Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. The ongoing debate within neuroethics concerning the degree to which neuromodulation such as deep brain stimulation (DBS) changes the personality, identity, and agency (PIA) of patients has paid relatively little attention to the perspectives of prospective patients. Even less attention has been given to pediatric populations. To understand patients’ views about identity changes due to DBS in obsessive-compulsive disorder (OCD), the authors conducted and analyzed semistructured interviews with adolescent patients with OCD and their parents/caregivers. Patients were asked about projected impacts (...) to PIA generally due to DBS. All patient respondents and half of caregivers reported that DBS would impact patient self-identity in significant ways. For example, many patients expressed how DBS could positively impact identity by allowing them to explore their identities free from OCD. Others voiced concerns that DBS-related resolution of OCD might negatively impact patient agency and authenticity. Half of patients expressed that DBS may positively facilitate social access through relieving symptoms, while half indicated that DBS could increase social stigma. These views give insights into how to approach decision-making and informed consent if DBS for OCD becomes available for adolescents. They also offer insights into adolescent experiences of disability identity and “normalcy” in the context of OCD. (shrink)

Background: A growing literature has raised—skeptically—the question of whether cutting-edge scientific research can identify and address broader ethical and policy considerations in real time. In genomics, the question is: Can ELSI contribute to genomics in real time, or will it be relegated to its historical role of after-the-fact outsider critique? We address this question against the background of a genomic screening project where we participated as embedded, real-time ELSI researchers and observers, from its initial design through its conclusion.Methods: As part (...) of the ELSI study design, the project included an ongoing reflexive ethnography in which the authors studied the process of its design and implementation. The authors were true participant observers, serving as members of various task-oriented groups while recording meetings and other events for ongoing qualitative analysis. We also conducted and analyzed interviews of multiple participants at the conclusion of the project.Results: Our real-time ELSI initiative had a mixed record of successes and challenges. If we define success as ELSI researchers having had an opportunity to participate fully in the project and to make the ELSI perspective heard, then our assessment is largely positive. If, however, we define successes as instances where real-time ELSI contributions changed the direction of the genomic or public health aspects of the GeneScreen project or, after careful deliberation, confirmed the appropriateness of the status quo, then we can identify only a few examples. While we had a seat at the table, we were, for the most part, tolerated guests.Conclusions: We conclude that there are significant barriers to real-time ELSI influence. The difficulty does not reside in any intended exclusion of an ELSI perspective, but in factors endemic to genomic research, including knowledge disparities, epistemological biases, and the pressures of time and money. In this period, an increasing number of scientific publications started to incorporate the digital format and became easily accessible through the Internet. Since then, we have become used to the idea that there is a hierarchy in medical evidence. Its upper stratum, the gold standard of evidence, contains systematic reviews and meta-analyses of randomized clinical trials. Given the negative costs of exclusion and the relevance of belongingness for humans, the experience of exclusion influences social affiliation motivation, which in turn is a relevant predictor of prosocial behavior. Skin conductance is a typical measure of the arousal elicited by emotions. Hence, we argued that both inclusion and exclusion will increase skin conductance level due to the increase of either positive affect or anger affects, respectively. Moreover, we argued that emotional arousal is also related to social affiliation motivation (...) and prosocial behavior. A total of 48 students were randomly allocated to either an inclusionary or exclusionary condition and their skin conductance levels were recorded during an experiment in which they completed an online questionnaire and played the game “Cyberball.” Results indicated that (a) individuals who perceived high exclusion felt angrier than individuals perceiving high inclusion, who feel positive affect; (b) no differences were evidenced in terms of skin conductance between exclusion and inclusion situations; (c) over-aroused individuals were less motivated to affiliate; and (d) individuals with lower affiliation motivation behaved in a less prosocial way. The results were congruent to the argument that behaving prosocially may be a way to gain the desired affiliation. (shrink)

Learning to live together is the central concern of education everywhere in the world. Traditional sporting games provide interpersonal experiences that shape miniature communities charged with emotional meanings. The objective of this study was to analyze the ethnomotor features of TSG in three Catalan-speaking Autonomous Communities and to interpret them for constructing emotional communities. The study followed a phenomenological-interpretative paradigm. The identification of TSG was done by a hermeneutic methodological approach by using an exhaustive exploratory documentary research. We studied 503 (...) games collected in the Dictionary Català-Valencià-Balear de Alcover and Moll. Instruments and procedure: A database was built up with information about the internal and external logic of the games. The validity of the information was confirmed by means of a concordance test between the researchers. Data processing was carried out by means of classification trees, identifying the predictive variables of the types of TSG. Most of the TSGs were sociomotor games. The classification tree identified four explanatory variables. Three variables were internal traits, and one variable corresponded to external logic. Features of the TSG of the Catalan-speaking Autonomous Communities build original emotional communities. The ethnomotor regularities triggered emotional experiences associated with pleasure for living together ; domesticating of aggressiveness over opponents ; developing sustainability ; educating the competition ; and interpersonal well-being based on the community. BackgroundInformation and communication technology solutions have the potential to support active and healthy aging and improve monitoring and treatment outcomes. To make such solutions acceptable, all stakeholders must be involved in the requirements elicitation process. Due to the COVID-19 situation, alternative approaches to commonly used face-to-face methods must often be used. One aim of the current article is to share a unique experience from the Pharaon project where due to the COVID-19 outbreak alternative elicitation methods were used. In addition, an (...) overview of common functional, quality, and emotional goals identified by six pilot sites is presented to complement the knowledge about the needs of older adults.MethodsOriginally planned face-to-face co-creation seminars were impossible to carry out, and all pilot sites chose alternative requirements elicitation methods that were most suitable in their situation. The elicited requirements were presented in the form of goal models. In one summary goal model, we provide an overview of common functional, quality, and emotional goals.ResultsDifferent elicitation methods were combined based on the digital literacy of the target group and their access to digital tools. Methods applied without digital technologies were phone interviews, reviews of literature and previous projects, while by means of digital technologies online interviews, online questionnaires, and virtual co-creation seminars were conducted. The combination of the methods allowed to involve all planned stakeholders. Virtual and semi-virtual co-creation seminars created collaborative environment comparable to face-to-face situations, while online participation helped to save the time of the participants. The most prevalent functional goals elicited were “Monitor health,” “Receive advice,” “Receive information.” “Easy to use/comfortable,” “personalized/tailored,” “automatic/smart” were identified as most prevalent quality goals. Most frequently occurring emotional goals were “involved,” “empowered,” and “informed.”ConclusionThere are alternative methods to face-to-face co-creation seminars, which effectively involve older adults and other stakeholders in the requirements elicitation process. Despite the used elicitation method, the requirements can be easily transformed into goal models to present the results in a uniform way. The common requirements across different pilots provided a strong foundation for representing detailed requirements and input for further software development processes. (shrink)

IntroductionDeep brain stimulation (DBS) is utilized to treat pediatric refractory dystonia and its use in pediatric patients is expected to grow. One important question concerns the impact of hope and unrealistic optimism on decision-making, especially in “last resort” intervention scenarios such as DBS for refractory conditions.ObjectiveThis study examined stakeholder experiences and perspectives on hope and unrealistic optimism in the context of decision-making about DBS for childhood dystonia and provides insights for clinicians seeking to implement effective communication strategies.Materials and MethodsSemi-structured interviews (...) with clinicians (n = 29) and caregivers (n = 44) were conducted, transcribed, and coded.ResultsUsing thematic content analysis, four major themes from clinician interviews and five major themes from caregiver interviews related to hopes and expectations were identified. Clinicians expressed concerns about caregiver false hopes (86%, 25/29) and desperation (68.9%, 20/29) in light of DBS being a last resort. As a result, 68.9% of clinicians (20/29) expressed that they intentionally tried to lower caregiver expectations about DBS outcomes. Clinicians also expressed concern that, on the flip side, unrealistic pessimism drives away some patients who might otherwise benefit from DBS (34.5%, 10/29). Caregivers viewed DBS as the last option that they had to try (61.3%, 27/44), and 73% of caregivers (32/44) viewed themselves as having high hopes but reasonable expectations. Fewer than half (43%, 19/44) expressed that they struggled setting outcome expectations due to the uncertainty of DBS, and 50% of post-DBS caregivers (14/28) expressed some negative feelings post treatment due to unmet expectations. 43% of caregivers (19/44) had experiences with clinicians who tried to set low expectations about the potential benefits of DBS.ConclusionThoughtful clinician-stakeholder discussion is needed to ensure realistic outcome expectations. Research on moral cleansing and moral self-licensing has introduced dynamic considerations in the theory of moral behaviour. Past bad actions trigger negative feelings that make people more likely to engage in future moral behaviour to offset them. Symmetrically, past good deeds favour a positive self-perception that creates licensing effects, leading people to engage in behaviour that is less likely to be moral. In short, a deviation from a is balanced with a subsequent action that compensates the prior behaviour. We model (...) the decision of an individual trying to reach the optimal level of moral self-worth over time and show that under certain conditions the optimal sequence of actions follows a regular pattern which combines good and bad actions. To explore this phenomenon we conduct an economic experiment where subjects play a sequence of giving decisions (dictator games). We find that donations in the previous period affect present decisions and the sign is negative: participants' behaviour in every round is negatively correlated to what they did in the past. Hence donations over time seem to be the result of a regular pattern of self-regulation: moral licensing (being selfish after altruistic) and cleansing (altruistic after selfish). (shrink)

We begin by remarking that telling and listening to stories are not an original thesis, especially if interpretive hermeneutics and phenomenology are central references. Academic and institutional settings are diverse if we consider the universe of empirical research grounded on philosophical methods and the teaching universe of practical and clinical disciplines, like psychiatry. The teaching of these disciplines frequently presents them merely as technics. In order to do this, we shall analyse the evolution of the number of ethical funds offered, the growth of its assets, its size, the typology of commercialised funds, and the main companies included in its investment portfolios, showing the importance that socially responsible mutual funds are gaining in Europe over these first few (...) years of the 21st century. Die Spanische Grippe 1918–1920 war mit 50 bis 100 Millionen Toten eines der gravierendsten Seuchenereignisse der Geschichte. Dennoch reagierten westdeutsche Behörden bei zwei weiteren Pandemien 1957/1958 und 1968–1970 mit „geduldige[m] Ausharren“ (Rengeling 2017). Erst ein veränderter Erinnerungsdiskurs führte zu einer „allumfassenden Prävention“, und doch lag die „allumfassende Prävention“ (ebd.) damit noch weit unterhalb dessen, was seit der weltweiten Verbreitung des Corona-Virus SARS-CoV‑2 praktiziert wird.

Among the phenomena that make up the mind, cognitive psychologists and philosophers have postulated a puzzling one that they have called ?epistemic feelings.? This paper aims to (1) characterize these experiences according to their intentional content and phenomenal character, and (2) describe the nature of these mental states as nonconceptual in the cases of animals and infants, and as conceptual mental states in the case of adult human beings. Finally, (3) the paper will contrast three accounts of the causes and (...) mechanisms of epistemic feelings: the doxastic account; the mental scanner account; and the heuristic mechanism account. Supererogatory acts—good deeds “beyond the call of duty”—are a part of moral common sense, but conceptually puzzling. I propose a unified solution to three of the most infamous puzzles: the classic Paradox of Supererogation (if it’s so good, why isn’t it just obligatory?), Horton’s All or Nothing Problem, and Kamm’s Intransitivity Paradox. I conclude that supererogation makes sense if, and only if, the grounds of rightness are multi-dimensional and comparative.

There are plenty of classic paradoxes about conditional obligations, like the duty to be gentle if one is to murder, and about “supererogatory” deeds beyond the call of duty. But little has been said about the intersection of these topics. We develop the first general account of conditional supererogation, with the power to solve familiar puzzles as well as several that we introduce. Our account, moreover, flows from two familiar ideas: that conditionals restrict quantification and that supererogation emerges from a (...) clash between justifying and requiring reasons. (shrink)

When, if ever, do we wrong ourselves? The Self-Other Symmetric answer is: when we do to ourselves what would wrong a consenting other. The standard objection, which has gone unchallenged for decades, is that Symmetry seems to imply that we wrong ourselves in too many cases—where rights are unwaivable, or “self-consent” is lacking. We argue that Symmetry not only survives these would-be counterexamples; it explains and unifies them. The key to Symmetry is not, as critics have supposed, the bizarre claim (...) that we must literally give ourselves consent if we are to avoid wronging ourselves. Instead, it is that we authorize ourselves simply by making decisions, just as we can authorize others by making decisions jointly. (shrink)

Recent debates on mental extension and distributed cognition have taught us that environmental resources play an important and often indispensable role in supporting cognitive capacities. In order to clarify how interactions between the mind –particularly memory– and the world take place, this paper presents the “selection problem” and the “endorsement problem” as structural problems arising from such interactions in cases of mental scaffolding. On the one hand, the selection problem arises each time an agent is confronted with a cognitive problem, (...) since she has to choose whether to solve it internally or externally. How does she choose? On the other hand, when confronted with the internally or externally retrieved solution to a cognitive task, the subject has to decide whether to endorse the information. How does the subject decide whether to endorse it or not? The last section proposes a solution to each problem in terms of metamemory and metacognitive feelings. Metamemory evaluates memory each time the subject is confronted with a memory task and elicits either a positive or negative metacognitive feeling that guides the decision. (shrink)

Two main theories about metacognition are reviewed, each of which claims to provide a better explanation of this phenomenon, while discrediting the other theory as inappropriate. The paper claims that in order to do justice to the complex phenomenon of metacognition, we must distinguish two levels of this capacity—each having a different structure, a different content and a different function within the cognitive architecture. It will be shown that each of the reviewed theories has been trying to explain only one (...) of the two levels and that, consequently, the conflict between them can be dissolved. The paper characterizes the high-level as a rationalizing level where the subject uses concepts and theories to interpret her own behavior and the low-level as a controlling level where the subject exploits epistemic feelings to adjust her cognitive activities. Finally, the paper explores three kinds of interaction between the levels. (shrink)

International criminal law (ICL) is an achievement, but at the same time a challenge to the traditional conception of the principle of legality (_lex praevia_, _scripta_, and _stricta_ – Sect. 1). International criminal tribunals have often based conviction for international crimes on unwritten norms the existence and scope of which they have failed to substantiate. In so doing, they have evaded the objection that they were applying _ex post facto_ criminal laws. This approach, the relaxation of the concept of law (...) by including norms whose existence is doubtful, has apparently served to maintain a concept of strict legality, but it is unsatisfying (Sect. 2). In my opinion, the strict principle of legality that has linked its absolute validity to the positivity of law is not the correct premise. It makes sense to state that positivity and validity do not necessarily go hand in hand (Sect. 3). Applied to ICL, this means that it is neither necessary nor convincing to “conceal” supra-positive law as positive law, as some decisions of the international criminal tribunals do. For this reason, I consider that Radbruch’s formula, consisting in admitting that there are supra-positive limits which positive law must respect in order to be valid, is well-founded (Sect. 4). The path taken by this significant philosopher of law is methodologically convincing, and it squarely faces the problem of the value of positive law. Nevertheless, if we admit Radbruch’s formula and thereby the limited value of positive law (if we claim that the validity of the law depends on it respecting supra-positive minimums of justice), we must also face the problem of the definition of supra-positive values, the epistemological difficulties of having access to them (Sect. 5), and the question of the scope and enforceability of supra-positive law (Sect. 6). In summary, this article aims to explain why Radbruch’s formula offers a convincing conceptual basis for international criminal legality and, in doing so, aims to contribute to the discussion about the foundations of ICL. After 50 years of debate, the ethics of aggregation has reached a curious stalemate, with both sides arguing that only their theory treats people as equals. I argue that, on the issue of equality, both sides are wrong. From the premise that “each counts for one,” we cannot derive the conclusion that “more count for more”—or its negation. The familiar arguments from equality to aggregation presuppose more than equality: the Kamm/Scanlon “Balancing Argument” rests on what social choice theorists call “(Positive) (...) Responsiveness,” Kamm’s “Aggregation Argument” assumes that “equal” lives are fungible, and Hsieh et al. have it that spreading goods broadly best approximates equality. In each case, the crucial premise is not equality itself but a further idea that Taurek, I argue, can safely reject. I conclude with a conjecture: there is no theory-neutral argument that settles the question of whether the numbers count. (shrink)

Why should ‘better than’ be transitive? The leading answer in ethics is that values do not change with context. But this cannot be the entire source of transitivity, I argue, since transitivity can fail even if values never change, so long as they are complex, with multiple dimensions combined non-additively. I conclude by exploring a new hypothesis: that all alleged cases of nontransitive betterness, such as Parfit’s Repugnant Conclusion, can and should be modelled as the result of complexity, not context-relativity.

Consequentialists say we may always promote the good. Deontologists object: not if that means killing one to save five. “Consequentializers” reply: this act is wrong, but it is not for the best, since killing is worse than letting die. I argue that this reply undercuts the “compellingness” of consequentialism, which comes from an outcome-based view of action that collapses the distinction between killing and letting die.

The cognitive phenomenology thesis claims that “there is something it is like” to have cognitive states such as believ- ing, desiring, hoping, attending, and so on. In support of this idea, Goldman claimed that the tip-of-the-tongue phe- nomenon can be considered as a clear-cut instance of non- sensory cognitive phenomenology. This paper reviews Goldman's proposal and assesses whether the tip-of-the- tongue and other metacognitive feelings actually constitute an instance of cognitive phenomenology. The paper will show that psychological data cast doubt (...) on the idea that the tip-of-the-tongue and other metacognitive feelings are clear-cut instances of cognitive phenomenology. (shrink)
