This paper provides a conceptual framework to explain why disparities may exist in food safety code compliance by food stores in different neighborhoods. Explanations include market dynamics, community characteristics, retailer attributes, inspector characteristics, and enforcement approaches, and interactions among the factors. A preliminary and limited empirical test of some of these relationships in Detroit, Michigan shows a higher rate of food safety violations by stores in poorer neighborhoods and in neighborhoods with higher concentrations of African-American residents. Stores inspected by female (...) inspectors also scored higher numbers of critical violations, suggesting a need for greater examination of the social relations associated with enforcement interactions in food safety studies. We show that the U.S. anti-discriminatory laws prohibiting discrimination in the workplace based on sexual orientation and gender identity identities) spur innovation, which ultimately leads to higher firm performance. We use the Human Rights Campaign’s Corporate Equality Index of 398 U.S. firms between 2011 and 2014, and find a significantly positive relationship between CEI and firm innovation. We also find that an interacting effect of CEI and firm innovation leads to higher firm performance. We use our understanding of Rawls’ Theory (...) of Justice and stakeholder theory to show that firms with workplace diversity policies are likely to be more innovative and perform better than those without such policies. Our results are robust to endogeneity, reverse causality and simultaneity issues. Our results will trigger debate in similar markets around the globe on the economic benefits of LGBT workplace diversity policies for firms. (shrink)

Normativity is assessed as we evaluate and compare the environmental reporting practices of a sample of French and Canadian companies through the lens of institutional legitimacy. More specifically, we examine how French and Canadian firms changed their reporting practices in reaction to the promulgation of laws and regulations in their respective countries, i.e., the NER and Grenelle II Acts in France, and National Instrument 51-102 and CSA Staff Notice NR 51-333, issued by the Canadian Securities Administrators. The firms’ voluntary disclosures (...) according to GRI guidelines are also investigated. Substantive legitimacy theory is used to explore the level of substantive disclosures provided by Canadian and French firms. The findings reveal that the French parliamentary regime is more successful than the Canadian stock exchange regulation in triggering environmental reporting, and that the GRI combined with local regimes prompts environmental disclosures. Notwithstanding the improvements in environmental reporting under all three regimes, a very low level of substantive disclosure is noted in both countries. (shrink)

We show that the conceptual distance between any two theories of first-order logic is the same as the generator distance between their Lindenbaum–Tarski algebras of concepts. As a consequence of this, we show that, for any two arbitrary mathematical structures, the generator distance between their meaning algebras (also known as cylindric set algebras) is the same as the conceptual distance between their first-order logic theories. As applications, we give a complete description for the distances between meaning algebras corresponding to structures (...) having at most three elements and show that this small network represents all the possible conceptual distances between complete theories. As a corollary of this, we will see that there are only two non-trivial structures definable on three-element sets up to conceptual equivalence (i.e., up to elementary plus definitional equivalence). Madness is a complex and contested term. Through time and across cultures it has acquired many formulations: for some, madness is synonymous with unreason and violence, for others with creativity and subversion, elsewhere it is associated with spirits and spirituality. Among the different formulations, there is one in particular that has taken hold so deeply and systematically that it has become the default view in many communities around the world: the idea that madness is a disorder of the mind. -/- (...) Contemporary developments in mental health activism pose a radical challenge to psychiatric and societal understandings of madness. Mad Pride and mad-positive activism reject the language of mental 'illness' and 'disorder', reclaim the term 'mad', and reverse its negative connotations. Activists seek cultural change in the way madness is viewed, and demand recognition of madness as grounds for identity. But can madness constitute such grounds? Is it possible to reconcile delusions, passivity phenomena, and the discontinuity of self often seen in mental health conditions with the requirements for identity formation presupposed by the theory of recognition? The concept of the sublime was crucial to the thought of Immanuel Kant, who defined it as the experience of what is great in power, size, or number. From ancient times to the present, the aesthetic experience of the sublime has been associated with morality, but if we want to be able to exclude evil, fascistic, or terroristic uses of the sublime—the inescapable awe generated by the Nuremberg rallies, for example—we require a systematic justification of the claim that there are (...) internal moral constraints on the sublime. Nietzsche’s critique of causality is at the heart of his critiques of metaphysics and natural science, for causality is the mechanism by which metaphysical concepts are generated and nature is transformed into a system of universal laws. Yet the nature, variety, and radical entailments of his critique of causality have been insufficiently appreciated in the scholarship. By eliminating cause, he deals a death blow to the naturalism currently in vogue in Nietzsche studies,1 according to which Nietzsche is “engaged in giving (...) causal explanations of various human phenomena.”2 The mistake is to read his metaphysically deflationary views concerning nonnatural causality and his privileging of nature and philosophical .. To assess the ability of the disconnected cerebral hemispheres to recognize images of the self, a split-brain patient was tested using morphed self-face images presented to one visual hemifield at a time while making “self/other” judgments. The performance of the right and left hemispheres of this patient as assessed by a signal detection method was not significantly different, though a measure of bias did reveal hemispheric differences. The right and left hemispheres of this patient independently and equally possessed the ability (...) to self-recognize, but only the right hemisphere could successfully recognize familiar others. Hacking and other entity realists suggest a strategy to build scientific realism on a stronger foundation than inference to the best explanation. They argue that if beliefs in the existence of theoretical entities are derived from experimentation rather than theories, they can escape the antirealist's criticism and provide a stronger ground for realism. The purpose of this paper is to investigate the nature of rhetoric and rhetorical strategies that are implicit in the standalone sustainability reporting of the top 24 companies of the Fortune 500 Global. We adopt Bormann’s :396–407, 1972) SCT framework to study the rhetorical situation and how corporate sustainability reporting messages can be communicated to the audience. The SCT concepts in the sustainability reporting’s communication are subject to different types of legitimacy strategies that are used by corporations as a validity (...) and legitimacy claim in the reports. A content analysis has been conducted and structural coding schemes have been developed based on the literature. The schemes are applied to the SCT model which recognizes the symbolic convergent processes of fantasy among communicators in a Society. The study reveals that most of the sample companies communicate fantasy type and rhetorical vision in their corporate sustainability reporting. However, the disclosure or messages are different across locations and other taxonomies of the SCT framework. This study contributes to the current CSR literature about how symbolic or fantasy understandings can be interpreted by the users. It also discusses the persuasion styles that are adopted by the companies for communication purposes. This study is the theoretical extension of the SCT. Researchers may be interested in further investigating other online communication paths, such as human rights reports and director’s reports. (shrink)

This approach calls for a paradigm shift in conceptualizing and researching African epistemology free from Eurocentric and Afrocentric biases.

Juran has been called the father of quality, a quality guru, and the man who taught quality to the Japanese. One of his stellar contributions is the Juran trilogy of the three quality processes: quality control, quality planning, and quality improvement. In the wake of the February 1997 announcement that Dolly the sheep had been cloned, Muslim religious scholars together with Muslim scientists held two conferences to discuss cloning from an Islamic perspective. They were organized by two influential Islamic international religioscientific institutions: the Islamic Organization of Medical Sciences and the International Islamic Fiqh Academy. Both institutions comprise a large number of prominent religious scholars and well‐known scientists who participated in the discussions at the conferences. This article gives a comprehensive (...) analysis of these conferences, the relation between science and religion as reflected in the discussions there, and the further influence of these discussions on Muslims living in the West. Modern discussions on Islamic bioethics show that formulating an Islamic perspective on these issues is not the exclusive prerogative of religious scholars. Formulating such perspectives has become a collective process in which scientists play an essential role. Such a collective approach strengthens the religious authority of Muslim scholars and makes it more influential rather than undermining it. (shrink)

The multiple sources and functions of Heraclitus in Nietzsche’s writings should not be underestimated. Nietzsche’s early readings of Heraclitus are steeped in the Greek fragments, the doxographical tradition, and in philological scholarship. Hence, they are largely either fair interpretations of the extant fragments, clear translations of a select group of fragments into his own language, or improvisations based in part on a narrow subset of the spurious remarks set down in the doxographical tradition. Nietzsche’s later departures from this tradition articulate (...) an anti-metaphysical Heraclitus that he found in the Heraclitean fragments, which he takes to prefigure and later parrot his doctrines of becoming, the child, strife, chance, and eternal recurrence. For this reason, Nietzsche’s Heraclitus is necessarily no objective, individual historical person, but at various times and to various degrees a copy, an appropriative invention, and a personal-philological-philosophical archetype filtered through the lenses of ancient Greek understandings of how he must have lived, given what he said and what philosophy is; nineteenth-century German philological reconstructions of Heraclitean thought; and Nietzsche’s own need for such a precursor to voice his own doctrines and thereby lend them heft against the Platonic tradition of metaphysical philosophy. The main purpose of this paper is to better understand how sustainability rating agencies, through discourse, promote an “ideology of numbers” that ultimately aims to establish a regime of normalization governing social and environmental performance. Drawing on Thompson’s (Ideology and modern culture: Critical social theory in the era of mass communication, 1990 ) modes of operation of ideology, we examine the extent to which, and how, the ideology of numbers is reflected on websites and public documents published by a range (...) of sustainability rating agencies. Our analysis indicates that the ideology of numbers promotes a relatively narrow vision of corporate social and environmental responsibility. That is, it establishes some areas of visibility while leaving in the shadow certain aspects of the ways in which companies fulfill, or fail to meet, their social and environmental responsibilities. The ideology of numbers also exerts power by identifying those companies that are deemed to be worthy of inclusion, or not, in a supposedly socially responsible corporate elite. (shrink)

End-of-life organ donation is controversial in Islam. The controversy stems from: scientifically flawed medical criteria of death determination; invasive perimortem procedures for preserving transplantable organs; and incomplete disclosure of information to consenting donors and families. Data from a survey of Muslims residing in Western countries have shown that the interpretation of religious scriptures and advice of faith leaders were major barriers to willingness for organ donation. Transplant advocates have proposed corrective interventions: reinterpreting religious scriptures, reeducating faith leaders, and utilizing media (...) campaigns to overcome religious barriers in Muslim communities. This proposal disregards the intensifying scientific, legal, and ethical controversies in Western societies about the medical criteria of death determination in donors. It would also violate the dignity and inviolability of human life which are pertinent values incorporated in the Islamic moral code. Reinterpreting religious scriptures to serve the utilitarian objectives of a controversial end-of-life practice, perceived to be socially desirable, transgresses the Islamic moral code. It may also have deleterious practical consequences, as donors can suffer harm before death. The negative normative consequences of utilitarian secular moral reasoning reset the Islamic moral code upholding the sanctity and dignity of human life. (shrink)

The Royal College of Physicians of London published the 2013 national clinical guidelines on prolonged disorders of consciousness in vegetative and minimally conscious states. The guidelines acknowledge the rapidly advancing neuroscientific research and evolving therapeutic modalities in PDOC. However, the guidelines state that end-of-life decisions should be made for patients who do not improve with neurorehabilitation within a finite period, and they recommend withdrawal of clinically assisted nutrition and hydration . This withdrawal is deemed necessary because patients in PDOC can (...) survive for years with continuation of CANH, even when a ceiling on medical care has been imposed, i.e., withholding new treatment such as cardiopulmonary resuscitation for acute life-threatening illness. The end-of-life care pathway is centered on a staged escalation of medications, including sedatives, opioids, barbiturates, and general anesthesia, concurrent with withdrawal of CANH. Agitation and distress may last from several days to weeks because of the slow dying process from starvation and dehydration. The potential problems of this end-of-life care pathway are similar to those of the Liverpool Care Pathway. After an independent review in 2013, the Department of Health discontinued the Liverpool Care pathway in England. The guidelines assert that clinicians, supported by court decisions, have become the final authority in nonconsensual withdrawal of CANH on the basis of “best interests” rationale. We posit that these guidelines lack high-quality evidence supporting: 1) treatment futility of CANH, 2) reliability of distress assessment from starvation and dehydration, 3) efficacy of pharmacologic control of this distress, and 4) proximate causation of death. Finally, we express concerns about the utilitarian-based assessment of what constitutes a person’s best interests. We are disturbed by the level and the role of medical authoritarianism institutionalized by these national guidelines when deciding on the worthiness of life in PDOC. We conclude that these guidelines are not only harmful to patients and families, but they represent the means of nonconsensual euthanasia. The latter would constitute a gross violation of the public’s trust in the integrity of the medical profession. (shrink)

Recently, due to the rapid progress of computer technology, researchers develop an effective computer program to enhance the achievement of the student in learning process, which is Intelligent Tutoring System (ITS). Science is important because it influences most aspects of everyday life, including food, energy, medicine, leisure activities and more. So learning science subject at school is very useful, but the students face some problem in learning it. So we designed an ITS system to help them understand this subject easily (...) and smoothly by analyzing it and explaining it in a systematic way. In this paper, we describe the design of an Intelligent Tutoring System for teaching science for grade seven to help students know the 7 characteristics for living things smoothly. The system provides all topics of living things and generates some questions for each topic and the students should answer these questions correctly to move to the next level. In the result of an evaluation of the ITS, students like the system and they said that it is very useful for them and for their studies. (shrink)

Friedrich Nietzsche expresses self-refuting claims to universal skepticism not only in his early writings on language, but also in his middle and later writings. But this is not the full story, for he simultaneously propounds alternative, relativistic, contextual, imperative, perspectival, and instinctual, drive- or need-based forms of knowledge throughout his career. Here, there is no straightforward answer to the question whether Nietzsche's skeptical accounts of knowledge and truth are self-refuting, since he determines knowledge, skepticism and truth in various ways. In (...) order to assess his accounts, then, it is necessary to articulate the linguistic, epistemological and metaphysical conditions under which Nietzsche could express a non self-refuting, universal skepticism.Friedrich Nietzsche formuliert selbstwiedersprüchliche Aussagen eines universellen Skeptizismus nicht nur in den frühen Schriften über Sprach, sondern auch in den mittleren und späteren Schriften. Darüber hinaus hat er während seines gesamten Schaffens gleichzeitig auch alternative, relativistische, kontextabhängige, auslegende, perspektivische, trieb- und bedürfnisorientierte Formen des Wissens verteidigt. Folglich gibt es keine einfache Antwort auf die Frage, ob Nietzsches skeptische Erklärungen des Wissens und der Warheit selbstwiderlegend sind, da er Wissen, Skeptizmus und Warheit in unterschiedlicher Weise bestimmt. Um seine Erklärungen zu beurteilen ist es daher notwendig, die linguistischen, epistemologischen und metaphysischen Bedingungen zu artikulieren, unter denen Nietzsche einen nicht-selbstwiderlegenden, universellen Skeptizismus formulieren konnte. The ethical climate in Turkey is beset by ethical problems. Bribery, environmental pollution, tax frauds, deceptive advertising, production of unsafe products, and the ethical violations that involved politicians and business professionals are just a few examples. The purpose of this study is to compare and contrast the ethical beliefs of American and Turkish consumers using the Ethical Position Questionnaire (EPQ) of Forsyth (1980), the Machiavellianism scale, and the Consumer Ethical Practices of Muncy and Vitell questionnaire (MVQ). A sample of 376 (...) subjects that consists of American consumers (n = 188) and Turkish consumers (n = 199) was used to compare the ethical beliefs and practices of the two samples. The MANOVA results for the two nationality groups found that five out of six criterion variables differed between the two groups. The implications of this study are intended to assist marketers to develop strategies that suit a particular market and lessen their risk of entry. (shrink)

Artificial intelligence (AI) technologies are increasingly creeping into the work sphere, thereby gradually questioning and/or disturbing the long-established moral concepts and norms communities have been using to define what makes work good. Each community, and Muslims make no exception in this regard, has to revisit their moral world to provide well-thought frameworks that can engage with the challenging ethical questions raised by the new phenomenon of AI-mediated work. For a systematic analysis of the broad topic of AI-mediated work ethics from (...) an Islamic perspective, this article focuses on presenting an accessible overview of the “moral world” of work in the Islamic tradition. Three main components of this moral world were selected due to their relevance to the AI context, namely (1) Work is inherently good for humans, (2) Practising a religiously permitted profession and (c) Maintaining good relations with involved stakeholders. Each of these three components is addressed in a distinct section, followed by a sub-section highlighting the relevance of the respective component to the particular context of AI-mediated work. The article argues that there are no unsurmountable barriers in the Islamic tradition against the adoption of AI technologies in work sphere. However, important precautions should be considered to ensure that embracing AI will not be at the cost of work-related moral values. The article also highlights how important lessons can be learnt from the positive historical experience of automata that thrived in the Islamic civilization. (shrink)

The N‐end rule denotes the relationship between the identity of the amino‐terminal residue of a protein and its in vivo half‐life. Since its discovery in 1986, the N‐end rule has generally been described by a defined set of rules for determining whether an amino‐terminal residue is stabilizing or not. However, recent studies are revealing that this N‐end rule (or N‐degron concept) is less straightforward than previously appreciated. For instance, it is unveiled that N‐terminal acetylation of N‐terminal residues may create a (...) degradation signal (Ac‐degron) that promotes the degradation of target proteins. A recent high‐throughput dissection of degrons in yeast proteins amino termini intriguingly suggested that the hydrophobicity of amino‐terminal residues—but not the N‐terminal acetylation status—may be the indispensable feature of amino‐terminal degrons. Herein, these recent advances in N‐terminal acetylation and the complexity of N‐terminal degradation signals in the context of the N‐degron pathway are analyzed. (shrink)

The determination of death by neurological criteria remains controversial scientifically, culturally, and legally, worldwide. In the United Kingdom, although the determination of death by neurological criteria is not legally codified, the Code of Practice of the Academy of Medical Royal Colleges is customarily used for neurological death determination and treatment withdrawal. Unlike some states in the US, however, there are no provisions under the law requiring accommodation of and respect for residents' religious rights and commitments when secular conceptions of death (...) based on medical codes and practices conflict with a traditional concept well-grounded in religious and cultural values and practices. In this article, we analyse the medical, ethical, and legal issues that were generated by the recent judgement of the High Court of England and Wales in Re: A [2015] EWHC 443. Mechanical ventilation was withdrawn in this case despite parental religious objection to a determination of death based on the code of practice. We outline contemporary evidence that has refuted the reliability of tests of brainstem function to ascertain the two conjunctive clinical criteria for the determination of death that are stipulated in the code of practice: irreversible loss of capacity for consciousness and somatic integration of bodily biological functions. We argue that: the tests of brainstem function were not properly undertaken in this case; the two conjunctive clinical criteria set forth in the code of practice cannot be reliably confirmed by these tests in any event; and absent authentication of the clinical criteria of death, the code of practice wrongly invokes a secular definition of death based on the loss of personhood. Consequently, the moral obligation of a pluralistic society to honor and respect diverse religious convictions to the greatest extent possible is being violated. Re A is contrasted with the US case of Jahi McMath in which the court accommodated parental religious objection to the determination of neurological death codified in the Uniform Determination of Death Act. We conclude that the legal system in the United Kingdom should not favour a secular definition of death over a definition of death that is respectful of religious values about the inviolability and sanctity of life. We recommend the legal recognition of religious accommodation in death determination to facilitate cultural sensitivity and compassionate care to patients and families in a pluralistic society. The enlarging domain of psychiatric intervention is frequently associated with the undue medicalization of unusual experiences. In such a climate, it becomes of utmost importance to carefully choose appropriate candidates for the psychiatric gaze. This suggests a need to draw a distinction between religious experiences (with psychotic form) and pathological psychotic experiences. As Jackson and Fulford (1997) maintain, “spiritual experiences, whether welcome or unwelcome, and whether or not they are psychotic in form, have nothing (directly) to do with medicine. The schism between ‘ordinary’ and scientific perception and knowledge implies that we lack any total or systematic means of describing the world or identifying any framework -independent reality. Philosophers as diverse as Kant, Putnam, Strawson, Barthes, and Foucault have attempted to overcome this epistemological divide by constructing a unified, continuous theory of knowledge capable of accounting simultaneously for an allegedly primitive, unreflective, unmediated view of the world and an abstract, highly technical, scientific product. Rather than identifying analytic and continental epistemologies, (...) adverting to continental philosophy to resolve the analytic problems of defining knowledge or determining its necessary and sufficient conditions, as in Gettier problem cases, or homogenizing ordinary and scientific cognition, I assess diverse epistemological responses to the Cartesian problem of bridging perceptual experience and conceptual knowledge in order to catalog and validate the turn from a structuralist phenomenology to a historical deconstruction of isolated, ahistorical notions of subjectivity and objectivity. The conventional view is that analytic philosophy has dominated American philosophy departments since 1950 and that continental philosophy and pragmatism have been marginalized almost out of existence due to philosophical inferiority or McCarthyist persecution. But a precise historical treatment of transformations in the field shows that this is, in fact, the golden age of continental philosophy and pragmatist scholarship, that McCarthyism had nothing to do with pragmatism’s fall from dominance, and that the shape of the field depends more on larger (...) academic-historical trends. The current study investigates Arabic orientational metaphors in Modern Standard Arabic. Specifically, it is a corpus-based study that tries to retrieve conceptual orientational metaphors ofup-down, front-back, right-left, andcentral-peripheralspatial orientation. The study assumes that every orientation can be described using a set of different lexemes, and these lexemes express different linguistic orientational metaphors with different levels of usage frequency. It is hypothesized that studying the relationships between these lexemes, their etymologies, and frequency can provide a detailed, integrative account of metaphorical aspects (...) and conceptual systems related to each spatial orientation. A bottom-up methodology to identify metaphorical usages of spatial lexemes was applied to theStanford Arabic Corpus. The results list the spatial linguistic metaphors comprising conceptual metaphors and show for each orientation that mapping orientations onto conceptual metaphors is a complicated process, which integrates linguistic and cognitive levels. The cognitive-perceptual and cultural implications of these findings are discussed. (shrink)

During the 1990s, biomedical scientists and Muslim religious scholars collaborated to construe Islamic responses for the ethical questions raised by the AIDS pandemic. This is the first of a two-part study examining this collective legal reasoning (ijtihād jamā‘ī). The main thesis is that the role of the biomedical scientists is not limited to presenting scientific information. They engaged in the human rights discourse pertinent to people living with HIV/AIDS, gave an account of the preventive strategy adopted by the World Health (...) Organization, and offered an (Islamic) virtue-based preventive model. Finally, these scientists tried to draft a number of Islamic legal rulings (aḥkām), usually seen in Islamic jurisprudence as the exclusive business of Muslim religious scholars. This multilayered role played by the scientists reflects intriguing developments in the Islamic religio-ethical discourse in general and in the field of Islamic jurisprudence in particular. (shrink)
