Civil society organizations (CSOs) have significantly impacted on the politics of health research and the field of bioethics. In the global HIV epidemic, CSOs have served a pivotal stakeholder role. The dire need for development of new prevention technologies has raised critical challenges for the ethical engagement of community stakeholders in HIV research. This study explored the perspectives of CSO representatives involved in HIV prevention trials (HPTs) on the impact of premature trial closures on stakeholder engagement. Fourteen respondents from South (...) African and international CSOs representing activist and advocacy groups, community mobilisation initiatives, and human and legal rights groups were purposively sampled based on involvement in HPTs. Interviews were conducted from February-May 2010. Descriptive analysis was undertaken across interviews and key themes were developed inductively. CSO representatives largely described positive outcomes of recent microbicide and HIV vaccine trial terminations, particularly in South Africa, which they attributed to improvements in stakeholder engagement. Ongoing challenges to community engagement included the need for principled justifications for selective stakeholder engagement at strategic time-points, as well as the need for legitimate alternatives to CABs as mechanisms for engagement. There is little published literature on the ethical concerns of stakeholders in HIV vaccine trials. This study explored the ethical challenges identified by various stakeholders, through an open-ended, in-depth approach. While the few previous studies have been largely quantitative, respondents in this study had the opportunity to spontaneously identify the issues that they perceived to be of priority concern in the South African context. Stakeholders spontaneously identified the following as ethical priorities: informed consent, social harms, collaborative relationships between research stakeholders, (...) the participation of children and adolescents, access to treatment for participants who become infected with HIV, physical harms, fair participant and community selection, confidentiality, benefits, and payment. While there is some speculation that research in developing countries poses special ethical challenges, overall no issues were identified that have not been anticipated in international guidance, literature and popular frameworks. However, the South African context affords a distinctive gloss to these expected issues; for example, respondents were concerned that the predominant selection of black participants may perpetuate racist practices of apartheid. Stakeholders should be aware of contextual factors impacting on the implementation of ethical principles. We make a series of recommendations for South African trials, including amendments to the ethical-legal framework and research policies, and, for further research. (shrink)

BackgroundAfrica continues to bear a disproportionate share of the global HIV/AIDS, tuberculosis (TB) and malaria burden. The development and distribution of safe, effective and affordable vaccines is critical to reduce these epidemics. However, conducting HIV/AIDS, TB, and/or malaria vaccine trials simultaneously in developing countries, or in populations affected by all three diseases, is likely to result in numerous ethical challenges.MethodsIn order to explore convergent ethical issues in HIV/AIDS, TB and malaria vaccine trials in Africa, the Ethics, Law and Human Rights (...) Collaborating Centre of the WHO/UNAIDS African AIDS Vaccine Programme hosted a consultation on the Convergent Ethical Issues in HIV/AIDS, TB and Malaria Vaccine Trials in Africa in Durban, South Africa on the 10-11 February 2009.ResultsKey cross cutting ethical issues were prioritized during the consultation as community engagement; ancillary care obligations; care and treatment; informed consent; and resource sharing.ConclusionThe consultation revealed that while there have been few attempts to find convergence on ethical issues between HIV/AIDS, TB and malaria vaccine trial fields to date, there is much common ground and scope for convergence work between stakeholders in the three fields. Researchers and sponsors are required to assist HIV prevention trial participants to remain HIV-uninfected by ensuring access to prevention services. Ethics guidelines require that these HIV risk-reduction services be state of the art. This and related ethics recommendations have been intensely debated. This descriptive study aimed to identify actual HIV prevention practices for two HIV vaccine trials at five South African sites, to explore whether actual practices meet guideline recommendations and to discuss implications for practices and ethics guidelines. Practices were (...) examined through a review of site documents and interviews with site staff and network representatives, as well as community advisory board and research ethics committee representatives. A thematic analysis of HIV prevention practices, perspectives and perceived challenges was undertaken. Findings indicated that there was a high degree of correspondence between actual practices in South African HIV vaccine trials and guideline recommendations. Key challenges for implementing prevention services were identified as partnerships, provider-promotion of services and participant uptake of services. Practices deviated most from guidelines with regard to the description of prevention plans in informed consent forms. Recommendations are made for both practices and ethics guidelines. (shrink)

Until recently, any sex or sexual activity with a person under the age of 16 was criminalised, regardless of consent. All such incidents were considered criminal offences and needed to be reported to the police. This paper explores the knowledge, practices and perspectives of seventeen social workers in KwaZulu-Natal in relation to their mandatory reporting responsibilities on consensual underage sex. All social workers were clear about their reporting responsibilities regarding child abuse and non-consensual underage sex. However, findings suggest that social (...) workers were less clear on the exact circumstances in which they ought to report consensual underage sex. Most participants indicated that they would make individual assessments about when to report underage consensual sex and sexual activity. Such decisions would be influenced by structural factors, the personal circumstances of affected children and the availability of other interventions to address early sexual activity. This study has shown that social workers are struggling to comply with mandatory reporting responsibilities involving underage consensual sex. Most social workers approach reporting of consensual sex and sexual activity differently to other reporting responsibilities and use a case-by-case approach. Given these findings, it is argued that parliament should consider reforming mandatory reporting provisions so that there is a distinction between the obligation to report consensual and non-consensual sexual offences against children. The mandatory obligation to report non-consensual sexual offences against children should remain but the obligation to report consensual sex or sexual activity should be discretionary and depend on the facts of each case. Background The South African legal framework requires mandatory parental/legal guardian consent for all research with children. Ethics guidelines provide some reprieve by allowing RECs to grant waivers of parental or guardianship consent in certain defined circumstances. In the first instance, consent may be provided by a proxy when parents or guardians are unavailable, for example with orphaned children. In the second instance, guidelines permit adolescent self-consent when the nature of the study justifies this approach, for example, research on sensitive issues (...) like sexual behaviour or substance use. Discussion South African guidelines set several conditions that must be met for waivers to be granted. These norms overlap with those in international guidelines. However, the ethical norms, especially related to self-consent are sometimes vague. This article critically evaluates the consent norms in the national ethics guidelines and makes recommendations for reform to ethics guidelines in a way that recognises the value of child participation in research, their evolving decision-making capacity and their best interests. Conclusion Recommendations are made to harmonise ethics guidelines and law in a way that promotes child participation in research, to ensure additional protections for adolescents when self-consent is allowed, and to withdraw procedural requirements for the community endorsement of self-consent strategies. South Africa is a major hub of HIV prevention trials, with plans for a licensure trial to start in 2015. The appropriate standards of care and of prevention in HIV vaccine trials are complex and debated issues and ethical guidelines offer some direction. However, there has been limited empirical exploration of South African stakeholders’ perspectives on ethical guidance related to prevention and care in HIV vaccine trials.

Among philosophical questions about human agency, one can distinguish in a rough and ready way between those that arise in philosophy of mind and those that arise in ethics. In philosophy of mind, one central aim has been to account for the place of agents in a world whose operations are supposedly ‘physical’. In ethics, one central aim has been to account for the connexion between ethical species of normativity and the distinctive deliberative and practical capacities of human beings. Ethics (...) then is involved with questions of moral psychology whose answers admit a kind of richness in the life of human beings from which the philosophy of mind may ordinarily prescind. Philosophy of mind, insofar as it treats the phenomenon of agency as one facet of the phenomenon of mentality, has been more concerned with how there can be ‘mental causation’ than with any details of a story of human motivation or of the place of evaluative commitments within such a story. Tolerance for blood transfusion risks is very low, as evidenced by the implementation of expensive blood tests and the rejection of gay men as blood donors. Is this low risk tolerance supported by the precautionary principle, as defenders of such policies claim? We discuss three constraints on applying the precautionary principle and show that respecting these implies tolerating certain risks. Consistency means that the precautionary principle cannot prescribe precautions that it must simultaneously forbid taking, considering the harms they might cause. (...) Avoiding counterproductivity requires rejecting precautions that cause more harm than they prevent. Proportionality forbids taking precautions that are more harmful than adequate alternatives. When applying these constraints, we argue, attention should not be restricted to harms that are human caused or that affect human health or the environment. Tolerating transfusion risks can be justified if available precautions have serious side effects, such as high social or economic costs. (shrink)

Wherever philosophers disagree, one of the things at issue is likely to be what they disagree about, itself. In addition to asking whether moral realism is true, and which forms of moral realism are more likely to be true than others, we can also ask what it would mean for some form of moral realism to be true. The usual aspiration of such inquiry is to find definitions that all can agree on, so that we can use terms in a (...) uniform way. But we doubt that this aspiration is always possible, or even desirable. It will be our goal in this chapter to sketch out some of our reasons for such skepticism, and to lay out a picture of what philosophical inquiry can look like in metaethics and beyond, even when it is impossible to reach uniform agreement on the terms of the debate. ABSTRACT:The primacy of shareholder demands in the traditional theory of the firm has typically excluded marginalised stakeholder voices. However, shareholders involved in social shareholder engagement (SSE) purport to bring these voices into corporate decision-making. In response to ethical concerns about the legitimacy of SSE, we use the lens of discourse ethics to provide a normative analysis at both action and constitutional levels. By specifying three normative questions, we extend the analysis of SSE to identify a political role for shareholders in (...) pursuit of the common good. We demonstrate the desirability for SSE to promote regulatory/institutional change to guarantee marginalised stakeholders a voice in corporate decisions that affect them. The theory of SSE we propose thus calls into question the stark separation of the political and economic spheres and reveals an underlying tension, often overlooked, within the responsible investment literature. The aim of this paper is to present a new logic-based understanding of the connection between classical kinematics and relativistic kinematics. We show that the axioms of special relativity can be interpreted in the language of classical kinematics. This means that there is a logical translation function from the language of special relativity to the language of classical kinematics which translates the axioms of special relativity into consequences of classical kinematics. We will also show that if we distinguish a class (...) of observers in special relativity and exclude the non-slower-than light observers from classical kinematics by an extra axiom, then the two theories become definitionally equivalent. Furthermore, we show that classical kinematics is definitionally equivalent to classical kinematics with only slower-than-light inertial observers, and hence by transitivity of definitional equivalence that special relativity theory extended with “Ether” is definitionally equivalent to classical kinematics. So within an axiomatic framework of mathematical logic, wee xplicitly show that the transition from classical kinematics to relativistic kinematics is the knowledge acquisition that there is no “Ether”, accompanied by a redefinition of the concepts of time and space. This book presents a thorough and critical evaluation of the monetary and financial system prevalent in Western economies. Further, it seeks to explain why this system so often leads to financial crises and why they have been dealt with unsatisfactorily in the past. In order to provide answers to these questions, the book investigates the monetary and financial system from a multidisciplinary perspective, with a strong focus on the ethical value choices which throughout history have shaped the monetary and financial (...) legal system. In the closing chapters, the book also advances a detailed proposal for a New Global Monetary Order, one based on altruism, as an alternative to the neoliberal values dominant today. (shrink)

Social workers must often decide about priority at a case level, in a context of scarce resources. These decisions are disputable and controversial, which raises the question on what grounds are they made in practice. This article addresses that question through an empirical study of real-life case discussions in youth care in Flanders, the Dutch-speaking part of Belgium. Toulmin’s argumentation model is used to analyse the data. The study finds that most case discussions are processed in a rather technical manner. (...) But where there is active deliberation, key incidents show that the decision-makers undertake active and personal interpretation of the situation at hand, and that they also take a personal stance on the criteria for assigning priority. In other words, their practice can be understood as a hermeneutical activity. The article’s main conclusion is that the prioritisation process illustrates the moral-political core that is present in any social work decision-making practice. As this moral-political core seems to be hidden most of the time behind a technical-rational approach, questions remain whether the professionals involved are aware that it characterises their own judgements and whether insights into its nature are stimulated. We investigate empirically whether framing in general, and the use of Simplifying Models as a framing tool in particular, has an effect on the way topics are cognitively construed. Existing studies on framing in linguistics have either been theoretical or descriptive. Going beyond such methodologically simple approaches, we use a more rigid test design involving the use of a control group, the construction of test conditions in which different Simplifying Models constitute the major source of variation, the inclusion of independent (...) variables like age and prior knowledge of the subjects, and the use of linear and logistic regression analysis. Our results show that our more rigid methodological approach yields a more reliable image of the effect of Simplifying Models on the way in which people deal with information on a complex topic like sustainable food production. Fleshing out these effects further may in time lead to a better informed construction of communication on complex social topics. (shrink)

For simplicity, most of the literature introduces the concept of definitional equivalence only for disjoint languages. In a recent paper, Barrett and Halvorson introduce a straightforward generalization to non-disjoint languages and they show that their generalization is not equivalent to intertranslatability in general. In this paper, we show that their generalization is not transitive and hence it is not an equivalence relation. Then we introduce another formalization of definitional equivalence due to Andréka and Németi which is equivalent to the Barrett–Halvorson (...) generalization in the case of disjoint languages. We show that the Andréka–Németi generalization is the smallest equivalence relation containing the Barrett–Halvorson generalization and it is equivalent to intertranslatability, which is another definition for definitional equivalence, even for non-disjoint languages. Finally, we investigate which definitions for definitional equivalences remain equivalent when we generalize them for theories in non-disjoint languages. (shrink)

Here, we contribute to a minority tradition in the Kuhn literature by interpreting the history of evolutionary biology through the prism of the entire historical developmental model of sciences that he elaborates in The Structure. This research not only reveals a certain match between this model and the history of evolutionary biology but, more importantly, also sheds new light (...) on several episodes in that history, and particularly on the publication of Charles Darwin’s On the Origin of Species (1859), the construction of the modern evolutionary synthesis, the chronic discontent with it, and the latest expression of that discontent, called the extended evolutionary synthesis. BACKGROUND: The availability of costly safety measures against transfusion-transmissible infections forces Western countries to confront difficult ethical questions. How to decide about implementing such measures? When are such decisions justified? As a preliminary to addressing these questions, we assessed which concerns shape actual donor blood safety policymaking in five Western countries. STUDY DESIGN AND METHODS: Our qualitative study involved determining which issues had been discussed in advisory committee meetings and capturing these issues in general categories. Appropriate documents were identified in (...) collaboration with local decision-making experts in Canada, Germany, the Netherlands, the United States, and the United Kingdom. The introduction of hepatitis B virus nucleic acid testing and selected measures against variant Creutzfeldt-Jakob disease, West Nile virus, and Q-fever were chosen as cases representing decision-making on safety measures with high costs and low or uncertain added safety. RESULTS: A broad inventory of concerns was established, including: 1) nine categories of advantages and disadvantages of candidate safety policies; 2) six kinds of difficulties in assessing risks and forecasting the effects of safety policies; 3) 13 decision-making principles; and 4) six kinds of practical barriers hampering the translation of candidate policies into decisions. CONCLUSION: Blood safety policymaking involves a wide variety of competing concerns, and approaches to reconcile these considerations are themselves contested. Developing a systematic decision-making approach requires ethical reflection on, among others, reasonable costs of safety and the value of transparency in public policy. (shrink)

How are masculinity and nationalism intertwined? This question has received scant theoretical attention, and existing theories tend to focus on their shared ideals and are embedded in a heteronormative, homophobic, and patriarchal framework. Such views imply a static relationship between the two phenomena and are incompatible with the recent phenomenon of homonationalism and the incorporation of some homosexual bodies within the nation. Addressing this theoretical gap, this article develops a more holistic framework of the relationship between nationalism and masculinity. Drawing (...) on relational sociology, it conceptualises nationalism as competing masculinities. It argues that the link between masculinities and nationalism is not found in their overlapping substantive ideals, but rather that the two phenomena are co-constructed through their overlapping Othering processes. The proposed theoretical framework does not only provide a more dynamic understanding of the link between masculinity and nationalism, but it also helps to overcome the apparent duality between homonationalism and heteronationalism. It is shown that both phenomena are in fact two sides of the same coin, with the main difference between them being the location of homophobia as a technology of Othering within different types of Self/Other relations. Overall, the article provides an analytical tool that allows for the contextualisation and understanding of seemingly contradictory features of nationalism and its relationship to masculinity. What could a social-justice oriented, feminist data studies look like? The current datalogical turn foregrounds the digital datafication of everyday life, increasing algorithmic processing and data as an emergent regime of power/knowledge. Scholars celebrate the politics of big data knowledge production for its omnipotent objectivity or dismiss it outright as data fundamentalism that may lead to methodological genocide. In this feminist and postcolonial intervention into gender-, race- and geography-blind ‘big data’ ideologies, I call for ethical, anti-oppressive digital data-driven research in (...) the social sciences and humanities. I argue that a reflexive data scholarship can emerge from the reintegration of feminist and postcolonial science studies and ethics of care ideals. Although it is not a panacea for all ails of data mining, I offer a road map for an alternative data-analysis practice that is more power-sensitive and accountable. By incorporating a people-centric and context-aware perspective that acknowledges relationships of dependency, reflects on temptations, and scrutinises benefits and harm, an ‘asymmetrically reciprocal’ (Young, 1997) research encounter may be achieved. I bring this perspective to bear on experiences of a two-year research project with eighty-four young Londoners on digital identities and living in a highly diverse city. I align awareness of uneven relations of power and knowledge with the messy relation of dependency between human and non-human actors in data analysis. This framework productively recognises that digital data cannot be expected to speak for itself, that data do not emerge from a vacuum, and that isolated data patterns cannot be the end-goal of a situated and reflexive research endeavor. Data-driven research, in turn, shows the urgency for renewed feminist ethical reflection on how digital mediation impacts upon responsibility, intersectional power relations, human subjectivity and the autonomy of research participants over their own data. The discussion about the impact of agricultural biotechnology on Africa is deeply divided and contains widely diverging claims about the impact of biotechnology on African farmers. Building upon literature on the ‘good farmer’ that highlights that farmers identities are an important factor in explaining the success or failure of agricultural change, we argue that the identity of the farmer is an undervalued yet crucial aspect for understanding the debate about the impact of agricultural biotechnology on African farmers. In this article (...) we therefore investigate what farmers’ identities are implicated in the arguments about the impact of biotechnology on African farmers. We aim to identify the main fault lines in different accounts of the African biotechnology farmer by analysing the identities ascribed to them in two prominent cases of controversy: the debates at the 2002 World Summit on Sustainable Development in Johannesburg and the discussion about the impact of biotechnology on smallholder farmers in the Makhathini flats in KwaZulu Natal, South Africa. Our findings demonstrate that arguments about biotechnology are informed by diverging conceptions of who the African farmer is, what is important for the African farmer, and what role the African farmer has in relation to agricultural biotechnology. These findings remain relevant for current discussions on gene editing technologies like CRISPR-Cas. Openly discussing these different views on the identity of smallholder farmers is crucial for moving forward in the biotechnology controversy and can inform future attempts to elicit the farmer’s voice. This book examines how legal systems and mechanisms give shape to the capitalist economic system. In this regard, it focuses on the most important of these systems, such as monetary and financial law, company law, fiscality, contract and labour law. Further, the book provides a thorough analysis of the underlying ethical values of said legal systems and mechanisms. It also gives an overview of several potentially devastating related effects, such as poverty, the increasing polarisation between rich and poor, climate change, (...) and mounting debts at both the public and private level. The book concludes by presenting proposals for change. Given its critical analysis of legal systems and mechanisms in connection with the value choices dictated by economic ideologies, the book will be of particular interest to legal and economic academics, researchers and students, but also to policymakers, and, more generally, to anyone with a genuine concern for how the socio-economic order will evolve.
