An ethics consultant’s scope of practice is best understood as equipping stakeholders to achieve closure over time following after the ethics consultation. This is in contrast to Autumn Fiester’s position in the article, “Neglected Ends: Clinical Ethics Consultation and the Prospects for Closure,” where she claims that moral closure is a necessary condition for the proper completion of an ethics consultation case.

Leftist political theory remains trapped between two dominant conceptions of sovereignty: the liberal conception of popular sovereignty and the decisionist conception of sovereignty as the power to declare a state of exception. This essay offers a historical critique of the liberal and decisionist conceptions of sovereignty and develops a descriptive theory of aristocratic sovereignty, which is more suited to the history and the needs of radical political theory and praxis. By tracing the genealogy of sovereignty through early modern European political (...) thought to the founding of the United States, this essay reveals the debilitating shortcoming of notions of sovereignty derived from both Carl Schmitt and the liberal tradition and provides a basis for a distinctively radical analysis of the sovereign aristocracy in Amerika. This article critically reconstructs militant democracy’s ‘institutional conservatism’, a theoretical preference for institutions that restrain transformation. It offers two arguments, one historical and one normative. Firstly, it traces a historical development from a substantive to a procedural version of institutional conservatism from the traditional militant democratic thought of Schmitt, Loewenstein and Popper to the contemporary militant democratic theories of Kirshner and Rijpkema. Substantive institutional conservatisms theorize institutions that hinder transformation of the existing order; procedural conservatisms encourage transformation but contain (...) and limit it within the boundaries of existing institutions. Secondly, the article uses resources internal to this historical reconstruction to make the normative case that even the procedural version of institutional conservatism, which characterizes contemporary theories of militant democracy, is problematic from a democratic perspective. The reason for this is that it unjustifiably restricts fundamental democratic change to existing institutions. In conclusion, the article calls for further engagement with modes of democratic defence that do not limit the possibility of radical democratic change but nevertheless enable the protection of democratic institutions against authoritarian regression. A popular principle about grounding, “Internality”, says that if A grounds B, then necessarily, if A and B obtain, then A grounds B. I argue that Internality is false. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. I construct a new theory.

Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

Hogan argues that the basis of interpretive method is ordinary inferential reasoning - that there is no general methodological difference between interpretation in the humanities and theory construction in the physical sciences. Further, the nature of interpretation does not entail cultural, historical, or other forms of relativism, as is commonly thought. However, this does not imply that there is only one way of approaching interpretation or that there is one true meaning of any particular work. Rather, there are many kinds (...) of interpretation and many kinds of meaning and the interpreter is free to stipulate one of these in the context of a particular enquiry. More exactly, discussing the constraints upon stipulation, Hogan says that, although there are a large number and variety of intents (those of authors and readers, conscious and unconscious), there are no nonintentional meanings - Platonic, social, essential, or otherwise. The Polymath Project is an online collaborative enterprise that was initiated in 2009, when Timothy Gowers asked whether and how groups could work together to solve mathematical problems that “do not naturally split up into a vast number of subtasks.” Gowers proposed to answer this question himself by actually trying to set up such a collaboration, based on interactions taking place in the comment-threads of a series of posts on a WordPress blog. Hence, the first project officially started in early (...) 2009, to be proclaimed successful only 6 weeks later (Gowers and Nielsen 2009). From its inception until April 2018, 15 more Polymath problems (and a handful of smaller or related ones) have been launched. These projects have attracted attention from different scholarly communities, including the philosophy of mathematical practices, from the perspective of which the Polymath Project can be seen as a vast repository of mathematics in action. This chapter continues previous work by its authors on the topic in question and topics related. More specifically, for the purposes of this volume, it is our aim to both summarize and expand upon these earlier contributions. The starting point is the above observation that in the past decade, the issue of “massively collaborative mathematics” (to be qualified below) has drawn quite some attention. However, does it also warrant intensive philosophical attention in particular? For, as exciting as these developments might be from mathematical and other points of view, the enhanced possibilities that have come with it do not per se give rise to any philosophical import. In Van Bendegem (2011), one of us has indeed tentatively argued for the philosophical relevance of these new dynamics of proof construction flowing from the wide availability and efficiency of Internet technology. This modern, advanced textbook reviews modal logic, a field which caught the attention of computer scientists in the late 1970's.

According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. Soren Kierkegaard, one of the most original thinkers of the nineteenth century, wrote widely on religious, psychological, and literary themes. Descartes with his sharp separation of the mental and the physical set the stage for the philosophy of mind for the next 350 years. Philosopher Patrick T. Mackenzie finds in the later writings of Wittgenstein the suggestion that Descartes got off on the wrong foot. Following Wittgenstein's lead, Mackenzie argues that instead of analyzing our human nature as a composite of mind and body, we should view ourselves as whole persons. One of the dividends of this approach to the (...) mind-body problem is that it provides us with a resolution to the problem of human freedom—i.e., how can a human being be free if his or her body (including the brain) belongs to a deterministic world? Mackenzie here argues that the person is largely free even though the movements of the body are determined by neurophysiological events. Why do humans make music? Theories of the evolution of musicality have focused mainly on the value of music for specific adaptive contexts such as mate selection, parental care, coalition signaling, and group cohesion. Synthesizing and extending previous proposals, we argue that social bonding is an overarching function that unifies all of these theories, and that musicality enabled social bonding at larger scales than grooming and other bonding mechanisms available in ancestral primate societies. We combine cross-disciplinary evidence from archeology, anthropology, (...) biology, musicology, psychology, and neuroscience into a unified framework that accounts for the biological and cultural evolution of music. We argue that the evolution of musicality involves gene–culture coevolution, through which proto-musical behaviors that initially arose and spread as cultural inventions had feedback effects on biological evolution because of their impact on social bonding. We emphasize the deep links between production, perception, prediction, and social reward arising from repetition, synchronization, and harmonization of rhythms and pitches, and summarize empirical evidence for these links at the levels of brain networks, physiological mechanisms, and behaviors across cultures and across species. Finally, we address potential criticisms and make testable predictions for future research, including neurobiological bases of musicality and relationships between human music, language, animal song, and other domains. The music and social bonding hypothesis provides the most comprehensive theory to date of the biological and cultural evolution of music. (shrink)

This paper develops and refines the suggestion that logical systems are conceptual artefacts that are the outcome of a design-process by exploring how a constructionist epistemology and meta-philosophy can be integrated within the philosophy of logic.

Carl Schmitt veröffentlichte einen Großteil seiner wichtigen Werke im Verlag Duncker & Humblot. Im Zuge der engen Zusammenarbeit mit dem damaligen Verlagsleiter Ludwig Feuchtwanger entwickelte sich ein reger intellektueller, anspielungsreicher Austausch auf Augenhöhe zwischen Autor und Verleger. Ludwig Feuchtwanger, ein heute nahezu vergessener Intellektueller der jüdischen Renaissance nach dem Ersten Weltkrieg, vermochte es, auf Schmitts Interessen einzugehen und diese z.T. zu lenken. Dieser nun erstmals edierte Briefwechsel zeichnet ein Bild zweier Gelehrter in der Weimarer Republik, veranschaulicht u.a. auch die (...) materielle Lage eines wissenschaftlichen Autors und gibt Einblick in den damaligen Buchmarkt. Daneben finden sich Bausteine zur Biographie Carl Schmitts und Ludwig Feuchtwangers sowie ihren intellektuellen Netzwerken. Der Briefwechsel dokumentiert zugleich aber auch das Scheitern einer Freundschaft. (shrink)

Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Partant du débat qui oppose les orientations sémiologique et esthétique, l'auteur propose une troisième voie qui, comme les deux autres, vise à rendre compte de la perception esthétique du film, mais, au lieu de s'enfermer dans l'antinomie discours-figure, ou représentation-visibilité, problématise le fait de " l'impossible à représenter " dans sa confrontation avec le langage et le visible. Ce projet peut être considéré, selon l'auteur, comme une poétique, en un sens plus radical que la notion traditionnelle ou son prolongement chez (...) les formalistes russes, étant donné le thème de " l'articulation des signifiants à l'impossible " - une poétique qui procède de la crise de la représentation dans certains films (Duras) et trouve ses principaux instruments dans la psychanalyse. La première partie du livre explore deux propositions majeures de poétique, comme étude du discours et comme approche du sensible, puis les met à l'épreuve du cinéma de Duras, avant d'utiliser les conclusions de cette partie pour instaurer un débat épistémologique autour de la théorie psychanalytique du sujet divisé, laquelle permet d'accéder à la problématique centrale du livre : la rencontre avec le réel comme impossible. In diesem Beitrag wollen wir zeigen, wieso die Fachdidaktik Philosophie und Ethik (neue) Ansätze entwickeln muss, um dem Anspruch auf (philosophische) Bildung von Menschen mit sonderpädagogischem Förderbedarf gerecht zu werden. Dafür zeigen wir anhand von Schüler_innen mit eingeschränkten Kommunikationsmöglichkeiten auf, wie Philosophieren mit ihnen dennoch möglich ist. Gleichzeitig wenden wir uns im Beitrag dem Haupteinwand zu, der darin besteht, dass Philosophieren mit dieser Schüler_innengruppe nicht möglich sei. Wir erklären unter welchen Umständen dieser Einwand nicht aufrecht erhalten werden sollte, sondern vielmehr (...) eine moralische Pflicht besteht, Menschen mit Behinderung philosophische Bildungsprozesse zu ermöglichen. The author explores how Catholic social teaching and the principle of the common good can be successfully deployed in the public sphere, be it in relation to education, economics, democracy or civil rights.

Up to now theories of semantic information have implicitly relied on logical monism, or the view that there is one true logic. The latter position has been explicitly challenged by logical pluralists. Adopting an unbiased attitude in the philosophy of information, we take a suggestion from Beall and Restall at heart and exploit logical pluralism to recognise another kind of pluralism. The latter is called informational pluralism, a thesis whose implications for a theory of semantic information we explore.

Sets itself the Herculean task of comparing and reconciling the modern and Platonic concepts of rationality.

Der Mensch als Subjekt ethisch-moralischen Handelns lässt sich in der Gegenwart nur noch selten von den Forderungen antreffen, die die Ethik an ihn stellt. Die in dieser Arbeit angeführten Autoren - allesamt Phänomenologen - sehen den Grund dafür in einem überholten Welt- und Menschenbild der Ethik. Gleichzeitig entwickeln sie eine faszinierende Alternative für die Konstitution von Subjektivität. Damit eröffnen sie der philosophischen und der theologischen Ethik ein neues Verständnis dessen, womit es jede Ethik an erster Stelle zu tun hat: Mit (...) dem einzelnen Menschen als Gestalter eines sittlich-moralischen Handelns.
