“Archangel” explores the consequences of Marie's over‐parenting of her daughter, Sara, through the use of a neural implant (the Archangel) that allows Marie to track (and block) Sara's experiences. In attempting to fulfill her duty to protect Sara, Marie ultimately fails morally as a parent. What is fascinating is that different schools of philosophical thought – contemporary liberal philosophy, ancient Greek Aristotelian ethics, contemporary feminist ethics of care, and contemporary Wittgensteinian ethics – all reach the same conclusion about Marie's moral (...) failure, while teasing out different strands of this failure. Commentators on the work of Catharine Macaulay acknowledge her influence on the pioneering feminist writing of Mary Wollstonecraft. Yet despite Macaulay's interest in equal education for women, these commentators have not considered that Macaulay offered a self-contained, sustained argument for the equality of women. Commentaries on the Treatise have not always been clear as to why Hume includes a discussion of the virtue of female chastity among the apparently different artificial virtues of justice, promises, and allegiance. Placing Hume's discussion of chastity within its specific historical location can illuminate its presence and role in Book 3 of the Treatise and demonstrate how chastity is a virtue of social utility. An examination of the "practice of the world" can show how female chastity was a necessary (...) virtue for the emerging "middling" classes of the eighteenth century in their pursuit of economic stability and social status. This landmark study examines the role played by the rediscovery of the writings of the ancient atomists, Epicurus and Lucretius, in the articulation of the major philosophical systems of the seventeenth century, and, more broadly, their influence on the evolution of natural science and moral and political philosophy. The target of sustained and trenchant philosophical criticism by Cicero, and of opprobrium by the Christian Fathers of the early Church, for its unflinching commitment to the absence of divine supervision and the (...) finitude of life, the Epicurean philosophy surfaced again in the period of the Scientific Revolution, when it displaced scholastic Aristotelianism. Both modern social contract theory and utilitarianism in ethics were grounded in its tenets. Catherine Wilson shows how the distinctive Epicurean image of the natural and social worlds took hold in philosophy, and how it is an acknowledged, and often unacknowledged presence in the writings of Descartes, Gassendi, Hobbes, Boyle, Locke, Leibniz, Berkeley. With chapters devoted to Epicurean physics and cosmology, the corpuscularian or "mechanical" philosophy, the question of the mortality of the soul, the grounds of political authority, the contested nature of the experimental philosophy, sensuality, curiosity, and the role of pleasure and utility in ethics, the author makes a persuasive case for the significance of materialism in seventeenth-century philosophy without underestimating the depth and significance of the opposition to it, and for its continued importance in the contemporary world. This paper considers some aspects of the morality of complicity, understood as participation in the wrongs of another. The central question is whether there is some way of participating in the wrongs of another other than by making a causal contribution to them. I suggest that there is not. In defending this view I encounter, and resist, the claim that it undermines the distinction between principals and accomplices. I argue that this distinction is embedded in the structure of rational agency.

Leibniz has often been described as holding to a kind of phenomenalism. Yet Leibniz did not have a single account of perception, or of the embodied mind, or of the monad, but a set of conflicting and mutually inconsistent accounts that preclude the possibility that there is any such thing as “Leibniz's System.” This difficulty raises problems of interpretation, since it is sometimes maintained that the principle of charity precludes the assignment of frankly inconsistent views to a philosopher. The essay (...) argues that we should not be misled by the intentionalist fallacy into looking for order within a text as opposed to order commentators can impose by making a philosopher's inconsistencies intelligible. Truth is standardly considered a requirement on epistemic acceptability. But science and philosophy deploy models, idealizations and thought experiments that prescind from truth to achieve other cognitive ends. I argue that such felicitous falsehoods function as cognitively useful fictions. They are cognitively useful because they exemplify and afford epistemic access to features they share with the relevant facts. They are falsehoods in that they diverge from the facts. Nonetheless, they are true enough to serve their epistemic purposes. Theories that contain (...) them have testable consequences, hence are factually defeasible. (shrink)

The development of genomics has dramatically expanded the scope of genetic research, and collections of genetic biosamples have proliferated in countries with active genomics research programs. In this essay, we consider a particular kind of collection, national biobanks. National biobanks are often presented by advocates as an economic ‘‘resource’’ that will be used by both basic researchers and academic biologists, as well as by pharmaceutical diagnostic and clinical genomics companies. Although national biobanks have been the subject of intense interest in (...) recent social science literature, most prior work on this topic focuses either on bioethical issues related to biobanks, such as the question of informed consent, or on the possibilities for scientific citizenship that they make possible. We emphasize, by contrast, the economic aspect of biobanks, focusing specifically on the way in which national biobanks create biovalue. Our emphasis on the economic aspect of biobanks allows us to recognize the importance of what we call clinical labor—that is, the regularized, embodied work that members of the national population are expected to perform in their role as biobank participants—in the creation of biovalue through biobanks. Moreover, it allows us to understand how the technical way in which national biobanks link clinical labor to databases alters both medical and popular understandings of risk for common diseases and conditions. Prominent consumer depression manuals issued in recent years circulate a standard depression script as scientific knowledge. The script, asserting that a broad spectrum of depressions are brain illnesses that require antidepressant treatment, is in fact highly contested among researchers. This paper reviews the logical problematics of these manuals, and how such discourse promotes the diagnosis and pharmaceutical treatment of behaviors ranging from mild symptoms to severe depression. In keeping with the trends of pharmaceutical advertising and State health policy, these manuals (...) encourage consumers to self-scrutinize risky behavior, and to treat common behavioral and mood distresses with antidepressants. Online personalized genetic testing services offer accessible and convenient options for satisfying personal curiosity about health and obtaining answers about one’s genetic provenance. They are especially attractive to healthy people who wish to learn about their future risk of disease, as Paul Mason’s case study of “Jordan” illustrates. In this response, we consider how online genetic testing services are used by people diagnosed with a common neurodegenerative disease, Parkinson’s disease, to gain a sense of certainty regarding the future.

This study examines the apparently well-established rule that the equitable doctrine of conversion operates on a contract to grant an interest only so long as it is specifically enforceable. It observes that in principle and in practice there is good reason to believe this not to be the case. It looks at the original culture of conversion, in terms of the historical relationship of property and contract from which it emerged, but suggests that the specific enforceability rule first arose out (...) of the narrowness of the original availability of common injunctions. But when, in the late nineteenth century, common injunctions began to lie more expansively and the rule could have been discarded, it was in fact preserved, and indeed insisted upon. It is suggested that this was because adherence to the old narrow view on common injunctions and to its concomitant, the specific enforceability rule in estate contracts, served the purposes of the Chancery lawyers who were contemporaneously adopting a restrictive attitude to the effects of the Judicature Acts 1873–5, by emphasizing the distinctiveness of equitable institutions. However, such views were not a doctrinally necessary consequence of that attitude, and, given the a priori unsuitability of the specific performance rule, there seems no reason why it should not nowadays be regarded as obsolete. But the lessons which equity had thus had to learn by experience can usefully be extrapolated into conclusions of more general applicability for legal development. (shrink)

This article seeks to trace the origins of the requirement that a squatter must have an intention to possess (animus possidendi) in order to establish title by adverse possession. The requirement has been confirmed by the House of Lords in the recent case of Pye (Oxford) Ltd v Graham [2003] 1 AC 419. Its origins can readily be traced back to the decision of the Court of Appeal in Littledale v Liverpool College [1900] 1 Ch 19, but there is little (...) evidence of any need for intention before that case, and no convincing authority is cited for it. Possible explanations for the source of this requirement are considered by the article (for instance cases on re-entry by landlords and the so-called ‘found chattel’ cases), but these are ultimately rejected. The article goes on to suggest that the reason for this is that the intention requirement was ‘imported’ into English law from German Pandectist writers of the nineteenth century. It suggests that Littledale was the case in which this happened. It seeks to support this hypothesis by reference to biographical details of Lindley MR, who gave the leading judgment in Littledale, and who not only trained in part in Germany but also took an active interest in German scholarship of the time. A brief survey of the relevant German sources is undertaken, focusing primarily on the work of Savigny, but also considering the rival theory of Jhering. Finally, it tracks the development and refinement of the content of animus possidendi, first by 19th century legal scholars and then by 20th century judges, to make it ‘fit’ with English property law. It seeks to address the question of whether the animus possidendi requirement is a free-standing element (the ‘strong’ will theory), or whether it is simply implied from the acts of the squatter (the ‘weak’ will theory), and suggests a solution by reference to the German sources and later English cases. Finally, it considers how the House of Lords decision in Pye reflects the logical culmination of the acceptance of this ‘legal transplant’ into the common law. (shrink)
