Cet article analyse la manière dont les mouvements gais militants des années 1970 ont amorcé une politisation de la question de la majorité sexuelle, préalable à une série de réformes entreprises dans les années 1980. Au début des années 1970, ces mouvements font face à un enjeu comparable, en France et au Québec : l’âge de la majorité sexuelle, plus élevée pour les homosexuels, soulève la question de la liberté sexuelle des mineurs. Dans les deux pays, l’histoire des mouvements gais (...) suit une trajectoire parallèle. Fondés en lien avec des mouvements politiques révolutionnaires, les mouvements gais se restructurent, au milieu des années 1970, autour de revendications plus ciblées, liées notamment à la discrimination légale dont les homosexuels sont victimes concernant l’âge de la majorité sexuelle. Dans les années 1980, les lois qui en résultent redéfinissent presque en même temps la majorité sexuelle et le viol. Elles dessinent un processus similaire en France et au Canada : si la majorité sexuelle est réformée, son principe est réaffirmé, comme un rempart contre la nouvelle figure du danger, le pédophile. On a l’habitude de lire dans Antigone l’histoire d’un conflit entre d’un côté l’expression des liens affectifs et de la piété, et de l’autre les prérogatives de l’État dont le but premier serait le maintien des institutions. D’un côté Antigone fidèle à son frère, de l’autre Créon attaché à sa Cité. D’un côté la morale de l’affectivité ou de la conviction (Gesinnungsethik), de l’autre la morale de la responsabilité (Verantwortungsethik), pour parler comme Max Weber. Cette lecture classique de la tragédie (...) demeure sans doute pertinente à bien des égards, mais traduit-elle l’essentiel? Et si l’intention du poète n’avait pas été d’en rester à cette confrontation mais de suggérer, par-delà l’affrontement ruineux, une troisième voie possible? Il n’y aurait plus alors deux termes seulement, le privé et le public que tout sépare, mais deux manières pour l’ordre public lui-même de se rapporter au privé, l’une conflictuelle et tyrannique, celle de Créon, l’autre conciliatrice et délibérative – démocratique en ce sens –, celle défendue par Hémon, par Tirésias, et finalement peut-être par Sophocle lui-même qui, par l’emploi d’un vocabulaire tiré de l’expérience politique athénienne, dénoue d’une main l’intrigue qu’il noue de l’autre. Éclairée entre autres par Aristote, une interprétation nouvelle de la pièce en découle, celle d’un poète qui surjoue les conflits pour mieux insinuer les moyens politiques de les résoudre ou de les atténuer. L’édition critique des œuvres de Moïse ben Sabbataï, philosophe juif actif (à Rome?) vers 1340, avait signalé, parmi d’autres sources latines lues dans les traductions en hébreu de son contemporain Juda de Rome, un exemplum présentant le sage athénien Solon sur son lit de mort en champion de la doctrine de l’élévation intellectuelle en vue de la vie éternelle. Cette note identifie comme sa source un chapitre d’Albert le Grand, De natura et origine animae II, 13, dont la traduction en (...) hébreu se trouve dans un ouvrage inédit de Juda de Rome, son Commentaire du Qaddīš et de la Qeduššāh. La traduction du chapitre est éditée, l’histoire de l’ exemplum reconstituée et son emploi par les trois auteurs, remis en contexte et interprété. (shrink)

One of the strongest strands in Nancy's philosophy is an attempt to rethink community and the very idea of the social in a way that does not ground these ideas in some individual subject or subjectivity. The fundamental argument of this book is that being is always 'being with', that 'I' is not prior to 'we', that existence is essentially co-existence. Social theory remains puzzled by the relation between practices and structures, or the link between ‘micro’ and ‘macro’. Grand theorists including Giddens and Bourdieu have gained distinction for their writings on these questions, trying to marry insights and concerns of a ‘micro’ sociological nature with traditional ‘macro’ structural questions including inequality, power relations, and social reproduction. These theorists arguably fail, however, in their attempts to move social theory beyond traditional dualisms. Relevant but neglected contributions from ethnomethodology are introduced and compared (...) to the work of Giddens and Bourdieu in an attempt to identify and outline an approach to practices and structures that more reliably avoids problems of dualism and reification, and at the same time offers an understanding of structures and their relations to practices that can be much more closely grounded in empirical studies. The issue of whether formal reasoning or a computing-intensive approach is the most efficient manner to address scientific questions is the subject of some considerable debate and pertains not only to the nature of the phenomena and processes investigated by scientists, but also the nature of the equation and algorithm objects they use. Although algorithms and equations both rely on a common background of mathematical language and logic, they nevertheless possess some critical differences. They do not refer to the same (...) level of symbolization, as equations are based on integrated concepts in a denotational manner, while algorithms specifically break down a complex problem into more elementary operations, in an operational manner. They may therefore be considered as suited to the representation of different phenomena. Specifically, algorithms are by nature sufficient to represent weak emergent phenomena, but not strong emergent patterns, while equations can do both. Finally, the choice between equations and algorithms are by nature sufficient to represent weak emergent phenomena, but not strong emergent patterns, while equations behave conversely. We propose a simplified classification of scientific issues for which both equation- and/or algorithm-based approaches can be envisaged, and discuss their respective pros and cons. We further discuss the complementary and sometimes conflicting uses of equations and algorithms in a context of ecological theory of metapopulation dynamics. We finally propose both conceptual and practical guidelines for choosing between the alternative approaches. (shrink)

This paper examines Alfred Schutz’s insights on types and typification. Beginning with a brief overview of the history and meaning of typification in interpretive sociology, the paper further addresses both the ubiquity and the necessity of typification in social life and scientific method. Schutz’s contribution itself is lacking in empirical application and grounding, but examples are provided of ongoing empirical research which advances the understanding of types and typification. As is suggested by illustrations from scholarship in the social studies of (...) social science, studies of social identity associated with membership categorization analysis, and constructionist social problems theory, typification can be found to be central to social research whether it is taken up as a largely unacknowledged resource or whether it is addressed by different names. The overview and illustrations suggest the continuing, widespread, and indeed foundational relevance of Schutz’s insights into types and typification. (shrink)
