If folk science means individuals having well worked out mechanistic theories of the workings of the world, then it is not feasible. Laypeople’s explanatory understandings are remarkably coarse, full of gaps, and often full of inconsistencies. Even worse, most people overestimate their own understandings. Yet recent views suggest that formal scientists may not be so different. In spite of these limitations, science somehow works and its success offers hope for the feasibility of folk science as well. The success of science (...) arises from the ways in which scientists learn to leverage understandings in other minds and to outsource explanatory work through sophisticated methods of deference and simplification of complex systems. Three studies ask whether analogous processes might be present not only in laypeople but also in young children and thereby form a foundation for supplementing explanatory understandings almost from the start of our first attempts to make sense of the world. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Finally, he also addresses the question of the utopian horizon of social criticism. (shrink)

Vague expressions are omnipresent in natural language. As such, their use in legal texts is virtually inevitable. If a law contains vague terms, the question whether it applies to a particular case often lacks a clear answer. One of the fundamental pillars of the rule of law is legal certainty. The determinacy of the law enables people to use it as a guide and places judges in the position to decide impartially. Vagueness poses a threat to these ideals. In borderline (...) cases, the law seems to be indeterminate and thus incapable of serving its core rule of law value. -/- In the philosophy of language, vagueness has become one of the hottest topics of the last two decades. Linguists and philosophers have investigated what distinguishes "soritical " vagueness from other kinds of linguistic indeterminacy, such as ambiguity, generality, open texture, and family resemblance concepts. There is a vast literature that discusses the logical, semantic, pragmatic, and epistemic aspects of these phenomena. Legal theory has hitherto paid little attention to the differences between the various kinds of linguistic indeterminacy that are grouped under the heading of "vagueness ", let alone to the various theories that try to account for these phenomena. -/- The paper is an introduction to a book of the same title. Bringing together leading scholars working on the topic of vagueness in philosophy and in law, the book fosters a dialogue between philosophers and legal scholars by examining how philosophers conceive legal ambiguity from their theoretical perspective and how legal theorists make use of philosophical theories of vagueness. Because modern societies are built on elaborate divisions of cognitive labor, individuals remain laypersons in most knowledge domains. Hence, they have to rely on others' expertise when deciding on many science-related issues in private and public life. Even children already locate and discern expertise in the minds of others. This study examines how far university students accurately judge experts' pertinence for science topics even when they lack proficient knowledge of the domain. Participants judged the pertinence of experts from diverse disciplines (...) based on the experts' assumed contributions to texts adapted from original articles from Science and Nature. Subjective pertinence judgments were calibrated by comparing them with bibliometrics of the original articles. Furthermore, participants' general science knowledge was controlled. Results showed that participants made well-calibrated pertinence judgments regardless of their level of general science knowledge. (shrink)

Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. People feel they understand complex phenomena with far greater precision, coherence, and depth than they really do; they are subject to an illusion—an illusion of explanatory depth. The illusion is far stronger for explanatory knowledge than many other kinds of knowledge, such as that for facts, procedures or narratives. The illusion for explanatory knowledge is most robust where the environment supports real‐time explanations with visible mechanisms. We demonstrate the illusion of depth with explanatory knowledge in Studies 1–6. Then we show (...) differences in overconfidence about knowledge across different knowledge domains in Studies 7–10. Finally, we explore the mechanisms behind the initial confidence and behind overconfidence in Studies 11 and 12, and discuss the implications of our findings for the roles of intuitive theories in concepts and cognition. In a number of articles, Hans-Johann Glock has argued against the »lingualist« view that higher mental capacities are a prerogative of language-users. He has defended the »assimilationist« claim that the mental capacities of humans and of non-human animals differ only in degree. In the paper under discussion, Glock argues that animals are capable of acting for reasons, provided that reasons are construed along the lines of the new »objectivist« theory of practical reasons.

This paper argues that Frankfurt-style counterexamples (FSCs) do not compromise the agent’s ability to decide otherwise. In his attack on the Principle of Alternative Possibilities, Frankfurt relied on what Austin called the ‘all-in’ sense of ‘can’, and misconstrued the agent’s inability to do otherwise as an all-in can’t. Like the new dispositionalists, I maintain that the agent’s relevant abilities are ‘masked’ rather than lost in Frankfurt cases. The argument from masked abilities, however, is not confined to a compatibilist construal of (...) the relevant abilities. On a libertarian construal, Black deprives Jones of the opportunity to use his two-way power of choice to a different outcome than he actually uses it. I argue that being deprived of this opportunity is immaterial to what free will requires. In the second half of the paper, I relate my approach to the ‘flicker of freedom’ strategy. On closer look, we do find a residual ability that Jones not only possesses but also exercises in cases where Black intervenes. I argue that Jones tries to decide otherwise in these cases, that Black only thwarts the success of Jones’s attempt, and that being snatched from the wheel at the very last moment does not compromise Jones’s free will. Rule systems are used every day to share experience, pre-existing knowledge, beliefs and ethical rules, and to provide instructions for future action. This article expands and builds upon an approach pioneered by Julius M. Moravcsik to argue that ethics cannot be completely codified into a rigid set of rules, because any such set lacks a misapplication-correcting sensibility. Thus, an ethics that is transferred purely by means of a rule-set is incomplete and thus cannot be used reliably to guide future action. (...) The balancing sensibility is formed out of pre-existing expert knowledge and takes account of the limitations of rule-sets in specific contexts. Moravcsik’s approach is then expanded by incorporating it into a holistic framework for the analysis, guidance and development of actions to be taken to support the emergence, selection and implementation of solutions for a sustainable future. This approach has profound implications for managers and organisers in new or critical situations. (shrink)

Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously. Evidence on the coherence between emotion and facial expression in adults from laboratory experiments is reviewed. High coherence has been found in several studies between amusement and smiling; low to moderate coherence between other positive emotions and smiling. The available evidence for surprise and disgust suggests that these emotions are accompanied by their “traditional” facial expressions, and even components of these expressions, only in a minority of cases. Evidence concerning sadness, anger, and fear is very limited. For sadness, one study (...) suggests that high emotion–expression coherence may exist in specific situations, whereas for anger and fear, the evidence points to low coherence. Insufficient emotion intensity and inhibition of facial expressions seem unable to account for the observed dissociations between emotion and facial expression. (shrink)

Based on the belief that computational modeling (thinking in terms of representation and computations) can help to clarify controversial issues in emotion theory, this article examines emotional experience from the perspective of the Computational Belief–Desire Theory of Emotion (CBDTE), a computational explication of the belief–desire theory of emotion. It is argued that CBDTE provides plausible answers to central explanatory challenges posed by emotional experience, including: the phenomenal quality,intensity and object-directedness of emotional experience, the function of emotional experience and its relation (...) to cognition and motivation, and the relation between emotional experience and emotion. In addition, CBDTE avoids most objections that have been raised against cognitive theories of emotion. A remaining objection, that beliefs are not necessary for the emotions covered by CBDTE, is rejected as empirically unsupported. (shrink)

Colour has long been a source of fascination to both scientists and philosophers. In one sense, colours are in the mind of the beholder, in another sense they belong to the external world. Colours appear to lie on the boundary where we have divided the world into 'objective' and 'subjective' events. They represent, more than any other attribute of our visual experience, a place where both physical and mental properties are interwoven in an intimate and enigmatic way. -/- The last (...) few decades have brought fascinating changes in the way that we think about 'colour' and the role 'colour' plays in our perceptual architecture. In Colour Perception: Mind and the physical world, leading scholars from cognitive psychology, philosophy, neurophysiology, and computational vision provide an overview of the contemporary developments in our understanding of colours and of the relationship between the 'mental' and the 'physical'. The chapter argues from an ethology-inspired internalist perspective that ‘colour’ is not a homogeneous and autonomous attribute, but rather plays different roles in different conceptual forms underlying perception. It discusses empirical and theoretical evidence that indicates that core assumptions underlying orthodox conceptions are grossly inadequate. The assumptions pertain to the idea that colour is a kind of autonomous and unitary attribute. It is regarded as unitary or homogeneous by assuming that its core properties do not depend on the type of (...) ‘perceptual object’ to which it pertains and that‘colour per se’ constitutes a natural attribute in the functional architecture of the perceptual system. It is regarded as autonomous by assuming that it can be studied in isolation of other perceptual attributes. More generally, the chapter argues on the bases of corresponding empirical and theoretical evidence that perception cannot be understood as the ‘recovery’ of physical world structure from sensory structure by input-based computational processes. Rather, the sensory input serves as a kind of sign for biologically relevant aspects of the external world that activates biologically given conceptual forms with their internal parameters. Although the sensory input is a causally necessary requirement for the activation of conceptual forms, the perceptual computations triggered are under the control of an internal programme based on a set of conceptual forms. Three studies provided evidence that syntax influences intentionality judgments. In Experiment 1, participants made either speeded or unspeeded intentionality judgments about ambiguously intentional subjects or objects. Participants were more likely to judge grammatical subjects as acting intentionally in the speeded relative to the reflective condition (thus showing an intentionality bias), but grammatical objects revealed the opposite pattern of results (thus showing an unintentionality bias). In Experiment 2, participants made an intentionality judgment about one of the two actors in a partially (...) symmetric sentence (e.g., “John exchanged products with Susan”). The results revealed a tendency to treat the grammatical subject as acting more intentionally than the grammatical object. In Experiment 3 participants were encouraged to think about the events that such sentences typically refer to, and the tendency was significantly reduced. These results suggest a privileged relationship between language and central theory-of-mind concepts. More specifically, there may be two ways of determining intentionality judgments: (1) an automatic verbal bias to treat grammatical subjects (but not objects) as intentional (2) a deeper, more careful consideration of the events typically described by a sentence. Temporary migration raises two different challenges. The first is whether territorial democracies can integrate temporary migrants as equal citizens; the second is whether transnationally mobile societies can be organized democratically as communities of equal citizens. Considering both questions within a single analytical framework will reveal a dilemma: on the one hand, liberals have good reasons to promote the expansion of categories of free-moving citizens as the most effective and normatively attractive response to the problem of partial citizenship for temporary migrants; (...) yet, on the other hand, if free movement rights were actually used by too many, this might fatally undermine the sustainability of intergenerational and territorial democratic polities. Research on cognition and emotion during the past 30 years has made reasonable progress in theory, methods and empirical research. New theories of the cognition–emotion relation have been proposed, emotion research has become more interdisciplinary, and improved methods of emotion measurement have been developed. On the empirical side, the main achievement of the past 30 years is seen to consist in the reduction of the set of serious contenders for a theory of emotions. Still, several important issues are not fully (...) resolved, including the computational implementation of appraisal processes, the nature of emotions, and the link between emotions and actions. Also, quantitative theories of the cognition–emotion relation need to be refined and tested, and improved theories of the link between emotions and bodily and facial expressions need to be developed. To counter the dangers of theoretical fragmentation and knowledge loss, more efforts should be devoted to the analysis, reconstruction, comparison and integration of important theories and hypotheses in the field of emotion, as well as to the systematization of arguments in favor and against these theories and hypotheses. A new experimental paradigm involving a computerised quiz was used to examine, on an intra-individual level, the strength of association between four components of the surprise syndrome: cognitive (degree of prospectively estimated unexpectedness), experiential (the feeling of surprise), behavioural (degree of response delay on a parallel task), and expressive (the facial expression of surprise). It is argued that this paradigm, together with associated methods of data analysis, effectively controls for most method factors that could in previous studies have lowered the (...) correlations among the components of emotion syndromes. It was found that (a) the components of the surprise syndrome were all positively correlated; (b) strong association existed only between the cognitive and the experiential component of surprise; (c) the coherence between syndrome components did not increase with increasing intensity of surprise; and (d) there was also only moderate coherence between the components of the facial expression of surprise (eyebrow raising, eye widening, mouth opening), although in this case, coherence tended to increase with intensity. Taken together, the findings support only a weakly probabilistic version of a behavioural syndrome view of surprise. However, the component correlations seem strong enough to support the existence of strong associations among a subset of the mental or central neurophysiological processes engaged in surprise. The chapter deals with the notion of phenomenal realness, which was first systematically explored by Albert Michotte. Phenomenal realness refers to the impression that a perceptual object is perceived to have an autonomous existence in our mind-independent world. Perceptual psychology provides an abundance of phenomena, ranging from amodal completion to picture perception, that indicate that phenomenal realness is an independent perceptual attribute that can be conferred to perceptual objects in different degrees. The chapter outlines a theoretical framework that appears particularly (...) well-suited for dealing with corresponding phenomena. According to this framework, perception can be understood as a triggering of conceptual forms by sensor inputs. It is argued that the attribute of phenomenal realness is based on specific types of internal evaluation functions which deal with the segregation of causes conceived as ‘external’ from those conceived as ‘internal’. These evaluation functions integrate different internal sources of ‘knowledge’ about the potential causes for the activation of conceptual forms and provide markers by which conceptual forms can be tagged as ‘external world objects’.
