  2. How to Reconstruct a Thought Experiment.Marek Picha - 2011 - Organon F: Medzinárodný Časopis Pre Analytickú Filozofiu 18 (2):154-188.
The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...)

On the legal responsibility of autonomous machines.Bartosz Brożek & Marek Jakubiec - 2017 - Artificial Intelligence and Law 25 (3):293-304.
The paper concerns the problem of the legal responsibility of autonomous machines. In our opinion it boils down to the question of whether such machines can be seen as real agents through the prism of folk-psychology. We argue that autonomous machines cannot be granted the status of legal agents. Although this is quite possible from purely technical point of view, since the law is a conventional tool of regulating social interactions and as such can accommodate various legislative constructs, including legal (...)

Recent developments in virtual reality technology raise a question about the experience of presence and immersion in virtual environments. What is immersion and what are the conditions for inducing the experience of virtual presence? In this paper, we argue that crucial determinants of presence are perception of affordances and sense of embodiment. In the first section of this paper, we define key concepts and introduce important distinctions such as immersion and presence. In the second and third sections, we respectively discuss (...)

  8. Changing higher education and welfare states in postcommunist Central Europe: New contexts leading to new typologies?Marek Kwiek - 2014 - Human Affairs 24 (1):48-67.
The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...)

Timing together, acting together. Phenomenology of intersubjective temporality and social cognition.Marek Pokropski - 2015 - Phenomenology and the Cognitive Sciences 14 (4):897-909.
In this article I consider how the problem of social (intersubjective) cognition relates to time-consciousness. In the first part, I briefly introduce Husserl’s account of intersubjective cognition. I discuss the concept of empathy (Einfühlung) and its relation with time-consciousness. I argue that empathy is based on pre-reflective awareness of the other’s harmony of behaviour. In the second part, I distinguish pre-reflective (passive) and reflective (active) empathy and consider recent empirical research in the field of social cognition. I argue that these (...)

The author examines the arguments for applicability of the limitation clause which specifies the requirements for limitation of constitutional freedoms and rights (Article 31 para. 3 of the Constitution) to the right to protection of life (Article 38). Even if there is almost a general acceptance of such applicability, this approach does not hold up to criticism based on the rule existing in the Polish legal order that treaty commitments concerning human rights have supremacy over national statutory regulations. Due to (...)

This article seeks to justify the claim that Thomas Aquinas proposed a concept of natural law which is immune to the argument against the recognition of an objective grounding of the good formulated by a well-known representative of the liberal tradition, Isaiah Berlin, in his famous essay “Two Concepts of Freedom.” I argue that Aquinas’s concept of freedom takes into account the very same values and goals that Berlin set out to defend when he composed his critique of natural law. An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- Résumé (...)

AI statecraft heating-up: the automation of governance through Canada’s Chinook case study.Nicolas Chartier-Edwards, Marek Blottiere & Jonathan Roberge - forthcoming - AI and Society:1-10.
In the years 2020–2021, journalists, lawyers, scholars, and civil society actors noticed an unusual spike in the refusal of francophone African immigrants in Québec, Canada. While Immigration, refugee and citizenship Canada’s systemic racism problem were already documented, the novelty appeared to be how standardized and sometimes, “nonsensical” the reasons given to many of the applicants were. This eventually prompted a lawsuit against IRCC in which it was revealed that a new piece of software called “Chinook” had been deployed since 2018, (...)

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...)

The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. My aim is to show that the elaborated and very attractive theory of the purely intentional object developed by Roman Ingarden within the framework of his ontology is nevertheless untenable. The main reason of this is the false assumption, generally accepted in phenomenology, that some existing object always corresponds to an act of consciousness. This general issue has been investigated in my paper "On Intending and Being Intended" (to appear in Studia Philosophiae Christianae). In the present paper however I am (...)

Zagadnienie konkluzywności krytyki idealizmu przeprowadzonej przez Kazimierza Ajdukiewicza.Marek Rosiak - 1993 - Acta Universitatis Lodziensis. Folia Philosophica. Ethica-Aesthetica-Practica 9:73-80.

Childhoods in contemporary Kenya are entangled with discourses of care in a post-colonial landscape. Such imaginaries of childhoods through discourses of ‘care’ and ‘charity’ are well established through Western lenses. Another lens that is often enacted is the lens of de-commercialised, un-spoilt, pure and innocent childhoods in the Kenyan landscape. In this study, the authors utilize Nel Nodding’s concept of an ethics of care, and a feminist lens, to explore this binary of Western views through real experiences of childhoods. This (...)

The author reflects on the moral attitudes displayed by Poles fighting in the Warsaw Uprising. He believes that the sacrifice and selflessness with which Varsovians battled for their city had its roots in the general mentality of the Poles, who for generations had been raised in the spirit of “mutual and willing endowment”. He also notes that the noble ideals of the wartime generations have today been largely replaced by mercenary selfishness.

Multi-agent systems where the agents are developed by parties with competing interests, and where there is no access to an agent’s internal state, are often classified as ‘open’. The members of such systems may inadvertently fail to, or even deliberately choose not to, conform to the system specification. Consequently, it is necessary to specify the normative relations that may exist between the members, such as permission, obligation, and institutional power. We present a framework being developed for executable specification of open (...)

This paper proposes a unified dependent type analysis of three puzzling phenomena: inversely linked interpretations, weak definite readings in possessives and Haddock-type readings. We argue that the three problematic readings have the same underlying surface structure, and that the surface structure postulated can be interpreted properly and compositionally using dependent types. The dependent type account proposed is the first, to the best of our knowledge, to formally connect the three phenomena. A further advantage of our proposal over previous analyses is (...)
