It has been claimed that beneath the government rhetoric of patient choice, no real choice exists either in law or in National Health Service policy. Thus, choice is considered to be a fallacy in that patients are not able to demand specific treatment, but are only able to express preferences amongst the available options. This article argues that, rather than considering choice only in terms of patient autonomy or consumer rights, choice ought to be seen as serving other functions: Choice (...) serves as a mechanism of destabilisation, i.e., as a lever for change. This is apparent at the level of patient and doctor, and at the level of patient and health authority, but even more so, at the level of government. Patient choice, rather than benefiting the individual, can have effects on a wider scale. It encourages change and reform in healthcare practices and in the NHS institutions. (shrink)

María Lugones, one of the premiere figures in feminist philosophy, has at last collected some of her most famous essays, as well as some lesser-known gems, into her first book.

Important empirically informed proposals of virtue cultivation invoke techniques of goal pursuit. This paper argues that these techniques are effective in changing behavior due to the attention narrowing they bring about, and further show that such attention narrowing can threaten the appropriate exercise of phronetic-related capacities. When these phronetic-related capacities are threatened, two derivative problems arise: (1) One can end up acting in morally inappropriate ways, and (2) Even in cases where one performs the morally appropriate action, one nonetheless can (...) fail to notice and appreciate features of moral value. In light of these concerns, such techniques of goal pursuit – at least, by themselves – serve the most good for those who are merely trying to avoid vice, rather than cultivate virtue. And so, I suggest that such accounts of virtue cultivation are incomplete. I then go on to argue that these undesirable effects of attention narrowing brought about by these goal pursuit techniques may be ameliorated by also engaging in certain indirect modifications of cognition, particularly those which broaden attention. The suggestion, then, is that attention narrowing techniques of goal pursuit, along with attention broadening modifications, might best facilitate virtue cultivation when employed together. While the particulars of how we might best go about this are currently unclear, this paper ends by looking at empirical research on Open Monitoring Meditation as providing a hopeful option that might be further investigated. We argue that philosophers are competent to facilitate public discussion concerning restrictions on human migration across political borders. We also argue that presenting public audiences with a prima facie case for open borders offers a unique opportunity to elucidate important aspects of philosophical reasoning. Finally, we share resources and a lesson plan for those keen to examine the case for open borders with students, or to facilitate public discussion on these issues.

In this conceptual article, we argue that defining corporate social responsibility and corporate social irresponsibility as opposite constructs produces a lack of clarity between responsible and irresponsible acts. Furthermore, we contend that the treatment of the CSR and CSI concepts as opposites de-emphasizes the value of CSI as a stand-alone construct. Thus, we reorient the CSI discussion to include multiple aspects that current conceptualizations have not adequately accommodated. We provide an in-depth exploration of how researchers define CSI and both identify (...) and analyze three important gray zones between CSR and CSI: the role of harm and benefit, the role of the actor and intentionality, and the role of rectification. We offer these gray zones as factors contributing to the present lack of conceptual clarity of the term CSI, as a concept in its own right, leading to difficulties that researchers and managers experience in categorizing CSI acts as distinct from CSR. This paper argues that the so-called ‘paradox’ of dehumanization is a mirage arising from misplaced abstraction. The alleged ‘paradox’ is taken as challenge that arises from a skeptical stance. After reviewing the history of that skeptical stance, it is reconstructed as an argument with two premises. With the help of an epistemologically structured but pluralistic frame it is then shown how the two premises of the Skeptic’s argument can both be debunked. As part of that it emerges that there are (...) a couple of ways how dehumanization can be realized, and one such realization can be sufficient for affirming the reality of dehumanization for a specific case. O presente artigo objetiva fornecer uma apresentação crítica, compreensiva e inédita na língua portuguesa do Processamento Preditivo (PP) – um esquema teórico para a compreensão da cognição que propõe uma inversão de nosso entendimento padrão da ação, percepção, sensação e sua relação. Aqui, nosso objetivo primário será introduzir os principais conceitos e ideias do PP, tratando-o como um modelo moderadamente corporificado de cognição e analisando suas credenciais como uma proposta teórica unificadora. Para tanto, partiremos de uma contextualização histórica de algumas (...) correntes de pensamento que teriam fomentado seu desenvolvimento inicial, passando por uma descrição não-matemática do Princípio da Energia Livre, que fundamenta e subentende a atuação de suas especificidades para, então, esclarecermos o papel que, segundo o PP, a inferência bayesiana, a minimização dos erros de predição e a chamada Inferência Ativa possuiriam na manutenção homeostática de nossos cérebros e corpos preditivos. Por fim, forneceremos uma síntese de algumas consequências daquilo que o PP poderia trazer à compreensão contemporânea do cérebro e comportamento humanos, concluindo que, embora sua descrição da cognição como um processo preditivo único e contínuo prometa eventualmente unificar paradigmas explicativos e níveis de análise distintos, por ora, talvez seja melhor concebê-lo de forma mais modesta, como uma ferramenta ou heurística para nos auxiliar a repensar vários dos tópicos centrais ao estudo científico e filosófico da mente. In _Kazimierz Twardowski: A Grammar for Philosophy_ Maria van der Schaar shows the importance of Twardowski’s method, his philosophical grammar, for both the Lvov-Warsaw School, and analytic philosophy today.

This paper revisits Donnellan’s distinction between referential and attributive uses of definite descriptions and argues that it is not exhaustive. Donnellan characterizes the distinction in terms of two criteria: the speaker’s intentions and the type of content the speaker aims to express. I argue that contrary to the common view, these two criteria are independent and that the distinctive features may be coinstantiated in more than two ways. This leaves room for nonattributive and nonreferential uses of definite descriptions. Kripke’s notions (...) of general and specific intentions provide a framework that accommodates such cases. Additionally, it proves useful for the analysis of the use of proper names with specific nonsingular intentions. The paper also discusses how the interpretation of the use of definite descriptions as attributive or referential (or neither) is sensitive to which theory of singular thoughts one adopts. (shrink)

The present paper analyses how top managers construct the meaning of sustainable human resource management and its responsibility areas and how they identify and prioritize stakeholders in sustainable HRM. The empirical data were collected as part of the Finnish HR Barometer inquiry. A qualitative analysis reveals four dimensions of sustainable HRM: Justice and equality, transparent HR practices, profitability, and employee well-being. It also reveals four broader responsibility areas: Legal and ethical, managerial, social, and economic. Contrary to the prior green HRM (...) literature, ecological responsibility was largely ignored. The study also reveals a wide range of stakeholders, specifically, owners, managers, employees, customers, and employee representatives, as well as their special roles and requirements for sustainable HRM. These findings contribute to the literature of sustainable HRM by illustrating the dimensions and broader responsibilities of sustainable HRM as seen by top managers. Their conceptions of sustainable HRM are largely neglected in the prior literature despite their crucial role in legitimating HRM and thus sustainable HRM in companies. These results also contribute to the theory of stakeholder salience in the sustainable HRM context from the viewpoint of top managers. (shrink)

Leibniz's metaphysics appears to go a long way towards monism: it supports a strong dependence of limited things on the absolute or God and understands this dependence not only as causal dependence but also as a pervasive ontological dependence which involves the communality of nature between absolute and limited. Yet, Leibniz stops short of affirming monism. Why? This paper takes a fresh look at Leibniz's reasons for opposing monism through the lens of a virtually unknown text of 1698 on the (...) metaphysical foundations of the infinite. Against the backdrop of the present-day monistic proposals of Jonathan Schaffer and Michael Della Rocca, the paper identifies and evaluates four different types of monism: 1. Whole-Part Monism; 2. World-Animal Monism; 3. God-Nature Monism and 4. Eleatic Monism. It argues that Leibniz's opposition to Whole-Part Monism, World-Animal Monism, and God-Nature Monism, is due to his conceptions of the infinite and of what it is to be “an absolutely absolute Being”. Furthermore, it argues that the only type of monism which could preserve Leibniz's demanding notions of real infinite and absolute is Eleatic Monism. The latter, however, is also rejected by Leibniz due to our first-hand experience of what it is to be a substance. (shrink)

This article explores the concept of cultural competence and its relevance as an organizational resource in ethical disputes. Empirically, we aim to reveal the cultural competences that a global forest industry company, StoraEnso, and a global environmental nongovernmental organization (NGO), Greenpeace, utilized in forestry conflicts during 1985–2001. Our study is based on data which were collected from corporate and NGO communication outlets and which have gone through a detailed discourse-semiotic analysis. Our reinterpretation of the discourses identified three cultural competences: (1) (...) the ability to understand changing consumer preferences and values, (2) the ability to utilize culturally determined positions of expertise, and (3) the ability to maintain trust and credibility in the community through open communicative practices. We argue that these competences are relevant in industry–NGO disputes for both parties. However, maintaining them all simultaneously is a difficult task, since various discourses which aim at upholding them can sometimes have contradictory effects. (shrink)

This paper examines Bohdan Boichuk’s poetry by looking into the role his childhood memories played in forming his poetic imagination. Displaced by World War II, the poet displays a unique capacity to transcend his traumatic experiences by engaging in creative writing. Eyewitnessing war atrocities perpetrated by the Nazis does not destroy his belief in the healing power of poetry; on the contrary, it makes him appreciate poetry as the only existentially worthy enterprise. Invoking Gaston Bachelard’s classic work The Poetics of (...) Reveries: Childhood, Language, and the Cosmos, I argue that Boichuk’s vivid childhood memories, however painful they might be, helped him poetically recreate and reimagine fateful moments of his migrant life. How can we avoid the conventional opposition of mythology and the dawn of reason and instead explore the multiple styles of thought that emerged between them? The diagnosis of idiopathic short stature refers to children who are considerably shorter than average without any identified medical reason. The US Food and Drug Administration authorised marketing of recombinant human growth hormone for ISS in 2003, while the European Medicines Agency refused it in 2007. This paper examines the arguments for these decisions as detailed in selected FDA and EMA documents. It combines argumentative analysis with an approach to policy analysis called ‘What’s the problem represented to be’. It argues (...) that the FDA presents its approval as an argument for equity of access to the treatment, describing short stature as a potential disadvantage, and assuming that height normalisation is a clinically meaningful result. The EMA, instead, refuses marketing authorisation with an argument that there is an imbalance of risks and benefits, describing ISS as a healthy condition, and arguing that hGH should provide some psychosocial and/or quality of life benefits to children with ISS other than height gain. This paper then discusses how these arguments could be read through different models of disability, particularly through the medical model of disability and the relational, experiential, and cultural understandings of disability. The authors discuss the consistency of transnational companies in their home, as well as in less developed host countries, concerning ethics, values and social responsibility. Ethical behavior offers good reputation, credibility and tradition to the corporation. It leads to corporate social, environmental and economic responsibilities, cooperating to the desired sustainability. This paper analyzes the inversion of values that corporate governance systems have suffered. The meaning and implication of the corporate social responsibility is investigated and discussed. A "pyramid of values" is (...) built upon individual ethical values at the basis. Over them, the organizational ethical values should indicate the limits of operations, so that the corporate social responsibility can be sustained, in the top. The authors comment that ethical values no longer lead the organization. Its communication with the stakeholders, specifically through reports, has been gradually replacing the code of ethics and corporate values. These reports have taken the basis of the pyramid leading the organizations to socially irresponsible and unethical behavior. They do not guarantee transparency or communicate the needs of the society. It appears that transnational companies do not behave the same way in their home country as they do in host countries, particularly in less developed regions like Latin America and Africa. Lack of communication and transparency may induce employees to unethical decisions and transform the reporting system into a marketing instrument. In order to guarantee compliance with the codes, transparency and ethical responsibility, communication within the organization is essential. (shrink)

We conducted three studies to examine how the recipients of negative workplace gossip judge the gossip sender’s morality and how they respond behaviorally. Study 1 provided experimental evidence that gossip recipients perceive senders as low in morality, with female recipients rating the sender’s morality more negatively than male recipients. In a follow-up experiment (Study 2), we further found that perceived low morality translates into behavioral responses in the form of career-related sanctions by the recipient on the gossip sender. A critical (...) incident study (Study 3) enhanced the external validity and extended the moderated mediation model by showing that gossip recipients also penalize senders with social exclusion. We discuss the implications for practice and research on negative workplace gossip, gender differences in attributions of morality, and gossip recipients’ behavioral responses. (shrink)

Combining the liberalism of Locke and the "civic humanism" of Republicanism, Mary Wollstonecraft explored the need of women for coed and equal education with men, economic independence whether married or not, and representation as citizens in the halls of government. In doing so, she foreshadowed and surpassed her much better known successor, John Stuart Mill. Ten feminist scholars prominent in the fields of political philosophy, constitutional and international law, rhetoric, literature, and psychology argue here that Wollstonecraft, by reason of the (...) scope and complexity of her thought, belongs in the "canon" of political philosophers along with Rousseau and Burke, her contemporaries, both of whom she strenuously engaged in political debate. These essays explore the many aspects of her thought that resound so tellingly to the modern woman, including her groundbreaking attempt to be completely self-sufficient. The final bibliographical essay outlines the changing interpretations of Wollstonecraft's work over the past two hundred years and evaluates her standing among political theorists today. Deliberative Transformative Moments (DTM) is a new concept that serves as an amendment to the DQI. With this new concept it is easier to get at the quick give-and-take of discussions of small groups of ordinary citizens. As an illustration, we apply the concept to discussions about the peace process among Colombian ex-combatants, ex-guerrillas and ex-paramilitaries. Specifically, we show how personal stories can transform a discussion from a low to a high level of deliberation and how they can have the (...) opposite effect. To increase the level of deliberation in the general population, we recommend that good illustrations of DTM’s should be part of the school programs from an early age on, so that children learn how to discuss with others who have different opinions and values. RESUMEN El concepto heterotopía, definido por Michel Foucault como espacio otro, es retomado en este artículo, desde un enfoque crítico, para analizar los procesos de construcción, gestión y puesta en marcha del Museo Itinerante de la Memoria y la Identidad de Los Montes de María, El Mochuelo. Bajo la premisa de que el desarrollo de los procesos de memorialización debe atenderse más allá del cumplimiento normativo por parte del Estado, puesto que estas prácticas de memoria territoriales en El Mochuelo subvierten (...) el estatismo y la homogeneidad con los cuales se instauran las verdades oficiales. ABSTRACT Heterotopia concept, defined by Michel Foucault as another space, is taken up in this article to analyze the processes of construction, management, and implementation of the Museo Itinerante de la Memoria y la Identidad de Los Montes de María, El Mochuelo (Itinerant Museum of Memory and Identity of Los Montes de María, El Mochuelo). Under the premise that the development of memorialization processes must be addressed beyond regulatory compliance by the State since these territorial memory practices in El Mochuelo subvert the statism and homogeneity with which official truths are established. A range of themes—race and gender, sexuality, otherness, sisterhood, and agency—run throughout this collection, and the chapters constitute a collective discourse at the intersection of Black feminist thought and continental philosophy, converging on a similar set of questions and concerns. These convergences are not random or forced, but are in many ways natural and necessary: the same issues of agency, identity, alienation, and power inevitably are addressed by both camps. Goal – The aim of the article is to identify dysfunctional phenomena (implementation of specific mechanisms/solutions and actions taken), generating increased opacity and limit the responsibility/accountability of public finance in Poland, exacerbated by the COVID-19 crisis. Methods – descriptive analysis, comparative analysis and financial analysis methods were used. Results – fiscal transparency and accountability in Poland is limited by: the marginalisation of the role of the state budget, the loosening of the stabilising expenditure rule, the creation of financial mechanisms based (...) on special funds fed by repayable financing sources for the implementation of state tasks, inter alia, in the fight against the effects of the COVID-19 crisis, the use of national and EU methodologies for calculating the deficit and debt of the public sector in order to conceal part of them, the lack of a consolidated financial statement of the public finance sector. En ellas arguyo que, en Cinema Libertad, Menéndez propone la tesis de lo que será su producción como cineasta y sugiere diferentes vías para la renovación estética y ética del cine salvadoreño. En Cinema Libertad, Menéndez aboga por la capacidad creadora del cine y la libertad artística del autor al (...) tiempo que invita a reflexionar –aunque de forma más íntima, crítica y meditativa que producciones audiovisuales más convencionales de la región– sobre las violencias que aún aquejan El Salvador. El artículo presenta resultados de una investigación doctoral en género centrada en la experiencia de mujeres argentinas con las Técnicas de Reproducción Humana Asistida (TRHA). En Argentina, la ley que regula el acceso a las TRHA garantiza el acceso a una diversidad de personas usuarias que no siempre parten de un diagnóstico de infertilidad. Se propone como objetivo principal conocer las diversas relaciones de las usuarias de TRHA con la tecnología reproductiva. Desde una perspectiva feminista, se trabaja con el análisis (...) cualitativo de relatos de usuarias de TRHA, mediante su codificación. Como resultados se identifican dos grandes categorías: “relatos de reparación”, donde la decisión de usar las TRHA se vincula a la noción de infertilidad; y los “relatos de simultaneidad”, donde la tecnología reproductiva aparece posibilitando una decisión reproductiva. Estas reflexiones constituyen un aporte para pensar las tecnologías desde las propias experiencias de las usuarias, así como las tensiones en la construcción de la autonomía reproductiva. (shrink)
