Sie wird im klinischen Alltag häufig als ethische Herausforderung wahrgenommen, zudem sind unter Klinikern juristische Unsicherheiten und Fragen der korrekten Vorgehensweise verbreitet. Die hier vorgestellte Münchner Leitlinie zu Entscheidungen am Lebensende soll rechtliche Unsicherheit reduzieren, Klinikumsmitarbeiter für die ethische Dimension von Therapieentscheidungen am Lebensende sensibilisieren und ethisch begründete Entscheidungen fördern. Aus organisationsethischer Perspektive soll mit der Leitlinie eine Reflexion und Meinungsbildung zu einem ethisch relevanten (...) Themenbereich erfolgen und ein Beitrag zur Qualitätssicherung der Patientenversorgung und damit auch zur Patientenzufriedenheit geleistet werden. Die Prozesse der Leitlinienentwicklung, -aktualisierung und -implementierung werden vorgestellt. Die wesentlichen inhaltlichen Elemente der Leitlinie mit Darstellung der Rechtslage, der Definition zentraler Begriffe und Klärung medizinischer Entscheidungskriterien werden an Hand eines Entscheidungsalgorithmus dargestellt. Inhalt und Prozess der Leitlinienentwicklung werden auf die folgenden organisationsethischen Qualitätskriterien hin überprüft: deliberativer Prozess, inhaltliche Transparenz, repräsentative Zusammensetzung der Arbeitsgruppe, Implementierung und Evaluation der Leitlinie. Methodenstreit in Economics. This essay offers an account of the Methodenstreit in economics between first Menger and Schmoller and later Max Weber and again Schmoller. It is argued that, for Schmoller, two issues were central; to use economics (widely conceived) as an instrument for economic policy and notably social policy: and to base the science empirically with all the modern methods available. In contrast, the Austrian position had a different view of economics as a science, seeing it more as (...) a system of ideas, which implies a radically different use of empirical evidence. (shrink)

Here, for the first time in English, is volume one of Jurgen Habermas's long-awaited magnum opus: The Theory of Communicative Action. This pathbreaking work is guided by three interrelated concerns: to develop a concept of communicative rationality that is no longer tied to the subjective and individualistic premises of modern social and political theory; to construct a two-level concept of society that integrates the 'lifeworld' and 'system' paradigms; and to sketch out a critical theory of modernity that explains its sociopathologies (...) in a new way. O artigo aborda a discussão entre John Rawls e Jürgen Habermas no que diz respeito ao processo democrático e à neutralidade. Indica que a formação do processo democrático acontece de maneira distinta em uma perspectiva liberal e republicana e que ambos os autores assimilam essa questão de forma diferente. No que se refere à neutralidade, embora tanto Rawls quanto Habermas defendam uma prioridade do justo sobre o bem, o intuito é mostrar que as implicações derivadas de suas perspectivas também são (...) distintas. language-theoretic attempt to ground a post-liberal theory of democracy on Kant's intuitions concerning subjective autonomy is flawed because it leaves unexamined the internally contradictory experiential content of the Cartesian subject's experience of self. This case is made through reference to aspects of Habermas’ reconstructions of Kant and Mead; iek's criticisms of Kant, Heidegger and Habermas; and Honneth's idea that autonomy, for the post-Cartesian self, involves the ability of the subject to come to terms with the experience of negativity. Jürgen Habermas has been the most prolific and influential representative of the second generation of the Frankfurt School. He has not only continued the theoretical tradition of his teachers Adorno and Horkheimer and his friend Marcuse, but also significantly departed from classical critical theory and made many important contributions to contemporary philosophy and social theory. In particular, he has opened critical theory to a dialogue with other philosophies and social theories such as the hermeneutics of Gadamer, systems theory and structural (...) functionalism, empirical social sciences, analytic and linguistic philosophy, and theories of cognitive and moral development. He has been synthesizing these influences into a theory of communicative action, which presents the foundation and framework of a social theory that builds on the tradition of Marx, Weber and classical critical theory, but also criticizes his predecessors and breaks new theoretical ground. Jürgen Habermas seeks to defend the Enlightenment and with it an "emphatical", "uncurtailed" conception of reason against the post-modern critique of reason on the one hand, and against so-called scientism (which would include critical rationalism and the greater part of analytical philosophy) on the other. His objection to the former is that it is self-contradictory and politically defeatist; his objection to the latter is that, thanks to a standard of rationality derived from the natural sciences or from Weber's concept (...) of purposive rationality, it leaves normative questions to irrational decisions. Habermas wants to offer an alternative, trying to develop a theory of communicative action that can clarify the normative foundations of a critical theory of society as well as provide a fruitful theoretical framework for empirical social research. This study is a comprehensive and detailed analysis and sustained critique of Habermas' philosophical system since his pragmatist turn in the seventies. It clearly and precisely depicts Habermas' long chain of arguments leading from an analysis of speech acts to a discourse theory of law and the democratic constitutional state. Along the way the study examines, among other things, Habermas' theory of communicative action, transcendental and universal pragmatics and the argument from "performative contradictions", discourse ethics, the consensus theory of truth, Habermas' ideas on developmental psychology, communicative pathologies and social evolution, his theory of social order, the analysis of the tensions between system and lifeworld, his theory of modernity, and his theory of deliberative democracy. Max Weber famously diagnosed both an excess and a subordination of meaning in modernity when he coined the term disenchantment next to the fragmentation and irreconcilability of value spheres. Unlike Weber, however, who sought to keep the ideological and the rationalist sides of the modern divide together, his immediate followers capitalized either on his decisionism (i.e. Carl Schmitt) or on his universalism (i.e. Jürgen Habermas). In an attempt to develop a constructive perspective on the question of how we (...) can conceive of irreconcilable values within a larger normative horizon, this article introduces Karl Jaspers’s interpretation and refinement of Weber’s work. Most fundamentally, Jaspers’s existentialist philosophy of communication sought to turn Weber’s warring gods into a source of solidarity rather than divisiveness. I argue that Jaspers did so in rooting human freedom not in the decision or the law but in an experiential uncertainty and the knowledge not to know. The article closes with a discussion of some practical and theoretical implications of Jaspers’s thought for our understanding of diversity in unity in post-truth times. (shrink)

Nella Premessa al "Discorso filosofico della modernità" (1985) Habermas scrive, in maniera enfatica, che il tema, ricco di sfaccettature, della “modernità come progetto in-compiuto” segna l’inizio la sua riflessione e dagli anni ’80 “non gli ha dato più pace”. In effetti, la “modernità” si presenta come un “oggetto d’analisi obbligato” anche solo dal punto di vista del necessario auto-chiarimento disciplinare. È con la formazione delle società moderne che si differenziano come “forme del sapere specialistico”, la scienza politica, l’economia politica, l’antropologia (...) culturale e la sociologia. Ed è, ancora, dalla prospettiva della “riflessione filosofica” che si avvia dal tardo secolo XVIII una rinnovata consapevolezza intellettuale intorno alla coscienza storica del tempo moderno, ai principi costitutivi del “nuovo mondo” e alle “cesure” rispetto alla cultura passata. Non si deve, però, ridurre il concetto di modernità alla visione filosofica del mondo. Anche questa prospettiva – peraltro presente negli scritti di Habermas –, deve essere ricondotta all’interno del programma di ricerca della “teoria dell’evoluzione sociale”, considerando assieme i processi di “razionalizzazione culturale” del mondo vitale e la “differenziazione” di nuovi “principi di organizzazione sociale” rispetto a quelli con cui si erano riprodotte le formazioni tradizionali. Il merito dei suoi studi, una volta ricondotti a unità, è di seguire la trasformazione delle sfere culturali di valore alla luce dei problemi che coinvolgono la riproduzione delle strutture sociali e delle forme di vita tradizionali, mediando le esigenze della teorizzazione astratta e le vicende della storia con-creta. In tal senso, egli segue la tradizione di ricerca dei classici del pensiero sociale, da Comte sino alla scuola di Parsons, attraverso Marx, Durkheim e Weber. Dopo aver esposto in che cosa consiste, secondo il nostro Autore, il “razionalismo occidentale”, qui, ci limitiamo a fornire un indice ragionato dei temi con cui Habermas ha ricostruito il concetto “formazione sociale moderna” attraverso l'analisi degli “albori della modernità”, delle “società capitalistico-liberali” e delle “società contemporanee”. Em vez de abandoná-lo, Habermas procura reconstruir o projeto de emancipação moderno através da reconstrução dos fundamentos da racionalidade da ação e da racionalização social moderna a partir: da reconstrução da explicação e superação crítica das interpretações unilaterais e funcionalistas de Max Weber e Talcott Parsons, e da fundamentação de uma teoria da racionalidade comunicativa capaz de se desvencilhar dos pressupostos subjetivistas e individualistas teoria (...) social moderna. Varied evidence confirms more strongly than less varied evidence, ceteris paribus. This epistemological Variety of Evidence Thesis enjoys widespread intuitive support. We put forward a novel explication of one notion of varied evidence and the Variety of Evidence Thesis within Bayesian models of scientific inference by appealing to measures of entropy. Our explication of the Variety of Evidence Thesis holds in many of our models which also pronounce on disconfirmatory and discordant evidence. We argue that our models pronounce rightly. Against (...) a backdrop of failures of the Variety of Evidence Thesis, the intuitive case for the Variety of Evidence Thesis emerges strengthened. Our models do however not support the general case for the thesis since our explication of it fails to hold in certain cases. The parameter space of this failure is explored and an explanation for the failure is offered. (shrink)

This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...) Titelbaum, 252–262, 2015) do not undermine the argument of Hawthorne et al.. (shrink)

In this, the second of two articles outlining a theory of communicative competence, the author questions the ability of Chomsky's account of linguistic competence to fulfil the requirements of such a theory. ?Linguistic competence? for Chomsky means the mastery of an abstract system of rules, based on an innate language apparatus. The model by which communication is understood on this account contains three implicit assumptions, here called ?monologism?, ?a priorism?, and ?elementarism?. The author offers an outline of a theory of (...) communicative competence that is based on the negations of these assumptions. In opposing the first two assumptions he introduces distinctions, respectively, between semantic universals which process experiences and those that make such processing possible, and between semantic universals which precede all socialization and those that are linked to the conditions of potential socialization. Against elementarism, he argues that the semantic content of all possible natural languages does not consist of combinations of a finite number of meaning components. Differences in systems of classification preclude this, and such differences can be seen to infect all respects of intercultural comparison. Using the notion of ?performative utterance?, the author elucidates the role of dialogue?constitutive universals as part of the formal apparatus required of a?; speaker's capacity to communicate. He then notes what would be required of a general semantics based on a theory of communicative competence; and finally points out how this theory might be used for social analysis. (shrink)

J.L. Austin has demonstrated that people can do things—bring about social facts — with words. Here we describe how some people do things with things. This is a study of the symbolic use and situated history of material objects during a business negotiation between two German entrepreneurs: of the practical transformation of things-at-hand from objects of use into exemplars, or into forms-at-hand that can be used for the construction of transitory symbolic artifacts. Arranging boxes in a particular fashion can be (...) the equivalent of an illocutionary act, but unlike words things remain on the scene as indexical monuments to prior interactional arrangements. It is easy to imagine being someone else from the first-person point of view. Such imaginings give rise to a puzzle. In this paper I explain what the puzzle is and then consider several existing attempts of solving the puzzle. I argue that these attempts are unsuccessful. I propose a Lewisian account of first-person imagination and make the case that this account has the potential to solve the puzzle.

Historians of biology have argued that much of the dynamics of experimental disciplines such as genetics or molecular biology can be understood from studying experimental systems and model organisms alone . Such accounts contrast sharply with more traditional philosophies of science which viewed scientific research essentially as a process of inventing and testing theories. I present a case from the history of biochemistry which can be viewed from both the experimental systems perspective and from the methodology of theory testing. Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem. Arming uninhabited vehicles (UVs) is an increasing trend. Widespread deployment can bring dangers for arms-control agreements and international humanitarian law (IHL). Armed UVs can destabilise the situation between potential opponents. Smaller systems can be used for terrorism. Using a systematic definition existing international regulation of armed UVs in the fields of arms control, export control and transparency measures is reviewed; these partly include armed UVs, but leave large gaps. For preventive arms control a general prohibition of armed UVs would be (...) best. If that is unattainable, several measures should be taken. An explicit prohibition of autonomous attack, that is without a human decision, should be added to IHL. Concerning armed UVs remotely controlled by a human soldier, recommendations differ according to type or mission. New kinds of uninhabited nuclear-weapon carriers should be banned. Space weapons should be prohibited in general. UVs smaller than 0.2–0.5 m should be banned. Bigger remotely controlled armed UVs not equipped with weapons of mass destruction should be subject to numerical limitations in various categories. For these the Treaty on Conventional Armed Forces in Europe is an important precedent. (shrink)

The article deals with the question whether an unconditional basic income is part of an ideal liberal-egalitarian welfare regime. Analyzing UBI from an ideal-theoretical perspective requires a comparison of the justice performance of ideal welfare regimes instead of comparing isolated institutional designs. This holistic perspective allows for a more systematic consideration of issues like institutional complementarity. I compare three potential ideal welfare regimes from a liberal-egalitarian perspective of justice: An ideal social democratic regime, a mixed regime containing a moderate UBI (...) and a maximal UBI regime where UBI replaces most of the welfare state. These regimes are evaluated with respect to three aspects of justice performance: the scope and neutrality of opportunities provided, institutional complementarities with a dynamic, globalized economy and the policy feedback effects on the political stability of liberal-egalitarian political coalitions. I conclude that the overall performance of a mixed regime is superior to the other regimes. (shrink)

In this, the first of two articles outlining a theory of communicative competence, the author shows how the requirements of such a theory are to be found in an analysis not of the linguistic competence of a native speaker, but of systematic distortion of communication of the kind postulated by psychoanalytic theory. The psychoanalyst's hermeneutic understanding of initially incomprehensible acts and utterances depends on the explanatory power of this understanding, and therefore rests on theoretical assumptions. After a preliminary delineation of (...) the range of incomprehensible acts and utterances dealt with in psychoanalysis, the author presents an account of psychoanalysis as linguistic analysis. He then explicates the key theoretical assumptions underlying the analytical procedure, in particular those relating to the notion of ?scenic understanding?, and concludes by indicating the place of explanatory understanding in a theory of communicative competence. In a case study Kuhn's morphology of scientific revolutions is put to the test in confronting it with the contemporary developments in physics. It is shown in detail, that Kuhn's scheme is not compatible with the situation in physics today.

The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

These norms of belief are often explicated using the maximum entropy principle. In this paper we investigate the extent to which one can provide a unified justification of the objective Bayesian norms in the case in which the background language is a first-order predicate language, with a view to applying the resulting formalism (...) to inductive logic. This paper addresses a data integration problem: given several mutually consistent datasets each of which measures a subset of the variables of interest, how can one construct a probabilistic model that fits the data and gives reasonable answers to questions which are under-determined by the data? Here we show how to obtain a Bayesian network model which represents the unique probability function that agrees with the probability distributions measured by the datasets and otherwise has maximum entropy. We provide a general (...) algorithm, OBN-cDS, which offers substantial efficiency savings over the standard brute-force approach to determining the maximum entropy probability function. Furthermore, we develop modifications to the general algorithm which enable further efficiency savings but which are only applicable in particular situations. We show that there are circumstances in which one can obtain the model directly from the data; by solving algebraic problems; and by solving relatively simple independent optimisation problems. The article deals with the question whether an unconditional basic income (UBI) is part of an ideal liberal-egalitarian welfare regime. Analyzing UBI from an ideal-theoretical perspective requires a comparison of the justice performance of ideal welfare regimes instead of comparing isolated institutional designs. This holistic perspective allows for a more systematic consideration of issues like institutional complementarity. I compare three potential ideal welfare regimes from a liberal-egalitarian perspective of justice: An ideal social democratic regime, a mixed regime containing a moderate (...) UBI and a maximal UBI regime where UBI replaces most of the welfare state. These regimes are evaluated with respect to three aspects of justice performance: the scope and neutrality of opportunities provided, institutional complementarities with a dynamic, globalized economy and the policy feedback effects on the political stability of liberal-egalitarian political coalitions. I conclude that the overall performance of a mixed regime is superior to the other regimes. (shrink)

The maximum entropy principle is widely used to determine non-committal probabilities on a finite domain, subject to a set of constraints, but its application to continuous domains is notoriously problematic. This paper concerns an intermediate case, where the domain is a first-order predicate language. Two strategies have been put forward for applying the maximum entropy principle on such a domain: applying it to finite sublanguages and taking the pointwise limit of the resulting probabilities as the size n of the sublanguage (...) increases; selecting a probability function on the language as a whole whose entropy on finite sublanguages of size n is not dominated by that of any other probability function for sufficiently large n. The entropy-limit conjecture says that, where these two approaches yield determinate probabilities, the two methods yield the same probabilities. If this conjecture is found to be true, it would provide a boost to the project of seeking a single canonical inductive logic—a project which faltered when Carnap's attempts in this direction succeeded only in determining a continuum of inductive methods. The truth of the conjecture would also boost the project of providing a canonical characterisation of normal or default models of first-order theories. Hitherto, the entropy-limit conjecture has been verified for languages which contain only unary predicate symbols and also for the case in which the constraints can be captured by a categorical statement of quantifier complexity. This paper shows that the entropy-limit conjecture also holds for categorical statements of complexity, for various non-categorical constraints, and in certain other general situations. (shrink)
