Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. In the Netherlands, in 2002, euthanasia became a legitimate medical act, only allowed when the due care criteria and procedural requirements are met. Legally, an Advanced Euthanasia Directive can replace direct communication if a patient can no longer express his own wishes. In the past decade, an exponential number of persons with dementia share a euthanasia request with their physician. The impact this on physicians, and the consequent support needs, remained unknown. Our objective was to gain more insight into the (...) experiences and needs of Dutch general practitioners and elderly care physicians when handling a euthanasia request from a person with dementia. We performed a qualitative interview study. Participants were recruited via purposive sampling. The interviews were transcribed verbatim, and analyzed using the conventional thematic content analysis. Eleven general practitioners and elderly care physicians with a variety of experience and different attitudes towards euthanasia for PWD were included. Euthanasia requests appeared to have a major impact on physicians. Difficulties they experienced were related to timing, workload, pressure from and expectations of relatives, society’s negative view of dementia in combination with the ‘right to die’ view, the interpretation of the law and AEDs, ethical considerations, and communication with PWD and relatives. To deal with these difficulties, participants need support from colleagues and other professionals. Although elderly care physicians appreciated moral deliberation and support by chaplains, this was hardly mentioned by GPs. Euthanasia requests in dementia seem to place an ethically and emotionally heavy burden on Dutch GPs and elderly care physicians. The awareness of, and access to, existing and new support mechanisms needs further exploration. (shrink)

The debate over scientific or critical realism is characterized by confusion, which I claim is a result of approaching the issue from both modern and ‘postmodern’ perspectives. Modern thought is characterized by foundationalism in epistemology and representationalism in philosophy of language, while holism in epistemology and the theory of meaning as use in philosophy of language are postmodern. Typical forms of scientific realism (which seek referents for theoretical terms or correspondence accounts of the truth of scientific theories) are positions at (...) home only in a modern framework. Postmodern presuppositions of other participants in the debate account for the ability of opponents to talk past one another. (shrink)

We argue that the claim that essence-based causal explanations emerge, hydra-like, from an inherence heuristic is incomplete. No plausible mechanism for the transition from concrete properties, or cues, to essences is provided. Moreover, the fundamental shotgun and storytelling mechanisms of the inherence heuristic are not clearly enough specified to distinguish them, developmentally, from associative or causal networks.

Professional standards in medicine and psychology treat concurrent sexual relationships with patients as violations of fiduciary trust, and they sometimes rule out sexual relationships even after a clinical relationship is over. These standards also rule out sex with research subjects who are also patients, but what about nonclinical relationships where there are not always parallels to the standards of clinical medicine? One way to treat sex in nonclinical research relationships is to treat it as sex is treated elsewhere among adults, (...) as a matter of individual choice and responsibility. Alternately, one could ask oversight bodies to draw lines between research that can safely accommodate sexual relationships and research that cannot. One could even ask researchers to avoid all concurrent sexual relationships with their research participants, as happens in clinical medicine. Each of these options has drawbacks that undermine its value as a definitive solution. The deficiencies of these options highlight the need for a professional code of conduct for nonclinical researchers. (shrink)

In my commentary, I first argue that Shachar’s analysis implicitly calls into question the legitimacy of the international order. I then raise the worry that the logic which severs the link between the exercise of sovereignty and territory is the same logic that can be used to (...) justify injustice and atrocity such as ethnic cleansing. Experience with electronic communication in ethics committees at two hospitals is reviewed and discussed. A listserver of ethics committee members transmitted a synopsis of the ethics consultation shortly after the consultation was initiated. Committee comments were sometimes incorporated into the recommendations. This input proved to be most useful in unusual cases where additional, diverse inputs were informative. Efforts to ensure confidentiality are vital to this approach. They include not naming the patient in the e-mail, requiring a password for access to (...) the listserver, and possibly encryption. How this electronic communication process alters group interactions in ethics committees is a fruitful area for future investigation. (shrink)

The paper attempts in fact to be little more than a paraphrase of the Greek, which aims only at accuracy of statement, but I am adding in the third section a note on the relation of this passage to the discussion of method in Republic VI, mainly in order to minimize its (...) relevance. My aim is to defend the conscience principle: One ought never to act against the dictates of one’s conscience. In the first part of this paper, I explain what I mean by “conscience” and “dictate of conscience,” and I show that the notion that the conscience principle is inherently anti-authoritarian or inherently fanatical is mistaken. In the second part, I argue that the existence of mistaken conscience does not reduce the conscience principle to absurdity. Semantic internalism is the view that linguistic meaning amounts to forms of conceptual instructions, and that the process of forming linguistic representations does not involve reference to extra-mental entities. Contemporary philosophy of language remains predominantly externalist in focus, having developed systems of extensional reference which depart from classical rationalist assumptions. Semantic internalism is defended here using a broad range of case studies. Particular focus is be placed on exemplar cases such as natural kind and artifactual terms. Typical natural kind terms (...) are shown to have their meaning constructed via a range of cognitive faculties (considerations of material basis being only one of them), and consulting basic properties of language processing and parsing can explain our intuitions about common word use, a major goal of the internalist enterprise. Copredication via inherent polysemy is used as a strong source of evidence for internalism, countering the received view of the externalist character of meaning. Semantic internalism is comprehensively defended against its critics, pushing the exploration of linguistic content and meaning “back into the head”. (shrink)

Transitional justice refers to the process of dealing with widespread wrongdoing characteristically committed during the course of conflict and/or repression. Examples of such processes include criminal trials, truth commissions, reparations, and memorials. Technology is altering the forms that widespread wrongdoing takes. Technology is also altering the form of processes of transitional justice themselves. This essay provides a map of these changes and their normative implications.

The epistemology and ontology of experimentation are discussed in depth with special reference to biology and medicine. Two types of experiments are distinguished: exploratory (or "blazing") and consolidating. They Have objectives and canons that are strikingly different. A contrast is drawn between the literalism of the most pragmatic scientists and the formalism of most statisticians. The terms and notions of the one may have imperfect correspondence with those of the other, or perhaps none at all. This article outlines an approach to a critical cosmopolitan social theory derived from the thought of the Japanese philosopher, Watsuji Tetsurō. In order to develop this, his thought is positioned against the works of the British sociologist, Gerard Delanty, and the Argentinian semiotician, Walter Mignolo. This will be done through the concepts of space, time and the imagination. From their respective intellectual positions these other two have attempted to develop an approach to social theory that cannot be reduced to the (...) optic of conceptual Eurocentrism. However, while they have made significant and important contributions to the development of critical approaches to cosmopolitan social theory, of providing tools to re-imagine the world, they have done so through maintaining old ways of seeing the world. What emerges from Watsuji’s work is an account of a critical cosmopolitanism that moves beyond conceptual Eurocentrism through an approach to social theory grounded in a relational social ontology. His focus on the ontology of social relationships also provides a cosmopolitanism that makes room for the ‘non-social’ and identifies a cosmopolitan view of the world as plural and as ‘hetero-spatial-temporal’. The social ontology developed by Watsuji also forces us to reconsider our understanding of the imagination, and its potential, beyond the dichotomy of an individual faculty or the product of social context. By expanding the notion of the Imaginal of Chiara Bottici, the article introduces a new understanding of the imagination into the debate. (shrink)
