Research question/issue This paper aims to contribute to an improved theoretical and empirical understanding of the role that corporation has to play in anticorruption efforts. Research findings/insights Using cross-country data from three databases (Bribe Payers Index, Corruption Perceptions Index, and Doing Business) we found that pro-bribery Investment Climate conditions in host countries are not related to the payments of bribes by multinational companies when these corporations operate abroad. Theoretical/academic implications After describing the conceptual and policy framework that (...) surrounds the discussion on the role played by firms in anticorruption, we present the current debate regarding the effectiveness of international bribery control instruments, with the World Bank-GAC (2006-2008) report as a basis. Both literature and policy seem to be divided into two main, although not mutually exclusive, positions: one demands improvements in Investment Climate conditions from a joint public-private consensus led by international agencies; the other one supports the effectiveness of self-regulation by firms, independent of Investment Climate improvements. The study provides empirical support to the idea that a better Investment Climate is not enough for reducing corrup tion. Practitioner/policy implications This study offers insights to policy makers interested in promoting the involvement of corporations in the fight against corruption. (shrink)

La dataización de la vida, de la sociedad, en el siglo XXI se ha convertido en una realidad indiscutible, alcanzando igualmente a la algoritmización de la Justicia. Los retos y los riesgos son enormes y el panorama que se presenta es complejo. Asistimos a una cada vez mayor “hibridación” de la Justicia: las máquinas ylos humanos interaccionan, los algoritmos asisten a los operadores jurídicos, se crean sistemas complementarios de las decisiones de jueces, fiscales, abogados, notarios, etc., si bien, cada vez (...) más, caminamos hacia la sustitución progresiva del ser humano en la Justicia por las máquinas, por los robots. El dilema de la Justicia está presente. Hay que evitar el desequilibrio, las desigualdades, la brecha digital, la aminoración de garantías, la conversión de Justicia en el frío dato estadístico-matemático, que pervierta el modelo de Justicia humano; un modelo con falencias pero que ha venido construyéndose desde el respeto a los derechos y garantías. Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. A partir del enfoque desarrollador del proceso de enseñanza- aprendizaje y teniendo en cuenta las dificultades que se muestran con la literatura en la asignatura Historia de Cuba I para algunos contenidos, se presenta un sistema de medios con el objetivo de resolver estas dificultades. Se concluye que el sistema que se ofrece contribuye a la motivación del estudiante por el estudio de la asignatura; eleva la calidad de la clase; proporciona la asimilación y profundización del contenido, así como el (...) desarrollo de habilidades docentes, intelectuales y específicas; permite la participación activa y reflexiva de los estudiantes en la clase y facilita un mayor nivel de organización del contenido para la realización de las tareas docentes. Taking into consideration a developmental approach to the teaching-learning process and the instructional challenges linked to literature content of Cuban History I coursework, a system of teaching aids is presented. It is suggested that the proposed system enhances student motivation to study this subject, raises the quality of instructional lessons, favors the assimilation of the content, and improves the development of educational, intellectual and specific skills. It also allows for the active and reflexive participation of students in the lessons and facilitates a greater level of content organization for successful instruction. (shrink)

Thomas Kuhn’s relativistic position is usually expounded in terms of its subjectivist and irrationalist consequences and, accordingly, as a contribution to anti-scientificism. This paper explains his pluralism in semantics and ontology and shows in it a kind of relativism from which those consequences do not follow. It is also argued that, despite that, this version does not converge to empiricism or scientific realism.

Francis Bacon's position on the existence of void and its nature has been mostly studied with regard to his views on the atom. This approach is undoubtedly right, but it disregards further topics related to Bacon's account of void, namely the world system and the transmutation of bodies. Consequently, a more comprehensive study of Bacon's view on vacuum seems desirable where all the contexts are taken into account. To address this desideratum, the present paper examines Bacon's different views on vacuum (...) drawing attention to the various contexts of the discussion. It also gives an evaluation of the arguments put forward in support of his positions. The first section presents a reconstruction of Bacon's consecutive positions and the reasons for his changes of mind. The second section lists the experimental facts traditionally cited in debates about vacuum and Bacon's interpretation of these. The final section evaluates the role that these experimental facts played in Bacon's arguments. As a result, it is shown that Bacon fits entirely into the general pattern of the early seventeenth century. Empirical arguments by themselves had little value for solving the question of the void; it was also necessary to have a formerly established theory. (shrink)

Once upon a time, Aesop says, there was a donkey who wanted to be a pet dog. The pet dog was given many treats by the master and the household servants, and the donkey was envious of him. Hence, the donkey began emulating the pet dog. What happened next? The story ends up with the donkey beaten senseless, chased off to the stables, exhausted and barely alive. Who is to blame for the poor donkey’s unfortunate fate? Well, there could be (...) disagreement upon this, but we think emulation is to blame. And it’s on the kinds of envy-related emulation that we focus in this chapter. More analytically, we aim at vindicating the role of envy for moral exemplars within an exemplarist character educational framework. In the first section, we recall the central tenets of an exemplarist account of moral progress, and highlight how negative emotions, in general, have suffered a bad press within character education, with exemplarism being no exception. Then we provide a brief outline of standard strategies of defending envy by appealing to useful taxonomies of envy (e.g., Taylor 1988; Protasi 2016; Fussi 2018). After that, we put forward our 'Donkey Objection' by recalling Aesop’s fable on "foolish imitation", so as to show that when envy triggers mere emulation, it can bear devastating effects such as conformism and a lack of self-worth and personal integrity. In response to this objection, we bring into play a distinction between two rival forms of imitation—emulation and inspiration—and we coin the label of "inspired envy" for those forms of imitation by inspiration triggered by envy that lead to self-improvement avoiding morally detrimental consequences. In lieu of an abstract, here is a brief excerpt of the content:“A Child Has Been Born unto Us”Arendt on BirthAdriana CavareroTranslated by Silvia Guslandi and Cosette BruhnsIn The Human Condition, at the end of the dense chapter on action, Hannah Arendt reiterates that action, that is, the political faculty for excellence, “is ontologically rooted” in the fact of natality, “like an ever-present reminder that men, though they must die, are not born in order to die but in order (...) to begin” (Arendt 1998, 246).1 To reinforce this argument, Arendt compares action to miracles, and makes an interesting and, as we will see, somewhat perplexing reference to the Bible:[The miracle] is, in other words, the birth of new men and the new beginning, the action they are capable of by virtue of being born. Only the full experience of this capacity can bestow upon human affairs faith and hope, those two essential characteristics of human existence which Greek antiquity ignored altogether.…It is this faith in and hope for the world that found perhaps its most glorious and most succinct expression in the few words with which the Gospels announced their “glad tidings”: “A child has been born unto us.”(HC, 247)The citation is suggestive, but incorrect. In the Gospels, which do announce with true joy the birth of the child, the phrase as it is quoted here does not exist. It appears instead in Isaiah (9:6), translated into English both as “For to us a child is borne,” and, in the version of the King James Bible from which Arendt is plausibly drawing, as “For unto us a child is born.” The error, if indeed it is an error, is thus twofold (see Young-Ah Gottlieb 2003, 136ff.), since [End Page 12] both the passage referenced and the words cited are incorrect. That Arendt frequently cites from memory, and that the citations tend to be bibliographically incorrect, is known to her interpreters, but in this case the error ends up being quite significant. As is well known, the prophetic text carries a strong Messianic burden, and such a burden would trouble significantly the thesis that Arendt is here illustrating; the Gospels’ message creates instead fewer obstacles to her strategy of framing the meaning of birth within the mundane horizon that in her vocabulary takes the names of “world” or “worldliness.” Since “‘to live’ and to ‘be among men’” mean the same thing (HC, 7), the child, every newborn, that is, every human being that makes its entrance in the world, is not, according to the Arendtian vision, born to us, coming from elsewhere, but appears among us here. The scenario of birth, like that of action, whatever be the holy text that mentions or exemplarily validates them, is, for Arendt, a radically mundane scenario that does not call into question any transcendence or religious instance of salvation.Jewish, secular, and classically trained in Greek and Latin, Arendt, who had little familiarity with the Jewish language and tradition, met Christian thought primarily through Saint Augustine, to whom she dedicated her doctoral thesis (Der Liebesbegriff bei Augustin, published in Berlin in 1929 and then in English in 1996 as Love and Saint Augustine), and who remained a constant point of reference throughout her work. A phrase from Augustine—initium ut esset homo creatus est—present in the thesis, appears, in fact, in Arendt’s later texts, including The Human Condition, indeed with obsessive repetitiveness in reference to the category of birth.2 In her monumental work The Origins of Totalitarianism, published in 1951, a full seven years prior to The Human Condition, Arendt already writes: “Beginning, before it becomes a historical event, is the supreme capacity of man; politically, it is identical with man’s freedom. According to a widely held view in the philosophy of mathematics, direct inferential justification for mathematical propositions (that are not axioms) requires proof. I challenge this view while accepting that mathematical justification requires arguments that are put forward as proofs. I argue that certain fallacious putative proofs considered by the relevant subjects to be correct can confer mathematical justification. But mathematical justification doesn’t come for cheap: not just any argument will do. I suggest that to successfully transmit justification an argument (...) must satisfy specific standards, some of which are social. I contrast my view with Huemer’s inferential conservatism, which makes mathematical justification too easy to get. Although in this article I focus on mathematical inferential beliefs, the view on offer generalizes to other inferential beliefs. (shrink)

Desde que se optó por legislar los ilícitos penales cometidos por aquellos menores con edades comprendidas entre los 14 y los 18 años, muchas y variadas son las certezas e incertidumbres que, al respecto de un tema tan complejo y tortuoso, han visto la luz en nuestro entramado social.

In the present manuscript, we comment upon a paper that strongly criticized an expert report written by the consultants of the defense in a case of pedophilia, in which clinical and neuro-scientific data were used to establish the causal link between brain alterations and onset of criminal behavior. These critiques appear to be based mainly on wrong pieces of information and on a misinterpretation of the logical reasoning adopted by defense consultants. Here we provide a point-by-point reply to the issues (...) raised in the above paper and also discuss the potential role that neuroscience may contribute in the forensic context. Did the forensic neuroscience defense consultants claim the existence of a deterministic relationship between brain structure or function and behavior? How did the neuroscientific logic work in this specific case? How may the classic psychiatric/neurologic examination and neuroscientific evidence work side by side? Does the rarity of a disease impact on the causal relationship between the disease and the crime? Do neuroscientific data need to be interpreted? We address the above questions and conclude that neuroscience may strengthen the results of psychiatric evaluations, thus reducing uncertainty in the forensic settings. (shrink)

This study focuses on food waste generated by households in four Nordic countries: Finland, Denmark, Norway, and Sweden. Based on existing literature we present comparable data on amounts and monetary value of food waste; explanations for food waste at household level; a number of public and private initiatives at national levels aiming to reduce food waste; and a discussion of ethical issues related to food waste with a focus on possible contributions from ecocentric ethics. We argue that reduction of food (...) waste at household level, which has an impact on issues such as climate change and unjust distribution of food resources, needs to be based on an appreciative and relational understanding of nature and food and not only on economic and moralizing arguments. This is done by drawing on an ecocentric perspective where food is seen as one of the areas where new narratives need to be developed to establish cultural habits replacing a focus on affluence and individual choice with a focus on participatory embeddedness in a more-than-human lifeworld. The cinema of Martin Scorsese has been analysed in connection with a wide range of themes and issues. In this paper, through a film-philosophical analysis, we aim to demonstrate how his filmography produces storyworlds pervaded by a tension similar to the one Søren Kierkegaard expressed in his existentialist writings. Indeed, one of the tenets of film-philosophy is that audio-visual media generate, in an affective and experiential manner, complex moral and ethical systems and existential viewpoints with which viewers interact in a (...) direct and creative way. Empathising with the self-sacrifice of the unlikely martyr played by Jake LaMotta or feeling the collapsing certainties of a missionary in seventeenth-century Japan are thus occasions to encounter particular conceptual personae. These characters embody specific iterations of Kierkegaardian knights of faith: existentialist figures whose doom takes in ambiguous film ecologies where the desire for wholesomeness constantly clashes with mortality and finitude. This work presents the case of the Yanomami indigenous people from Brazil that were the object of US ethnography initiated in the 1960s. The research brought harmful repercussions to the life of the Indigenous people of Brazil for several decades, and it took more than 40 years until the beginning of a process of reparation involving the Brazilian government and American universities. Objective: to discuss the meaning of the return of Yanomami blood samples, as well as contributions from the epistemologies (...) of traditional Indigenous knowledge to the debate about research ethics and the structuring of means for the social control of researchers and the protection of participants in scientific studies, having as an example the Yanomami indigenous people from Brazil, subjected to noxious ethnography in the 1960s and the 1970s. This work used data reports recorded in secondary sources. In this article we argue that Bioethics needs to further diversify its epistemological foundations and to consider epistemologies and cosmologies beyond the frontiers of Western science, as the case of the abusive research involving the Yanomami indigenous people in Brazil reveals. We argue that traditional knowledge, such as those of indigenous and quilombolas, with their epistemologies and cosmologies, are fundamental for the election of less colonized and more efficient principles of research ethics, regarding the protection of the participants' rights in scientific studies. Traditional indigenous populations can teach us a great deal about doing research. (shrink)

Investigar a los buenos profesores es complejo porque se corre el riesgo de generalizar trivializando sus características, por lo mismo, es fundamental no caer en la tentación de pensar que son ideales, puesto que son seres humanos que viven su existencia al igual que cada uno de nosotros, sólo que con compromiso y amor por lo que hacen. Gracias a las historias de vida pudimos entender el proceso de la profesionalización docente, develar sus principales complejidades y señalar tendencias válidas para (...) cualquier profesor que pueden ajustarse con flexibilidad a esos patrones. La construcción analítica nos aportó luces para entender y explicar qué es lo que hace a un profesor un Buen Profesor. Esto es, la valoración del sentido común, la improvisación, la conciencia del cambio, la reflexión y la acción pedagógica. Sus características pueden ser intencionalmente promovidas en las distintas etapas de formación profesional porque tienen la cualidad de generar entusiasmo, contagio con un compromiso pedagógico, social y político por el trabajo bien hecho. This article discusses some of the results of an action based-research project developed in 2007 and 2008. We dedicated ourselves to the experience of installing “small children communities with thoughts of their own” in a rural public school, and in early childhood education classrooms in El Bolsón and Bariloche, both located in the province of Río Negro which lies in the Argentinean Patagonia region. This article presents our considerations about the temporal dimension prevailing in the spaces and mechanisms used when (...) “philosophizing” with small children: a temporal dimension answering more to the aionic character of time more than to the chronological one in the act of thinking; of a thinking built as a joint result of the whole group, in which the corporal manifestations during the process of expressing their thoughts are quite evident. During this project we could also confirm the efficiency of the mechanisms used: weekly encounters of 40 or 50 minutes, the circle, the use of a microphone or other symbolic ways used for the distribution of speech, attentive listening, respect for the words of others, a climate of confidence, the offering of any type of proposition or question without the fear of being mocked, and focusing the discussion on an interesting theme for all. In this way, the experience was also one of democratic dialogue and collective thought building; a way to create something “in common” for the group in question, allowing for the construction of cultural referents of their own, and allowing for better knowledge of themselves and of others. We initiate this article by discussing some of the proposals expressed in the virtual dialogue between D. Kennedy and W. Kohan which appeared in the previous volume of this revue. (shrink)

Usually within the context of computer simulations in quantum chemistry practices, there is a distinction between ab initio and semi-empirical methods. Related to this, a controversy within the scientific and philosophical communities came about regarding the superiority of the ab initio methods due to their theoretical rigor. In this article we re-evaluate the condition of the semi-empirical simulations in this area of research. Pan es un dios peculiar en muchos aspectos. Al contrario que los restantes dioses del panteón griego, él no es antropomorfo, sino que tiene patas, cola y cuernos de carnero. Un dios con características tan arcaicas sólo puede sobrevivir confinado a la Arcadia, una región que conserva numerosos arcaísmos religiosos. Sin embargo, a partir del 490 a.C. en que se instaura su culto en Atenas, el dios comienza a cambiar. En su evolución, Pan se asimila cada vez más a Dioniso. (...) El acercamiento entre ambas figuras deja su huella en el mito, pero sobre todo en el culto. Así, un dios que en Arcadia era venerado en santuarios construidos por la mano del hombre, en el resto de Grecia recibe culto en parajes agrestes, fundamentalmente cuevas. No parece casual el hecho de que también fuera de Arcadia la gruta sea el lugar reservado a los cultos mistéricos, incluidos los dionisíacos Pan is a god peculiar in many respects. In contrast to the other gods of the Greek pantheon, he is not anthropomorphic, but he has the legs, tail and horns of a goat. These features show his age. A god like Pan can only survive in Arcadia, a region that preserves many religious archaisms. However, from 490 BC, when his cult is established in Athens, this god begins to change. In his evolution, Pan becomes increasingly assimilated the god Dionysus. The rapprochement between the two gods left his mark on the mythology, but especially in the cult of Pan. Thus, a god who was worshiped in Arcadia in sanctuaries built by men, in the rest of Greece is worshiped in wild shrines, mainly caves.
