El aumento en la producción y consumo de frutas y hortalizas mínimamente procesadas de los últimos años ha con­tribuido a incrementar las toxiinfecciones alimentarias asociadas al consumo de productos vegetales frescos. Esto es debido a que los tratamientos desinfectantes llevados a cabo actualmente por industria de IV gama son insuficientes para garantizar la seguridad microbiológica de los productos finales, y además estos no reciben ningún tratamiento capaz de eliminar todos los patógenos antes de su consumo. Por lo tanto, es necesario (...) utilizar estrategias al­ternativas para reducir los microorganismos patógenos y alteran­tes en frutas y hortalizas. La bioconservación, mediante el uso de microorganismos o sus metabolitos, es una alternativa que, en combinación con las prácticas habituales, puede reducir o prevenir el crecimiento de patógenos en productos mínimamente procesa­dos, mejorando su calidad microbiológica. While recent studies have claimed that non-referential gestures are used to mark discourse-new and/or -accessible referents and focused information in adult speech, to our knowledge, no prior investigation has studied the relationship between information structure and gesture referentiality in children’s narrative speech from a developmental perspective. A longitudinal database consisting of 332 narratives performed by 83 children at two different time points in development was coded for IS and gesture referentiality. Results revealed that at both time points, both referential and (...) non-referential gestures were produced more with information that moves discourse forward and predication rather than topical or background information. Further, at 7–9 years of age, children tended to use more non-referential gestures to mark focus and comment constituents than referential gestures. In terms of the marking of the newness of discourse referents, non-referential gestures already seem to play a key role at 5–6 years old, whereas referential gestures did not show any patterns. This relationship was even stronger at 7–9 years old. All in all, our findings offer supporting evidence that in contrast with referential gestures, non-referential gestures have been found to play a key role in marking IS, and that the development of this relationship solidifies at a period in development that coincides with a spurt in non-referential gesture production. La presencia de estos compuestos ha sido demostrada en una amplia variedad de materias primas, alimentos y piensos, en los que lo habitual es encontrar de for­ma frecuente una contaminación múltiple por diferentes mico­toxinas, en pequeñas cantidades, lo que puede generar efectos tóxicos subcrónicos, así como bioacumulación. Este artículo revisa los (...) principales elementos que configuran la problemática de las micotoxinas para el hombre y los animales, y aborda los retos de futuro que se plantean en el estudio de las micotoxinas, entre los que destacan el efecto que el cambio climático puede tener sobre el patrón de contaminación por micotoxinas en los alimentos, el descubrimiento creciente de nuevas micotoxinas en formas modificadas, la evaluación de la coexistencia de estas to­xinas y otros contaminantes, y las formas para detectar e intentar eliminar estos compuestos tóxicos de los alimentos. Research on salesperson creativity remains as one of the most under-researched topics in the sales literature despite the evidence that encouraging creativity in the sales domain is a source of competitive advantage. This paper aims to fill this research gap by exploring the influence of perceived ethical climate on salesperson creative performance, paying special attention to the role that emotions play in this process. Data provided by 176 supervisor–salesperson dyads confirm that the trust/responsibility dimension of an ethical climate is positively (...) related to salesperson creative selling by increasing salespeople's organizational pride. Similarly, the perception of unethical selling practices negatively affects salesperson organizational pride, reducing the expression of creative behaviors. Moreover, the negative effect of unethical selling practices on creative performance is stronger (more negative) when salespeople's identification with an organization increases. Managerial implications and future research directions are also addressed. (shrink)

This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. The stream on political corporate social responsibility argues that companies have recently assumed state-like roles to influence global governance. However, following emerging calls for greater contextualization of CSR, we trace the historic evolution of PCSR in the case of Colombia and argue that such political engagement by firms is not new. Looking beyond a linear chronological account, we reveal the sedimentation process behind PCSR by exploring the archetypical political roles businesses have taken on in providing public goods and acting as (...) regulators, and chart their transformation. Our findings allow us to make two main contributions. First, by unearthing different strata of business and society relations, we enrich the research on PCSR, highlighting its historical sedimentation dynamics. By integrating institutional and historical perspectives, we respond to calls for complementary accounts of one of the premises found in the literature that considers globalization as the starting point of PCSR. Second, our exploration of the past and present of PCSR in Colombia provides scholars and practitioners with an overview of the complex state and stakes of CSR in that country. We also discuss the implications of sedimentation for PCSR theory and future research directions. (shrink)

Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different participating countries: (...) Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. The necessity defense is barely accepted in contemporary Western case law. The courts, relying on the opinion held by the majority of legal scholars, have reduced its margin of application to practically zero, since in the framework of contemporary welfare states, there is almost always a “legal alternative.” The needy person who acts on their own behalf, regardless of whether they save an interest higher than the one they injure, does not show due deference to democratic legal solutions and procedural (...) channels. This article aims to contest this abrogative interpretation of the necessity defense and to outline the limits of its legitimate scope. Even in welfare states, there are actions in a necessity scenario that neither question the legal decisions of the democratically elected legislature nor make a mockery of established procedural channels. Noël Carroll denies and Robert Stecker affirms that it is a necessary condition of aesthetic experience that it should be valued for its own sake. I make use of their controversy to argue for the psychological impossibility of discharging very common practices of art evaluation and analysis without undergoing an aesthetic experience valued for its own sake. By way of supporting my thesis and also making progress in Stecker and Carroll’s dispute about aesthetic experience, I analyse their methodological assumptions and (...) develop further our understanding of negative, indifferent and unexpected aesthetic experiences. Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

I also explore the implications of my proposal for several aspects of Hume’s aesthetics, including the one brought into relief by Shelley’s interpretation of Hume along the lines of distinguishing between the perceptual and affective stages in aesthetic (...) appreciation. Partiendo de la constatación husserliana de la crisis filosófica como crisis vital de una humanidad que se ha desviado de su _télos_ al implantar el modelo tecno-científico del dominio del mundo, el artículo investiga el lugar de la filosofía en el sistema educativo, explorando las reformas propuestas en Baviera y Prusia por Niethammer y Humboldt a principios del siglo XIX y que plantean, cada una a su modo, la necesaria incorporación de la filosofía a una educación de Estado que, frente (...) a las pretensiones utilitarias del filantropismo, logre elevar al hombre a su humanidad. En este sentido, retorna al concepto humanista de formación (_Bildung_) al que se consagran ambas reformas y que Gadamer recupera precisamente en _Verdad y método_ como un ideal para enfrentar la pretensión de universalidad de la ciencia moderna en relación a las nociones de conocimiento y de verdad, así como para pensar el horizonte ontológico de la experiencia hermenéutica. Es precisamente este ideal el que permite localizar el lugar de la filosofía en el conjunto del saber y conducir al hombre a su humanidad. (shrink)

Nowadays, consumer ethics represents a relevant field of review. There have been some attempts to conduct literature reviews; however, these have been few and incomplete. For this reason, this paper follows two main objectives: (1) to develop a performance analysis to measure the impact/perceptibility of academic production on consumer ethics (most cited authors, journals and themes) and (2) to visually present the scientific structure by themes of research in consumer ethics as well as its evolution along time. Using SciMAT software, (...) a comprehensive thematic review is discussed. 568 scientific papers (2569 keywords and 8642 citations) were retrieved from the Web of Science from 1995 to 2021 (May). Our results show three main periods with two main research themes (consumer and corporate social responsibility), which remain relevant themes at the time. Also, some new themes that promote ethical consumption have gained weight or appear over time, some of which are linked to the marketing field (such as experiences, satisfaction, attitudes or privacy among others). ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. The flowers of the primitive angiosperm plants were radially symmetrical (actinomorphic). Flowers with bilateral symmetry (zygomorphic) evolved in several clades independently as an adaptation to specialized methods of pollination and played an important role in the diversification of flowering plants. In the model species Antirrhinum majus (snapdragon), the related genes CYCLOIDEA (CYC) and DICHOTOMA (DICH) are key in the development of this trait. This raises the question of whether they played a role in the evolution of floral bilateral symmetry. To (...) address this, the evolution of CYC in relation to the evolution of zygomorphy is being investigated. Phylogenetic and functional analyses of CYC‐like genes are being carried out in groups either closely related to Antirhinum or in families where zygomorphy evolved as an independent event. In addition, the origin of zygomorphy is being studied by comparing the function of CYC‐like genes in species with zygomorphic flowers with their function in species with radially symmetrical flowers. ABSTRACT My aim in this paper is to present a pluralist thesis about the inferential role of logical constants, which embraces classical, relevant, linear and ordered logic. That is, I defend that a logical constant c has more than one correct inferential role. The thesis depends on a particular interpretation of substructural logics' vocabulary, according to which classical logic captures the literal meaning of logical constants and substructural logics encode a pragmatically enriched sense of those connectives. The paper is divided (...) into four parts: first, I introduce the motivation for the pluralist thesis of the paper; second I introduce the calculus for the different logics endorsed in the pluralist thesis; third, I motivate how the different behaviors of the logical vocabulary of these logics can be pragmatically interpreted, and fourth, I motivate how the different inferential roles that each substructural logic attribute to logical constants can coexist, and how we should reason with a logical constant c given this plurality. The search for an answer entails at least the following items: (a) the generic concept of a “reason for action” and its distinction from other possible motivations for action; (b) the distinctive elements of a legal reason for action, and its difference from other classes of reasons for action; (c) the correlative (...) concepts of authority and obligation, as applied to Law. This analysis will highlight some descriptive and evaluative achievements in Finnis’ proposal, particularly regarding his positivist predecessors, but also some theoretical difficulties, which we presume are linked to Finnis’ aim in trying to conciliate Legal Positivism and Natural Law Theory.Resumen:Este estudio intenta responder a la siguiente pregunta: ¿cómo introduce John M. Finnis en la teoría ius-naturalista del derecho, la idea hartiana y raziana de que el derecho proporciona razones excluyentes para la acción? En la búsqueda de una respuesta se abordarán los siguientes ejes temáticos: (a) el concepto genérico de razón para actuar, y su distinción de otras motivaciones posibles para la acción; (b) los rasgos propios de la razón jurídica para obrar, que la diferencian de otro tipo de razones para la acción; (c) los conceptos correlativos de autoridad y obligación en referencia al derecho. En este análisis se señalarán algunas fortalezas en la propuesta de Finnis con respecto a sus predecesores de la tradición positivista, pero también algunas debilidades descriptivas e inconsistencias teóricas. Estas dificultades se presumen ligadas a la dificultad de Finnis en su intento de conciliar el aparato conceptual heredado de la tradición iuspositivista, con el esquema conceptual heredado de la tradición iusnaturalista y, más ampliamente, con la epistemología práctica tomista que recoge de esta tradición. The claim of this paper is to argue contra Waluchow’s and Raz’s versions of legal positivism – as main representatives of the inclusive and exclusive variants – that legal interpretation always requires an appeal to law’s rea- son or purpose. The main thesis could be expressed as follows: one technique of legal interpretation (the author labels it as systematical), one that demands that the interpreter interprets the law through its general pur- poses in legal practice, is not one technique amongst (...) many, it is necessary in all legal interpretation.The second purpose of the paper is to argue that this systematic approach towards legal interpretation enables an evaluative role on the part of the interpreter that may be called “interpretative creativity”. Due to this, the creative role in legal interpretation is not an exception, but a necessary element in all interpretation. This creative role is not a defect or an inevitable evil in law, but is functional and instrumental to law’s coordinating activity of citizen’s conducts in a reasonable manner.Resumen:Este trabajo se propone mostrar, en contraposición al positivismo jurídico de Wilfrid Waluchow y Joseph Raz —como representantes, respectiva- mente, de la versión incluyente y excluyente del positivismo contemporáneo—, que la interpretación jurídica supone atender siempre, y no de modo excepcional o recortado, a las razones o fines del derecho. La expresión metodológica de esta tesis podría enunciarse diciendo que la interpretación teleológica-sistemática, mediante la cual el intérprete determina el sentido de las normas a la luz de los fines globales de la práctica jurídica, no es un método interpretativo más, sino el modo necesario de toda interpretación jurídica.El segundo propósito de este trabajo es argumentar que la dimensión teleológica sistemática de la interpretación abre un espacio para la valoración por parte del intérprete que podría denominarse, “creatividad interpretativa”. Por esto mismo, la creatividad en la interpretación jurídica no es una excepción, sino una nota general y necesaria de toda interpretación. Se intentará mostrar, por último, que esta creatividad interpretativa no es un defecto o un mal inevitable del derecho, sino que es funcional o instrumental a la función del derecho de coordinar conductas de modo razonable. Este artículo se centra en el gozo intelectual spinoziano. Después de un breve repaso de un libro de Jorge Wagensberg sobre la experiencia del gozo intelectual, aludo al fenómeno contrario: el pensamiento sombrío y el pesimismo. Después, remarco la defensa de Spinoza del gozo del conocimiento y su poder contra la tristeza y el pesimismo. Finalmente, analizo el peculiar gozo intelectual en Spinoza y conecto este gozo con la experiencia de eternidad y su expresión a través de categorías espaciales.

Las frutas y hortalizas han sido siempre noticia debido principalmente a sus propiedades beneficiosas para la salud. Sin embargo, cada vez más ocupan titulares debido a su implicación en toxiinfecciones alimentarias. Por este motivo, desde 2008, las frutas y hortalizas frescas son consideradas por muchos organismos internacionales como un alimento de riesgo. Uno de los principales problemas microbiológicos de las hortalizas de hojas son las bacte­rias entéricas que pueden adherirse rápidamente al tejido durante el cultivo, coexistir con las bacterias epífitas (...) y persistir por largos periodos de tiempo. La prevalencia de microorganismos patógenos en las frutas y hortalizas es baja y la cuantificación de las bac­terias patógenas o de microorganismos indicadores generalmente muestra niveles muy bajos, lo que no justificaría el elevado número de alertas microbiológicas asociadas a este tipo de productos. Sin embargo, existen dudas sobre si los recuentos obtenidos utilizan­do las técnicas convencionales son capaces de reflejar realmente todos los microorganismos presentes en el producto vegetal, así como en el agua de riego y en el suelo. Varios estudios han demos­trado que cuando las bacterias son sometidas a distintos factores de estrés entran en un estado temporal de baja actividad metabóli­ca en el cual las células pueden persistir durante largos periodos de tiempo sin división celular, llamado estado de latencia o viable pero no cultivable. La relevancia que el estado fisiológico de las bacterias puede tener en el desarrollo de toxiinfecciones alimenta­rias causadas por las frutas y hortalizas es un tema de gran interés que está atrayendo más y más la atención de los investigadores. El artículo investiga, en relación con la noción de formación, el concepto de humanismo al que se remonta Gadamer en _Verdad y método._ Para ello, trata de reconstruir las líneas generales del debate que tuvo lugar en Alemania en torno a 1800 sobre el significado de la _Bildung_ y sus implicaciones para las primeras reformas educativas estatales del siglo XIX. Con ello, busca ganar un horizonte desde el que volver a pensar el concepto humanista de formación como un modo de (...) enfrentar las pretensiones de universalidad de la ciencia moderna y para entender, a partir de ahí, una noción de verdad que abre, a su vez, nuevos horizontes desde los que pensar el compromiso hermenéutico con la educación.
