race, class, and sexuality. Underlying this interpretation, I argue, is the metaphysical assumption that identity is a fixed entity. This is a misunderstanding of identity that neglects how identity is actually lived. By exploring how Asian American women experience their “Asian” identity in their (...) everyday lives (e.g., the “Asian-as-patriarchal vs. White-as-gender-progressive” stereotype, growing anti-Asian racism amid COVID-19, and Asian-Black feminist solidarities), I demonstrate that Asian identity is not fixed but changing according to how it is related to power. I identify and discuss three characteristic types of the identity-power relationship: manifestation of power-as-oppression through the construction of identity, reproduction of power-as- oppression, and creation of new forms of power, namely resistance and solidarity, through the reconstruction of identity. The lives of multiply-oppressed women (e.g., Asian women) can be understood as the locus at which the identity-power relationship is worked out, that is, the power dynamics of oppression are manifested, reproduced, and resisted through the (re)construction of identity. Building on this analysis and engaging discussions on non-ideal theory in social/political philosophy, I argue that intersectional feminist theory can be best explained as a non-ideal theory in a strong sense: a theory that, by focusing on the lives of the multiply oppressed, presents the intersecting dynamics of oppression as central and theory-guiding. The death of Jesse Gelsinger in 1999 during a gene therapy trial raised many questions about the ethical review of medical research. Here, the author argues that the principle of justice is interpreted too narrowly and receives insufficient emphasis and that what we permit in terms of bodily invasion affects the value we place on individuals. Medical research is a societally supported activity. As such, the author contends that justice requires that invasive medical research demonstrates sufficiently compelling societal benefit. Many (...) consider this societal benefit to be self evident. However, medical research is a complex activity; it yields new treatments but also creates financial rewards and affects health resource allocation. As research evolves into a multibillion pound, multinational enterprise, justice requires a much broader analysis of societal benefit. Without such evaluation we risk undermining the value of bodily integrity and of research participants. (shrink)

Property transaction reports are a hybrid genre that combines the characteristics of news reports and advertisements. However, they are different from the traditional hybridity of advertorials, which carry a full-blown label of ‘advertisement’ or ‘promotional material’ and may repeat the name of a product or service many times. Property transaction reports, as an emerging genre in Hong Kong property magazines, combine the voices of property agencies and journalists in a very subtle and sophisticated manner, which is partly made possible (...) by the ambiguous local citing framework. Although the genre is a more successful mix of voices than advertorials, this is not the result of a conscious attempt to mix two genres. Indeed, it is the result of how two ‘communities of practice’ accommodate their practices to accomplish their tasks. This highlights the importance of ‘practice’ in understanding the complex issue of intertextuality. (shrink)

London Medical Group was founded in 1963. It was student-led, spawned Medical Groups in almost every UK medical school and met a need for non-partisan debate and dialogue in medical ethics. It became a victim of its own success as the Institute of Medical Ethics published the Pond Report in 1987, which recommended that medical ethics be incorporated into the undergraduate curriculum. Medical schools began to teach medical ethics and the General Medical Council demanded this in 1993's Tomorrow's Doctors. The (...) Institute of Medical Ethics had grown out of the LMG. After running a number of successful conferences for medical ethics teachers, the Institute of Medical Ethics is recapturing the natural innovative tendencies of students and junior doctors that the LMG and related Medical Groups had fostered. It is now launching itself as a membership organisation: the recommendations of the Francis report and responses to it have emphasised the need to support individuals with the ability, freedom and confidence to question the status quo from a reasoned ethical basis. This paper offers a critique of Christine Korsgaard’s interpretation of Kantian instrumental reason. Korsgaard understands Kantian hypothetical imperatives to share a common normative source with the categorical imperative – namely self-legislating, human rational agency. However, her reading of Kantian hypothetical imperatives is problematic for three reasons. Firstly, Korsgaard’s agent-centred approach renders incoherent Kant’s analytic-synthetic division. Secondly, by minimising the dualistic framework of Kant’s practical philosophy the dialectical character of practical rationality is lost: norms of instrumental reasoning therefore become confused with (...) those of moral reasoning. Thirdly, this in turn curtails the distinct critical authority of pure practical rationality over instrumental choice. The paper argues that we need to understand the normativity of instrumental rationality through the lens of Kant’s dualisms. An alternative interpretation is offered which highlights how the norms of hypothetical imperatives appeal to standards of theoretical cognition and practical efficiency rather than the self-legislative demands of pure practical reason. This paper analyzes the impacts of index inclusions and exclusions on corporate sustainable firms by studying a sample of US stocks that are added to or deleted from the Dow Jones Sustainability World Index over the period 2002-2008. The impacts are measured in terms of stock return, risk and liquidity. We cannot find any strong evidence that announcement per se has any significant impact on stock return and risk. However, on the day of change, index inclusion (exclusion) stocks experience a (...) significant but temporary increase (decrease) in stock return. Liquidity deteriorates after the announcement day and bounces back significantly near the day of change. Systematic risk shows little change after announcements. But, idiosyncratic risk is higher after announcements. The overall results support Harris and Eitan's (The Journal of Finance 41(4), 815-829, 1986) price pressure hypothesis, which posits that event announcement does not carry information and any shift in demand (and hence the corresponding price change and liquidity change) is temporary. Richard Rorty, a neo-pragmatist well known for his anti-universalist philosophy, applies his anti-universalist approach to feminism in the paper titled “Feminism and Pragmatism” (1991). In this paper, Rorty claims that universalism is not helpful for feminists in making changes to a masculinist society. In contrast, the main point of my paper is to defend universalism as appropriate to feminism. It is not, however, argued in the form of advocacy for all versions of universalism. I will classify universalism into two distinguished (...) types, ahistoricist-essentialist universalism and historicist, anti-essentialist universalism, and I will defend the latter as consonant with feminism and with Rorty’s own pragmatist approach. Individual health savings accounts are an important part of the current basic medical insurance system for urban workers in China. Since 1998 when the system of personal medical insurance accounts was first implemented, there has been considerable controversy over its function and significance within different social communities. This paper analyzes the main problems in the practical implementation of individual medical insurance accounts and discusses the social and cultural foundations for the establishment of family health savings accounts from the perspective of (...) Employees’ felt neglect by their employer signals to them that their employer violates ethics of care, and thus, it diminishes employee perceptions of work meaning. Drawing upon work meaning theory, we adopt a relationship-based perspective of felt neglect and its downstream outcome— reduction in organizational citizenship behaviors (OCB) amid the COVID-19 pandemic. We propose and test a core relational mechanism— relatedness need frustration (RNF)—that transmits the effect of felt neglect onto work meaning. A four-wave survey study of 111 working employees (...) in the USA demonstrated that employees’ felt neglect had negative implications for their work meaning and subsequent OCB due to their RNF. Our findings contribute to research on ethics of care and work meaning theory and stress the importance of work meaning amid crises. In addition, our findings suggest steps that employers can take to mitigate employees’ felt neglect (a violation of ethics of care) and its negative ramifications. (shrink)

This study examines whether and how board gender diversity can affect corporate wage inequity by drawing on diversity theory and gender socialization and ethicality theories. Building on an exogenous relaxation of China’s one-child policy (OCP) in 2013, which led to a substantial decline in the female labor force participation rate. Our empirical analysis suggests that board gender diversity is negatively associated with corporate wage inequity. This result is robust to various endogeneity and sensitivity analyses. We find that the OCP relaxation (...) only increases average executive pay; it does not affect employee pay. One potential mechanism driving our results is that the decline in board gender diversity caused by the OCP relaxation reduces supervision, restriction, and fairness within the firm, which increases executives’ pursuit of personal interests and ultimately leads to the rise of wage inequity. Our findings are particularly significant for firms in capital-intensive industries, firms with a low level of employee bargaining power, and large firms. (shrink)

Recently, social and political philosophers have shown increased interest in the ideological nature of ideal theory and the importance of non-ideal theory. Charles Mills, who sparked recent critiques of ideal theory, invokes the notion of “non-idealizing abstractions” and argues that these are helpful when applying non-ideal theory. In contrast, I argue that the notion of non-idealizing abstractions is not a helpful tool for non-ideal theory. I suspect that it pays insufficient attention to the actual power dynamics of oppression, which significantly (...) influence judgments about whose experiences and interests are worth being reflected by an abstraction. Failing to take account of the power differences among the oppressed, what Mills considers non-idealizing abstractions falls into ideology, which cannot reflect the experiences or interests of less-privileged minorities, and only concerns those of more-privileged minorities. I examine cases in which the concept of “patriarchy,” which Mills alleges to be a non-idealizing abstraction, functions as what I refer to as the “Colonialist Concept of Patriarchy” that marginalizes Third World women’s experiences of intersectional oppression. I suggest that a more suitable and less ideological way to apply non-ideal theory should avoid asserting that an abstraction is “non-idealizing” and should, instead, protect “resignifiability” of the abstraction. The existence of cooperative labor relations within leading firms in South Korea, amid unfavorable national-level economic and political institutions, merits study by comparative political economists. Late industrializing Korea lacks the conditions that sustain cooperative labor relations in other nonliberal capitalist countries like Germany and Japan. More relevant, therefore, are debates over the emergence and practice of “high performance work systems” in the unfavorable environments of advanced liberal and developing country capitalism. As a successful late industrializing country that combines both advanced (...) and developing capitalism characteristics, Korea represents a useful testing ground for ideas about HPWS. This article will examine cooperation in four leading Korean firms and use the findings to advance key HPWS debates about the possibilities of participation and the conditions under which cooperation can emerge and be sustained. Psychiatric genomics research protocols are increasingly incorporating tools of deep phenotyping to observe and examine phenotypic abnormalities among individuals with neurodevelopmental disorders. In particular, photography and the use of two-dimensional and three-dimensional facial analysis is thought to shed further light on the phenotypic expression of the genes underlying neurodevelopmental disorders, as well as provide potential diagnostic tools for clinicians. In this paper, I argue that the research use of photography to aid facial phenotyping raises deeply fraught issues from an ethical (...) point of view. First, the process of objectification through photographic imagery and facial analysis could potentially worsen the stigmatisation of persons with neurodevelopmental disorders. Second, the use of photography for facial phenotyping has worrying parallels with the historical misuse of photography to advance positive and negative eugenics around race, ethnicity and intellectual disability. The paper recommends ethical caution in the use of photography and facial phenotyping in psychiatric genomics studies exploring neurodevelopmental disorders, outlining certain necessary safeguards, such as a critical awareness of the history of anthropometric photography use among scientists, as well as the exploration of photographic methodologies that could potentially empower individuals with disabilities. The Research Excellence Framework of the Higher Education Funding Council for England is taking place in 2013, its three key elements being outputs, impact, and “quality of the research environment”. Impact will be assessed using case studies that “may include any social, economic or cultural impact or benefit beyond academia that has taken place during the assessment period.”1 Medical ethics in the UK still does not have its own cognate assessment panel—for example, bioethics or applied ethics—unlike in, for example, Australia. (...) Several researchers in medical ethics have reported to the Institute of Medical Ethics that during the internal preliminary stage of the Research Excellence Framework several medical schools have decided to include only research that entails empirical data gathering. Thus, conceptual papers and ethical analysis will be excluded. The arbitrary exclusion of reasoned discussion of medical ethics issues as a proper subject for medical research unless it is based on empirical data gathering is conceptually mistaken. “Empirical ethics” is, of course, a legitimate component of medical ethics research, but to act as though it is the only legitimate component suggests, at best, a partial understanding of the nature of ethics in general and medical ethics in particular. It also mistakenly places medicine firmly on only one side of the science/humanities “two cultures” divide instead of in its rightful place bridging the divide. Given the emphasis by the General Medical Council on medical ethics in properly preparing “tomorrow’s doctors,” we urge medical schools to find a way of using the upcoming Research Excellence Framework to highlight the expertise residing in their ethicist colleagues. We are confident that appropriate assessment will reveal work of high quality that can be shown to have social and cultural impact and benefit beyond academia, as required by the framework. (shrink)
