Background In this study, we examined the ethical implications of Egypt’s new clinical trial law, employing the ethical framework proposed by Emanuel et al. and comparing it to various national and supranational laws. This analysis is crucial as Egypt, considered a high-growth pharmaceutical market, has become an attractive location for clinical trials, offering insights into the ethical implementation of bioethical regulations in a large population country with a robust healthcare infrastructure and predominantly treatment-naïve patients. Methods We conducted a comparative (...) analysis of Egyptian law with regulations from Sweden and France, including the EU Clinical Trials Regulation, considering ethical human subject research criteria, and used a directed approach to qualitative content analysis to examine the laws and regulations. This study involved extensive peer scrutiny, frequent debriefing sessions, and collaboration with legal experts with relevant international legal expertise to ensure rigorous analysis and interpretation of the laws. Results On the rating of the seven different principles (social and scientific values, scientific validity, fair selection of participants, risk-benefit ratio, independent review, informed consent and respect for participants) Egypt, France, and EU regulations had comparable scores. Specific principles (Social Value, Scientific Value, and Fair selection of participants) were challenging to directly identify due to certain regulations embodying 'implicit' principles more than explicitly stated ones. Conclusion The analysis underscores Egypt's alignment with internationally recognized ethical principles, as outlined by Emanuel et al., through its comparison with French, Swedish, and EU regulations, emphasizing the critical need for Egypt to continuously refine its ethical regulations to safeguard participant protection and research integrity. Key issues identified include the necessity to clarify and standardize the concept of social value in research, alongside concerns regarding the expertise and impartiality of ethical review boards, pointing towards a broader agenda for enhancing research ethics in Egypt and beyond. When Western philosophy was introduced to Indian academia in the late nineteenth century, there arose for Indian philosophers a two-fold need: the need to preserve the self-identity of Indian philosophy and the need to dialogue with Western philosophy. In their attempt to defend the distinctiveness of Indian philosophy, the philosophers of the first half of the twentieth century affirmed that classical Indian philosophy was essentially spiritual. The philosophers of the second half of the twentieth century, however, did not have a (...) compulsion to defend Indian philosophy in the face of Western philosophy. Many of them critiqued the traditional view about classical Indian philosophy. For them classical Indian philosophy, too, was a rational discourse and it is equally capable to contribute to the enrichment of philosophy. Today the two traditions—Indian and Western—are known to each other fairly well and hence there is little need to pursue comparative philosophy as a distinct discipline in philosophy. Hermeneutic philosophy, and Paul Ricoeur’s formulation of hermeneutics in particular, faces a serious challenge, not from external sources, but from internal proponents of the program. In what might be called the Collapse Challenge, Ricoeur’s understanding of the hermeneutic circle is criticized for making use of structuralist methods that are no longer considered viable. Rather than look to replace Ricoeur’s work with an external model, the present essay draws on his late model of translation to suggest two viable paths forward beyond (...) the Collapse Challenge. In order to develop a true biological science of consciousness, we have to remove humans from the center of reference and develop a bottom-up comparative study of animal minds, as Donald Griffin intended with his call for a “cognitive ethology.” In this article, I make use of the pathological complexity thesis (Veit 2022a, b, c ) to show that we can firmly ground a comparative study of animal consciousness by drawing on the resources of state-based behavioral life history (...) theory. By comparing the different life histories of gastropods and arthropods, we will be able to make better sense of the possible origins of consciousness and its function for organisms in their natural environments. In The Philosophy of Change, the distinguished scholar of Chinese philosophy Chung-ying Cheng advances our understanding of the Yijing by analyzing its philosophy in comparison to Western philosophical traditions. Drawing upon theories preserved in Buddhist and Western philosophies, authors in this collection present a diversity of viewpoints to advance the current philosophical discussion and, thus, add "new possibilities for thinking about old questions" (p. 7). In appreciating the intellectual insights and diverse voices from non-Western philosophical traditions, all the eight chapters in this volume make philosophical research, both in content and method, more inclusive.That is why contributors to this volume do not follow the traditional way of sorting philosophical inquiries into subfields, such as epistemology, metaphysics, or ethics. Rather, their chapters revolve around major philosophical questions that make these subfields possible. As such, they not only make philosophical writings more accessible to non-specialists, but also introduce readers to the practice of philosophy itself. As remarked by Gilles Deleuze, "the truth is that in philosophy and even elsewhere it is a question of finding the problem and consequently of positing it, even more than of solving it."1 Indeed, a true philosophical question does not predetermine its answers and, thus, cannot be resolved with a simple "yes" or "no." Rather, by reconceptualizing the presumptions that constitute a philosophical problem, people can reimagine philosophy as a field and rethink philosophical practice as a meaningful way of life.Following this line of reasoning, Chapter 1 asks the question of how we should live (p. 23). Expanding the widely held understanding of happiness as merely "subjective well-being," Stephen J. My paper sets out to compare neuroaesthetics and transcendental philosophy, concerning the perception of schemes of imitation in aesthetic experience. The argument is structured in four steps: first, I will introduce the function of schemes in mirror-neuron-based processes and in general in the embodiment theory of Mark Johnson and George Lakoff; second, I will consider some analogical relations between a transcendental approach and neuroaesthetics concerning semantics; third, starting with the statement that one open question in neuroaesthetics is how creativity emerges, (...) We point out how some Christian-Muslim comparative philosophies of religion may be enhanced with certain translations or interpretations of Christianity: a modalist view of the trinity and a high Christology. While perhaps of only limited significance, we argue in more detail that a comparison of two leading philosophers, one Islamic, the other Christian, can bring to light a shared philosophy of innate ideas or nativism, grounding moral and theological views of goodness and the divine.

Comparative philosophy and religion can help us to understand the violence and terrror that often dominate our world. These new, creative studies - ranging in scope from ancient Biblical, Greek, Indian, and Chinese formulations to recent religious and philosophical positions - broaden and deepen our understanding of terror and present new possibilities for greater nonviolence, peace, and true security.

In this article I intend, on the basis of some previous relevant works on the issue, to further examine a range of conditions for maintaining adequate methodological guiding principles concerning how to look at the relation between distinct methodological perspectives in comparative-engagement exploration in philosophy. Paperback $40.28, isbn 978-1-350-29704-3.The editors Steven Burik, Robert Smid and Ralph Weber, who have all made important (...) revisions to the theory of comparative philosophical method, have pulled together the contributions of ten other influential scholars in the field and their own work into this much-needed collection of essays. There has been much written about the methodology of comparative philosophy in the last hundred years. More recent reflections in this field have been strongly fueled by post-colonial evaluations as well as a proliferation of methodological approaches. Nonetheless, some consensus on what methods the field should adopt and to what ends still needs overt discussion. The editors argue in an Introduction and Epilogue to the volume that, now faced with the "obstacles" of often conflicting principles and aims of different methodological approaches which leads to their frequent mutual rejection, there is need for a wide acceptance of pluralism in the methodology of comparative philosophy (pp. 4–5). This methodological pluralism, for the editors, should be understood in two senses. Firstly, there should be a broad-based "methodological commitment to pluralism," which amounts to an acceptance that there is an existing plurality of philosophical traditions in the world which have very different foundational insights and worldviews (p. 254). Secondly, the fact that the plurality of philosophical traditions actually exhibits quite different approaches ought, despite any individual comparativist's preferred method, compel us to accept that this diversity is best dealt with by a plurality of research approaches (pp. 254–55). That is to say that, while the editors both acknowledge and endorse the particular specializations of any and all scholars engaged in intercultural philosophy, they urge each scholar to accept that both a descriptive and prescriptive pluralism of philosophical methodologies are necessary for the continued flourishing of the field. In order to demonstrate this descriptive and prescriptive pluralism, the editors organize the volume into what they call five "constellations" of discussion (p. 8).In the first "constellation" labeled "Necessary Conditions," Robert Neville, Jaap [End Page 1] van Brakel and Lin Ma offer general and detailed frameworks for what sorts of assumptions are needed for any comparative philosophical research to proceed fruitfully. Van Brakel and Ma present in their co-authored essay an elaborate blueprint for comparative research. This blueprint, while also conceding that there can never be "any one right interpretation" of any individual text, much less whole traditions, posit a basic "family resemblance principle" which highlights "mutually recognizable human practices" as the basic condition enabling comparative reflection in the first place (pp. 34–39).In the second "constellation," entitled "Generalization and Essentialization," Roger Ames and François Jullien insist in various ways that, while the essentialism that bedeviled previous eras of philosophy in general and comparative philosophy in particular should be rejected, generalizations are still fundamentally necessary to crystalize the most important ways in which traditions are distinct from one another. Ames, defending himself against recent allegations of essentialism in his approach, insists that the field needs to be supported by both a "self-reflective hermeneutical sensitivity" which acknowledges the positionality of the inquirer as well as a commitment to "search within the soil" of, in his case, the Chinese philosophical tradition for its own models of meaning (p. 58). Comparison is fundamental to the practice and subject-matter of philosophy, but has received scant attention by philosophers. This is even so in “comparative philosophy,” which literally distinguishes itself from other philosophy by being “comparative.” In this article, the need for a philosophy of comparison is suggested. What we compare with what, and in what respect it is done, poses a series of intriguing and intricate questions. In Part One, I offer a problematization of the tertium comparationis (the third (...) of comparison) by examining conceptualizations of similarity, family resemblance, and analogy, which it is sometimes argued can do without a tertium comparationis. In Part Two, I argue that a third of comparison is already required to determine what is to be compared, and insofar as that determination precedes the comparison that tertium may be called “pre-comparative.” This leads me to argue against incomparability and to show how anything can indeed be compared to anything. In Part Three, I relate my arguments to what is today commonly labelled “comparative philosophy.” Finally, I raise some questions of ontology and politics in order to demonstrate the relevance of a philosophy of comparison. Arguments for multiple realization depend on the idea that the same kind of function is realized by different kinds of structures. It is important to such arguments that we know the kinds used in the arguments have been individuated properly. In the philosophical literature, though, claims about how to individuate kinds are frequently decided on intuitive grounds. This paper criticizes this way of approaching kinds by considering how practicing researchers think about the matter. Many philosophers hold that generics (i.e., unquantified generalizations) are pervasive in communication and that when they are about social groups, this may offend and polarize people because generics gloss over variations between individuals. Generics about social groups might be particularly common on Twitter (X). This remains unexplored, however. Using machine learning (ML) techniques, we therefore developed an automatic classifier for social generics, applied it to 1.1 million tweets about people, and analyzed the tweets. While it is often suggested that generics (...) are ubiquitous in everyday communication, we found that most tweets (78%) about people contained no generics. However, tweets with generics received more “likes” and retweets. Furthermore, while recent psychological research may lead to the prediction that tweets with generics about political groups are more common than tweets with generics about ethnic groups, we found the opposite. However, consistent with recent claims that political animosity is less constrained by social norms than animosity against gender and ethnic groups, negative tweets with generics about political groups were significantly more prevalent and retweeted than negative tweets about ethnic groups. The purpose of this paper is to address some of the questions on the notion of agent and agency in relation to property and personhood. I argue that following the Kantian criticism of Aristotelian metaphysics, contemporary biotechnology and information and communication technologies bring about a new challenge—this time, with regard to the Kantian moral subject understood in the subject’s unique metaphysical qualities of dignity and autonomy. The concept of human dignity underlies the foundation of many democratic systems, particularly in Europe (...) as well as of international treaties, including the Universal Declaration of Human Rights. Digital agents, artificial organisms as well as new capabilities of the human agents related to their embeddedness in digital and biotechnological environments bring about an important transformation of the human self-appraisal. A critical comparative reflection of this transformation is important because of its ethical implications. I deal first with the concept of agent within the framework of Aristotelian philosophy, which is the basis for further theories in accordance with and/or in opposition to it, particularly since modernity. In the second part of this paper, I deal with the concept of personhood in Kantian philosophy, which supersedes the Aristotelian metaphysics of substance and builds the basis of a metaphysics of the moral human subject. In the third part, I discuss the question of artificial agents arising from modern biology and ICT. Blurring the difference between the human and the natural and/or artificial opens a “new space” for philosophical reflection as well as for debate in law and practical policy. (shrink)

The idea that thought and language can be clarified through logical methods seems problematic because, while thought and language are not always exact, logic (by its very nature) must be. According to Kuusela, ideal (ILP, represented by Frege and Russell) and ordinary language philosophy (OLP, represented by Strawson) offer opposed solutions to this problem, and Wittgenstein combines the advantages of both. I argue that, given Kuusela’s characterisation of OLP, Strawson was not an OLP’er. I suggest that, instead of seeing ILP (...) and OLP as opposed to one another, it is better to regard OLP as an extension of ILP. (shrink)

This paper seeks to highlight the East‐West asymmetry in philosophical exchanges. It draws attention to the absence of Eastern thought in the curriculum of philosophy in the West and suggests that cliches and stereotypes about cultures in general and thought‐traditions in particular are perpetuated in this manner. The aim of the paper is to encourage ‘cross‐cultural conversation’ among philosophers. A critical review of the project of ‘comparative philosophy’ is made to disclose the fact that despite the difficulties of such (...) an endeavor, it is an attempt to bring thought‐traditions together and is thereby useful for promoting intercultural understanding. Kant’s analysis of the concept of natural purpose in the Critique of judgment captured several features of organisms that he argued warranted making them the objects of a special field of study, in need of a special regulative teleological principle. By showing that organisms have to be conceived as self-organizing wholes, epigenetically built according to the idea of a whole that we must presuppose, Kant accounted for three features of organisms conflated in the biological sciences of the period: adaptation, functionality (...) and conservation of forms..Kant’s unitary concept of natural purpose was subsequently split in two directions: first by Cuvier’s comparative anatomy, that would draw on the idea of adaptative functions as a regulative principle for understanding in reconstituting and classifying organisms; and then by Goethe’s and Geoffroy’s morphology, a science of the general transformations of living forms. However, such general transformations in nature, objects of an alleged ‘archaeology of nature’, were thought impossible by Kant in the §80 of the Critique of judgment. Goethe made this ‘adventure of reason’ possible by changing the sense of ‘explanation’: scientific explanation was shifted from the investigation of the mechanical processes of generation of individual organisms to the unveiling of some ideal transformations of types instantiated by those organisms. The goal of this article is modest. It is simply to help illuminate the nature of egalitarianism. More particularly, I aim to show what certain egalitarians are committed to, and to suggest that equality, as these egalitarians understand it, is an important normative ideal that cannot simply be ignored in moral deliberations. In doing this, I distinguish between equality as universality, equality as impartiality, and equality as comparability, and also between instrumental and non-instrumental egalitarianism. I then characterise the version of (...) egalitarianism with which I am concerned, which I call equality as comparative fairness. I discuss the relations between equality, fairness, luck, and responsibility, and defend egalitarianism against rival views that focus on subsistence, sufficiency, or compassion. I also defend egalitarianism against the Levelling Down and Raising Up Objections, and present several key examples to illustrate egalitarianism's distinct appeal, in contrast to prioritarianism's. I conclude by considering two common questions about my view: first, whether my ultimate concern is really with comparative fairness, rather than equality, so that my view is not, in fact, a substantive, non-instrumental version of egalitarianism, and second, whether my view ultimately reduces to a theory about desert. For various reasons, that will be recalled and analysed throughout this paper, interdisciplinarity has become the keyword for any debate on legal education reform. However, what is meant by interdisciplinarity and how it should be achieved is open for discussion. Paradigms of “scientificity” of the law vary dramatically among legal cultures. Whereas in the US the advent of a more ‘substantial’ legal thought after the New Deal went hand in hand with the rise of the interdisciplinary paradigm, in Europe the (...) traditional assumption of law’s autonomy has repeatedly been challenged, eroded and adapted, but it still represents the bulwark of the orthodox approach to law and legal scholarship. In the Continent, mainstream legal scholarship does not take as its object the social reality, but only the gamut of rules recognized as binding norms. Coherent with this approach is a model of legal education built around certain axioms, such as the statist and nationalist attitude, the extreme compartmentalization among the various branches of law, and the blindness to its surroundings. Comparative law is one of the few disciplines that provide a different role model for a legal scholar who is apt to confront the challenges of complex societies. Keeping at a reasonable distance the authority paradigm, embodying the spirit of enquiry and cherishing the values of pluralism (both in terms of legal pluralism and cognitive openness), comparativists may give specific content to the paradigm of the jurist as a social engineer. Comparative law may therefore offer an invaluable contribution to the debate on legal education reform. (shrink)

This article examines various models of legal interpretation and their implications for comparative law, drawing inspiration from Rodolfo Sacco’s early career theories. It contrasts the Tarskian Correspondence Model, which seeks objective reality in legal texts, with the Symphonic Model, which interprets legal language as a harmonious interplay of elements. The Tarskian model reflects classical legal thought’s search for fixed meanings, while the Symphonic model aligns with contemporary legal practice’s nuanced understanding. Further, the article explores Heraclitean Realism, acknowledging the fluidity (...) of language and meaning, and the Provocative Tapestry Model, which introduces paradox and tension in legal interpretation. These models are likened to narrative genres, offering varied approaches to understanding legal discourse: the Tarskian model as a detective novel, the Symphonic model as a comedy, the Living Tapestry model as a melodrama, and the Provocative Tapestry model as a tragedy. The article argues that these models of legal interpretation do not inherently carry a political essence; the political stance emerges from the choices of interpreters. It emphasizes the need for human agency in the application of legal norms and the responsibility of legal professionals to actively engage in the interpretation process. Comparative law is discussed as a discipline that benefits from understanding these diverse interpretative models, as it seeks to analyze legal systems across jurisdictions. The article concludes that while narrative styles in legal interpretation have political histories, they are not bound to specific ideologies, highlighting the versatility and subjectivity in the field of legal interpretation. In this essay I offer an alternative perspective on how to organize class material for courses in Chinese philosophy for predominately American students. Instead of selecting topics taken from common themes in Western discourses, I suggest a variety of organizational strategies based on themes from the Chinese texts themselves, such as tradition, ritual, family, and guanxi (關係), which are rooted in the Chinese tradition but flexible enough to organize a broad range of philosophical material.

This essay challenges the claim that fusion philosophy is the successor to comparative philosophy. Comparative philosophy should find itself deeply at odds with the approach to various philosophical problems and traditions that fusion philosophy is taking, and comparative philosophers will surely deny Mark Siderits’1 claim that they have been superseded. The manner then in which fusion philosophy dismisses comparativist concerns and objections is to admit that such objections are valid in some case but to deny that they (...) are intrinsic to good fusion philosophy. Comparativists however generally do not claim that fusion philosophy is necessarily or inherently bound to make the mistakes and contribute to misunderstandings that they claim it often does. Their claim is that from the start such philosophy often does make just these kinds of problematic errors and assumptions, and that this is what comparativist philosophy must seek to avoid. By the time fusionists are done defending – actually 'sanitizing' – fusion philosophy from comparativist objections, one is left not with fusion philosophy but with what is – from the comparativist perspective – comparative philosophy. The adoption of a comparative method in research on the thought of Mao Zedong is essential. In the past, study in this area has frequently concentrated on the thought of Mao Zedong itself and there has been no attempt at a comprehensive comparison of it within a world-wide context.

A widespread assumption in experimental comparative cognition is that, barring compelling evidence to the contrary, the default hypothesis should postulate the simplest cognitive ontology consistent with the animal’s behavior. I call this assumption the principle of cognitive simplicity . In this essay, I show that PoCS is pervasive but unjustified: a blanket preference for the simplest cognitive ontology is not justified by any of the available arguments. Moreover, without a clear sense of how cognitive ontologies are to be carved (...) up at the joints—and which tools are appropriate for the job—PoCS rests on shaky conceptual ground. (shrink)

While pragmatic arguments for numerical probability axioms have received much attention, justifications for axioms of qualitative probability have been less discussed. We offer an argument for the requirement that an agent’s qualitative judgments be probabilistically representable, inspired by, but importantly different from, the Money Pump argument for transitivity of preference and Dutch book arguments for quantitative coherence. The argument is supported by a theorem, to the effect that a subject is systematically susceptible to dominance given her preferred acts, if and (...) only if the subject’s comparative judgments preclude representation by a standard probability measure.
