Cloth, $42.50.This important book is an interpretation and defense of Rousseau's theory of moral education, in which the author explains and justifies Rousseau's ideas about what virtue is, why it is important, and how it can be cultivated.Briefly, this is his reading: in (...) advanced societies, people come to possess intense and incoherent passions, enflamed by amour-propre, which set them at odds with themselves and with each other, making bourgeois existence unsatisfying and exploitive. To create a better life, people must learn to restrain their desires in a way that promotes their own happiness; they must be taught virtue, which Reisert defines as, "the strength of character to rule over one's passions, so that one can make oneself do what one knows one ought to do" (8). Finally, the best model for the moral educator is not ruler to ruled, but friend to friend.The book is both a defense of this interpretation of Rousseau, and a defense of Rousseau's social and psychological theory itself, most notably against Aristotle, Locke, and Buffon. While the two lines of argument do not go together seamlessly, Reisert offers a number of contributions to Rousseau scholarship and to social thought, especially as it intersects with liberal political theory. He divides the work into two parts. The first explains Rousseau's theory of human nature and his diagnosis of the ills of society. The second interprets and defends his ideas about how to remedy that condition through the cultivation of virtue by means of friendship. The final chapter discusses the importance of virtue for contemporary liberal politics.The first half of the book, on Rousseau's "physics of the soul," touches on self-love, pity, vanity, and conscience. For some reason, Reisert limits his discussion largely to the meaning of amour-propre in the second Discourse and Emile to the exclusion of other issues and other books. Even so, he gives an interesting interpretation of amour-propre, and how it leads to the restless, banal misery that both authors think is characteristic of modern life.The problems of this section come when Reisert attempts to defend Rousseau. He argues that his theory of human nature is to be preferred because it answers questions that others cannot, such as how essentially asocial beings have come to live in societies. Yet, this question and some others he discusses come into being only because of Rousseau's own assumptions, for example that people are asocial in the first place. So, Rousseau's ability to solve puzzles that exist only on the basis of his own principles cannot be taken as evidence for those principles without begging the question.The second half of the work is more innovative. Reisert makes two basic arguments: that only virtue can alleviate the dissatisfactions of bourgeois existence; and that only the relationship of friendship can bring about this "education to virtue" (141). The first is less controversial given that he defines virtue simply as the power to restrain irrational desires for the sake of happiness; yet he goes on to make an interesting distinction between the virtue of Socrates who does not have irrational desires to begin with, and that of Emile who has them but can control them.The most original part of the book is his argument that only the relationship of friendship can foster virtue. He says that the amour-propre which makes people miserable also makes them resistant to efforts to improve their character. "A friend," on the other hand, "can, through force of personality and the power of example, exert a potent influence on his friend without thereby provoking resistance or inspiring resentment" (171). He gives a fascinating account of how a friend can be a kind of better self through whose eyes one sees the source of one's own dissatisfaction and the need for virtue to make life enjoyable. The last two decades have seen two significant trends emerging within the philosophy of science: the rapid development and focus on the philosophy of the specialised sciences, and a resurgence of Aristotelian metaphysics, much of which is concerned with the possibility of emergence, as well as the ontological status and indispensability of dispositions and powers in science. Despite these recent trends, few Aristotelian metaphysicians have engaged directly with the philosophy of the specialised sciences. Recently, there have been attempts at offering new justifications of the Rawlsian idea of public reason. Blain Neufeld has suggested that the ideal of political autonomy justifies public reason, while R.J. Leland and Han van Wietmarschen have sought to justify the idea by appealing to the value of political community. In this paper, I show that both proposals are vulnerable to a common problem. In realistic circumstances, they will often turn into reasons to oppose, rather than support, public reason. This paper considers the phenomenon of lying and the implications it has for those subjects who are capable of lying. It is argued that lying is not just intentional untruthfulness, but is intentional untruthfulness plus an insincere invocation of trust. Understood in this way, lying demands of liars a sophistication in relation to themselves, to language, and to those to whom they lie which exceeds the demands on mere truth-tellers.

Counterspeech is communication that tries to counteract potential harm brought about by other speech. Theoretical interest in counterspeech partly derives from a libertarian ideal – as captured in the claim that the solution to bad speech is more speech – and partly from a recognition that well-meaning attempts to counteract harm through speech can easily misfire or backfire. Here we survey recent work on the question of what makes counterspeech effective at remedying or preventing harm, in those cases where it (...) is effective, as well as work investigating when and why there is a duty to engage in counterspeech. We suggest that the most fruitful area for philosophical inquiry on this topic, currently, relates to the questions about efficacy. Specifically, we argue that there is a need for better frameworks for conceptualizing the efficacy of counterspeech. Philosophers have collaborative work to do, alongside social scientists, in developing these frameworks. (shrink)

The introduction of normothermic regional perfusion (NRP) in controlled donation after circulatory determination of death (cDCDD) protocols is by some regarded as controversial and ethically troublesome. One of the main concerns that opponents have about introducing NRP in cDCDD protocols is that reestablishing circulation will negate the determination of death by circulatory criteria, potentially resuscitating the donor. In this article, I argue that this is not the case. If we take a closer look at the concept of death underlying the (...) circulatory criterion for determination of death, we find that the purpose of the criterion is to show whether the organism as a whole has died. I argue that this purpose is fulfilled by the circulatory criterion in cDCDD protocols, and that applying NRP does not negate the determination of death or resuscitate the donor. (shrink)

ABSTRACT When hope is discussed in bioethics’ literature, it is most often in the context of ‘false hopes’ and/or how to maintain hope while breaking bad news to patients. Little or no time is generally devoted to the description of hope that supports these analyses. In this paper, I present a detailed description of hope, one designed primarily for the healthcare context. Noting that hope is an emotional attitude, four key aspects are explored. In particular, the function of imagination in (...) hope is discussed in depth. Through an examination of the relationship between hope and vulnerability, I demonstrate how adequately describing hope can broaden the normative inquiry into the role of hope in healthcare. Three ways in which persons with hope can be vulnerable are illustrated, and the challenge of how healthcare providers can attend in moral ways to the hopes of patients is identified. (shrink)

The vital status of patients who are a part of controlled donation after circulatory death (cDCD) is widely debated in bioethical literature. Opponents to currently applied cDCD protocols argue that they violate the dead donor rule, while proponents of the protocols advocate compatibility. In this article, we argue that both parties often misinterpret the moral implications of the dead donor rule. The rule as such does not require an assessment of a donor’s vital status, we contend, but rather an assessment (...) of whether procurement of organs in cDCD cause the death of the donor or not. We then argue that commonly practiced cDCD protocols do not violate the dead donor rule, since the donation does not trigger or cause the death of the donors. (shrink)

In the twenty-five years since philosophers began to bemoan ‘the dreariness of aesthetics’, students in Wittgenstein's wake have done a great deal to eliminate the grounds of the complaint. Unfruitful essentialist theories have been largely displaced by the vigorous, if somewhat uncontrolled, growth of an enterprise which attempts to characterize and explicate aesthetic phenomena outside the desert of definition. The resulting view portrays typically aesthetic concepts as being indivisibly characterizing and evaluative, relativistic in application, necessarily linked to human attitudes, irreducible (...) to non-aesthetic concepts, and yet as having social conditions which make them capable of intersubjective comparison and test. These characteristics are usefully summarized in saying that aesthetic concepts are concepts of appraisal. The theory of aesthetic appraisal discussed here is clearly incompatible with views which postulate dichotomies between objectivity and subjectivity, fact and value, and it is quite analogous to ‘descriptivist’ theories in ethics which reject these absolute distinctions. Moral examples are thus often useful for explicating the notion of aesthetic appraisal and the theory embodying that notion likewise has an important bearing on contemporary controversies in ethics. Using a feminist hermeneutic, Autumn Reinhardt-Simpson attempts to set out in this article how a third- or fourth-wave intersectional reading of the stories of Hagar and Sarah and Leah, Rachel, and their maids can become a source of both truth and healing within feminist activist communities today, particularly those working for reproductive justice. Reinhardt-Simpson identifies several issues within the stories such as societal acceptance of women who seek power only within patriarchal constructs or to benefit the aims of (...) patriarchy, as well as issues that divide women both then and today such as class, race, and status and the way that women relate to each other within a patriarchal structure. ABSTRACT The Irish Republican Army (IRA) sometimes claim that their violent actions are sanctioned by traditional just war doctrine. To what extent is this true? To answer this question it is necessary to have a clear grasp of the principles of just war and of the situation in Northern Ireland to which they are to be applied. This is done in the first sections, and it is then argued that just war sanctions some kinds of violence in Northern Ireland but (...) only those of direct self‐defence. Violence outside the borders of Northern Ireland or for the sake of Irish Unity is not justifiable. Consequently the IRA must be viewed, in terms of just war theory at any rate, as in principle illegitimate, even though some of their actions are defensible. Finally it is suggested that non‐violence, after the pattern of Gandhi, while not required by justice might nevertheless be preferable. (shrink)

The Devlin Commission Report of 1959 on the handling of the emergency in Nyasaland (Malawi) was unique in British colonial history. On no other occasion was a commission, chaired by a British judge, established to consider generally the response of a colonial government to a problem of law and order. Though now remembered mainly as an incident in decolonization, the report has a special legal significance in that it addresses the perennial problem of the relationship between respect for the rule (...) of law and the supposed need to suppress an insurrectionary movement. Documents now available make it possible to give a full account of the work of the commission, and of the processes whereby the text was modified so as to downplay Devlin's desire to publish a report which squarely faced this problem.
