The current study examines similarity or disparity of a frontally mediated physiological response of mental effort among multiple executive functioning tasks between children and adults. Task performance and phasic heart rate variability (HRV) were recorded in children (6 to 10 years old) and adults in an examination of age differences in executive functioning skills during periods of increased demand. Executive load levels were varied by increasing the difficulty levels of three executive functioning tasks: inhibition (IN), working memory (WM), and planning/problem (...) solving (PL). Behavioral performance decreased in all tasks with increased executive demand in both children and adults. Adults’ phasic high frequency HRV was suppressed during the management of increased IN and WM load. Children’s phasic HRV was suppressed during the management of moderate WM load. HRV was not suppressed during either children’s or adults’ increasing load during the PL task. High frequency phasic HRV may be most sensitive to executive function tasks that have a time-response pressure, and simply requiring performance on a self-paced task requiring frontal lobe activation may not be enough to generate HRV responsitivity to increasing demand. The received view of implicit bias holds that it is associative and unreflective. Recently, the received view has been challenged. Some argue that implicit bias is not predicated on “any” associative process, but it is unreflective. These arguments rely, in part, on debiasing experiments. They proceed as follows. If implicit bias is associative and unreflective, then certain experimental manipulations cannot change implicitly biased behavior. However, these manipulations can change such behavior. So, implicit bias is not associative and unreflective. This paper (...) finds philosophical and empirical problems with that argument. When the problems are solved, the conclusion is not quite right: implicit bias is not necessarily unreflective, but it seems to be associative. Further, the paper shows that even if legitimate non-associative interventions on implicit bias exist, then both the received view and its recent contender would be false. In their stead would be interactionism or minimalism about implicit bias. (shrink)

In “On Begging the Systematicity Question,” Wayne Davis criticizes the suggestion of Cummins et al. that the alleged systematicity of thought is not as obvious as is sometimes supposed, and hence not reliable evidence for the language of thought hypothesis. We offer a brief reply.

The current debate over systematicity concerns the formal conditions a scheme of mental representation must satisfy in order to explain the systematicity of thought.1 The systematicity of thought is assumed to be a pervasive property of minds, and can be characterized (roughly) as follows: anyone who can think T can think systematic variants of T, where the systematic variants of T are found by permuting T’s constituents. So, for example, it is an alleged fact that anyone who can think the (...) thought that John loves Mary can think the thought that Mary loves John, where the latter thought is a systematic variant of the former. This article attemps to provide a good defense for battered women who kill their sleeping husbands, particularly in cases where it is judged that she was mistaken in her assumption of the need to exercise self-defense. Proceeding from the distinction between the imputation of an act to an actor and the imputation of blame to an actor for criminally prohibited conduct , the article moves on to a discussion of the relevance of mistakes as to justifying circumstances under the criminal (...) law. Although some attention is given to the theoretically sound solution to the problem raised by the unknowingly justified actor, primary emphasis is placed on the putatively justified actor. The argument is advanced that the false assumption of justifying circumstances negates the imputation of wrongful conduct to an actor, rather than negating the imputation of blame to him for his wrongful conduct. Accordingly, criminal liability can only attach to an individual acting in putative self-defense, for example, if that individual was negligent for making the mistake . The standard for judging negligence in the United States is that of the so-called "reasonable person". A great deal of discussion in the U.S. scholarly literature has been revolving around the question of whether an "objective" or "subjective" standard of reasonableness should be employed when determining whether an individual acted reasonable and thus non-negligently. This article argues for a "subjective" standard for the criminal law, as opposed to an "objective" standard, which is claimed to have more relevance for tort law . Finally, the claim is made that a battered woman who kills her sleeping husband should be given the benefit of the self-defense justification under the U.S. law approach to self-defense. If the woman is mistaken as to the need to exercise self-defense, then wrongful conduct should be imputed to her only on the basis of whether her mistake was subjectively unreasonable and thus negligent . Der Aufsatz liefert Argumente dafür, daß eine "battered woman" für die Tötung ihres schlafenden Ehemannes strafrechtlich nicht zur Verantwortung gezogen werden kann, und zwar insbesondere dann nicht, wenn sie irrig Umstände annimmt, die, wenn sie vorlägen, die Handlung der Frau unter Notwehrgesichtspunkten rechtfertigen würden. Die Unterscheidung zwischen der Zurechnung eines Vorgangs als Handlung und der Zurechnung einer rechtswidrigen Tat zur Schuld wird vorangeschickt . Dann wird die strafrechtliche Relevanz von Irrtümern über rechtfertigende Umstände besprochen. Zwar wird die theoretisch richtige Lösung auch solcher Fälle diskutiert, bei denen der Täter rechtfertigende Umstände verkennt. Doch wird die Betonung auf die Fälle der Putativnotwehr gelegt, wobei die These vertreten wird, daß die irrige Annahme von rechtfertigenden Umständen die Zurechnung des Vorgangs als Totschlagshandlung und nicht erst die Zurechnung zur Schuld ausschließt. Daraus läßt sich entnehmen, daß der Täter, der in Putativnotwehr handelt, strafrechtlich nur dann verantwortlich ist, wenn sein Irrtum auf Fahrlässigkeit beruht . In den U.S.A. wird die Frage, ob jemand fahrlässig gehandelt hat oder nicht, danach beantwortet, ob eine "reasonable person" in der gegebenen Situation genauso wie der Täter gehandelt hätte. Zur Zeit findet eine lebhafte Diskussion darüber statt, ob dieser Maßstab "objektiv" oder "subjektiv" aufzufassen sei. Anders ausgedrückt: Es wird die Frage gestellt, ob die Geschworenen die Annahmen eines Durchschnittsmenschen oder aber die eines Menschen mit den persönlichen Merkmalen und Erfahrungen des Angeklagten in ihren Überlegungen darüber heranziehen sollten, ob dieser hypothetische Mensch einem Irrtum wie dem des Angeklagten erlegen wäre. Der Aufsatz spricht sich, was strafrechtliche Urteile angeht, für den "subjektiven" und gegen den "objektiven" Maßstab aus, der statt dessen für die deliktsrechtlichen Urteile der angemessenere zu sein scheint . Die Ergebnisse dieser Argumentationen werden dann auf den Fall der "battered woman" angewandt. Es wird gezeigt, daß die geschundene Frau, die ihren schlafenden Ehemann tötet, nach dem U.S. Model Penal Code unter Notwehrgesichtspunkten gerechtfertigt sein kann. Sollte es im Einzelfall so sein, daß die Frau sich über die Erforderlichkeit der Notwehrhandlung geirrt hat, dann kann ihr die Handlung nur dann zugerechnet werden, wenn der Irrtum im "subjektiven" Sinne fahrlässig gewesen ist. In this book, T. L. Short corrects widespread misconceptions of Peirce's theory of signs and demonstrates its relevance to contemporary analytic philosophy of language, mind and science. Peirce's theory of mind, naturalistic but nonreductive, bears on debates of Fodor and Millikan, among others. His theory of inquiry avoids foundationalism and subjectivism, while his account of reference anticipated views of Kripke and Putnam. Peirce's realism falls between 'internal' and 'metaphysical' realism and is more satisfactory than either. His pragmatism is not verificationism; (...) rather, it identifies meaning with potential growth of knowledge. Short distinguishes Peirce's mature theory of signs from his better-known but paradoxical early theory. He develops the mature theory systematically on the basis of Peirce's phenomenological categories and concept of final causation. The latter is distinguished from recent and similar views, such as Brandon's, and is shown to be grounded in forms of explanation adopted in modern science. (shrink)

Controversy over providing financial incentives to research participants has a long history and remains an issue of contention in both current discussions about research ethics and for institutional review bodies/human research ethics committees which are charged with the responsibility of deciding whether such incentives fall within ethical guidelines. The arguments both for and against financial incentives have been well aired in the literature. A point of agreement for many is that inducement in the form of financial incentive is permissible when (...) the risk of harm to the individual is negligible in terms of degree and probability of occurrence. In the absence of harm to the individual, encouraging more people to participate in research would appear to be a good thing in so far as it will lead to statistically more robust research outcomes, which can then be translated into better healthcare and other practice. Whilst, on the face of it, this position seems highly defensible, I will explore the possibility that it is counterproductive – that is, providing individuals with financial incentives to become research participants may have the unintended outcome of reducing participation rates in some areas of research. In exploring this idea I will draw on empirical findings from the literature on crowding-out – the hypothesis that providing monetary incentives to people can backfire by overall reducing intrinsic motivation, in this instance intrinsic motivation to behave altruistically or undertake civic duties. Peirce earned his keep making measurements, mainly of gravity but also astronomical, and he made several contributions to the science of measurement. It has been said that his experience measuring had philosophical consequences: his adoption of fallibilism, his argument against necessitarianism, and his conception of inquiry as converging on the truth have all been mentioned. But not much attention has been paid to the curious episode of his making “the study of great men” part of a course in logic: students (...) were asked to rank a long list of men by order of greatness. That was at Johns Hopkins in 1883. I shall argue that that study, together with his reflections on pre-instrumental estimates of stars’ brightness, bears directly on the method of phaneroscopy formulated nearly two decades later. In each case, the problem is to show how objectivity is possible under conditions in which it must seem that objectivity is impossible. (shrink)

But as you know... my style of ‘brilliancy’ consists in a mixture of irony and seriousness,—the same things said ironically and also seriously.Peirce’s philosophical writings are notoriously difficult. The reasons most often cited are the apparent contradictions, the long, inconclusive technical digressions, and the unfinished character of his thought. His champions instead emphasize his originality, arguing that his apparent contradictions often mark traditional dualisms subtly transcended; some discern strands of an uncompleted system. Originality, subtlety, and the need to reconstruct the (...) whole from its fragmentary expressions also pose difficulties, albeit ones rewarding. I think, however, that the problem... (shrink)

In May 1867, when he was twenty-seven years of age, Charles Peirce read a paper to the American Academy of Arts and Sciences that was published in the next year under the title ‘On a New List of Categories’ (EP 1:1–10).1 It is remarkable for anticipating major features of his later thought: three categories relationally defined (bracketed, however, by two additional categories); a theory of signs, triadically conceived and triadically sub-divided, applied to thinking; the idea that every predicate is an (...) hypothesis; a form of abstraction named ‘prescision’; and a bold reconception of the Roman/medieval trivium. There have been many discussions on problems of logic over the past several years. While the problem of the nature of the law of contradiction, one of the laws of formal logic, has received particular attention by everyone, the question has not been posed very precisely in the arguments. Actually, the question is not whether the movement, change, and development of things can be reflected in consciousness by use of the methods of formal logic, or in distinguishing the effectiveness of (...) the law of contradiction in disputation, proofs, or theoretical systems from its effectiveness in the general process of cognition, when applied to phenomena. If the development of reality cannot at all be reflected by the use of the logical tools of formal logic, what use do they have? No one denies that formal logic does not suffice as a method of cognition. If, in disputations and proofs, or in the establishment of theoretical systems, one relies only on the logical tools of formal logic, this is also not enough. The scope of applicability of the laws of formal logic, as laws that are studied by a concrete science, is necessarily limited. It is impossible for them to be all-powerful; it is of course impossible, relying on the law of contradiction, to know and grasp the contradictions in reality — the unity and conflict of opposites. All disputations and proofs, and the establishment of theoretical systems, are, in fact, efforts to know real objects, efforts of the subjective to grasp the objective. In principle, the use of formal logic in disputations and proofs and in the establishment of theoretical systems, and its use in knowing an object, should be no different. What, then, is the question? The question should be posed as follows: can thought contravene the law of contradiction? (shrink)
