Interpretation of Law and Judges Communities.Marek Zirk-Sadowski - 2012 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 25 (4):473-487.
The principle of omnia sunt interpretanda refers to the derivational conception and derivational theory of interpretation. The principle appears in disputes concerning the role of a judge in the process of interpretation, and this has produced an effect that Polish theory of law is currently getting closer to the conceptions presented in the American debate on activism and textualism. In the practice of jurisdiction, the principle of omnia sunt interpretanda is mostly invoked outside theoretical context. It becomes a manifestation of (...)

    The Normative Permission and Legal Utterances.Marek Zirk-Sadowski - 2020 - Studia Humana 9 (3-4):194-202.
The author proves that rejecting the existence of permissive norms and limitation of norms to prohibitions and commands alone is possible only with reducing the idea of a function. The essence of the function is then the ability of the expression to generate independently the universal norm formation. Such manipulation is easy on the level of logical analysis, but proves risky from other points of view. If we want the deontic logic, which we construct, to consider the fact that permission (...)

The article concerns the situation of the judicial application of the law where the entity applying the law refers in a decision-making process to moral principles. The decision should be based on the directives of interpretation, which indicate the need for such a determination of the meaning of the applicable norms so that it remains in harmony with commonly accepted moral rules of the society. The equity has one more purpose; namely, it allows for the process of decision-making—and not just (...)

  9. Pytanie o kryterium poprawności wykładni prawa w świetle neopragmatyzmu Stanley'a Fisha.
Celem (...)

Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...)

In the first part, the paper outlines Rawls's main theses on the international conception of the law of peoples. The second part concerns a problem found in segments of Rawls's theory, specifically his concept of a social contract—contractualism. This problem (...)

  21. Facing Life: The messy bodies of enactive cognitive science.Marek McGann - forthcoming - Phenomenology and the Cognitive Sciences:1-18.
Descriptions of bodies within the literature of the enactive approach to cognitive science exhibit an interesting dialectical tension. On the one hand, a body is considered to be a unity which instantiates an identity, forming an intrinsic basis for value. On the other, a living body is in a reciprocally defining relationship with the environment, and is therefore immersed and entangled with, rather than distinct from, its environment. In this paper I examine this tension, and its implications for the enactive (...)

This article argues for engaging with the smart city as a sociotechnical imaginary. By conducting a close reading of primary source material produced by the companies IBM and Cisco over a decade of work on smart urbanism, we argue that the smart city imaginary is premised in a particular narrative about urban crises and technological salvation. This narrative serves three main purposes: it fits different ideas and initiatives into a coherent view of smart urbanism, it sells and disseminates this version (...)

Imitating Quantum Probabilities: Beyond Bell’s Theorem and Tsirelson Bounds.Marek Czachor & Kamil Nalikowski - forthcoming - Foundations of Science:1-25.
Local hidden-variable model of singlet-state correlations discussed in Czachor is shown to be a particular case of an infinite hierarchy of local hidden-variable models based on an infinite hierarchy of calculi. Violation of Bell-type inequalities can be interpreted as a ‘confusion of languages’ problem, a result of mixing different but neighboring levels of the hierarchy. Mixing of non-neighboring levels results in violations beyond the Tsirelson bounds.

The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...)

    A Loophole of All ‘Loophole-Free’ Bell-Type Theorems.Marek Czachor - 2020 - Foundations of Science 25 (4):971-985.
Bell’s theorem cannot be proved if complementary measurements have to be represented by random variables which cannot be added or multiplied. One such case occurs if their domains are not identical. The case more directly related to the Einstein–Rosen–Podolsky argument occurs if there exists an ‘element of reality’ but nevertheless addition of complementary results is impossible because they are represented by elements from different arithmetics. A naive mixing of arithmetics leads to contradictions at a much more elementary level than the (...)

Non-Newtonian Mathematics Instead of Non-Newtonian Physics: Dark Matter and Dark Energy from a Mismatch of Arithmetics.Marek Czachor - 2020 - Foundations of Science 26 (1):75-95.
Newtonian physics is based on Newtonian calculus applied to Newtonian dynamics. New paradigms such as ‘modified Newtonian dynamics’ change the dynamics, but do not alter the calculus. Complexity of distances: Theory of generalized analytic equivalence relations.Marek Cúth, Michal Doucha & Ondřej Kurka - 2022 - Journal of Mathematical Logic 23 (1).
We generalize the notion of analytic/Borel equivalence relations, orbit equivalence relations, and Borel reductions between them to their continuous and quantitative counterparts: analytic/Borel pseudometrics, orbit pseudometrics, and Borel reductions between them. We motivate these concepts on examples and we set some basic general theory. We illustrate the new notion of reduction by showing that the Gromov–Hausdorff distance maintains the same complexity if it is defined on the class of all Polish metric spaces, spaces bounded from below, from above, and from (...)

When data is capital: Datafication, accumulation, and extraction.Jathan Sadowski - 2019 - Big Data and Society 6 (1).
The collection and circulation of data is now a central element of increasingly more sectors of contemporary capitalism. This article analyses data as a form of capital that is distinct from, but has its roots in, economic capital. Data collection is driven by the perpetual cycle of capital accumulation, which in turn drives capital to construct and rely upon a universe in which everything is made of data. The imperative to capture all data, from all sources, by any means possible (...)

“Secularization” or Plurality of Meaning Structures? A. Schutz's Concept of a Finite Province of Meaning and the Question of Religious Rationality.Marek Chojnacki - 2012 - Open Journal of Philosophy 2 (2):92-99.
Referring to basic Weberian notions of rationalization and secularization, I try to find a more accurate sense of the term “secularization”, intending to describe adequately the position of religion in modernity. The result of this query is—or at least should be—a new, original conceptualization of religion as one of finite provinces of meaning within one paramount reality of the life-world, as defined by Alfred Schutz. I proceed by exposing a well known, major oversimplification of the Weberian concept of secularization, very (...)

Can we see the expressiveness of other people's gestures, hear the intentions in their voice, see the emotions in their posture? Traditional theories of social cognition still say we cannot because intentions and emotions for them are hidden away inside and we do not have direct access to them. Enactive theories still have no idea because they have so far mainly focused on perception of our physical world. We surmise, however, that the latter hold promise since, in trying to understand (...)

    Problem (a)czasowości Boga.

He highlights the real potential for a biophilic transformation of culture in the context of current knowledge on cognitive psychology, where emphasis is placed on the limits to the phenomena of cognitive dissonance. The author of the article seeks certain options to repress these limits in Gestalt theory, which (...)

Then we propose similar characterizations for equi-Bare 1 families of functions. Also, using related ideas, we give game characterizations of Baire measurable and Lebesgue measurable functions.
