Vivimos en unos tiempos en que la distancia entre el pensamiento crítico y el procedente de la Academia nunca había sido tan grande, y eso que hoy más que nunca resulta necesario repensar la sociedad en su conjunto para poder siquiera atisbar la posibilidad de un mundo futuro donde la vida sea digna de ser vivida. De vagos y maleantes, Michel Foucault en España nos permite acercarnos a una época de una gran vitalidad política y creatividad intelectual, la del final (...) del franquismo y la posterior Transición en el Estado español. Este periodo se caracteriza por una eclosión de movimientos sociales, ansiosos por recrear nuevos discursos superadores de las anquilosadas tesis marxistas oficiales y por dibujar horizontes de ruptura que fueran más allá de la reforma o pacto a la baja que finalmente devendría la Monarquía constitucional. Tanto en la calle como en la Universidad y su entorno, la progresiva entrada de los textos de Foucault fue seguida con gran atención, marcando de manera muy significativa la discusión política y filosófica del momento. El filósofo de Poitiers no dejó a nadie indiferente, ni a los que, aunando reflexión y praxis, se valieron con toda libertad de su ±caja de herramientas para encontrar nuevas vías de análisis y actuación para la transformación social; ni a los que, viendo peligrar las viejas ortodoxias marxistas, veían en Foucault un peligro para su hegemonía en el ámbito académico. Tal y como se refleja certeramente en esta radiografía de la Transición, los debates que el discurso crítico de Foucault provocó en los medios académicos y fuera de los mismos, para algunos no fueron más que una mera moda intelectual, en su época de "enfants terribles" o de "comunistas de salón" --tipo Fernando Savater, Josep Ramoneda o Gabriel Albiac--, antes de pasar a ejercer de intelectuales orgánicos del nuevo régimen. Sin embargo, tanto entonces como ahora las reflexiones de Foucault siguen siendo para muchos un referente fundamental para el análisis de las formas de opresión y la elaboración de nuevos discursos emancipatorios. ObjectiveTo investigate the association of pre-existing migraine in patients hospitalised and who recovered from severe acute respiratory syndrome coronavirus 2 infection with the presence of post-coronavirus disease symptoms.BackgroundNo study has investigated the role of migraine as a risk factor for development of post-COVID symptoms.MethodsA case-control study including individuals hospitalised during the first wave of the pandemic was conducted. Patients with confirmed previous diagnosis of migraine were considered cases. Two age- and sex-matched individuals without a history of headache per case were (...) also recruited as controls. Hospitalisation/clinical data were collected from hospital medical records. Patients were scheduled for a telephone interview. A list of post-COVID symptoms was systematically evaluated, but participants were invited to freely report any symptom. The Hospital Anxiety and Depression Scale and the Pittsburgh Sleep Quality Index were used to assess anxiety/depressive symptoms and sleep quality. Multivariable conditional logistic regression models were constructed.ResultsOverall, 57 patients with confirmed diagnosis of migraine and 144 non-migraine controls who had recovered from COVID-19 were assessed at 7.3 months after hospital discharge. The number of post-COVID symptoms in the migraine group was significantly greater than in the non-migraine group. Fatigue was significantly more prevalent in the migraine group. However, no between-groups difference in the prevalence of headache as a post-COVID symptom was detected.ConclusionPatients with a history of migraine who recovered from COVID-19 exhibited more long-term fatigue as post-COVID sequelae than those without migraine. Some of the pathophysiological changes associated with migraine could predispose to the occurrence of post-COVID symptoms. (shrink)

Background Paternalism/overprotection limits communication between healthcare professionals and patients and does not promote shared therapeutic decision-making. In the global north, communication patterns have been regulated to promote autonomy, whereas in the global south, they reflect the physician’s personal choices. The goal of this study was to contribute to knowledge on the communication patterns used in clinical practice in Mexico and to identify the determinants that favour a doctor–patient relationship characterized by low paternalism/autonomy. Methods A self-report study on communication patterns in (...) a sample of 761 mental healthcare professionals in Central and Western Mexico was conducted. Multiple ordinal logistic regression models were used to analyse paternalism and associated factors. Results A high prevalence of paternalism was observed among mental health professionals in Mexico. The main determinants of low paternalism/autonomy were medical specialty and gender, with female physicians being more likely to explicitly share diagnoses and therapeutic strategies with patients and their families. A pattern of highly explicit communication was strongly associated with low paternalism/autonomy. Finally, a modifying effect of age strata on the association between communication pattern or specialty and low paternalism/autonomy was observed. Conclusions Among mental health professionals in Mexico, high paternalism prevailed. Gender, specialty, and a pattern of open communication were closely associated with low paternalism/autonomy. Strengthening health professionals’ competencies and promoting explicit communication could contribute to the transition towards more autonomist communication in clinical practice in Mexico. Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

Why are negative emotions so central in art reception far beyond tragedy? Revisiting classical aesthetics in the light of recent psychological research, we present a novel model to explain this much discussed (apparent) paradox. We argue that negative emotions are an important resource for the arts in general, rather than a special license for exceptional art forms only. The underlying rationale is that negative emotions have been shown to be particularly powerful in securing attention, intense emotional involvement, and high memorability, (...) and hence is precisely what artworks strive for. Two groups of processing mechanisms are identified that conjointly adopt the particular powers of negative emotions for art's purposes. The first group consists of psychological distancing mechanisms that are activated along with the cognitive schemata of art, representation, and fiction. These schemata imply personal safety and control over continuing or discontinuing exposure to artworks, thereby preventing negative emotions from becoming outright incompatible with expectations of enjoyment. This distancing sets the stage for a second group of processing components that allow art recipients to positively embrace the experiencing of negative emotions, thereby rendering art reception more intense, more interesting, more emotionally moving, more profound, and occasionally even more beautiful. These components include compositional interplays of positiveandnegative emotions, the effects of aesthetic virtues of using the media of (re)presentation (musical sound, words/language, color, shapes) on emotion perception, and meaning-making efforts. Moreover, our Distancing-Embracing model proposes that concomitant mixed emotions often help integrate negative emotions into altogether pleasurable trajectories. (shrink)

Recent debates on phenomenal consciousness have shown renewed interest for the idea that experience generally includes an experience of the self—a self-experience—whatever else it may present the self with. When a subject has an ordinary experience (as of a bouncing red ball, for example), the thought goes, she is not just phenomenally aware of the world as being presented in a certain way (a bouncy, reddish, roundish way in this case); she is also phenomenally aware of the fact that it (...) is presented to her. This supposed phenomenal dimension has been variously called “mineness,” “for-me-ness,” “pre-reflective self-awareness,” and “subjective character,” among others. This view, associated with historical figures such as William James, Husserl, Merleau-Ponty, and Sartre, is attracting a new surge of attention at the crossroads of phenomenology, analytic philosophy of mind, and the philosophy of cognitive science, but also intense controversy. This book explores some of the questions running through the ongoing debate on the putative subjective dimension of experience: Does it exist?, the existence question; What is it?, the essence question; What is it for?, the function question; and What else does it explain?, the explanation question. The volume also surveys various domains of human experience, both normal and pathological, where a “sense of self” might be at play, including agency, bodily awareness, introspection, memory, emotions, and values, and offers insights into the possible relations between the notions of subjective awareness involved. The first part of the book is devoted to more skeptical or deflationary views about self-experience, and the second, to more robust ones. (shrink)

The paper begins with the prerequisite assumption that social deprivation is a fragile and porous category. Thus, our hypothesis is, that how people are affected by the restrictions against the spreading of the coronavirus is often discussed in far too general and simplistic terms. It is often taken as a given, that the virus and the restriction measures not only have caused severe difficulties for us all (due to social distancing, fear, affected health, etc.), but that the measures have exacerbated (...) already previously existing forms of social deprivation. Therefore, it is assumed that marginalized groups are particularly affected by these effects of the pandemic. Two major German studies show the alleged effects of the relevant measures on adolescents and emerging adults (COPSY and FIBS) against the backdrop of social and economic deprivation; their results confirmed that social deprivation entails a higher degree of being affected by the pandemic.However, this picture becomes thwarted by considering the results of 10 narrative interviews, that were conducted by us with emerging adults in a German vocational training institute between April and August 2021 and showed variegated forms of experiencing issues related to the pandemic. In our analysis, we used the method of objective hermeneutics. In this paper, we present our considerations by outlining two contrastive experiences with the Covid-19 pandemic, in order to highlight the divergent ways in which the pandemic has been experienced even among individuals who previously had been affected by social deprivation – at least at first glance – in similar ways. The conceptual lens through which we interpret these two examples is, firstly, the one of precariousness and precarity (Butler 2009). And secondly, the concept of recognition derived from Honneth’s pertinent theory and Butler’s account of recognizability will play a pivotal role. While Honneth’s approach allows us to emphasize the normative and existential role of the fulfilment of our basic desire for recognition and the detrimental implications of disregard, Butler provides us with the means to thoroughly analyse the socio-historical conditions of misrecognition and social invisibility. Moreover, Butler focuses specifically on the recognizability of precariousness (Honneth’s triad of love, being respected as a rights bearer and solidarity shows a different focus). Combining qualitative research on precarious live circumstances with a theoretical perspective on recognition can also be found in a stunning research on couples in atypical working relations (Wimbauer and Motakef 2019). Proceeding from these theories and ‘applying’ them to our empirical material, we seek to call into question a too generalizing and hegemonic picture of how people were affected by pertinent restrictions. Qualitative interviews are able to point us to significant differences in the experience of the restrictions.In terms of an outlook, we suggest that a sensitization for previously excluded kinds of experiences forms a crucial basis for a less normalizing, that is, more inclusive account of interpreting the affectedness and needs of variegated social groups; the pandemic has influenced and altered structures of the recognition of vulnerability and, by the same token, made them more explicit. It thus is an occasion for a critical engagement with the recognizability of needs, deprivation, discrimination, and related phenomena. (shrink)

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

Este artigo apresenta uma revisão de literatura, que possui como objetivo investigar como o fenômeno corpolatria está inserido em publicações científicas. Teve como lócus três portais de buscas (Scielo, Portal de Periódicos da CAPES e Google Acadêmico) e recorte temporal de 2012 a 2021. Os dados foram analisados qualitativamente, no qual, averiguou-se a conceituação de corpolatria destacada na literatura e o local de origem dos estudos. A partir dos resultados, inferiu-se que a temática ainda é incipiente entre os pesquisadores brasileiros, (...) embora haja boa distribuição geográfica dos estudos. Percebeu-se que corpolatria é uma patologia da modernidade, caracterizada pelo culto exagerado do corpo, referendada como uma espécie de ditadura corporal, estabelecida pelo discurso do corpo perfeito. Disseminada pela mídia, pelas redes sociais e pela sociedade, caracteriza-se como uma patologia social à medida que causa mal-estar social, pois pode gerar consequências físicas, transtornos psicológicos e insegurança. The digital transfer of the mind to a computer system requires representing the mind as a finite sequence of bits. The classic “stored-program computer” paradigm, in turn, implies the equivalence between program and data, so that the sequence of bits themselves can be interpreted as a program, which will be algorithmically executed in the receiving device. Now, according to a previous proof, on which this paper is based, a computational or algorithmic machine, however complex, cannot be free. Consequently, a finite (...) sequence of bits cannot adequately represent a free mind and, therefore, a free mind cannot be digitally transferred, quod erat demonstrandum. The impossibility of making this transfer, as demonstrated here, should be a concern especially for those who wish to achieve it. Since we intend this to be a rigorous demonstration, we must give precise definitions and conditions of validity. The most important part of the paper is devoted to explaining the meaning and reasonableness of these definitions and conditions. Special attention is paid, also, to the philosophical implications of the demonstration. Finally, this thesis is distinguished from other closely related issues. (shrink)

ObjectiveThis study aimed to analyze the influence and measurement of the relationship and interaction between the elderly lifestyles after the appearance of the SARS-CoV-2 variant and the factors analyzed comprised life satisfaction levels, social relationships, and daily-life activities.MethodsThe study population was ≥ 65 in Castile-La Mancha. The research design was quantitative and arose from primary data collected via an ad hoc survey carried out through the Computer Assisted Telephone Interview system by randomly stratified sampling. The sample size was made up (...) of 1,065 cases, and the participants were selected through a random sampling stratified by gender quotas, age, province, and habitat size.ResultsThe results obtained revealed two main lifestyles, from which a notable behavioral change in personal relationships led to infer toward alternative lifestyles.ConclusionNotwithstanding the variation in lifestyles of the elderly after the pandemic, certain relationships remained unaltered. Thus, from the analyzed variables, relatives and friends relationships were scarcely influenced by the supervened incident. (shrink)

En filosofía de la percepción el relacionamiento con el entorno es el terreno donde el Realismo Ingenuo y el Intencionalismo se posicionan como dos posturas contrarias. La primera de ellas presenta una explicación que satisface al que busca un esclarecimiento del relacionamiento íntimo en la presentación del entorno durante la percepción, mientras que la otra teoría podría satisfacer a aquellos que buscan un esclarecimiento de la manera en la cual el entorno se presente de tal o cual modo a diferentes (...) percipientes, dando espacio para la formación de juicios y creencias particulares. Pero ¿podrá existir un planteamiento intermedio que asegure la intimidad de la presentación perceptual y la representación del entorno? El siguiente articulo expondrá los elementos del debate abordando una definición de cada teoría, luego avanzando hacia una alternativa intermedia y, finalmente, concluyendo de la posibilidad de tal postura intermedia, pero con un enfoque representacional dinámico. The introduction of a new analytical method, due fundamentally to François Viète and René Descartes and the later dissemination of their works, resulted in a profound change in the way of thinking and doing mathematics. This change, known as process of algebrization, occurred during the seventeenth and early eighteenth centuries and led to a great transformation in mathematics. Among many other consequences, this process gave rise to the treatment of the results in the classic treatises with the new analytical method, (...) which allowed new visions of such treatises and the obtaining of new results. Among those treatises is the Arithmetic of Diophantus of Alexandria which was written, using the new algebraic language, by the French mathematician Jacques Ozanam, who in addition to profusely increasing the original problems of Diophantus, solved them in a general way, thus obtaining many geometric consequences. The work is handwritten, it has never been published, it has been lost for almost 300 years, and the known references show its importance. We will show that Ozanam’s manuscript was quoted as an important work on several occasions by others mathematicians of the time, among whom G. W. Leibniz stands out. Once the manuscript has been located, our aim in this article is to show and analyze this work of Ozanam, its content, its notation and its structure and how, through the new algebraic method, he not only solved and expanded the questions proposed by Diophantus, but also introduced a connection between the algebraic solutions and what he called geometric determinations by obtaining loci from the solutions. Drawing on Brown and Fraser’s (in: Giles, Scherer (eds) Social markers in speech, Cambridge University Press, Cambridge, pp 33–62, 1979) framework for the analysis of communicative situations and Fuentes Rodríguez’s (Lingüística pragmática y Análisis del discurso, Arco Libros, Madrid, 2000; in Estudios de Lingüística: Investigaciones lingüísticas en el siglo XXI, 2009. https://doi.org/10.14198/ELUA2009.Anexo3.04 ) model of pragmatic analysis, this paper examines three home-made recordings featuring some of the members of the terrorist cell responsible for the 2017 vehicle-ramming attacks in Barcelona and (...) Cambrils weighted as evidence during the trial held between November 2020 and May 2021 in the Spanish National High Court. The aim of this qualitative analysis is to test whether the linguistic evidence available supports the allegation that the participation in these recordings by one of the accused, Mohamed Houli Chemlal, had been planned by his interlocutors. Results show, first, that the exchanges analyzed present features indicative of both spontaneity and (limited) planification. Second, that Houli makes key contributions to the unfolding of the interactions shown in the recordings and that he does so in a cooperative and apparently relaxed manner, which could at best provide only partial support to his allegations. It is claimed that forensic linguistic analysis can generate valuable insights within terrorism-related legal proceedings. (shrink)

The nurse-patient relationship involves complex attitudes and behaviours with ethical and deontological implications. It has been linked to improvements in patient health outcomes, although there is still no consensus in the scientific literature as to the definition and characterisation of the concept. This article aim to define the concept of the nurse-patient relationship. A concept analysis was conducted using the Walker and Avant method to identify the attributes defining the nurse-patient relationship. An integrative review of the literature was conducted using (...) the PubMed, Web of Science, Scopus, and Cumulative Index to Nursing & Allied Health Literature databases. A review of the grey literature and other minor non-indexed publications on the topic was also conducted. A total of 36 articles were included in the review. A model case, a contrary case, a related case, and empirical references were produced to clarify the concept and identify its essential attributes. The concept is defined as a helping relationship involving interaction between different players. It is the basis of nursing care and is intended to meet the healthcare needs of the individual receiving this care. It is also viewed as an intervention in itself, requiring a specific training process just like any other nursing skill. The essential attributes of the relationship are empathy, presence, contact, authenticity, trust, and reciprocity. In conclusion, the nurse-patient relationship is a helping relationship established with the patient and/or their family based on interaction, communication, respect for ethical values, acceptance, and empathy in order to encourage introspection and behavioural change. Key components include communication, active listening, and respect. Bioethical values and confidentiality must also be present to ensure that the relationship is built on equality and intimacy. Using a prototype approach, we assessed people’s lay conceptions of intuition and analysis. Open-ended descriptions of intuition and analysis were generated by participants (Study 1) and resulting exemplars were sorted into features subsequently rated in centrality by independent participants (Study 2). Feature centrality was validated by showing that participants were quicker and more accurate in classifying central (as compared to peripheral) features (Study 3). Centrality ratings suggested a single-factor structure describing analysis but revealed that participants held lay conceptions of intuition (...) as involving two different types of processes: (1) as an automatic, affective, and non-logical processing, and (2) as a holistic processing that can assist in problem-solving. Additional analyses showed that the centrality ratings of intuition’s facets were predicted by participants’ self-reported intuitive style, suggesting intuition is differently perceived by intuitive and non-intuitive people. We discuss the implications of these results for the study of intuition and analysis. (shrink)

This essay concerns the causation involved in divine sustenance—the “pressure of the will of God” that continually upholds things in existence and supplies them with their properties and powers. My aim is to consolidate the theological doctrine of sustenance and a metaphysical theory of properties. Towards that end, I develop and motivate two consolidatory proposals, which together secure a more parsimonious theistic ontology and integrate the doctrine of sustenance and a theory of properties in a mutually enhancing way. Die Studie untersucht die Entwicklung des Gottesbegriffs und der diesbezüglichen Erkenntnisschritte im Werk des Nikolaus von Kues. Im Einzelnen werden in chronologischer Reihenfolge textphilologisch analysiert: 'De docta ignorantia', 'De coniecturis', 'De deo abscondito', 'De visione Dei', 'Trialogus de possest', 'De non aliud' und 'De apice theoriae'. Die Untersuchung unterstreicht die Relevanz der cusanischen Theologie für den gegenwärtigen Diskurs, wobei sie zugleich deren Anschlussfähigkeit an die christliche Tradition thematisiert. Zahlreiche Graphiken und formallogische Darstellungen bündeln die gewonnenen Erkenntnisse.

Is ethics a computable function? Can machines learn ethics like humans do? If teaching consists in no more than programming, training, indoctrinating… and if ethics is merely following a code of conduct, then yes, we can teach ethics to algorithmic machines. But if ethics is not merely about following a code of conduct or about imitating the behavior of others, then an approach based on computing outcomes, and on the reduction of ethics to the compilation and application of a set (...) of rules, either a priori or learned, misses the point. Our intention is not to solve the technical problem of machine ethics, but to learn something about human ethics, and its rationality, by reflecting on the ethics that can and should be implemented in machines. Any machine ethics implementation will have to face a number of fundamental or conceptual problems, which in the end refer to philosophical questions, such as: what is a human being (or more generally, what is a worthy being); what is human intentional acting; and how are intentional actions and their consequences morally evaluated. We are convinced that a proper understanding of ethical issues in AI can teach us something valuable about ourselves, and what it means to lead a free and responsible ethical life, that is, being good people beyond merely “following a moral code”. In the end we believe that rationality must be seen to involve more than just computing, and that value rationality is beyond numbers. Such an understanding is a required step to recovering a renewed rationality of ethics, one that is urgently needed in our highly technified society. (shrink)

This chapter discusses fundamental problems and prospects for ethical naturalism. Section 1 explains what is meant by “ethical naturalism” and surveys different versions of the view. Section 2 discusses the central philosophical challenge to ethical naturalism, viz., the “Normativity Objection.” Section 3 offers a battery of responses to it on behalf of the ethical naturalist. Section 4 explores a promising and novel approach to ethical naturalism, viz., a moral nativist theory that that combines a Chomskian approach to moral competence with (...) a structuralist metaphysics. This paper aims to offer an alternative view for understanding scientific models based on metaphors. To accomplish this, we employ a special case of Darwin’s use of metaphors, such as the notion of powerful Being, in order to represent natural selection. Our proposal contributes to issues in the literature of scientific model, such as imprecisions in the understanding of scientific models, especially in models based on metaphors. Thus, our alternative view of models based on metaphors, and inspired by Darwin’s use (...) of metaphors, provides us with four features, a-simplification and selection; b-articulation of familiar-unfamiliar structures; c-accessibility and moderations of complexity, and finally d-local realism. We contrast these features with Darwin’s use of a metaphors. We conclude by saying that our proposal of metaphor’s approach of models does not only contribute to the clarification of how these types of scientific models can be understood but it shows that metaphors can also contain a realist element that explains why scientists often use it in their practices of modeling the world. De ciborgs a posthumanos, pasando por una amplia y variada gama de sujetos contemporáneos, se puede apreciar que el concepto de Übermensch aporta las claves fundamentales con las cuales deconstruir el concepto de identidad fija que pone en juego el universalismo abstracto. Sin embargo, estas propuestas han pasado por alto algo fundamental. Short overview of the From Small Beginnings Project and its relevance for resisting eugenics in contemporary society.

ABSTRACT:Ethical research on consumption has focused mainly on the obligations, principles and values guiding consumers' actions and reasons for action. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. Dating manuscripts is a difficult task – particularly when these are not expressly datemarked, but even when they are. Factors such as the existence of successive copies that continue and repeat established models and production methods make dating a challenging task. The present work forms part of a much broader, comprehensive, investigation on the material composition of dated and bound manuscripts from the School of arabic Studies– CSIC of Granada. By means of a study protocol, errors in the dating of (...) manuscripts ms6, ms10, ms26 and ms29 are successfully detected and corrected, and alternative dating proposed. (shrink)

Guy Rohrbaugh and Allan Hazlett have provided two arguments against the thesis that musical works are types. In short, they assume that, according to our modal talk and intuitions, musical works are modally flexible entities; since types are modally inflexible entities, musical works are not types. I argue that Rohrbaugh’s and Hazlett’s arguments fail and that the type/token theorist can preserve the truth of our modal claims and intuitions even if types are modally inflexible entities. First, I consider two alternatives (...) for the type/token theorist proposed in recent literature about the topic: the created types’ solution and the created abstract objects’ solution. I argue that none of them is attractive for the type/token theorist because they do not preserve the theoretical advantages of type/token theories to explain musical works’ repeatable nature. Then, I focus on the arguments’ common premise that musical works are modally flexible entities. A deeper analysis of musical practice will show that this premise is not true: our modal claims do not imply that musical works could have had different intrinsic but, instead, extrinsic properties. Finally, I show how the nested types theory may offer a satisfactory explanation of this fact and how it captures the truth of our modal talk about musical works. (shrink)

The American Society for Bioethics and Humanities promulgated standards for clinical ethics consultants and is currently developing a national Quality Attestation in Clinical Ethics Consultation to assist facilities in ensuring that those performing clinical ethics consultations meet minimum standards. As the field moves towards such professionalization, there is a need to provide access to qualified clinical ethicists at a broad range of medical facilities. Currently, however, there are insufficient numbers of trained clinical ethicists to staff all healthcare facilities, and many (...) facilities lack the necessary resources to hire staff clinical ethicists. In this review, we describe several models for providing expert clinical ethics support to remote facilities that lack access to qualified clinical ethicists. Based on this analysis, we recommend telemedicine as the optimal model providing expert support to local ethics committee members tasked with providing clinical ethics consultation services. (shrink)
