Guidelines recommend a ‘do-not-resuscitate’ code status for inpatients in which cardiopulmonary resuscitation attempts are considered futile because of low probability of survival with good neurological outcome. We retrospectively assessed the prevalence of DNR code status and its association with presumed CPR futility defined by the Good Outcome Following Attempted Resuscitation score and the Clinical Frailty Scale in patients hospitalised in the Divisions of Internal Medicine and Traumatology/Orthopedics at the University Hospital of Basel between September 2018 and June 2019. The definition (...) of presumed CPR futility was met in 467 of 2889 patients. 866 patients had a DNR code status. In a regression model adjusted for age, gender, main diagnosis, nationality, language and religion, presumed CPR futility was associated with a higher likelihood of a DNR code status. In the subgroup of patients with presumed futile CPR, 144 of 467 had a full code status, which was independently associated with younger age, male gender, non-Christian religion and non-Swiss citizenship. We found a significant proportion of hospitalised patients to have a full code status despite the fact that CPR had to be considered futile according to an established definition. Whether these decisions were based on patient preferences or whether there was a lack of patient involvement in decision-making needs further investigation. (shrink)

Raoul Moati intervenes in the critical debate that divided two prominent philosophers in the mid-twentieth century. In the 1950s, the British philosopher J. L. Austin advanced a theory of speech acts, or the "performative," that Jacques Derrida and John R. Searle interpreted in fundamentally different ways. Their disagreement centered on the issue of intentionality, which Derrida understood phenomenologically and Searle read pragmatically. The controversy had profound implications for the development of contemporary philosophy, which, Moati argues, can profit greatly by (...) returning to this classic debate. In this book, Moati systematically replays the historical encounter between Austin, Derrida, and Searle and the disruption that caused the lasting break between Anglo-American language philosophy and continental traditions of phenomenology and its deconstruction. The key issue, Moati argues, is not whether "intentionality," a concept derived from Husserl's phenomenology, can or cannot be linked to Austin's speech-acts as defined in his groundbreaking _How to Do Things with Words_, but rather the emphasis Searle placed on the performativity and determined pragmatic values of Austin's speech-acts, whereas Derrida insisted on the trace of writing behind every act of speech and the iterability of signs in different contexts. Definition of the problemFrom an ethical point of view we analyse the ruling of the German Federal Joint Committee (Gemeinsamer Bundesausschuss, G‑BA) of September 2019 to revise the guidelines about the coverage of noninvasive prenatal tests (NIPT) by mandatory health insurance, in order to include them under specified conditions. The decision contains four essential elements: a definition of the aim of NIPT testing (to avoid invasive testing), a criterion of access (test must be “necessary” for the pregnant woman to tackle (...) her individual situation), statements about the process of decision-making (after counselling by a physician and case by case) and a normative contextualization (termination of pregnancy under § 218 a German penal law) which is to be found in its explanations. There are tensions in the proposed model that oscillate about two axes: (1) The suffering that results from a possible birth of a child with trisomy or from not knowing about the genetic condition of the fetus can ultimately only be evaluated subjectively, from the perspective of the pregnant woman. (2) The meaning of an individual decision in the case-by-case model remains unclear because when judging about individual cases general points of view also need to be considered. However, we argue that the model of the G‑BA could be a sociopolitically and ultimately also ethically defensible pragmatic solution, exactly because of its paradoxes and its inherent flexibility. In this paper, I argue that explaining cognitive behavior can be achieved through what I call hybrid explanatory inferences: inferences that posit mechanisms, but also draw on observed regularities. Moreover, these inferences can be used to achieve unification, in the sense developed by Allen Newel in his work on cognitive architectures. Thus, it seems that explanatory pluralism and unification do not rule out each other in cognitive science, but rather that the former represents a way to achieve the latter.

Two solutions are offered to the problem of distinguishing "historical" from "functional" associations in cross-cultural surveys. The underlying logic of the mathematical model is discussed and three kinds of association distinguished: hyperdiffusional or purely "historical" association, undiffusional or purely "functional" association, and semidiffusional or mixed "historical-functional" association. Two overland diffusion arcs constitute the test sample; the relationship of social stratification to political complexity constitutes the test problem. A sifting test establishes a bimodal distribution of interval lengths between like types and (...) sifts out repetitions with a lesser interval length than the second mode. A cluster test shows that for the test problem, the "hits" cluster more than the "misses". (shrink)

In a 2008 paper, Walmsley argued that the explanations employed in the dynamical approach to cognitive science, as exemplified by the Haken, Kelso and Bunz model of rhythmic finger movement, and the model of infant preservative reaching developed by Esther Thelen and her colleagues, conform to Carl Hempel and Paul Oppenheim’s deductive-nomological model of explanation (also known as the covering law model). Although we think Walmsley’s approach is methodologically sound in that it starts with an analysis of scientific practice rather (...) than a general philosophical framework, we nevertheless feel that there are two problems with his paper. First, he focuses only on the deductivenomological model and so neglects the important fact that explanations are causal. Second, the explanations offered by the dynamical approach do not take the deductive-nomological format, because they do not deduce the explananda from exceptionless laws. Because of these two points, Walmsley makes the dynamical explanations in cognitive science appear problematic, while in fact they are not. (shrink)

In this paper we argue that in recent literature on mechanistic explanations, authors tend to conflate two distinct features that mechanistic models can have or fail to have: plausibility and richness. By plausibility, we mean the probability that a model is correct in the assertions it makes regarding the parts and operations of the mechanism, i.e., that the model is correct as a description of the actual mechanism. By richness, we mean the amount of detail the model gives about the (...) actual mechanism. First, we argue that there is at least a conceptual reason to keep these two features distinct, since they can vary independently from each other: models can be highly plausible while providing almost no details, while they can also be highly detailed but plainly wrong. Next, focusing on Craver's continuum of ?how-possibly,? to ?how-plausibly,? to ?how-actually? models, we argue that the conflation of plausibility and richness is harmful to the discussion because it leads to the view that both are necessary for a model to have explanatory power, while in fact, richness is only so with respect to a mechanism's activities, not its entities. In the literature on dynamical models in cognitive science, two issues have recently caused controversy. First, what is the relation between dynamical and mechanistic models? I will argue that dynamical models can be upgraded to be mechanistic as well, and that there are mechanistic and non-mechanistic dynamical models. Second, there is the issue of explanatory power. Since it is uncontested the mechanistic models can explain, I will focus on the non-mechanistic variety of dynamical models. It is often claimed by proponents (...) of mechanistic explanations that such models do not really explain cognitive phenomena . I will argue against this view. Although I agree that the three arguments usually offered to vindicate the explanatory power of non-mechanistic dynamical models are not enough, I consider a fourth argument, namely that such models provide understanding. The integration of multisensory information is an essential mechanism in perception and action control. Research in multisensory integration is concerned with how the information from the different sensory modalities, such as the senses of vision, hearing, smell, taste, touch, and proprioception, are integrated to a coherent representation of objects (for an overview, see e.g., Calvert, Spence and Stein, 2004). The combination of information from the different senses is central for action control. For instance, when you grasp for a rubber duck, (...) you can see its size, feel its compliance and hear the sound it produces. Moreover, identical physical properties of an object can be provided by different senses. You can both see and feel the size of the rubber duck. Die breite Einführung nicht-invasiver pränataler Tests sowie die Ausweitung der Testziele über Trisomien hinaus machen es notwendig, Sinn und Ziel der pränatalen Diagnostik als emergente soziale Praxis grundsätzlich zu diskutieren. Wenn, wie angenommen wird, PND nicht zu eugenischen Zwecken, sondern zur Stärkung der Autonomie dienen soll, muss gefragt werden, welche Bedeutung die Entscheidungen haben, ein bestimmtes zukünftiges Kind zu gebären. Stephen Wilkinson hat vorgeschlagen, PND als eine Form „selektiver Reproduktion“ zu verstehen. In diesem Paper wird geprüft, ob die Charakterisierung der (...) Entscheidung nach PND als „Selektion“ zutrifft und welche moralischen Vorannahmen ihr zugrunde liegen.Es zeigt sich, dass das Konzept der „selektiven Reproduktion“ die Handlungen der PND inakkurat repräsentiert. Es beinhaltet zudem sowohl eine Abstrahierung als auch eine Distanzierung. Es nimmt an, dass Frauen und Paare entweder falls nötig mehrere Schwangerschaften planen, um ein gesundes Kind zu erzeugen, oder sich als Ausführende einer selektiven Strategie auf der Populationsebene verstehen. Die Einschränkung der ethischen Diskussion auf das Problem der Selektion verdeckt zwei wichtige Problemfelder, die die konflikthaltige Situation der PND aus der Perspektive der Frau oder des Paares charakterisieren: die Schwangerschaft als persönliche Beziehung und den Akt des Abbruchs der Schwangerschaft. Aufgrund seiner impliziten Normativität wird „selektive Fortpflanzung“ als sinnvolle Bezeichnung für die Praxis der PND zurückgewiesen. (shrink)

Cette idée implique l'élaboration d'une discipline complémentaire à la phénoménologie, capable de cerner l'homme dans la réalité et la singularité absolues de son projet dans (...) le monde. Méthode que Sartre nomme, en modifiant la pensée de Freud, psychanalyse existentielle. Que la singularité de notre épreuve personnelle du monde soit tout à la fois ce qui nous est le plus accessible, et ce qui, pourtant, échappe constamment à notre connaissance, constitue un paradoxe, un "mystère en pleine lumière", légitimant la formation d'une psychanalyse, non moins paradoxale, de la conscience. Psychanalyse d'un genre nouveau dont Sartre esquisse dans de nombreux textes théoriques la méthode, qu'il mettra lui-même en application dans ses essais biographiques sur Baudelaire, Mallarmé, Genet et Flaubert. Percer l'identité du monde singulier d'un écrivain afin d'enrichir la compréhension de son oeuvre par celle de son élan unique dans le monde, tels sont les résultats auxquels la méthode psychanalytique sartrienne, permet d'aboutir, par-delà la seule méthode héritée de la phénoménologie. L’auteur dénonce des comportements provocants peu conformes à leur réputation de douceur et de pacifisme. Il évoque les divisions internes de ces communautés et la filiation probable entre les Esséniens et les premiers chrétiens. En s’appuyant sur des historiens, il cherche à prouver qu’on a exagéré l’importance de la persécution dont les chrétiens furent victimes sous l’empire romain. (...) La conclusion de cette conférence documentée mais polémique, est que l’histoire du christianisme est celle d’une secte ambitieuse qui a usé de stratégie non seulement pour se répandre mais aussi pour écrire sa propre légende. Dans cet article de 1903 paru dans une revue positiviste, le naturaliste Raoul Francé (1874-1943) se réfère l’école critique d’exégèse biblique (de Strauss à Wrede) pour faire entendre la voix des libres penseurs qui remettent en question l’existence historique de Jésus. Francé considère le texte des Evangiles comme une des expressions du mouvement messianique juif, qu’il faut comprendre symboliquement et non comme un récit historique. This article provides a critical survey of the debate on intertheoretic relations, with particular emphasis on the cognitive sciences. I begin by distinguishing two opposing sides, reductionism and antireductionism, and proceed by tracking the changes these positions underwent in the twentieth century. It appears that these changes consist to a significant degree in smoothing out the rough edges of both, so that the original positions can be understood as crude extremes. The monistic accounts of intertheoretic relations were traded in for (...) more tolerant and nuanced approaches, a tendency that is chiefly inspired by an increasing focus on actual scientific practice. ZusammenfassungZumindest bei bestimmten Gruppen kann die Aneuploidietestung im Rahmen der PID für die Schwangerschaft medizinisch sinnvoll sein. Die gegenwärtige Rechtslage in Deutschland scheint die PID auf eine Chromosomenfehlverteilung im Embryo nicht auszuschließen; diese Testung muss aber im Einzelfall begründet und von der Frau bei einer PID-Ethikkommission beantragt werden. Der Artikel untersucht die Frage aus ethischer und rechtlicher Sicht, ob prinzipielle Gründe dagegen stehen, dass die zuständigen Ethikkommissionen Anträgen auf die Durchführung von Aneuploidietests zustimmen. Es können drei verschiedene Fallkonstellationen unterschieden werden, (...) in denen Aneuploidietests Teil von unterschiedlichen Handlungen werden und entsprechend unterschiedliche ethische Implikationen aufweisen: Das Ziel der IVF kann (i) der Aneuploidietest selbst sein, oder (ii) die IVF kann eine indizierte Unfruchtbarkeitsbehandlung sein, bei der man auch PID und Aneuploidietests durchführen kann, oder (iii) die PID ist indiziert zur Vermeidung einer Erbkrankheit oder Chromosomenschädigung und Aneuploidie kann in dieser Situation ein Zufalls- oder ein Zusatzbefund werden. Ethische Argumente, die grundsätzlich gegen eine Zulässigkeit von Aneuploidietests sprechen könnten, sind die Vermeidung einer Diskriminierung von Menschen mit Aneuploidien und der Embryonenschutz. Sie könnten gegen das Fallszenario (i) erhoben werden, aber nicht gegen (ii) und (iii). Es gibt aber mindestens drei ethische Argumente, die für die Zulässigkeit sprechen: die „gute Praxis“ der IVF, die Pflicht gegenüber dem entstehenden Kind und die Mitsprache des Paares. Ergebnis: Es ist aus rechtlichen und ethischen Gründen nicht ausgeschlossen und deshalb in Deutschland durch die zuständigen PID-Kommissionen offen zu diskutieren, ob Aneuploidietests in der PID möglich werden. As the technology for ectogenesis continues to advance, the ethical implications of such developments should be thoroughly and proactively explored. The possibility of full ectogenesis remains hypothetical at present, and myriad concerns regarding the safety and efficacy of the technology must be evaluated and addressed, while pressing moral considerations should be fully deliberated. However, it is conceivable that the technology may become sufficiently well established in the future and that eventually full ectogenesis might be deemed ethically acceptable as a reproductive (...) alternative to gestation within a human womb under certain circumstances. If the safety and efficacy of full ectogenesis are established, if ethical dilemmas are sufficiently well addressed, and if the technology is offered as a reproductive option to cisgender heterosexual individuals or couples desiring to become parents, there is a moral obligation grounded in social justice to ensure that full ectogenesis be made available to individuals or couples identifying as members of sexual‐ or gender‐minority groups who likewise seek to pursue parenthood. We examine the history of access to current family‐building options, including assisted reproductive technology, surrogacy and adoption, for these populations and conclude that in the absence of robust empirical evidence suggesting an increased risk of harm to children of individuals and couples who identify as members of sexual‐ or gender‐minority groups, equitable access to ectogenesis as a pathway to parenthood for sexual and gender minorities must be assured as a matter of reproductive justice. In the debate about values in science, it is a time-honored tradition to distinguish between the normative question of whether non-cognitive values should play a role in science and the descriptive question of whether they in fact do so or not.1 Among philosophers of science, it is now an accepted view that the descriptive question has been settled. That is, it is no longer disputed that non-cognitive values play a role in science. Hence, all that is left to do on (...) the descriptive front is to describe these values and their roles in more detail. Currently, the neurosciences challenge the concept of will to be scientifically untenable, specifying that it is our brain rather than our "self" that decides what we want to do. At the same time, we seem to be confronted with increasing possibilities and necessities of free choice in all areas of social life. This paper provides a relational analysis of James Fowler's Faith Development Theory and Heinz Streib's Religious Styles Perspective in light of a recent study of apostasy from religious fundamentalisms. Empirical support is provided for both theories. RSP is endorsed as a more encompassing theory of religious development which accounts for more contingencies than FDT. However, FDT is subsumed rather than superseded by RSP as a powerful lens through which to observe cognitive dimensions of religious development. The paper introduces an integrative (...) paradigm, phenomenological empiricism, to conceptualise a complementary relationship between FDT and RSP as key theories in the future study of religious development.
