Moral rights feature prominently and are relied on substantially in debates in bioethics. Conceptually, however, duties can perform the logical work of rights, but not vice versa, and reference to rights is therefore inessential. Normatively, rights, like duties, depend on more basic moral values or principles, and attempts to establish the logical priority of rights over duties or the reverse are misguided. In practical decision making, however, an analysis in terms of duties is more fruitful than one based on rights. (...) A right may function as a proxy term for a consequentialist rule, or for a deontological constraint, but does not thereby enrich these concepts. Rights may also help in a purely expressive sense and may assist an initial focusing on a moral conflict. However, their role in bioethics discourse is more one of convenience than of necessity. Moreover, unless rights are firmly founded on fundamental moral values, their use encourages rhetoric rather than argument. (shrink)

Outcome-adaptive randomization has been proposed as a corrective to certain ethical difficulties inherent in the traditional randomized clinical trial using fixed-ratio randomization. In particular, it has been suggested that OAR redresses the balance between individual and collective ethics in favour of the former. In this paper, I examine issues of welfare and autonomy arising in relation to OAR. A central issue in discussions of welfare in OAR is equipoise, and the moral status of OAR is crucially influenced by the way (...) in which this concept is construed. If OAR is based on a model of equipoise that demands strict indifference between competing interventions throughout the trial, such equipoise is disturbed by accruing data favouring one treatment over another; OAR seeks to redress this by weighting randomization to the seemingly superior treatment. However, this is a partial response, as patients continue to be allocated to the inferior therapy. Moreover, it rests upon considerations of aggregate harms and benefits, and does not therefore uphold individual ethics. Issues of fairness also arise, as early and late enrollees are randomized on a different basis. Fixed-ratio randomization represents a fuller and more consistent response to a loss of equipoise, as so construed. With regard to consent, the complexity of OAR poses challenges to adequate disclosure and comprehension. Additionally, OAR does not offer a remedy to the therapeutic misconception—participants’ tendency to attribute treatment allocation in an RCT to individual clinical judgments, rather than to scientific considerations—and, if anything, accentuates rather than alleviates this misconception. In relation to these issues, OAR fails to offer ethical advantages over fixed-ratio randomization. More broadly, the ethical basis of OAR can be seen to lie more in collective than in individual ethics, and overall it fares worse in this territory than fixed-ratio randomization. (shrink)

This paper explores the nature of rights, and their implications for the ethics of nursing. A right is seen as an entitlement which is justified on moral and/or legal grounds, and which may take the form of a right of action or a right of recipience, or both; in either case, correlative duties are generally imposed on others. Some of the conflicts which can occur among two or more conflicting rights are examined through three hypothetical scenarios, and approaches to their (...) resolution are suggested. The question of whether nurses, as nurses, possess rights is then considered, and it is suggested that they do not. In conclusion, it is argued that, if rights are to be a helpful concept, they must be carefully defined and analysed, and their relationship to one another, and to duties, must be clarified. The increasing prevalence of ecologically sustainable products in consumer markets, such as organic produce, are generally assumed to curtail anthropogenic impacts on the environment. Here I intend to present an alternative perspective on sustainable production by interpreting the relationship between recent rises in organic agriculture and greenhouse gas emissions from agricultural production. I construct two time series fixed-effects panel regressions to estimate how increases in organic farmland impact greenhouse gas emissions derived from agricultural production. My analysis finds that the rise (...) of certified organic production in the United States is not correlated with declines in greenhouse gas emissions derived specifically from agricultural production, and on the contrary is associated positively overall agricultural greenhouse gas emissions. To make sense of this finding, I embed my research within the conventionalization thesis. As a result I argue that the recent USDA certification of organic farming has generated a bifurcated organic market, where one form of organic farming works as a sustainable counterforce to conventional agriculture and the other works to increase the economic accessibility of organic farming through weakening practice standards most conducive to reducing agricultural greenhouse gas output. Additionally, I construct my own theoretical framework known as the displacement paradox to further interpret my findings. (shrink)

Zu den wichtigsten Entwicklungen der Diskussion der Frage, ob Freiheit und moralische Verantwortung einerseits, und der Determinismus andererseits miteinander vereinbar sind, zählen nach verbreiteter Ansicht die Überwindung der Konditionalanalyse von Freiheit, sowie der wachsende Zweifel daran, dass alternative Möglichkeiten Voraussetzung für Verantwortung sind. In meiner Habilitationsschrift versuche ich zu zeigen, dass beide Entwicklungen Irrwege sind. Das Buch gliedert sich in zwei Hauptteile. Im ersten Teil wird der Begriff der praktischen Fähigkeit bzw. der Handlungs- und Willensfreiheit analysiert. Unter welchen Bedingungen kann (...) ein Akteur etwas anderes als das tun, was er faktisch tut, bzw. unter welchen Bedingungen ist ein Akteur frei, anders zu handeln? In der philosophischen Diskussion dieser Frage ist traditionell ein zentraler Aspekt, ob zu diesen Bedingungen auch Indetermination zählt. Philosophen, die die Freiheit, anders zu handeln, für kompatibel mit dem Determinismus halten, haben oftmals eine konditionale Analyse von Freiheit/Können vertreten (Augustin, Hobbes, Hume, Moore, Tugendhat). Gegen diese Analyse sind jedoch zahlreiche Einwände erhoben worden, die von den meisten Philosophen, auch von Kompatibilisten, für triftig gehalten werden. Ich versuche im ersten Teil, die Konditionalanalyse gegen die erhobenen Einwände zu verteidigen. Im zweiten Teil der Arbeit geht es um die Frage, unter welchen Bedingungen Akteure moralisch verantwortlich gemacht werden können. Diese Frage ist mit der Frage nach der Fähigkeit, anders zu handeln, dadurch verbunden, dass einer lange unbestrittenen Annahme zufolge jemand nur dann moralisch verantwortlich sein kann, wenn er anders hat handeln können. Diese Annahme ist in neuerer Zeit – im Gefolge Harry Frankfurts – angezweifelt worden. Ich versuche zu zeigen, dass die Annahme dennoch richtig ist. Ich entwickle eine an Überlegungen Peter Strawsons angelehnte Analyse von moralischer Verantwortung, der zufolge ein Akteur moralisch verantwortlich für ein Ereignis ist, wenn er in einer kausalen Beziehung zu ihm steht, welche Rückschlüsse auf die moralische Qualität seines Willens ermöglicht. Durch eine Analyse der Adäquatheitsbedingungen moralischer Beurteilung von Akteuren versuche ich zu zeigen, dass die relevanten Kausalbeziehungen dann bestehen, wenn eine bestimmte Konditionalanalyse die Fähigkeit zuschreibt, anders zu handeln. Alternative Möglichkeiten im Sinne dieser Analyse sind notwendig und hinreichend für moralische Verantwortung. (shrink)

Thus begins this remarkable interdisciplinary study of time by a master of the subject. And while developing a theory of "time as conflict," J. T. Fraser does offer "many things indeed"--an enormous range of ideas about matter, life, death, evolution, and value.

Scientific models are used to predict and understand the target phenomena in the reality. The kind of epistemic relationship between the model and the reality is always regarded by most of the philosophers as a representational one. I argue that, complementary to this representational role, some of the scientific models have a constructive role to play in altering and reconstructing the reality in a physical way. I hold that the idealized model assumptions and elements bestow the constructive force of a (...) model on the reality. By recognizing the physical constructive force of some scientific models, the merit of these models could be judged by how successful they are in the reality construction, rather than by the traditional criterion of model-world representation. Aristotle did not see a sharp contrast between the psychological and the physical. He viewed the physical as just the natural, and treats the psychological as part of the physical. This essay attempts to explain why this is so, and presents observations about Aristotle’s framework. It explores the relation of hylomorphism to functionalism, and argues against funtionalist interpretations of Aristotle due to the belief that Aristotle was confronting a different set of concerns and issues.

In this comment I respond to the criticisms put forth by Muller et al. It is my assessment that the authors’ make useful suggestions for future analyses. However, their conclusion regarding the invalidity of my results are based on a misconception of the goals and data used in my article.

Research on religion can advance understanding of social cognition by building connections to sociology, a field in which much cognitively oriented work has been done. Among the schools of sociological thought that address religious cognition are: structural functionalism, symbolic interactionism, conflict theory, phenomenology, and, most recently, exchange theory. The gulf between sociology and cognitive science is an unfortunate historical accident.

ion is one of the important processes in scientific modeling. It has always been implied that abstraction is an agent-centric activity that involves the cognitive processes of scientists in model building. I contend that there is an autonomous aspect of abstraction in many modeling activities. I argue that the autonomous process of abstraction is continuous with the agent-centric abstraction but capable of evolving independently from the modeler’s abstraction activity.

In this book, Julius M. Moravcsik disputes that a natural language is not and should not be represented as a formal language. The book criticizes current philosophy of language as having an altered focus without adjusting the needed conceptual tools. It develops a new theory of lexical meaning, a new conception of cognition-humans not as information processing creatures but as primarily explanation and understanding seeking creatures-with information processing as a secondary, derivative activity. In conclusion, based on the theories of (...) lexical meaning and cognition, this work sketches an argument showing that the human understanding of human understanding must always remain just partial. Pictorial representations such as diagrams and figures are widely used in scientific literature for explanatory and descriptive purposes. The intuitive nature of pictorial representations coupled with texts foster a better understanding of the objects of study. Biological mechanisms and processes can be clearly illustrated and grasped in pictures. I argue that pictorial representations describe biological phenomena by telling stories. I elaborate on the role of narrative structures of pictures in the frontier research using a case study in immunology.
