Starmaking brings together a cluster of work published over the past 35 years by Nelson Goodman and two Harvard colleagues, Hilary Putnam and Israel Scheffler, on the conceptual connections between monism and pluralism, absolutism and relativism, and idealism and different notions of realism -- issues that are central to metaphysics and epistemology. The title alludes to Goodman's famous defense of the claim that because all true representations of stars and other objects are human creations, it follows that in an important (...) sense the stars themselves are made by us. More generally, the argument moves from the fact that our right representations are constructed by us to the claim that the world itself is similarly constructed. Starmaking addresses the question of whether this seeming paradox can be turned into a serious philosophical view. Goodman and Putnam are sympathetic; Scheffler is the critic. Although many others continue to write about pluralism, relativism, and constructionalism, Starmaking brings together the protagonists in the debate since its beginnings and follows closely its still developing form and substance, focusing sharply on Goodman's claim that "we make versions, and right versions make worlds.". This study is concerned with the problem of political obligation, the normative question of why one should obey the law, and with social contract thought as an answer to this question. It is entitled a critique, but the critique is not of social contract theory as such, but rather of the "orthodox" treatment of contract that yields so readily to the rough handling and easy rejection that is the normal lot of contractarianism in contemporary treatments. In (...) its place will be suggested a reinterpretation of contract that sees it as making different assumptions and requiring different premises, and that is proof against many of the orthodox refutations of social contract theory; the reinterpretation is thus in the nature of a vindication. First, from an examination of the most commonly cited champions of contractarianism will be derive a reinterpretation of contract in the form of a new model or syllogism, the features of which will be brought out by contrasting it first with the contemporary ideas of John Rawls and then with the orthodox model itself. Democratic consent theory, as the heir to the remnants of the orthodox model, will be examined, and the ideas of T. H. Green will be considered as embodying an important feature of contractarianism omitted or ignored by the orthodox model Finally, the new model of contract will be suggested as a potentially useful approach to the problem of political obligation in the modern context. After all, Aquinas is the most famous medieval thinker in the West, and the question of Church and state is one of the best-known medieval political questions. And yet his thought on that polemical topic remains obscure. As John Watt (...) puts it: "There are too many ambiguities in his doctrine and too many unanswerable questions about what he did or did not hold."1Why is his view not better understood? Part of its obscurity is the relative infrequency with which he writes on politics.2 Another is the relative lack of interest in medieval political thought among political scientists and historians of political thought, an obscurity dating back to the Renaissance.3 Those who do study Aquinas's thought, moreover, have been mired in a controversy over two key texts: one from book II of his Scriptum or commentary on Peter Lombard's Sentences (d. 44, q. 2, a. 3, exp. text.), and the other in book II of De regno (On kingship), chapter 3 (no. 110). For brevity, I will use S for the Scriptum passage and R for the De regno passage.4 These two [End Page 1019] appear to contradict each other, and with respect to fundamental political questions. The debate over these two texts points to what most contributes to the obscurity of Aquinas's teaching on Church and state: confusion about his vision of politics in human life. As I will show in this paper, Aquinas transcends modern categories of the "secular" and "belief" in his treatment of politics. Aquinas valorizes the integrity of political activity: that autonomy is not just a concession to the modern condition. It is in fact when Aquinas is most theological that he is most open to that integrity. The integrity of the political speaks to the intrinsic goodness of that order: it mirrors God's unity in its complex and ordered diversity.In this paper I examine R and S to show their concordance. I argue that they are complementary in what they prescribe for relations between Church and state, and indeed grounded in the same account of the origins of political authority. Through this investigation we will uncover key principles of Aquinas's political thinking that show him to have a capacious vision of politics where humans achieve the actualization of their full beings as human.A key notion will be unitas ordinis, or unity of order: the form of human cooperation in political life. As we will see, that form strikes a middle path between the simple unity of the individual person and the orderless collectivity of a crowd. For Aquinas, that order is itself a common good of politics, and an intrinsic one at that, before any "extrinsic" common good achieved by the people through that order. Part of why this seemingly secular consideration is good is its theological importance: it mirrors God.Further, if Aquinas does not elaborate on political arrangements as much as one would like, nevertheless he offers sure guidance for the principles which ought to guide the prudent development of those arrangements in a particular time and place. Taking my cue from Donald Davidson’s closely argued exchanges with Michael Dummett and Ian Hacking, I take up a puzzling instance of understanding the literal in artistically represented normative discourse. Unlike Davidson, however, I will focus not on the truth-conditional aspects of the supposed literal meanings of the propositional contents of literarily represented assertive sentences. Rather, I would like to call renewed attention to several puzzling communicative aspects of supposed literal meanings, especially in literarily represented interrogative sentences in ethically charged normative conversations. Il y a des oeuvres d'art poétiques, et en particulier quelques poèmes modernistes, qui nous offrent des représentations du sublime dans un de ses aspects les plus problématiques. Cet aspect comporte la simultanéité des éléments à la fois subjectifs et objectifs. Mais comment peut-on comprendre le sublime sous ce double masque ? Comment se fait-il que le sublime puis- se être à la/ois objectif et subjectif? Dans cet article je propose d'articuler ces deux aspects du sublime en ayant recours aux (...) réflexions tardives de Kant dans son Opus postumum sur le Selbstsetzungs- lehre, sur ce que j'appellerai « une auto-position fictive ».Some poetic works of art, and in particular some modernist poems, present us literary representa- tions of the sublime in one of its most searching, and still problematic, aspects. This aspect of the sublime, unlike many others, involves the simultaneity of both subjective and objective elements. But how are we to understand the sublime in such a double guise ? How can the sublime be simultaneously both objective and subjective ? My suggestion here is that we can best articulate both the objective and subjective aspects by making use of Kant's late reflections in the Opus Postumum on the Selbstsetzungslehre, that is, on what I will call a fictional self-positing. How is the ethically unacceptable persistence of the unnecessary suffering of extraordinarily poor street children in extraordinarily rich European Union capital cities to be durably remedied? Perhaps centrally, this philosophical essay argues, by re-articulating current inadequate understandings in the European Union of social injustice not as an absence of solidarity but as the failure to imagine and to act on "mutualities." First presented in 2011 as invited lectures for the Institute of European Studies of the Jagiellonian University in Krakow, this (...) extended reflection explores four central elements of the empirical situations of such extreme child poverty amid great affluence in the contexts of a progressively developed case study of destitute street children in Paris. The essay focuses successively on such utterly destitute children's poor health, poor housing, poor food, and poor education. In each case, outstanding contemporary philosophical reflections on violations of social justice - those of J. Rawls, A. Sen, R. Dworkin, and J. Habermas - are found to be deeply suggestive but finally insufficient for understanding such legally and morally intolerable situations. Yet each may be interpreted as contributing substantively to a progressive re-articulation of at least four critical elements of what a renewed idea of social justice in the European Union tomorrow must involve - "mutualizations" of fairness, understanding, respect, and articulacy. In this short response to Peter Clarke's thorough and interesting tracing of the developments in Richard McCormick's approach to moral questions, I take a perspective external to the concerns of Clarke's paper. I propose to look at the developments in McCormick's approach not so much from the perspective of contemporary Catholic moral theology but from that of the impact on the practices and beliefs of the Catholic community. From that perspective, the really important events in McCormick's (...) theological development are his rejection of the received teaching on contraception and his closely connected embracing of a moral theory that implies that there are no moral absolutes, namely, proportionalism. This paper develops the concept of the ‘continuum of destructiveness’ in relation to organizational corruption. This notion captures the slippery slope of wrongdoing as actors engage in increasingly dubious practices. We identify four kinds of individuals along this continuum in corrupt organizations, who range from complete innocence to total guilt. They are innocent bystanders, innocent participants, active rationalizers and guilty perpetrators. Traditional explanations of how individuals move from bystander status to guilty perpetrators usually focus on socialization and institutional factors. In (...) addition to these factors, we propose that the very distance between an act and its ethical consequences (ethical distance) may also play a determining role – if not always in the same way – in the transition process. The prospect of using genome technologies to modify the human germline has raised profound moral disagreement but also emphasizes the need for wide-ranging discussion and a well-informed policy response. The Hinxton Group brought together scientists, ethicists, policymakers, and journal editors for an international, interdisciplinary meeting on this subject. This consensus statement formulated by the group calls for support of genome editing research and the development of a scientific roadmap for safety and efficacy; recognizes the ethical challenges involved in clinical reproductive (...) applications of genome editing but, importantly, rejects the idea that human reproductive germline modification is necessarily morally unacceptable; and highlights the importance of meaningful engagement in discussions of genome editing and the development of regulation and oversight mechanisms to govern future uses of such technologies. This text provides an introduction to conceptions of international justice, spanning 2500 years of intellectual history from Thucydides and Plato to Morgenthau and Waltz. It shows how older traditions of political philosophy remain relevant to contemporary debates in international relations.

Nutrition and hydration—including artificially delivered, or assisted, nutrition and hydration (ANH)—are typically considered ordinary or proportionate care in the Roman Catholic moral tradition. They are thus morally obligatory, except when the benefit to the patient does not justify the burden their administration places on the patient or when they no longer prolong life (e.g., in end-stage disease when death is imminent). A review of Church documents and the medical literature provides convincing evidence that there are cases in which ANH provides (...) little hope of benefit and may impose an excessive burden on the patient. This paper closely examines advanced dementia of the Alzheimer’s (DAT) type and shows how ANH can be properly considered extraordinary care and hence is not obligatory in patients with advanced DAT. The epistemological premises and scientific viability of Stoffregen & Bardy's ecological perspective are evaluated by analyzing the concept of direct perception of global invariants vis-à-vis (1) behavioral evidence that perception is based on the integration of modal sources of information and (2) neurophysiological aspects of the integration of sensory signals.

Current cognitive models of addiction imply that speeded detection and increased distraction from substance cues might both independently contribute to the persistence of addictive behavior. Speeded detection might lower the threshold for experiencing craving, whereas increased distraction might further increase the probability of entering a bias-craving-bias cycle, thereby lowering the threshold for repeated substance use. This study was designed to examine whether indeed both attentional processes are involved in substance use disorders. Both attentional processes were indexed by an Odd-One-Out visual (...) search task in individuals diagnosed with alcohol use disorder and cannabis use disorder. To test whether the detection and/or the distraction component are characteristic for AUD and CUD, their indices were compared with matched individuals without these diagnoses. Individuals with CUD showed speeded detection of cannabis cues; the difference in detection between AUD and the comparison group remained inconclusive. Neither the AUD nor the CUD group showed more distraction than the comparison groups. The sample size of the CUD group was relatively small. In addition, participants made relatively many errors in the attentional bias task, which might have lowered its sensitivity to detect ABs. The current study provided no support for the proposed role of increased distraction in CUD and AUD. The findings did, however, provide support for the view that speeded detection might be involved in CUD. Although a similar trend was evident for AUD, the evidence was weak and remained therefore inconclusive. (shrink)

This book takes an interdisciplinary, transnational and cross-cultural approach to reflect on, critically examine, and challenge the surprisingly robust practice of making art after death in an artist's name, through the lenses of scholars from the fields of art history, economics and law, as well as practicing artists. Works of art conceived as multiples, such as sculptures, etchings, prints, photographs and conceptual art, can be - and often are - remade from original models and plans long after the artist has (...) passed. Recent sales have suggested a growing market embrace of posthumous works, contemporaneous with questioning on the part of art history. Legal norms seem unready for this surge in posthumous production and are beset by conflict across jurisdictions. Non-Western approaches to posthumous art, from Chinese emulations of non-living artists to Native American performances, take into account rituals of generational passage and emotional aspects foreign to Western ideas. The authors offer a fresh look at the debate about the use of assisted nutrition and hydration in advanced dementia. The philosophical and ethical issues are presented. The importance of distinguishing basic care from medical acts is explained. A key question is addressed: Does ANH nourish and hydrate the patient with dementia? The ANH debate is placed in its cultural context and contrasted with the Catholic response. A clinical analysis of the evidence for benefit and harm of ANH in advanced (...) dementia is given. The authors point out the lack of hard evidence against ANH, discuss questions that need further clinical research, and argue that there is sufficient evidence for a presumption, in principle, in favor of ANH in patients with advanced dementia. The United States Court of Appeals for the Eighth Circuit held that ERISA did not preempt a Minnesota tort claim alleging fraud and negligent misrepresentation against primary-care physicians who failed to disclose their financial incentives to minimize specialist referrals. The original action was filed in state court after the plaintiff's husband died of heart failure, alleging that his family doctors had assured him that referral to a cardiologist was unnecessary. The plaintiff filed a wrongful death suit against the doctors, their (...) clinic, and her husband's HMO. Her complaint against the HMO alleged that certain financial incentives built into the HMO-physician contract were designed to minimize referrals to specialists. The HMO removed the case to the District of Minnesota, contending that ERISA preempted the plaintiff's wrongful death claim. (shrink)

The 2017 story of Charlie Gard is revisited. Upon the British High Court’s ruling in favor of the physicians that the infant should be allowed to die without the experimental treatment, the view of the public as well as the opinions of bioethicists and Catholic bishops are divided, interestingly along with a cultural line. American bioethicists and Catholic bishops tend to believe that the parents should have the final say while British/European bioethicists and Catholic bishops in general side with the (...) court’s decision. The paper explores the place of culture in bioethical reasoning between the UK/Europe and the US while claiming that cultural differences are more important than geopolitical or religious differences to understand the bioethical positions of a group. In addition, the authors introduce a decision-making program for handicapped neonates which is developed by the American Jesuit Bioethicist, Richard McCormick, and modified further by the contemporary American Jesuit Bioethicist, Peter A. Clark, in an attempt to see if the program’s normatizing categories can contribute to the culture-laden ethical discussions on Charlie’s case. However, it is admitted that the McCormick-Clark device is borne out of the American and Catholic theological context. (shrink)
