In this paper I argue against the holistic claim that the description and explanation of human behaviour is irreducibly social in nature. I focus on the more specific thesis that human behaviour is rule-guided and that 'rule' is an irreducibly social notion. Against this claim I defend a teleofunctional and reductionist view. Following Millikan (1990), who argues that 'rule' can be explicated in functional terms, I extend her argument to cover social rules as well, and argue that rules are laws. (...) This book features essays that investigate the nature of legal validity from the point of view of different traditions and disciplines. Validity is a fascinating and elusive characteristic of law that in itself deserves to be explored, but further investigation is made more acute and necessary by the production, nowadays, of soft law products of regulation, such as declarations, self-regulatory codes, and standardization norms. These types of rules may not exhibit the characteristics of formal law, and may lack full formal (...) validity but yet may have a very real impact on people's lives. The essays focus on the structural properties of hard and soft legal phenomena and the basis of their validity. Some propose to redefine validity: to allow for multiple concepts instead of one and/or to allow for a gradual concept of validity. Others seek to analyze the new situation by linking it to familiar historical debates and well-established theories of law. In addition, coverage looks at the functions of validity itself. The discussion considers both international law as well as domestic law arrangements. What does it mean to say that something is valid? Should we discard validity as the determining aspect of law? If so, what does this mean for our concept of law? Should we differentiate between kinds of validity? Or, can we say that rules can be "more" or "less" valid? After reading this book, practitioners, scholars and students will have a nuanced understanding of these questions and more. Spiritual care is a profession in transformation. It is evolving from a denominationally bound profession into a specific kind of healthcare profession. In the Netherlands, as elsewhere, debates are going on about the introduction of standards in public services such as health care. Many spiritual counsellors oppose standardization of spiritual care. Most importantly, standards seem to conflict with their sanctuary position as well as with the ?theory of presence? that many spiritual counsellors adhere to. A questionnaire was distributed among spiritual (...) counsellors asking them about the nature and number of standards they work with and the positive and negative effects of these standards on their daily work. This exploratory study shows that only a few spiritual counsellors work with standards. It also reveals that those who work with standards are neutral to positive about the ways in which standards influence their work. In particular, spiritual counsellors working with standards state that doing so does not conflict with their sanctuary position, nor with their ?being present?. The responses suggest that it does not seem to be standards as such but rather the social setting within which the standards are used that determines the effects that standards have on the content and quality of spiritual care. The paper concludes with some recommendations and suggestions for further investigation. (shrink)

Van Koppen and Mackor offer a scenario‐approach analysis of the case. They first explicate their approach, linking it to inference to the best explanation and theories of explanatory coherence. An important distinction in their analysis is between explaining known facts and predicting novel facts. They claim that their approach is cognitively feasible and stays close to descriptive theories of evidential reasoning. They want to keep it informal, so that legal professionals can apply it.

Moral Case Deliberation is an up and coming form of ethics support wherein clinical professionals deliberate about moral questions they face in their work. So far, it has been unclear what quality of deliberation in MCD is entailed and how to evaluate this quality. This article proposes a coding scheme that fits the theoretical background of MCD and allows researchers to evaluate the quality of the deliberation in MCDs. We consider deliberation in MCD to be of good quality when participants (...) enrich their own understanding of a case by being exposed to the viewpoints of others. In order to have such an enriching effect, the deliberation in an MCD ought to involve different kinds of arguments from the perspectives of different stakeholders and in favour of different resolutions to the case; and the process of deliberation ought to be critical but constructive. A basic naturalistic epistemological intuition that Theo Kuipers and I share is the idea that the differences between the natural and the social sciences do not stand in the way of co-operative, integrative, and perhaps even reductive relations between them. In several papers I have offered a teleofunctional argument against interpretationalist autonomy claims and Kuipers (2001), Chapter 6 seems to favor this type of rebuttal. However, within the last 15 years or so, there has been a revival of another kind (...) of "verstehende," or rather "einfühlende," approach, which differs in some significant respects from the interpretationalist view. In this paper I investigate whether this so-called simulation theory might cause trouble for our naturalistic view of the relation between the natural and the social sciences. (shrink)

Decisions concerning proof of facts in criminal law must be rational because of what is at stake, but the decision‐making process must also be cognitively feasible because of cognitive limitations, and it must obey the relevant legal–procedural constraints. In this topic three approaches to rational reasoning about evidence in criminal law are compared in light of these demands: arguments, probabilities, and scenarios. This is done in six case studies in which different authors analyze a manslaughter case from different theoretical perspectives, (...) plus four commentaries on these case studies. The aim of this topic is to obtain more insight into how the different approaches can be applied in a legal context. This will advance the discussion on rational reasoning about evidence in law and will contribute more widely to cognitive science on a number of topics, including the value of probabilistic accounts of cognition and the problem of dealing with cognitive biases in reasoning under uncertainty in practical contexts. This collection of 17 articles offers an overview of the philosophical activities of a group of philosophers (who have been) working at the Groningen University. The meta-methodological assumption which unifies the research of this group, holds that there is a way to do philosophy which is a middle course between abstract normative philosophy of science and descriptive social studies of science. On the one hand it is argued with social studies of science that philosophy should take notice of what scientists (...) actually do. On the other hand, however, it is claimed that philosophy can and should aim to reveal cognitive patterns in the processes and products of scientific and common sense knowledge. Since it is thought that those patterns can function as guidelines in new research and/or in research in other disciplines, philosophy can nevertheless hold on to the normative aim which is characteristic of 'classical' philosophy of science. Compared to this common assumption, there is a diversity of subjects. Some papers deal with general problems of science, knowledge, cognition and argumentation, others with topics relating to foundational problems of particular sciences. Therefore this volume is of interest to philosophers of science, to philosophers of knowledge and argumentation in general, to philosophers of mind, as well as for scientists working in the physical and applied sciences, biology, psychology and economy who are interested in the foundations of their disciplines. This edition of the early diaries of Rudolf Carnap (1891–1970), which are housed in the Carnap estate at the University of Pittsburgh, was published in two volumes by Felix Meiner Verlag Hamburg in 2021 and 2022. These are also the first two volumes of the Meiner Edition Schriften aus dem Nachlass von Rudolf Carnap. The title of these two volumes is succinctly Rudolf Carnap. Tagebücher (Rudolf Carnap. Diaries), supplemented by the respective indication of the volume. Volume 1 (approx. 600 pages) (...) comprises the diaries from 1908 to 1919, Volume 2 (approx. 900 pages) those from 1920 to 1935. With these volumes, the diaries of one of the central thinkers of the Vienna Circle and Logical Empiricism become accessible to a wider circle of researchers and interested parties. While the diaries were previously only partially accessible, they have now for the first time been released in their entirety in the form of a proper text-critical edition. The editor is Christian Damböck with the collaboration of Brigitte Arden, Roman Jordan, Brigitte Parakenings and Lois M. Rendl. Text transcriptions of the originals, which Carnap had written in shorthand, served as the basis for the edition. The transcription was done by Brigitte Parakenings and Brigitte Arden, further editing by Lois M. Rendl and Roman Jordan. (shrink)

Democracy and democratization are now high on the political agenda, but there is growing indifference to the gap between rich and poor. Political equalities matter more than ever, while economic inequality is accepted almost as a fact of life. It is the separation between economic and political that lies at the heart of this book.

We examine recent evolution in corporate responsibility in the forest industry, an important natural‐resource‐based industry which is under rapid internationalisation and structural change under challenging financial pressures. We address two recent trends in corporate communication: corporate disclosure, that is the adoption of consistent external reporting standards [namely the Global Reporting Initiative (GRI) ], and the growing awareness of engagement with and impact on local communities through philanthropy, generation of prosperity, communication and the social impact of core activities. This study uses (...) a comparative qualitative case approach to forest industry multinational enterprises (MNEs) based on a combination of secondary (reporting, company newsletters and other documentation) and interview data. Three large‐scale multinational forest industry firms, all pursuing different strategies in terms of internationalisation and geographical and product diversification, were chosen for the study: Stora Enso, SCA and Sappi Ltd. Our results show that the overall quality of sustainability reporting has improved in these companies from 2005 to 2009 with the adoption of GRI. However, based on our fourfold categorisation of social impact, the core social impact indicator in GRI (SO1) has been interpreted very differently in these MNEs, and the adoption of GRI has not actually much improved the comparability of the reports or transparency of practices. In an effort to clear away confusions regarding the role of cultural analysis in historical explanation, this paper proposes a new approach to the issue of cultural autonomy. The premise is that there are two forms of cultural autonomy, analytic and concrete. Analytic autonomy posits the independent structure of culture-its elements, processes, and reproduction. It is achieved through the theoretical and artificial separation of culture from other social structures, conditions, and action. Concrete autonomy establishes the interconnection of culture with the (...) rest of social life, and is achieved by fleshing out the historically specific formulation of particular cultural structures. In addition to theoretically specifying the two forms of cultural autonomy, I demonstrate analytic and concrete autonomy in practice by examining two works that incorporate culture into the analysis of the same historical event. The rewards of recognizing both analytic and concrete cultural autonomy are twofold. First, cultural reductionism can be countered by establishing that culture is structural. Second and more important, once the independent nature of a cultural form is established, its causal contribution to concrete historical situations can be assessed accurately and integrated into historical explanation. The environmental crisis is the most prominent challenge humanity has ever had to battle with, and humanity is currently failing. The Anthropocene—or so called ‘age of humans’—is indeed a period when the survival of humanity has never been so much at risk. This book locates itself in the field of critical green political theory. In recent years, critics of modern obstetrics have cited technology as responsible for women's discontent regarding childbirth. In this essay, I investigate and pry apart the connection between the quality of childbirth experience and technology. After identifying three factors considered constitutive of a ‘good birth,’ I demonstrate how technology can either facilitate or hinder each, but how dominant strains of birthing practice that reinforce female shame consistently undermine them all. The content explores a variety of ideas that are covered in the myriad of courses experienced by undergraduate students and introduces new ones that are critical to the development of musicians (...) and prospective teachers. Some of these ideas might be alluded to or briefly discussed in methods classes, but not at the level of thoughtful detail as they are entertained and examined in the book. This level of depth would require students and teachers to discuss, dialogue, debate, and reflect over time within and across semesters and courses. I dare to suggest that some of the ideas might not be brought to students’ attention at all throughout the undergraduate experience, which is of a concern and suggests an even greater need for such a book.My overall impression of the book is that the content and the depth of writing would serve the undergraduate students throughout their undergraduate experience and the graduate population for similar and yet different reasons. In terms of the undergraduates, there are parts of the book that would be relevant during their first year in a foundations class, second year in technique classes, third year in methods (for lack of a better word) classes, and student teaching [End Page 109] seminar experiences as they prepare to enter the profession. Utilizing a book across an undergraduate’s experience could generate interesting conversation amongst faculty members as discussions about why, how, what, and when parts of the book would be relevant would need to evolve. Some chapters could be revisited while others visited for the first time at differing places and spaces across the four years. I cannot think of another book that could be utilized in this way and thus serve the undergraduate student throughout her four-year experience and this prospect I find exciting.The book is organized around fourteen chapters, all of which are followed by an afterward. The flow of the chapters invites the reader to examine aspects of becoming and being a music educator at various levels of growth and understanding.The first chapter is titled “Teacher” and requires the reader to think at broader and deeper levels when discussing the notions of role and identity, self-awareness, motivation to enter the profession, and reflective practice. While reading the text, I imagined conversations that would include a comparative analysis of students’ experiences, which could in turn provide larger contexts for the topics. Such a discussion is necessary when examining aspects of being and becoming a teacher in various contexts. The notion of situatedness is highlighted when individual cases are heard and examined and compared across other cases, carefully noting what might or might not be comparable and taking that bit of analysis into consideration. Having such discussions across the four years of undergraduate life allows students to re-visit what was and is, and to speculate about what is to come. Such reflection can be just as fruitful at the graduate level. Students enter graduate school with a variety of teaching experiences and time is needed to reflect on the transition from being a teacher to being a student again. Realization of the continuum on which they travel between learner and teacher becomes apparent in that the place on the continuum shifts regardless of their present position; that is, as a student or teacher. For doctoral students, this reflection is rich as they begin to engage with undergraduate students and forge a new path as budding teachers of teachers and researchers and continue to be musicians.Chapter Two took me to the writings of Dewey1 particularly as I read about a student-centered focus and the experience-based approach. So much of our profession has been driven by content and theories that the student has been removed from the center of the focus and thought of as peripheral. Background:Acting ethically, in accordance with professional and personal moral values, lies at the heart of nursing practice. However, contextual factors, or obstacles within the work environment, can constrain nurses in their ethical practice – hence the importance of the workplace ethical climate. Interest in nurse workplace ethical climates has snowballed in recent years because the ethical climate has emerged as a key variable in the experience of nurse moral distress. Significantly, this study appears to be the first of its kind (...) carried out in New Zealand.Aim/objective:The purpose of this study was to explore and describe how registered nurses working on a medical ward in a New Zealand hospital perceive their workplace ethical climate.Research design/participants/context:This was a small, qualitative descriptive study. Seven registered nurses were interviewed in two focus group meetings. An inductive method of thematic data analysis was used for this research.Ethical considerations:Ethics approval for this study was granted by the New Zealand Ministry of Health’s Central Regional Health and Disability Ethics Committee on 14 June 2012.Findings:The themes identified in the data centred on three dominant elements that – together – shaped the prevailing ethical climate: staffing levels, patient throughput and the attitude of some managers towards nursing staff.Discussion:While findings from this study regarding staffing levels and the power dynamics between nurses and managers support those from other ethical climate studies, of note is the impact of patient throughput on local nurses’ ethical practice. This issue has not been singled out as having a detrimental influence on ethical climates elsewhere.Conclusion:Moral distress is inevitable in an ethical climate where the organisation’s main priorities are perceived by nursing staff to be budget and patient throughput, rather than patient safety and care.
