    Bare statistical evidence and the legitimacy of software-based judicial decisions.Eva Schmidt, Maximilian Köhl & Andreas Sesing-Wagenpfeil - 2023 - Synthese 201 (4):1-27.
Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...)

Spirituality: The Legacy of Parapsychology.Stefan Schmidt, Harald Walach, Ilo Hinterberger, Nikolaus von Stillfried & Niko Kohls - 2009 - Archive for the Psychology of Religion 31 (3):277-308.
Spirituality is a topic of recent interest. Mindfulness, for example, a concept derived from the Buddhist tradition, has captivated the imagination of clinicians who package it in convenient intervention programs for patients. Spirituality and religion have been researched with reference to potential health benefits. Spirituality can be conceptualised as the alignment of the individual with the whole, experientially, motivationally and in action. For spirituality to unfold its true potential it is necessary to align this new movement with the mainstream of (...)

Eight theories of societalization: Toward a theoretically sustainable concept of society.Volker H. Schmidt - 2020 - European Journal of Social Theory 23 (3):411-430.
This article critically engages a recent essay Jeffrey Alexander has published on ‘societalization’, whose conceptualization it finds problematic; first, because in contrast to the impression conveyed by the essay, the term itself is anything but new (as shown in a summary of six theories of societalization which precede Alexander’s by decades, in two cases, by more than a century), and, second, because the way Alexander employs the term is highly aporetic, while also being emblematic of much deeper problems that afflict (...)

Implicit and explicit emotional behavior and mindfulness.Sebastian Sauer, Harald Walach, Stefan Schmidt, Thilo Hinterberger, Majella Horan & Niko Kohls - 2011 - Consciousness and Cognition 20 (4):1558-1569.
The objective of this study was to examine whether the “step back and watch” attitude of mindfulness manifests in less emotional behavior. We hypothesized that the “acceptance” facet of mindfulness, but not the “presence” facet, is negatively associated with the magnitude of emotional behavior in four tests, i.e., rating of words, rating of aversive and neutral pictures, and evaluative conditioning . Additionally, we hypothesized that the acceptance facet is associated with increased reaction time in an emotional Stroop test, and that (...)

Selection of recipients for donor organs in transplant medicine.Volker H. Schmidt - 1998 - Journal of Medicine and Philosophy 23 (1):50 – 74.
This paper deals with a problem which has received a great deal of attention in the ethical literature, but about which very little is known empirically: the selection of recipients for organs in transplant medicine. Based on a larger study, it is shown how this problem is practically resolved in one European country, Germany. It is demonstrated that most of the criteria used to determine recipients are non-medical in nature, even though they generally tend to be rationalized in medical terms. (...)

  15. Two challenges for CI trustworthiness and how to address them.Kevin Baum, Eva Schmidt & A. Köhl Maximilian - 2017
We argue that, to be trustworthy, Computa- tional Intelligence (CI) has to do what it is entrusted to do for permissible reasons and to be able to give rationalizing explanations of its behavior which are accurate and gras- pable. We support this claim by drawing par- allels with trustworthy human persons, and we show what difference this makes in a hypo- thetical CI hiring system. Finally, we point out two challenges for trustworthy CI and sketch a mechanism which could be (...)

    Public Health Ethics. Problems and Suggestions.Volker H. Schmidt - 2015 - Public Health Ethics 8 (1):18-26.
The article concerns itself with normative aspects of public health in light of recent debates. It starts out by introducing a few terminological and conceptual distinctions that set the stage for the subsequent discussion. This is followed by critical remarks on two proposals for developing an adequate public health ethics and the way that the growing health inequalities observed in much of the OECD-world are dealt with in parts of the pertinent literature. The article concludes with a cautionary note on (...)

Distributive justice in transplant medicine: what can sociology contribute?Volker H. Schmidt - 1998 - Ethik in der Medizin 10 (1):5-11.
Definition of the problem: The article discusses the ways in which sociological analyses can contribute to the problem of a just allocation of scarce donor organs.Arguments: It is argued that this contribution consists primarily in the demonstration of the ethical, rather than medical nature of the problem itself. Only if its ethical nature is acknowledged will it be possible to come to a proper understanding of the several dilemmas involved and to consider adequate means for handling them.

In the mid-1980s, German social democracy was revived like a Phoenix from the ashes. In the individual federal states, it proved its governing capability which had been lost in the final years of the Schmidt Administration: The Social Democrats not only controlled the city-states of Bremen and Hamburg widi an absolute majority, but were able to win die 1985 elections so overwhelmingly, both in the largest state of North Rhine-Westphalia and also in Saarland, that they were not forced to (...)

Axiomatic Theories of Truth.Volker Halbach - 2010 - Cambridge, England: Cambridge University Press.
At the centre of the traditional discussion of truth is the question of how truth is defined. Recent research, especially with the development of deflationist accounts of truth, has tended to take truth as an undefined primitive notion governed by axioms, while the liar paradox and cognate paradoxes pose problems for certain seemingly natural axioms for truth. In this book, Volker Halbach examines the most important axiomatizations of truth, explores their properties and shows how the logical results impinge on (...)

Physicians’ duty to climate protection as an expression of their professional identity: a defence from Korsgaard’s neo-Kantian moral framework.Henk Jasper van Gils-Schmidt & Sabine Salloch - 2024 - Journal of Medical Ethics 50 (6):368-374.
The medical profession is observing a rising number of calls to action considering the threat that climate change poses to global human health. Theory-led bioethical analyses of the scope and weight of physicians’ normative duty towards climate protection and its conflict with individual patient care are currently scarce. This article offers an analysis of the normative issues at stake by using Korsgaard’s neo-Kantian moral account of practical identities. We begin by showing the case of physicians’ duty to climate protection, before (...)

Persons or Property – Freedom and the Legal Status of Animals.Andreas T. Schmidt - 2017 - Journal of Moral Philosophy 15 (1):20-45.
_ Source: _Page Count 26 Is freedom a plausible political value for animals? If so, does this imply that animals are owed legal personhood rights or can animals be free but remain human property? Drawing on different conceptions of freedom, I will argue that while positive freedom, libertarian self-ownership, and republican freedom are not plausible political values for animals, liberal ‘option-freedom’ is. However, because such option-freedom is in principle compatible with different legal statuses, animal freedom does not conceptually imply a (...)

    Economic inequality and the long-term future.Andreas T. Schmidt & Daan Juijn - 2024 - Politics, Philosophy and Economics 23 (1):67-99.
Why, if at all, should we object to economic inequality? Some central arguments – the argument from decreasing marginal utility for example – invoke instrumental reasons and object to inequality because of its effects. Such instrumental arguments, however, often concern only the static effects of inequality and neglect its intertemporal consequences. In this article, we address this striking gap and investigate income inequality's intertemporal consequences, including its potential effects on humanity's (very) long-term future. Following recent arguments around future generations and (...)

Kant and the “Spirit as an Enlivening Principle”.Jan Volker - 2009 - Filozofski Vestnik 30 (2).
In a famous passage in the Critique of the Power of Judgement, Kant calls the “spirit” an animating or enlivening principle in the mind. Rather than a positive affirmation building on a protobiological background, this definition marks an aesthetic notion of life. As a first step, the “Gemüt” shows itself to be an ambivalent concept between transcendental philosophy and anthropology. This ambivalence then reoccurs in the notion of life in an aesthetical regard: Life in this sense is the one hand (...)
