In the summer of 1919, in the high Sierra of California, I chanced to talk with a cattleman who had driven his herd from the lower valleys to the highlands for summer pasture. When he had arrived at his destination he found a cow missing. He retraced his route, and forty miles below he found the cow by the roadside.Her calf, by reason (...) of its weakness, had been picked up by a waggoner and brought on, and the cow was found at the identical spot where the calf had been taken from the ground; the cow had found the place and had remained there for five days. The occurrence gave rise to a general discussion by the cattlemen present concerning the habits of these animals. When a cow misses her calf she will go by memory to the place where the calf was last seen by her, and will stay there for days; but she will graze and not go hungry herself. The cow will also search by smell; she can smell a herd or the odour left on bushes or that attached to footsteps for hours certainly, possibly for days. Morris Cohen’s classic essay, Property and Sovereignty, correctly discerned that political sovereignty and private property are alternative forms of government. Where it failed was in suggesting that the choice between these modes of governance is a matter of dialing one up and the other down. The relationship between political sovereignty and property is complex, and varies depending on the audience of property we have in view. With respect to some audiences — strangers and transactors — those who favor a strong (...) system of property will want to enlist a generous measure of assistance from the political sovereign. With respect to other audiences — neighbors and sharers — those who want a robust property system are more likely to want the powers of the political sovereign to be held in check. Cohen was thus right that the political order and private property are both forms of power over people. But the exact mix of these two regimes is anything but simple or unidimensional. (shrink)

Besides putting the entire enterprise of possible-worlds semantics into a perspective, we can also see that the actual history of possible-worlds seman­ tics is more complicated than it might first appear to be. For the standard in­ terpretation of modal logics has reared its beautiful head repeatedly in the writings of Stig Kanger, Richard Montague the pre-Montague-semantics theorist, and Nino Cocchiarella. De Interpretatione is among Aristotle's most influential and widely read writings; C. W. A. In this paper I argue that it is morally important for doctors to trust patients. Doctors' trust of patients lays the foundation for medical relationships which support the exercise of patient autonomy, and which lead to an enriched understanding of patients' interests. Despite the moral and practical desirability of trust, distrust may occur for reasons relating to the nature of medicine, and the social and cultural context within which medical care is provided. Whilst it may not be possible to trust (...) at will, the conscious adoption of a trusting stance is both possible and warranted as the burdens of misplaced trust fall more heavily upon patients than doctors. This paper sketches an account of public health ethics drawing upon established scholarship in feminist ethics. Health inequities are one of the central problems in public health ethics; a feminist approach leads us to examine not only the connections between gender, disadvantage, and health, but also the distribution of power in the processes of public health, from policy making through to programme delivery. The complexity of public health demands investigation using multiple perspectives and an attention to detail that is capable (...) of identifying the health issues that are important to women, and investigating ways to address these issues. Finally, a feminist account of public health ethics embraces rather than avoids the inescapable political dimensions of public health. (shrink)

This article examines the implicit promises of fairness in evidence based medicine , namely to avoid discrimination through objective processes, and to distribute effective treatments fairly. The relationship between EBM and vulnerable groups is examined. Several aspects of EBM are explored: the way evidence is created , and the way evidence is applied in clinical care and health policy. This analysis suggests that EBM turns our attention away from social and cultural factors that influence health and focuses on a narrow (...) biomedical and individualistic model of health. Those with the greatest burden of ill health are left disenfranchised, as there is little research that is relevant to them, there is poor access to treatments, and attention is diverted away from activities that might have a much greater impact on their health. In this paper we consider the use of cases in medical ethics research and teaching. To date, there has been little discussion about the consent or confidentiality requirements that ought to govern the use of cases in these areas. This is in marked contrast to the requirements for consent to publish cases in clinical journals, or to use personal information in research. There are a number of reasons why it might be difficult to obtain consent to use cases in ethics. (...) Many cases concern people who are incompetent, and thus unable to give consent. Often the material is of a sensitive nature, it is not clear who should give consent, or the ethicist has no access to those involved. We argue that the use of cases in ethics research and teaching can be justified by appeal to the public interest argument, and suggest a number of areas for discussion and clarification. (shrink)

This is a surprisingly good book. Published by Longmans in Great Britain as part of a series on "Education Today," it provides a very lucid and cogent first glimpse at the discipline of the philosophy of religion. The author's perspective is derivative of the analytic school, but what makes the book so valuable is that Goodall relates linguistic distinctions to Biblical categories. The author makes it obvious that he is a believer and authenticates the conviction that one can be a (...) believer and still sound like Flew or Ryle. The influence of Ian T. Ramsey comes through loud and clear. Goodall presents his proofs for the validity of religious statements with clarity and vigor. Worth the price of the book alone is Goodall's discussion of Lear's "The pobble who had no toes."--W. A. J. (shrink)

T he O bject of this paper is the development of a view of punishment which incorporates what is of importance in retributive and utilitarian justifications of the practice of punishment. This proposed theory was noted and referred to as the plene esse , but not fully worked out, in the course of a discussion paper in which my concern was to offer an alternative view, to that of Mr Anthony Quinton, by construing ‘the right to punishment’ as meaning that (...) ‘the offender has the right to be regarded as responsible for his actions’. This is an excellent addition to Bobbs-Merrill's "Text and Commentary Series." In addition to the text of the Principles, there are eleven critical essays, three of which are original with this volume. Turbayne has arranged the essays to parallel the unfolding of the major themes in the Principles. Thus, he himself opens with "Berkeley's Metaphysical Grammar," which picks up and develops the theme of the centrality of the study of language to the philosophical enterprise, a point Berkeley makes in (...) his "Preface." Next, W. H. Hay and Richard Van Iten are paired together with different perspectives on Berkeley's nominalism. By way of comment on esse is percipi, G. E. Moore and W. T. Stace present their respective refutations of idealism and realism. Richard Popkin discusses skepticism and Berkeley. Popper examines the ways in which Berkeley anticipated Mach and Einstein, as well as significant features of contemporary philosophy of science. Turbayne and Cornman offer differing appraisals of the philosophy of mind that is sketched in the Principles. Paul Olscamp attempts to systematize the elements of Berkeley's critical theory. Finally, J. D. Mabbott treats of "The Place of God in Berkeley's Philosophy" and argues for a radical voluntarism in Berkeley--a not surprising analysis, but one which often gets buried under the epistemological issues raised in the Principles. Turbayne has also supplied an excellent introduction, a chronology of Berkeley's life, a working bibliography, and an analytical index. This enhances the usefulness of an already first-rate book.--E.
