The United States Sentencing Commission’s guidelines for the sentencing of organizations found guilty of violating federal laws recently became effective. Dramatically increased penalties are possible under these gudelines, but so too is a substantial reduction in the penalties imposed on organizations that have an effective program in place to prevent and detect violations. This provides corporations with a tremendous new incentive in inaugurate organizational ethics audits both to avoid violations in the first instance and to reduce the penalty imposed in (...) the event that a violation occurs. We argue, however, that there have always been very good reasons for organizations to conduct such audits, which emphasize the identification of the organizational factors that create incentives for unethical behavior. Corporate ethics programs initiated without reference to such factors cannot reasonably be expected to be effective in improving a company’s internal ethical environment. (shrink)

Virtually every empirical inquiry of issues relevant to applied business ethics involves the asking of questions that are sensitive, embarrassing, threatening, stigmatizing, or incriminating. Accordingly, questions of this sort are likely to result in unsatisfactory outcomes: 1) many individuals will not respond; and/or, 2) many individuals will not respond candidly. An obvious objective, then, is to use a method to collect information which increases participation, provides absolute anonymity, and does not jeopardize subjects' privacy. The randomized response technique (RRT) is a (...) method designed to realize this promise. We provide here an overview of RRT approaches and applications 'which may be effectively used in empirical examinations of potentially sensitive issues in business ethics. (shrink)

Federal legislation (the Employee Polygraph Protection Act) adopted in 1988 prohibits virtually all private sector employers from requiring or requesting preemployment polygraph examinations for prospective employees. Since then, written integrity testing designed to reliably distinguish those prospective employees who may steal from the company from those who are far less likely to do so has been something of a growth industry. Indeed, the American Psychological Association has recently noted that honesty tests have demonstrated useful levels of validity as an employee (...) selection measure. We provide an alternative perspective. We argue that, even under the most charitable of assumptions, the propensity of integrity tests to generate false positives (i.e., to identify prospective employees as potential thieves when, in fact, they are not) is unsuitably large. Thus, the integrity test as currently configured is largely without merit as a personnel selection device. (shrink)

Regular musical activity as a complex multimodal lifestyle activity is proposed to be protective against age-related cognitive decline and Alzheimer’s disease. This cross-sectional study investigated the association and interplay between musical instrument playing during life, multi-domain cognitive abilities and brain morphology in older adults from the DZNE-Longitudinal Cognitive Impairment and Dementia Study study. Participants reporting having played a musical instrument across three life periods were compared to controls without a history of musical instrument playing, well-matched for reserve proxies of education, (...) intelligence, socioeconomic status and physical activity. Participants with musical activity outperformed controls in global cognition, working memory, executive functions, language, and visuospatial abilities, with no effects seen for learning and memory. The musically active group had greater gray matter volume in the somatosensory area, but did not differ from controls in higher-order frontal, temporal, or hippocampal volumes. However, the association between gray matter volume in distributed frontal-to-temporal regions and cognitive abilities was enhanced in participants with musical activity compared to controls. We show that playing a musical instrument during life relates to better late-life cognitive abilities and greater brain capacities in OA. Musical activity may serve as a multimodal enrichment strategy that could help preserve cognitive and brain health in late life. Longitudinal and interventional studies are needed to support this notion. (shrink)

In Living Well Now and in the Future: Why Sustainability Matters, Randall Curren and Ellen Metzger formulate an ethics of sustainability, conceptually connecting sustainability with ongoing opportunities for people to live well. Part of the sustainability ethics they develop is a principle called the Preservation of Opportunity Principle. My goal in this paper is to analyze the Preservation of Opportunity Principle, and amend the principle in light of certain considerations that are not at the forefront of Curren and (...) class='Hi'>Metzger’s project. Specifically, I want to develop the principle in a slightly different way given concerns about the noninstrumental value of nonhuman animals, concerns that are integral to a comprehensive environmental ethical theory. The misleading and propagandistic tendencies in American news reporting have been a part of public discussion from its earliest days as a republic (Innis, 2007;Sheppard, 2007). “Fake news” is hardly new (McKernon, 1925), and the term has been applied to a variety of distinct phenomenon ranging from satire to news, which one may find disagreeable (Jankowski, 2018;Tandoc et al., 2018). However, this problem has become increasingly acute in recent years with the Macquarie Dictionary declaring “fake news” the word of the (...) year in 2016 (Lavoipierre, 2017). The international recognition of fake news as a problem (Pomerantsev and Weiss, 2014;Applebaum and Lucas, 2016) has led to a number of initiatives to mitigate perceived causes, with varying levels of success (Flanagin and Metzger, 2014;Horne and Adali, 2017;Sample et al., 2018). The inability to create a holistic solution continues to stymie researchers and vested parties. A significant contributor to the problem is the interdisciplinary nature of digital deception. While technology enables the rapid and wide dissemination of digitally deceptive data, the design and consumption of data rely on a mixture of psychology, sociology, political science, economics, linguistics, marketing, and fine arts. The authors for this effort discuss deception’s history, both old and new, from an interdisciplinary viewpoint and then proceed to discuss how various disciplines contribute to aiding in the detection and countering of fake news narratives. A discussion of various fake news types (printed, staged events, altered photographs, and deep fakes) ensues with the various technologies being used to identify these; the shortcomings of those technologies and finally the insights offered by the other disciplines can be incorporated to improve outcomes. A three-point evaluation model that focuses on contextual data evaluation, pattern spread, and archival analysis of both the author and publication archives is introduced. While the model put forth cannot determine fact from fiction, the ability to measure distance from fact across various domains provides a starting point for evaluating the veracity of a new story. At the heart of ethics reside the concepts of good and bad; they are at work when we assess whether a person is virtuous or vicious, an act right or wrong, a decision defensible or indefensible, a goal desirable or undesirable. But there are many varieties of goodness and badness. At their core lie intrinsic goodness and badness, the sort of value that something has for its own sake. It is in virtue of intrinsic value that other types of value (...) may be understood, and hence that we can begin to come to terms with questions of virtue and vice, right and wrong, and so on. This book investigates the nature of intrinsic value: just what it is for something to be valuable for its own sake, just what sort of thing can have such value, just how such a value is to be computed. In the final chapter, the fruits of this investigation are applied to a discussion of pleasure, pain, and displeasure and also of moral virtue and vice, in order to determine just what value lies within these phenomena. In this paper I propose to shed new light on the role of feeling in Kant’s psychology of moral motivation by focusing on the concept of an incentive (Triebfeder), a term he borrowed from one of his most important rationalist predecessors, Alexander Gottlieb Baumgarten. I argue that, similar to Baumgarten, Kant understands an incentive to refer to the ground of desire and that feelings function as a specific kind of ground within Kant’s psychology of moral action, namely as the ‘impelling (...) cause’ of desire. I claim that this interpretation has several advantages over the alternatives currently on offer in the literature. (shrink)

Wolff's book defends the Kantian idea of a "general logic" whose principles underlie special systems of deductive logic. It thus undermines "logical pluralism," which tolerates the co-existence of divergent systems of modern logic without asking for consistent common principles. Part I of Wolff’s book identifies the formal language in which the most general principles of logic must be expressed. This language turns out to be a version of syllogistic language already used by Aristotle. The universal validity of logical principles, as (...) well as the translatability of other logical languages into this language, are shown to depend only on the meanings of its logical vocabulary. Part II of the book answers the metalogical question concerning the deductive relation between general logic and special logical systems, which also have their own (less general) principles. This part identifies the rules according to which logical rules can be derived from principles. The main result of the book is that the highest principles of logic and metalogics are provided by the syllogistic, when properly understood. (shrink)

Neuropsychiatrist Michael T. H. Wong argues that the notions of soul, mind, brain, self and consciousness are no longer adequate on their own to explain humanity. He formulates a “third discourse” that brings philosophy neuroscience theology and psychiatry together as an innovative multilayered narrative for the person in the twenty-first century.

This chapter offers an account of Crusius’ conception of freedom. In the first part of the chapter I sketch Crusius’ understanding of ‘Thelematology’ or ‘science of the will’ and his conception of the will itself. In the second part of the paper I provide an account of Crusius’ conception of freedom of the will and I focus on two topics: his understanding of freedom as self-determination and his conception of free choice. Contrary to how some of the secondary literature portrays (...) his view, I argue that freedom of the will, for Crusius, is not best described as the freedom to choose otherwise or liberty of indifference. On the contrary, Crusius argues that free choice is rarely indifferent to its choices and is most often strongly inclined towards certain ends that free choice must overcome and choose against. Inspired by the work of Wilfrid Sellars, Michael Williams launches an all-out attack on what he calls "phenomenalism," the idea that our knowledge of the world rests on a perceptual or experiential foundation. The point of this wider-than-normal usage of the term "phenomenalism," according to which even some forms of direct realism deserve to be called phenomenalistic, is to call attention to important continuities of thought between theories often thought to be competitors. Williams's target is not phenomenalism in its (...) classical sense-datum and reductionist form but empiricism generally. Williams examines and rejects the idea that, unless our beliefs are answerable to a "given" element in experience, objective knowledge will be impossible. Groundless Belief was first published in 1977. This second edition contains a new afterword in which Williams places his arguments in the context of some current discussions of coherentism versus the Myth of the Given and explains their relation to subsequent developments in his own epistemological views. The fact that Gilbert Ryle and J.L. Austin seem to disagree about the ordinary use of words such as ‘voluntary’, ‘involuntary’, ‘voluntarily’, and ‘involuntarily’ has been taken to cast doubt on the methods of ordinary language philosophy. As Benson Mates puts the worry, ‘if agreement about usage cannot be reached within so restricted a sample as the class of Oxford Professors of Philosophy, what are the prospects when the sample is enlarged?’ (Mates, Inquiry 1:161–171, 1958, p. 165). In this chapter, (...) we evaluate Mates’s criticism alongside Ryle’s and Austin’s specific claims about the ordinary use of these words, assessing these claims against actual examples of ordinary use drawn from the British National Corpus (BNC). Our evaluation consists in applying a combination of methods: first aggregating judgments about a large set of samples drawn from the corpus, and then using a clustering algorithm to uncover connections between different types of use. In applying these methods, we show where and to what extent Ryle’s and Austin’s accounts of the use of the target terms are accurate as well as where they miss important aspects of ordinary use, and we demonstrate the usefulness of this new combination of methods. At the heart of our approach is a commitment to the idea that systematically looking at actual uses of expressions is an essential component of any approach to ordinary language philosophy. (shrink)

Arguments from perceptual variation challenge the view that colors are objective properties of objects, properties that objects have independent of how they are perceived. This paper attempts, first, to diagnose one central reason why arguments from perceptual variation seem especially challenging for objectivists about color. Second, we offer a response to this challenge, claiming that once we focus on determinate colors rather than the determinables they determine, a response to arguments from perceptual variation becomes apparent. Third, our nominal opponents are (...) relationalist (like Cohen in The red and the real: an essay on color ontology, Oxford University Press, Oxford, 2009) and we will argue that the main argument for rejecting objectivism commits the relationalist to a position that is more radical than the one he would wish to endorse. Fourth, we suggest that insight into which properties could be relational may be found by looking to our best scientific theories. (shrink)

According to Darwinian thinking, organisms are (for the most part) designed by natural selection, and so are (for the most part) integrated collections of adaptations, where an adaptation is a phenotypic trait that is a specialized response to a particular selection pressure. For animals that make their living in the Arctic, one adaptive problem is how to maintain body temperature above a certain minimum level necessary for survival. Polar bears' thick coats are a response to that selection pressure (surviving in (...) extreme cold). A thick coat makes a positive difference to a polar bear's fitness, since polar bears with very thin coats left fewer offspring than those with thicker coats. The foundational idea ofevolutionary psychologyis that brains are no different from any other organ with an evolutionary function, insofar as brains too are systems shaped by natural selection to solve adaptive problems. Thus brains have a particular functional organization because their behavioural effects tend, or once tended, to help maintain or increase the fitness of organisms with those brains. Prominent evolutionary psychologists (for example: Cosmides and Tooby, 1987; Cosmides and Tooby, 1994 and Symons, 1992) have endorsed the view that the last time any significant modifications were made by natural selection to the human brain's functional architecture, we were hunter-gatherers, inhabiting a world quite different from that which we now inhabit. That world was the Pleistocene epoch, between about 2 million years ago and 10 thousand years ago. On this view, then, the Pleistocene constitutes what evolutionary psychologists often call ourenvironment of evolutionary adaptedness(or EEA), and the information- processing structure and organization of our present-day cognitive architecture is no different from that of our recent huntergatherer ancestors. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. Finally, we make a tentative effort to judge which of the three models is most able to do what constitutions should do in difficult times. (shrink)

In a rich and thought-provoking paper, Lambros Malafouris argues that taking material culture seriously means to be ‘systematically concerned with figuring out the causal efficacy of materiality in the enactment and constitution of a cognitive system or operation’ (Malafouris 2004, 55). As I understand this view, there are really two intertwined claims to be established. The first is that the things beyond the skin that make up material culture (in other words, the physical objects and artefacts in which cultural networks (...) and systems of human social relations are realized) may be essential to the enactment of, and be partly constitutive of, certain cognitive systems or operations. The consequence of establishing this claim is supposed to be that we have a mandate to recast the boundaries of the mind so as to include, as proper parts of the mind, things located beyond the skin. Thus, in talking about the contribution of the world to cognition, Malafouris (2004, 58) concludes that ‘what we have traditionally construed as an active or passive but always clearly separated external stimulus for setting a cognitive mechanism into motion, may be after all a continuous part of the machinery itself; at least ex hypothesi’. This is the position that, in philosophical circles, is known increasingly as the extended mind hypothesis (Clark & Chalmers 1998; Menary forthcoming). Henceforth I shall refer to this hypothesis as EM. A stock example will help bring the idea into view. Rumelhart et al. (1986) note that most of us solve difficult multiplication problems by using ‘pen and paper’ as an external resource. This environmental prop enables us to transform a difficult cognitive problem into a set of simpler ones, and to temporarily store the results of certain intermediate calculations. For the fan of EM, the distributed combination of this external resource and certain inner psychological processes constitutes a cognitive system in its own right. (shrink)

Formalised public participation in project approval procedures is rarely addressed in technology assessment. Empirical data about public participation processes are taken into account even more rarely. This article explores the practice of public participation in infrastructure projects in the Federal Republic of Germany on the basis of empirical data from the period of 1990 to 2010. The author compares the empirical data about participation processes with the targets of the public participation and asks for the reasons for the lack of (...) participation in formalised approval procedures. Furthermore, the author contrasts participation formats used in technology assessment with formalised public participation. He explores the potential for these attitudes and concludes by discussing the role of boundaries within communities in modernism and postmodernism.
