The results of applying Soft Systems Methodology (SSM) show that the nature of the solution and improvement in the problem situation involves some ambiguity. This is due to SSM’s theoretical inadequacy in extending multiple conceptual models to an agreed-upon human activity system. In fact, one of the most important and controversial issues in soft operations research is to ensure how the solution has been obtained and to secure whether the conditions under which the solution has been (...) obtained were satisfied. This article presents the necessary and sufficient conditions for achieving human activity systems as a solution to one of the widely-used methodologies of soft operations research, i.e. Soft Systems Methodology. Similarly, with the aim of reaching a better understanding of the nature of the solution provided by SSM, the soft solution is compared through an example with that of hard systems methodology. The UK NHS National Programme for IT has been criticized for a lack of clinical engagement. This paper uses a soft systems methodology analysis of a case study from the use of electronic systems within a National Health Service Mental Health Trust in the United Kingdom to explore the legal and ethical implications of the failure to develop clinical systems which are fit for purpose.Soft systems methodology was used as a theoretical model (...) both to derive deeper insights into the survey data and suggest how communication between those producing information and those using it, could be improved. Multiple methods were employed which included a postal survey and participant interviews to triangulate the data.The use of SSM reinforced the concept that the national IT programme is based on a ‘hard' systems view and does not take local factors into account. The study found administrative staff to be a crucial link between clinicians and information departments and highlighted the need for a joint-up information strategy and integrated systems.The article concludes with a discussion of the legal and ethical implications of the findings and the lessons for the broader UK national programme. It argues that the failure to deliver systems that are fit for purpose is not value neutral but an ethical issue. (shrink)

The paper sets out the challenges facing the Police in respect of the detection and prevention of the volume crime of burglary. A discussion of data mining and decision support technologies that have the potential to address these issues is undertaken and illustrated with reference the authors’ work with three Police Services. The focus is upon the use of “soft” forensic evidence which refers to modus operandi and the temporal and geographical features of the crime, rather than “hard” evidence (...) such as DNA or fingerprint evidence. Three objectives underpin this paper. First, given the continuing expansion of forensic computing and its role in the emergent discipline of Crime Science, it is timely to present a review of existing methodologies and research. Second, it is important to extract some practical lessons concerning the application of computer science within this forensic domain. Finally, from the lessons to date, a set of conclusions will be advanced, including the need for multidisciplinary input to guide further developments in the design of such systems. The objectives are achieved by first considering the task performed by the intended systems users. The discussion proceeds by identifying the portions of these tasks for which automation would be both beneficial and feasible. The knowledge discovery from databases process is then described, starting with an examination of the data that police collect and the reasons for storing it. The discussion progresses to the development of crime matching and predictive knowledge which are operationalised in decision support software. The paper concludes by arguing that computer science technologies which can support criminal investigations are wide ranging and include geographical information systems displays, clustering and link analysis algorithms and the more complex use of data mining technology for profiling crimes or offenders and matching and predicting crimes. We also argue that knowledge from disciplines such as forensic psychology, criminology and statistics are essential to the efficient design of operationally valid systems. (shrink)

Knowledge-Based Systems (KBS) are developed to contain substantial elements of human knowledge and expertise in a well-defined domain, and use these to support user or expert tasks. Issues related to the social and organisational contexts of these systems are widely acknowledged to be particularly critical to their success. However, methodology proposals usually stop short of adequately handling soft and unstructured data that frame the contexts of use. The handling of qualitative data needs to be done in (...) a way that directly impinges on the wider Knowledge-Based System engineering processes and decisions. In this paper, we discuss the nature of context-sensitive issues, and describe a methodological approach for resolving them through the rigorous analysis of qualitative data, using a methodology which is based upon the Grounded Theory method from the social sciences. Those who believe that explicitly Christian thinking is possible in the scientific disciplines tend to assume that it must be antithetical to the world’s thinking. Based on some of the author’s experience, this article examines a different approach, in which Christian thinking is used to account for and enrich the world’s thinking by transplanting it from its current ground-motive into the arguably more fertile soil of the creation-fall-redemption ground-motive. The article shows how Dooyeweerd’s version of Christian thinking has been employed (...) in two areas of thinking in information systems : thinking about the nature of computers and information, with the artificial intelligence question of whether computer is like human being soft systems methodology, by which perspectives on ‘human activity systems’ are orchestrated into new learning and plans. In both areas, the original ideas are accounted for, given philosophical underpinning, reinterpreted and enriched. These two show that Dooyeweerd’s philosophy can be equally useful in thinking grounded in both positivist and interpretivist cultures. (shrink)

The industries of Japan have developed by learning from Western industries, especially the USA, and by implementing many of their concepts and technologies. However, Japanese industries have often implemented these concepts and technologies in a very different way from the USA. For example, while the USA uses information systems in retail industries as a tool by which data are collected and analysed to ‘control the market’, in Japan this same technology is considered rather as a learning device to ‘interpret (...) the market’. While in the USA the market is seen as a natural phenomenon capable of being controlled, the Japanese see it as an ambiguous phenomenon that is ever changing and is not capable of being controlled. Critics have challenged agricultural scientists to address concerns for environmental quality, farm size and structure, international justice, and the health and welfare of consumers and farm labor in research planning. The goal of this research was to determine what is and what could be done to consider value-laden knowledge relevant to these concerns in research planning. Descriptions of a state agricultural experiment station and of a hierarchy of inquiry that included applied systems analysis and reductionist approaches to science revealed (...) the goal-seeking and expert-centered nature of agricultural research. Value-laden and value-free knowledge of agricultural scientists and administrators were heavily represented in broad research goals such as increased productivity and efficiency. In addition, these goals were not evaluated at the levels of inquiry typically practiced by agricultural scientists. A soft systems methodology provided a more holistic level of inquiry that could facilitate consideration of value-laden and value-free knowledge of world views more diverse than those of agricultural scientists and administrators. Scientists could function as co-learners with other participants to identify issues and to conceptualize systems that are relevant to improving research planning. Moreover, researching the practice of soft systems offers opportunities for exploring systems ideas and holistic value theory in relation to agricultural research. (shrink)

This chapter provides the rationale for applying a systems approach to language pedagogy; presents a case study in which soft systems methodology, a type of soft systems approach, was applied to language curriculum development; and attempts to manage language teaching research from a communicative perspective. In doing so, it argues that language pedagogy is a complex phenomenon in which various factors affect one another in complex ways. By referring to language teaching research that investigates (...) the nature of the factors of language pedagogy, it also argues that due to lack of communication among the research areas in the field, each of the discrete research topics has been discussed individually within the confines of those research areas, often resulting in the so-called silo effect. Understanding stakeholders’ perceptions and motivations is of significant importance in relation to conservation and protected area projects. The importance of stakeholder analysis is widely recognized as a necessary means for gaining insight into the complex systemic interactions between natural processes, management policies, and local people depending on the resource. Today, community and group-based participatory inquiry approaches are widely used for this purpose. Recently, participatory approaches have been critiqued for not considering power relations and conflict internal to the community. In this (...) article, we suggest that the five-step Rapid Stakeholder and Conflict Assessment (RSCA) methodology addresses this critique. The objective of the methodology is to provide a facilitator with a comprehensive foundation on which to plan and conduct subsequent participatory project development. The RSCA integrates elements of soft systems and critical systems thinking. Qualitative research interviews and cognitive mapping of stakeholders’ mental models are used for collection of empirical material and analysis. The RSCA methodology is demonstrated in a case study concerning buffer zone management in the coastal wetlands of southern Vietnam. The case study shows that the RSCA methodology can provide an efficient way of obtaining a holistic and critical understanding of a complex resource management situation, thus potentially enhancing project performance in an instrumental as well as an ethical sense. Orthodox business ethics, conventional management theory, and a great deal of higher education embody the overriding emphasis accorded to analysis by yesteryear''s science. An alternative strategy, exemplified by the war stories told by a Confederate Genral, is more consistent with late 20th century science in general and soft systems methodology in particular.The characteristic way of management that we have taught... is to take a complex system, divide it into parts, and then try to manage each part as (...) well as possible. Organisations increasingly use automated decision-making systems (ADMS) to inform decisions that affect humans and their environment. While the use of ADMS can improve the accuracy and efficiency of decision-making processes, it is also coupled with ethical challenges. Unfortunately, the governance mechanisms currently used to oversee human decision-making often fail when applied to ADMS. In previous work, we proposed that ethics-based auditing (EBA)—that is, a structured process by which ADMS are assessed for consistency with relevant principles or norms—can (a) help (...) organisations verify claims about their ADMS and (b) provide decision-subjects with justifications for the outputs produced by ADMS. In this article, we outline the conditions under which EBA procedures can be feasible and effective in practice. First, we argue that EBA is best understood as a ‘soft’ yet ‘formal’ governance mechanism. This implies that the main responsibility of auditors should be to spark ethical deliberation at key intervention points throughout the software development process and ensure that there is sufficient documentation to respond to potential inquiries. Second, we frame AMDS as parts of larger sociotechnical systems to demonstrate that to be feasible and effective, EBA procedures must link to intervention points that span all levels of organisational governance and all phases of the software lifecycle. The main function of EBA should, therefore, be to inform, formalise, assess, and interlink existing governance structures. Finally, we discuss the policy implications of our findings. To support the emergence of feasible and effective EBA procedures, policymakers and regulators could provide standardised reporting formats, facilitate knowledge exchange, provide guidance on how to resolve normative tensions, and create an independent body to oversee EBA of ADMS. This paper aims to make a proposal to govern the Peruvian State under the umbrella of management cybernetics, following the paths of the viable system model, proposed by Prof. Stafford Beer, enriched with other soft and hard systemic methodologies and technologies, to cover the soft and hard issues that are part of the complex Peruvian reality at different levels of recursion. For doing this, four defined perspectives were adopted to understand the complexity of Peru: the sectoral view, the (...) regions view, the river basins view and the macroregions view. Peru is seen as a system in focus, defining, for each of these four perspectives, the five systems that VSM has. The application of the VSM in each perspective serves to apply it in two modes: diagnosis and design, according to the respective perspective. Then an integrative analysis and reflection is done considering the four perspectives, to analyze the viability of the VSM approach in the governance of the Peruvian State to establish some conclusions and recommendations in relation to the proposal, appearing at the end of the paper. Engineers fine-tune the design of robot bodies for control purposes, however, a methodology or set of tools is largely absent, and optimization of morphology (shape, material properties of robot bodies, etc.) is lagging behind the development of controllers. This has become even more prominent with the advent of compliant, deformable or ”soft” bodies. These carry substantial potential regarding their exploitation for control—sometimes referred to as ”morphological computation”. In this article, we briefly review different notions of computation by physical (...) systems and propose the dynamical systems framework as the most useful in the context of describing and eventually designing the interactions of controllers and bodies. Then, we look at the pros and cons of simple vs. complex bodies, critically reviewing the attractive notion of ”soft” bodies automatically taking over control tasks. We address another key dimension of the design space—whether model-based control should be used and to what extent it is feasible to develop faithful models for different morphologies. (shrink)

Measurement in soft systems generally cannot exploit physical sensors as data acquisition devices. The emphasis in this case is instead on how to choose the appropriate indicators and to combine their values so to obtain an overall result, interpreted as the value of a property, i.e., the measurand, for the system under analysis. This paper aims at discussing the epistemological conditions of the claim that such a process is a measurement, and performance evaluation is the case introduced to (...) support the analysis, performed in systematic comparison with the paradigm of measurement of physical quantities. Some background questions arising here are: – Are the chosen indicators appropriate performance indicators? – Do such indicators convey complete and non-redundant information on performance? – Does the chosen combination rule generate results suitably interpretable as performance values? And enlarging the focus: – Does the obtained value specifically convey information on the system under analysis, instead of some different entity (typically including the subject who is evaluating)? Operatively: would different subjects evaluate the same system in the same way? i.e., is the obtained information objective? – Does the obtained value convey information that is interpretable in the same way by different subjects? Operatively: would different subjects who have agreed on a decision procedure make the same decision from the same performance information? i.e., is the obtained information intersubjective? Any well founded positive answers to these questions significantly support a structural interpretation of measurement encompassing both physical and soft measurement. (shrink)

This paper compares some key concepts from Buddhism with ideas from different traditions of systems thinking. There appear to be many similarities, suggesting that there is significant potential for dialogue and mutual learning. The similarities also indicate that it may be possible to develop a Buddhist systems methodology to help guide exploration and change within Buddhist organisations.

There is continuing interest in action research in health care. This is despite action researchers facing major problems getting support for their projects from mainstream sources of R&D funds partly because its validity is disputed and partly because it is difficult to predict or evaluate and is therefore seen as risky. In contrast traditional health science dominates and relies on compliance with strictly defined scientific method and rules of accountability. Critics of scientific health care have highlighted many problems including a (...) perpetual quality gap between what is publicly expected and what is deliverable in the face of rising costs and the cultural variability of scientific medicine. Political demand to close the quality gap led to what can be seen as an elitist reform of policy on UK health research by concentrating more resources on better fewer centres and this may also have reduced support for action research. However, incompetent, unethical or criminal clinical practice in the UK has shifted policy towards greater patient and public involvement in health care and research. This highlights complementarity between health science and action research because action research can, as UK health policy requires, involve patients and public in priority setting, defining research outcomes, selecting research methodology, patient recruitment, and interpretation of findings and dissemination of results. However action research will remain marginalised unless either scientific research is transformed generally into a more reflective cycle or there is increased representation of action research enthusiasts within the establishment of health R&D or current peer review and public accountability arrangements are modified. None of these seem likely at this time. The case for complementarity is illustrated with two case studies. (shrink)

This book has been written primarily for the applied and social scientist and student who longs for an integrated picture of the foundations on which his research must ultimately rest; but hopefully the book may also serve philosophers interested in applied disciplines and in systems methodology. If integration was the major motto, the need for a method ology, appropriate to the teleological peculiarities of all applied sciences, was the main impetus behind the conception of the present work. This (...) need I felt a long time ago in my own area of analytical and empirical research in accounting theory and management science; later I had the opportunity to teach, for almost a decade, graduate seminars in Methodology which offered particular insight into the methodological needs of students of such applied disciplines as business administration, education, engineering, infor matics, etc. Out of this effort grew the present book which among other things tries, on one side, to illuminate the difference and relationship between methods of cognition and methods of decision and on the other, to sketch a framework suitable for depicting means-end relationships in a holistic setting. I believe that a systems methodology which incorporates recent endeavours of deontic logic, decision theory, information economics and related areas would be eminently suited to break the ground for such a future framework. Yet systems theory has two major shortcomings which might prevent it from evolving into the desired methodology of applied science. (shrink)

Despite considerable recent attention, important features of Schelling’s famous work, the 1809 treatise On the Essence of Human Freedom, remain under-explored. One of these is the methodological dualism which Schelling advocates at the very start of the text. Schelling aims to weld together into a coherent position a first-person phenomenology of freedom and an explanation achieved by locating freedom within a conceptual system articulating the basic structure of the world. Most interpretations of the Freiheitsschrift, however, concentrate on only one of (...) these approaches, thus foreshortening their understanding of Schelling’s enterprise. The article explores this tendency towards one-sidedness by considering two sophisticated recent interpretations of the work, taking opposite tacks. One, by Markus Gabriel, focuses on the distinctive, self-reflexive metaphysics which Schelling proposes, while the other, by Sebastian Gardner, claims that Schelling’s ontology is extrapolated entirely from his account of our moral consciousness, a procedure pioneered by Kant. The article argues that neither of these interpretations can do full justice to Schelling’s project. Furthermore, although the Freiheitsschrift is not entirely successful, and hence points towards later developments in Schelling’s thinking, its treatment of freedom is superior to the ‘soft naturalism’ pioneered by Peter Strawson, and currently influential across various philosophical traditions. Reconstructability analysis (RA) decomposes wholes, namely data in the form either of set theoretic relations or multivariate probability distributions, into parts, namely relations or distributions involving subsets of variables. Data is modeled and compressed by variable-based decomposition, by more general state-based decomposition, or by the use of latent variables. Models, which specify the interdependencies among the variables, are selected to minimize error and complexity.

In this chapter, we argue that in order to understand the interdisciplinary and transdisciplinary dialectics in sustainability science, it is useful to see sustainability science as a kind of management science, and then to highlight the hard-soft distinction in systems thinking. First, we argue that the commonly made natural-social science dichotomy is relatively unimportant and unhelpful. We then outline the differences between soft and hard systems thinking as a more relevant and helpful distinction, mainly as a (...) difference between perspectives in systemic modeling toward models. We also illustrate that the distinction is methodologically useful to advance sustainability science by enabling us (i) to suggest novel ways of using existing theoretical, experimental, and computational resources of the sciences for renewable resource management, and (ii) to disentangle disciplinary disagreements in climate science. The purpose of this study is to take preliminary steps to unify psychoacoustic techniques with reaction-time methodologies to address the perceptual mechanisms responsible for the detection of one vs. multiple sounds. We measured auditory redundancy gains for auditory detection of pure tones widely spaced in frequency using the tools of Systems Factorial Technology to evince the system architecture and workload capacity in two different scenarios. We adopted an experimental design in which the presence or absence of a target at (...) each of two frequencies was combined factorially with two stimulus levels. Replicating previous work, results did not allow an assessment of system architecture due to a failure to observe factor influence at the level of distribution ordering for dual-target stimuli for both SOFT and LOUD scenarios. All subjects demonstrated very modest redundancy gains for the dual-target compared to the single-target stimuli, and results were similar for both LOUD and SOFT. We propose that these results can be predicted by a mental architecture that falls into the class of integrated subadditive parallel systems, using a well-supported assumption that reaction time is driven by loudness. We demonstrate that modeled loudness of the experimental sounds is highly correlated with mean reaction time, and we provide a proof-of-concept model based on Steven’s Power law that predicts both a failure of distributional ordering for dual-target stimuli and very modest redundancy gains. Scheduling has been an important research field in Artificial Intelligence. Because typical scheduling problems could be modeled as a Constraint Satisfaction Problem, several constraint satisfaction techniques have been proposed. In order to handle the different levels of importance of the constraints, solving a problem as a Weighted Maximal Constraint Satisfaction Problem is an promising approach. However, there exists the case where unexpected events are added and some sudden changes are required, i.e., the case with dynamic changes in scheduling problems. In (...) this paper, we describe such dynamic scheduling problem as a Dynamic Weighted Maximal Constraint Satisfaction Problem in which constraints would changes dynamically. Generally, it is undesirable to determine vastly modified schedule even if re-scheduling is needed. A new schedule should be close to the current one as much as possible. In order to obtain stable solutions, we propose the methodology to maintain portions of the current schedule using the provisional soft constraints, which explicitly penalize the changes from the current schedule. We have experimentally confirmed the efficacy of re-scheduling based on our method with provisional constraints. Punchenko, A. Zelenkova, C. Kirvel, A. Lazarevich, V. Nikitenko, A. Sosnin, A.Utkin and many others. The aim of the article is to concretize the concept of “globalization”, and also through the analysis of tectonic shifts in the world sociological system, to represent the main socio-political, cultural and civilizational dimensions of this concept. Research objectives - in the context of the stated goal, the essence of the social dynamics of a globalizing world is revealed. Research Methodology. The methodology is based on an integrated approach, due to its interdisciplinary nature. The result of the study. Sociodynamics is revealed as the process of its deployment in time and space in conjunction with the social organization of social organization, as well as with social changes and upheavals affecting the progressive course of its development. The contradictory nature of globalization has been proved, its brilliance and poverty are revealed with specific examples. The whole range of problems of globalization as a multidimensional phenomenon is actualized. The reasons that prevented the implementation of the concept of Western ideologists about building a unipolar world and the creation of a single governing body under the auspices of the United States are revealed. Sociodynamics of the global world, in the context of the goal set, is reflected through the prism of the financial and economic dimension; through the formation of frontiers, fraught with the charge of aggravation, instability, risks, dynamic chaos. Conclusions. The mechanisms of regulation of the emerging chaos in social relations - threats, sanctions, crisis fluctuations, the use of “soft power”, conflicts, etc. are substantiated. The thesis attempts to provide a real definition of religion and argues that this is less problematic than is often assumed. It begins with a brief introduction which outlines why it is attractive to subject the attempt to define religion to a philosophical investigation. It is argued that defining religion is interesting because it is something which appears difficult to do, which scholars of religion often oppose, and which has practical implications. In addition, defining religion provides an opportunity to address (...) fundamental philosophical issues (such as defining, social kinds, and theories of concepts) and theoretical questions concerning the study of religion. The introduction also mentions the difficulties these kinds of interdisciplinary enterprises are bound to meet because of differences in terminology and academic traditions. Part I is concerned with the philosophical, historical, and methodological issues in discussions necessary to pave the way for the attempt to provide a definition of religion. The first chapter addresses some fundamental philosophical issues concerning defining as a philosophical activity. It is argued that the traditional focus on natural kind concepts in discussions about defining needs to be supplemented with considerations about domain specificity and differences between social kinds. It is also argued that empirical findings from cognitive psychology are relevant to conceptual analysis and that two-dimensional semantics provides a productive approach to an analysis of the concept of religion. The chapter concludes with describing an approach to defining religion. The second chapter is also concerned with methodological questions and considers the potential contributions empirical studies of the concept of religion could make to the study. Some outlines of potentially useful studies are suggested, and pros and cons for including them in the present study are weighed up. The chapter concludes with drawing a distinction between essential and non-essential elements and assessing their relative importance in a definition. The third chapter offers, first, an overview of historical issues: the history of the term ‘religion’, the problem of determining the content of historical philosophical concepts of religion, and the history of the discussion about defining religion within the study of religion. The major conclusions of these sections are that the term ‘religion’ is likely to be a homonym and that several theoretical discussions have been intertwined in the historical debates about definitions of religion. The second part of the chapter discusses traditional fundamental issues in the study of religion in order to disentangle the discussion about definition from related discussions (about e.g. methods and religious (anti-)realism). It is concluded that an essentialist view on defining religion is not necessarily a return to apologetic approaches to religion. The fourth chapter offers an overview of positions for and against realism concerning religion and the possibility of providing a definition of religion. Important distinctions are drawn between two kinds of conceptual essentialism (related to definition) and two kinds of ontological essentialism (related to theories). A discussion of the various forms of essentialism concludes that a ‘soft essentialist’ approach to defining religion is preferable. It is also concluded that constructivist and other anti-realist objections to providing a real definition of religion are less obvious than is often assumed because they fail to offer a detailed account of the supposed ‘construction’ that is free of realist assumptions. They also appear to rely on controversial philosophical assumptions. The second part of the thesis is concerned with providing a definition of religion. It begins in chapter five with an overview of some multifactorial, or ‘soft essentialist’, approaches to defining religion. The purpose of this is to prepare the ground for the conceptual analysis, which opens with a discussion of various aspects of religion. Ten possible candidates for necessary and/or sufficient conditions for religion are discussed in order to determine their importance in a definition of religion. It is concluded that although many aspects are typical and/or relevant, only certain cognitive, normative, and practical aspects are necessary conditions for religion. It is also concluded that the necessary conditions for a religious cognitive aspect is supernatural and normative content of a certain scope combined with a certain attitudinal character. The chapter ends with a model of the working definition based on these intermediate conclusions. Chapter six contains the second step in the conceptual analysis. It confronts the working definition with various cases of more or less contested examples of religion or other systems of beliefs and practices in order to assess whether the definition needs revisions. The following discussions of special cases of beginning and ceasing of religious traditions, persons, and objects serve the same purpose. It is concluded that a revision of the working definition is unnecessary. Chapter seven concludes part II by tying up a few loose ends concerning the definition, some methodological aspects, and theories of concepts. The third and last part of the thesis contains, first, a brief discussion of practical implications of definitions of religion. Chapter eight illustrates the practical importance of a definition of religion by addressing the issue of the so-called ‘politics of defining religion’. It argues that scholars of religion as such are not unjustified in entering the debate about definitions, and it recommends efforts are made to separate discussions about defining religion from discussions about using definitions of religion as political tools. The final chapter of the thesis sums up important findings and insights of the study and points to some natural limitations. I warn that this study is only a rough outline of how a definition can be provided and which theoretical discussions lie behind such an attempt. Yet I also conclude that defining religion is a rewarding case study because it offers an opportunity to discuss fundamental questions in both philosophy and the study of religion while at the same addressing an interesting issue with immediate practical implications. This paper presents a methodology to design and implement programs intended to decide cases, described as sets of factors, according to a theory of a particular domain based on a set of precedent cases relating to that domain. We useDialectical Frameworks, a recent development in AI knowledge representation, as the central feature of our design method. ADFs will play a role akin to that played by Entity–Relationship models in the design of database systems. First, we explain how the (...) factor hierarchy of the well-known legal reasoning system CATO can be used to instantiate an ADF for the domain of US Trade Secrets. This is intended to demonstrate the suitability of ADFs for expressing the design of legal cased based systems. The method is then applied to two other legal domains often used in the literature of AI and Law. In each domain, the design is provided by the domain analyst expressing the cases in terms of factors organised into an ADF from which an executable program can be implemented in a straightforward way by taking advantage of the closeness of the acceptance conditions of the ADF to components of an executable program. We evaluate the ease of implementation, the performance and efficacy of the resulting program, ease of refinement of the program and the transparency of the reasoning. This evaluation suggests ways in which factor based systems, which are limited by taking as their starting point the representation of cases as sets of factors and so abstracting away the particular facts, can be extended to address open issues in AI and Law by incorporating the case facts to improve the decision, and by considering justification and reasoning using portion of precedents. The recent drastic development of agriculture, together with the growing societal interest in agricultural practices and their consequences, pose a challenge to agricultural science. There is a need for rethinking the general methodology of agricultural research. This paper takes some steps towards developing a systemic research methodology that can meet this challenge – a general self-reflexive methodology that forms a basis for doing holistic or (with a better term) wholeness-oriented research and provides appropriate criteria of scientific quality.From (...) a philosophy of research perspective,science is seen as an interactive learning process with both a cognitive and a social communicative aspect. This means, first of all,that science plays a role in the world that it studies. A science that influences its own subject area, such as agricultural science, is named a systemic science. From this perspective, there is a need to reconsider the role of values in science. Science is not objective in the sense of being value-free.Values play, and ought to play, an important role in science – not only in form of constitutive values such as the norms of good science, but also in the form of contextual values that enter into the very process of science. This goes against the traditional criterion of objectivity. Therefore, reflexive objectivity is suggested as a new criterion for doing good science, along with the criterion of relevance. Reflexive objectivity implies that the communication of science must include the cognitive context, which comprises the societal,intentional, and observational context. Ina ccordance with this, the learning process of systemic research is shown as a self-reflexive cycle that incorporates both an involved actor stance and a detached observer stance. The observer stance forms the basis for scientific communication.To this point, a unitary view of science as a learning process is employed. A second important perspective for a systemic research methodology is the relation between the actual,different, and often quite separate kinds of science. Cross-disciplinary research is hampered by the idea that reductive science is more objective, and hence more scientific, than the less reductive sciences of complex subject areas – and by the opposite idea that reductive science is necessarily reductionistic. Taking reflexive objectivity as a demarcator of good science, an inclusive framework of science can be established. The framework does not take the established division between natural, social, and human science as a primary distinction of science.The major distinction is made between the empirical and normative aspects of science,corresponding to two key cognitive interests.Two general methodological dimensions, the degree of reduction of the research world and the degree of involvement in the research world, are shown to span this framework. The framework can form a basis for transdisciplinary work by way of showing the relation between more and less reductive kinds of science and between more detached and more involved kinds of science and exposing the abilities and limitations attendant on these methodological differences. Existing accounts of Foucault’s archaeological methodology have not (a) contextualized the concept properly within the intellectual field of its emergence and (b) explained why it is called ‘archaeology’ and not simply ‘history’. Foucault contributed to the field of ‘history of systems of thought’ in France around 1960 by broadening its scope from the study of scientific and philosophical systems into systems of ‘knowledge’ in a wider sense. For Foucault, the term ‘archaeology’ provided a response to new (...) methodological questions arising from this initiative. Archaeological methodology had already been developed into a distinct comparative approach for the study of linguistic and cultural systems, notably by Dumézil. Foucault redevised archaeological methodology for the post-Hegelian tradition of studying ‘problems’ prevalent in the history of systems of thought. The article thus furnishes the groundwork for a ‘sociological archaeology’ or ‘problem analysis’ that is not particularly dependent on Foucault as a social theorist of power. (shrink)

Web legal information retrieval systems need the capability to reason with the knowledge modeled by legal ontologies. Using this knowledge it is possible to represent and to make inferences about the semantic content of legal documents. In this paper a methodology for applying NLP techniques to automatically create a legal ontology is proposed. The ontology is defined in the OWL semantic web language and it is used in a logic programming framework, EVOLP+ISCO, to allow users to query the (...) semantic content of the documents. ISCO allows an easy and efficient integration of declarative, object-oriented and constraint-based programming techniques with the capability to create connections with external databases. EVOLP is a dynamic logic programming framework allowing the definition of rules for actions and events. An application of the proposed methodology to the legal web information retrieval system of the Portuguese Attorney General’s Office is described. (shrink)

The primary way that explanations are constructed in cognitive psychology is by methodological functionalism: in short, functionally defined components are proposed in order to explain how inputs are turned into behavior. But despite its close association with cognitive psychology, methodological functionalism is a technique that can be used to describe any natural system. I look at how methodological functionalism has fared when used by other special sciences and what lessons can be learned from these cases. Three explanations of chemical and (...) biological systems that were developed using methodological functionalism are examined: Willis’s explanation of fermentation, Farr’s explanation of cholera, and Mendel’s explanation of inheritance. Contemporary Information Systems management incorporates the need to make explicit the links between semiotics, meaning-making and the digital age. This focus addresses, at its core, pure rationality, that is, the capacity of human interpretation and of human inscription upon reality. Creating the new real, that is the motto. Humans are intrinsically semiotic creatures. Consequently, semiotics is not a choice or an option but something that works like a second skin, establishing limits and permeable linkages between: human thought and human's (...) infinite world of imagination; and human action, with its correspondent infinite world of intentionality, of desire and of unexplored possibilities. Two instances are contrasted as two reading lenses of current business reality: IS governance and industry 4.0. These phenomena correspond to the need to take accountability, transparency and responsibility into account, when designing IS and when using such systems through the ecology of connectivity, Big Data and the Internet of Things. Political, social and cultural dimensions are brought into the equation, when addressing the question of the relevance and adequateness of IS theory and practice to respond to contemporary challenges. This study aims to identify the necessary strategies for the development of a sustainable financial system. For this purpose, a novel approach could be provided for soft computing with Gaussian-based fuzzy DEMATEL approach to understand the significant levels and impact-relation degrees of these criteria. For robustness check, this evaluation has also been performed for triangular and trapezoidal fuzzy sets. There are many novelties of this study. Firstly, computer science has a significant role in the decision-making process. Another specificity is (...) that the use of Gaussian numbers with fuzzy numbers is a new area. In addition, interval type-2 fuzzy sets also provide a significant advantage in decision-making under uncertainty. The results demonstrate that the size of the alternative financing, investment in efficient projects, and effective advertisement/promotions are the most important items to affect the performance of alternative banking system of emerging economies. Hence, it is recommended that the new banking applications should be applied by the state or the state can provide some incentives for foreign banks to invest in emerging economies, such as tax reduction. Another important point is that the financial intermediations should generate a component financial analysis team to examine the financial reports of the companies in detail so that the financial credibility of these companies can be evaluated more effectively. Methodological strategies for the identification and synthesis of ‘evidence’ to support decision‐making in relation to complex healthcare systems and practices This paper addresses the limitations of current methods supporting ‘evidence‐based health‐care’ in relation to complex aspects of care, including those questions that are best supported by descriptive or non‐empirical evidence. The paper identifies some new methods, which may be useful in aiding the synthesis of data in these areas. The methods detailed are broadly divided into those that facilitate the (...) identification of evidence and those that enable the interpretation of the data retrieved. To illustrate some of the issues involved, reference is made to a multimethod review recently completed by the authors, which aimed to identify factors that promote continuity in the transition from child to adult health and social care. It is argued that as healthcare organisations are becoming increasingly preoccupied with the evidence base of practice, such methods may help ensure that aspects of care and approaches that are outside the dominant pharmaco‐medical domain maintain a prominent position on the healthcare agenda while remaining open to external scrutiny. Healthcare professionals who use such approaches need to know their relative utility and benefits to inform clinical decisions, so as to ensure that best practice is observed. (shrink)

The last thirty years of scholarship in western medieval philosophical historiography have seen a number of reflections on the methodological paradigms, schools, trends, and dominant approaches in the field. As a contribution to this ongoing assessment of the existing methods of studies in medieval philosophy and theology and a supplement to classifications offered by M. Colish, J. Inglis, C. König-Pralong, J. Marenbon, A. de Libera, and others, the article offers another explanatory tool. Here is a description of an imaginary system (...) of methodological coordinates that systematizes the current tendencies by placing them in a three-dimensional system of axes. Every axis corresponds to a certain aspect of the historical and systematic research in medieval thought and symbolizes a possible movement between two extremes representing opposite methodological values and directions. The methods and approaches practiced in recent studies in medieval philosophy and theology might be schematically located inside this general system of argumentational, focal (or objectival), and (con)textual axes with their intersection identified with what some scholars call the “integral” model of study. This explanatory tool allows one to see how current approaches and methods form a panoply of axes that belong together in one complex grid and helps to visualize the tapestry of existing approaches in medieval philosophical historiography.
