A cross-cultural survey experiment revealed a widespread tendency to rely on a rule’s letter over its spirit when deciding which acts violate the rule. This tendency’s strength varied markedly across (k = 15) field sites, owing to cultural variation in the impact of moral appraisals on judgments of rule violation. Compared to laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether, and consequently exhibited more pronounced textualist tendencies. Finally, we evaluated a plausible mechanism for (...) the emergence of textualism: In a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (Ntotal = 5495) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an easily identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers and judges. John Rawls's claim to have demonstrated the superiority of his own two principles of justice to the principle of utility has generated fairly extensive critical discussion. However, this discussion has almost completely disregarded those of Rawls's arguments that are concerned with practicability, despite the significance accorded to them by Rawls himself. This article addresses the three most important of Rawls's objections against the practicability of utilitarianism: that utilitarianism would generate too much disagreement to be politically workable, that a utilitarian society (...) would be vulnerable to social instability, and that publicly adopting the principle of utility as the ultimate criterion of right and wrong would undermine the self-respect of some citizens. It is argued that Rawls's objections are either exaggerated or mistaken, and that this may have an impact on the assessment of `justice as fairness' as well as the utilitarian doctrine. A central tenet of contemporary moral psychology is that people typically reject active forms of utilitarian sacrifice. Yet, evidence for secularization and declining empathic concern in recent decades suggests the possibility of systematic change in this attitude. In the present study, we employ hypothetical dilemmas to investigate whether judgments of utilitarian sacrifice are becoming more permissive over time. In a cross-sectional design, age negatively predicted utilitarian moral judgment (Study 1). To examine whether this pattern reflected processes of maturation, we asked (...) a panel to re-evaluate several moral dilemmas after an eight-year interval but observed no overall change (Study 2). In contrast, a more recent age-matched sample revealed greater endorsement of utilitarian sacrifice in a time-lag design (Study 3). Taken together, these results suggest that today’s younger cohorts increasingly endorse a utilitarian resolution of sacrificial moral dilemmas. (shrink)

Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Some philosophers have claimed that pleasures and pains are characterized by their particular or . Most contemporary writers reject this view: they hold that hedonic states have nothing in common except being liked or disliked (alternatively: pursued or avoided) for their own sake. In this article, I argue that the hedonic tone view has been dismissed too quickly: there is no clear introspective or scientific evidence that pleasures do not share a phenomenal quality. I also argue that analysing hedonic states (...) in terms of liking or wanting is implausible. If it is correct that pleasures and pains are not united by any particular hedonic tone, we should instead simply conclude that there are several different hedonic tones. This pluralistic understanding of the hedonic tone view has generally been overlooked in the literature, but appears to be fairly plausible as a philosophical account of pleasure and pain. (shrink)

Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

Conservatives and liberals disagree sharply on matters of morality and public policy. We propose a novel account of the psychological basis of these differences. Specifically, we find that conservatives tend to emphasize the intrinsic value of actions during moral judgment, in part by mentally simulating themselves performing those actions, while liberals instead emphasize the value of the expected outcomes of the action. We then demonstrate that a structural emphasis on actions is linked to the condemnation of victimless crimes, a distinctive (...) feature of conservative morality. Next, we find that the conservative and liberal structural approaches to moral judgment are associated with their corresponding patterns of reliance on distinct moral foundations. In addition, the structural approach uniquely predicts that conservatives will be more opposed to harm in circumstances like the well-known trolley problem, a result which we replicate. Finally, we show that the structural approaches of conservatives and liberals are partly linked to underlying cognitive styles. Collectively, these findings forge a link between two important yet previously independent lines of research in political psychology: cognitive style and moral foundations theory. (shrink)

Logic is widely held to be a normative discipline. Various claims have been offered in support of this view, but they all revolve around the idea that logic is concerned with how one ought to reason. I argue that most of these claims—while perhaps correct—only entail that logic is normative in a way that many, if not all, intellectual disciplines are normative. I also identify some claims whose correctness would make logic normative in a way that sets it apart from (...) other disciplines. I argue that we have no reason think that these claims are correct. Ever since I first saw a dance performance I have wondered why it is that I am sometimes fascinated and touched by some people moving about on a stage, while at other times it leaves me completely indifferent. I will argue that an answer to this question has to be searched for in the way sensory stimuli are processed in the brain. After all, all our actions, perceptions and feelings are mediated and controlled by the brain. The ethics of corruption cannot be analysed without simultaneously addressing the legitimacy of public office or entrusted power. This paper introduces a concept of core unethical corruption, defined as violations of distributed ethical obligations for private gain. In other words, it is suggested that what is ethically wrong with corruption is that it entails the violation of certain obligations attributed to agents. By explicitly relating corruption to obligations, this approach helps make ethical sense of the concepts of public office or (...) entrusted power, attending to the question of their legitimacy. Since distributed obligations are implied by a wide range of ethical theories, the concept of core unethical corruption also reflects a (partial) overlapping consensus on the ethics of corruption. The importance of fairness in machine learning models is widely acknowledged, and ongoing academic debate revolves around how to determine the appropriate fairness definition, and how to tackle the trade-off between fairness and model performance. In this paper we argue that besides these concerns, there can be ethical implications behind seemingly purely technical choices in fairness interventions in a typical model development pipeline. As an example we show that the technical choice between in-processing and post-processing is not necessarily value-free and (...) may have serious implications in terms of who will be affected by the specific fairness intervention. The paper reveals how assessing the technical choices in terms of their ethical consequences can contribute to the design of fair models and to the related societal discussions. (shrink)

Though corporate social responsibility (CSR) is on the agenda of most major corporations, corporate executives still largely support the view that corporations should maximize the returns to their owners. There are two lines of defence for this position. One is the Friedmanian view that maximizing owner returns is the social responsibility of corporations. The other is a position voiced by many executives, that CSR and profits go together. This article argues that the first position is ethically untenable, while the latter (...) is not supported by empirical evidence. The implication is that there may be good reason for firms to deviate from a maxim of profit maximization. (shrink)

In his paper “The challenge of brain death for the sanctity of life ethic”, Peter Singer advocates two options for dealing with death criteria in a way that is compatible with efficient organ transplantation policy. He suggests that we should either redefine death as cortical death or go back to the old cardiopulmonary criterion and scrap the Dead Donor Rule. We welcome Singer’s line of argument but raise some concerns about the practicability of the two alternatives advocated by him. We (...) propose adding a third alternative that also – as the two previous alternatives – preserves and extends the possibility of organ transplantation without using anyone without their consent. Namely, we would like to draw readers’ attention to a proposal by Robert Veatch, formulated 42 years ago in his 1976 book “Death, dying, and the biological revolution” and developed further in his later publications. Veatch argues for a conscience clause for the definition of death that would permit people to pick from a reasonable range of definitional options. This autonomy-based option, we believe, is more likely to be practicable than the two options advocated by Singer. Furthermore, we present data from a study with Lithuanian participants that suggest that there is quite pronounced variation of preferences concerning death determination. (shrink)

There is a move towards more use of engagement strategies in responsible investment. This change in strategies is motivated by a number of claims about the effectiveness of engagement versus exclusion of companies from the investment universe. This paper examines the basis for three central claims: That engagement, in contrast to exclusion, does not reduce the investment universe; That exclusion reduces an investor's influence on a company; and That engagement with exclusion is necessarily a more effective means of influencing companies (...) than pure exclusion. All three claims are argued to be open to challenge. It is possible that the move towards more engagement reflects bureaucratic incentives and political considerations among institutional investors, rather than arguments about the effectiveness and efficiency of engagement. Despite organizational ethical training programs, some employees still engage in unethical behavior. As such, organizational researchers have sought to examine why employees engage in unethical behavior and whether interventions can improve ethical misconduct. While some instruments measure moral development or ethical/unethical behaviors toward the organization, this study utilized a unique scale which evaluates perceptions of ethical misconduct (PEMS). Data from a large Midwestern university, a large Southeastern university, and Amazon’s Mechanical Turk were used in the analyses. An exploratory and confirmatory (...) factor analyses were used in the creation of the PEMS. To examine the validity of the scale, the PEMS was correlated to scales which measure Dark Triad traits and Counterproductive Work Behaviors (CWBs). Findings showed a significant positive correlation between the PEMS and both scales. The results also show that the PEMS mediates the relationship between psychopathy and CWBs. (shrink)

Drawing from ethnographic research in the Research Triangle of North Carolina and Williamsburg, Virginia, the authors build on Anzaldúa's conceptualization of “borderlands” to analyze how borders of social membership are constructed and enforced in “el Nuevo South.” Our gender analysis reveals that intersecting structural conditions—the labor market, the organization of public space, and the institutional organization of health care and other public services—combine with gendered processes in the home and family to regulate women's participation in community life. Enforcers of borders (...) include institutional actors, mostly women, in social services and clinics who occupy institutional locations that enable them to define who is entitled to public goods and to categorize migrants as undeserving “others.” We reveal how a particularly configured matrix of domination transcends the spheres of home, work, and community to constrain women migrants' physical and economic mobility and personal autonomy and to inhibit their participation in their societies of reception. Philosophical discussions on cognition (ranging from computational and representational approaches to the 4E fra-mework), on the one hand, and those on sound and auditory per-ception, on the other, have hitherto remained apart. In this paper, the author addresses the concept of “auditory cognition”. While committing to the conceptual analysis of the latter, the author in-troduces the discussion of modality-specif ic approaches. Since the contributions made so far in the domain of the philosophy of sound and auditory perception are prone to (...) favor computational-repre-sentational approaches —e.g., the perceptual coherence model (Méndez-Martínez, 2022)—, the exploration of 4E possibilities will lay down a series of questions aimed to encourage future developers from that viewpoint. In that sense, the author explores conceptual entailments and connections between the genealogy of theories within the philosophy of sound and auditory perception, and the hypothesis of the extended cognition (EX). It is shown that according to this semantics, the essential presupposition underlying Łm4 is the following: A is a theorem iff A is true conforming to both the reductionist and possibilist theses defined as follows: rt: the value of modal formulas is equivalent to the value of their respective argument iff A is true, etc.); pt: everything is possible. This presupposition highlights and explains all oddities arising in Łm4.

Ofrece una revisión accesible de sus características y usos, comparando este concepto con otras formas de dependencia que se pueden encontrar en la literatura. El propósito de este artículo es analizar debates sobre la educación sexual en la Argentina entre 1910 y 1945, desde una perspectiva de género y enfocados en niños y niñas en procesos de escolarización. Se presentan tres ejes interrelacionados. El primero se centra en el sistema educativo y analiza principios, prescripciones y ponderaciones que se elaboraron en torno a la educación sexual. Para tal fin se analiza la revista La Higiene Escolar, publicación suplementaria del Monitor de Educación Común, y el (...) libro de texto obligatorio Higiene, publicado en 1927 y en circulación hasta la década de 1950.El segundo eje versa sobre la producción impresa de la Liga Argentina de Profilaxis Social, fundada en Buenos Aires en 1921 por un conjunto de médicos y profesores, con el objetivo de divulgar conocimientos sobre enfermedades venéreas y crear una conciencia sanitaria popular, que incluía la educación sexual de niños, niñas y adolescentes.El tercer eje analiza los vínculos entre los integrantes de la Liga con la Asociación Americana de Higiene Social, la Liga Nacional Francesa Contra el Peligro Venéreo y la Oficina Sanitaria de Berlín, que abonaron un discurso común sobre la educación sexual sustentado en el higienismo, la profilaxis y el eugenismo social. This article focuses on critical realist analysis of concrete processes of structure formation and realization of structural propensity. It aims to explain the reasons for the rise and fall of the neoliberal regime in Iceland that led to the extreme expansion of the Icelandic financial system and its crisis. The article argues that the neoliberal regime was actively constructed by economic and political actors within the framework of the particular structural characteristics of Iceland. It claims that rigid structural conditions due (...) to the very small size of the economy and severe problem of oligopoly undermined the neoliberal utopia of perfect market competition. In order to develop this argument, the paper observes how power elites actively affect public opinion and establish their hegemonic position in the political system. (shrink)

The present paper briefly reviews recent advances in spatial cognition. A central tenet in spatial cognition is that spatial information is simultaneously encoded in multiple formats. It also appears that at the level of neural processing there is no clear distinction between the representation of space and the control of action. I will argue that these findings offer novel insight into the nature of dance and choreography and that the concepts used by cognitive neuroscientists to frame their findings can be (...) fruitfully applied in a choreographic setting. Finally, I will speculate that both dancing oneself and watching dance may enhance one’s experience of space. (shrink)

En su libro The Way We Eat, Peter Singer pretende concienciarnos sobre la ética del comer y los gastos ocultos, para el medioambiente y para los más pobres, de la dieta típica del primer mundo. A partir del análisis crítico de la industria alimentaria, presenta tres propuestas para el lector concienciado: el consumo local, el comercio justo y el vegetarianismo. A pesar de los beneficios ecológicos del consumo local, otras vías para proteger el medioambiente que no impiden el desarrollo económico (...) de los países más pobres son éticamente preferibles. En la III sección arguyo desde un marco utilitarista que podemos hacer el mayor bien a largo plazo si contribuimos ahora al desarrollo del tercer mundo. En el presente artículo nos proponemos describir la racionalidad subyacente a las estrategias de adaptación al cambio ambiental global de los agentes poderosos de la vitivinicultura en Mendoza, Argentina. En términos estrictamente físicos, el Cambio Ambiental Global se presenta como un aumento de las temperaturas promedio a nivel global, las repercusiones de este cambio serán diferentes según sea la zona geográfica del planeta que se considere. En el oasis norte de la Provincia de Mendoza se espera una reducción en los (...) caudales del Río que lo alimenta. Frente a esta situación, los actores poderosos de la vitivinicultura mendocina han optado por estrategias de adaptación tendientes a profundizar la racionalidad instrumental, característica de estos grupos, para hacer frente al cambio ambiental global: obtener aguas en mayor cantidad y calidad a través del traslado de sus explotaciones a zonas de montaña ubicadas aguas arriba del río y búsqueda de mercados internacionales, entre otras. Many prominent bioethicists have recently raised the question of the possibility of moral status enhancement. In this paper I discuss the arguments advanced by Nicholas Agar for the possible existence of the postpersons. I argue that in spite of the many limitations and shortcomings of Agar’s account, there are no conclusive reasons to rule out the possibility of moral status enhancement. However, if post-persons are as they are described by Agar, the fact of their possibility is less interesting and ethically (...) relevant than it might seem. Most importantly, the account of post-persons given by Agar is rather an outcome of some implausible assumptions. I propose that Agar conflates the ethical with the scientific and dismisses the importance of phenomenology in framing our ethical outlook. Also, he seems to follow the assumption made by many utilitarian ethicists that such features as sentience and cognitive capacities have some universal relevance. This accounts for the delusion that we can view our moral attitudes from the point of view of the Universe. (shrink)

In discussing the atomists' theory of vision modern accounts have quite neglected to take into account two sections of Alexander of Aphrodisias on this topic. Nearly identical in length and content, they contain objections to the atomist theory of vision by means of the . In form they consist of a series of questions purporting to contain atomist doctrine. Each question is followed by objections to its subject-matter. Most of the questions contain doctrine known to us already from other sources.

Universal jurisdiction and the existence of an International Criminal Court (ICC) under the Rome Statute provide a framework through which true reconciliation can be achieved simultaneously with truth and justice. The ICC and universal jurisdiction can be viewed as laying out objective limits on the power of domestic and international actors to seek peace at any cost.This paper argues that those objective limits are not necessarily inimical to a just peace, nor are an undue burden on peacemakers. On the contrary, (...) they can set parameters whereby a just and lasting peace can be differentiated from impunity achieved through blackmail.The first step is to take a hard look at whether international standards of accountability for gross abuses have been met. At the same time, the examination of any specific scheme of domestic accountability cannot be done on a blanket basis. It will require a close look at conditions prevailing in the country, both at the time the scheme was adopted and later; at the policies adopted and how they were meant to advance the process of national reconciliation; at who adopted those measures and how; and at concrete applications of the scheme to individual cases.Even applying this exacting standard, there will be cases in which the best course of action for the ICC and for third country courts will be to defer to the greater wisdom of local actors operating in good faith, and to decline to prosecute. Mental causation, though a forceful intuition embedded in our commonsense psychology, is difficult to square with the rest of commitments of physicalism about the mind. Advocates of mental causation have found solace in the causal inheritance principle, according to which the mental properties of mental statesshare the causal powers of their physical counterparts. In this paper, I present a variety of counterarguments to causal inheritance and conclude that the conditions for causal inheritance are stricter than what standing versions of said (...) principle imply. In line with this, physicalism may be destined to epiphenomenalism unless multiple realizability turns out false. (shrink)

Socioscientific issues receive considerable public attention and there are concerns that people in general are not able or willing to deal with information at odds with what they believe to be true. In this study, we focused on students’ beliefs about two controversial issues: whether consumption of the artificial sweetener aspartame and use of cell phones, respectively, represent any serious health risks. Our aim was to investigate whether students’ trust in the information was related to prior beliefs, the nature of (...) the message, and students’ critical reading strategies. Results showed interactions between prior beliefs about the issues and text condition (risk vs. no risk) on trust in conclusions that indicated a confirmation bias assumption. Additionally, students trusted conclusions ascertaining that there were risks more than conclusions ascertaining that there were no risks. Finally, students’ self-reported use of critical reading strategies implied less trust in both types of conclusions. (shrink)

Resumen Este artículo busca reconstruir los principios metodológicos de la “arqueología de la política” que Foucault introduce hacia el final de L’archéologie du savoir aunque nunca desarrolla de manera explícita. La exposición se organiza en tres ejes. En primer lugar, explora los puntos de cruce y las posibles diferencias entre la arqueología del saber y la arqueología de la política. En segundo lugar, examina el lugar que podrían ocupar los “programas” y las “racionalidades de gobierno” en la arqueología de la (...) política. Por último, propone a la razón de Estado, el liberalismo y el neoliberalismo como posibles campos de investigación para el desarrollo de esa arqueología. Con ello se pretende obtener una “grilla de inteligibilidad” cuyo punto de partida no sean las categorías universales habitualmente utilizadas por el análisis jurídico-político procedente de los siglos XVI y XVII, sino las prácticas de los gobernantes y los gobernados.This article proposes to reconstruct the methodological principles of the “archaeology of politics” mentioned by Foucault at the end of L’archéologie du savoir, although never explicitly continued. The text is organized in three complementary axes. First, it explores the crossing points and possible differences between the archaeology of knowledge and the archaeology of politics. Second, it investigates the place that “programs” and “government rationalities” might take in the archeology of politics. Finally, it porposes the reason of State, liberalism and neoliberalism as possible research fields for the development of said archeology. Therefore, this article seeks to obtain a “grid of intelligibility” whose basis are not the universal categories usually used by legal-political analysis from the 16th and 17th centuries, but the practices of the governing and governed.
