A conflict within the community of those investigating business ethics is whether decision makers are motivated by an ethics of justice or an ethics of caring. The proposition put forward in this paper is that ethical orientations are strongly related to cultural backgrounds. Specifically, Hofstede's cultural stereotyping using his masculine-feminine dimension may well match a culture's reliance on justice or caring when decisions are made. A study of college graduates from six countries showed that Hofstede's dimension was remarkably accurate in (...) predicating a justice or caring orientation for decision makers from five of the six countries. Imagine that only the state can meet the need for housing but decides not to do so. Unsurprisingly, participants in a vignette experiment deem this scenario unjust. Hence, justice ratings increase when the living situation improves. To a lesser extent, this also holds beyond the need threshold, understood as the minimum amount necessary for a decent life. Surprisingly, however, the justice evaluation function is highly convex below this point. The resulting S-shaped curve is akin to the value function in prospect (...) theory, with the need threshold providing the point of reference and inflection. A control treatment without needs-information supports this interpretation. Needs-information furthermore compresses the perceived injustice of arbitrary inequality. As in prospect theory, such reference dependency suggests biases in judgment and decision making. A consequence may be that the lot of the poorest in society does not receive the attention it would otherwise get. (shrink)

Need considerations play an important role in empirically informed theories of distributive justice. We propose a concept of need-based justice that is related to social participation and provide an ethical measurement of need-based justice. The β-ε-index satisfies the need-principle, monotonicity, sensitivity, transfer and several »technical« axioms. A numerical example is given.

This study aims to describe social network and social participation and to assess associations with depressive symptoms in older persons with increased risk for dementia in Germany. We conducted a cross-sectional observational study in primary care patients (aged 60-77) as part of a multicenter cluster-randomized controlled trial (AgeWell.de). We present descriptive and multivariate analyses for social networks (Lubben Social Network Scale and subscales) and social participation (item list of social activities) and analyze associations of these variables with depressive symptoms (Geriatric (...) Depression Scale). Of 1030 included patients, 17.2% were at risk for social isolation (Lubben Social Network Scale < 12). Looking at the subscales, a reduced non-family network was found almost twice as often as a reduced family network. Patients with depressive symptoms had significantly smaller social networks than patients without depression (p < 0.001). They rather engaged in social activities of low involvement level or no weekly social activity at all (p < 0.001). The study shows associations of depressive symptoms with a decreased social network and less social participation in elderly participants. Sufficient non-family contacts and weekly social activities seem to play an important role in mental health and should be encouraged in elderly primary care patients. (shrink)

Einleitung Die Ausbreitung des Massentourismus und die Grundstücksspekulation gefährden frühbyzantinische und byzantinische archäologische Stätten im südwestlichen Kleinasien akut. Wie nun schon in den 1980er Jahren ein Vier-Sterne-Hotel einer spanischen Hotelkette direkt in das weit ausgedehnte spätantike und byzantinische Ruinengebiet von Kauniōn Panormos, das mittelalterliche Prepia (der heutige Name des benachbar ten Örtchens ist Sarigerme), das an der Mündung des Sarisu Çayi – zu deutsch: Gelbwasser-Fluß – im westlichen Lykien gelegen ist, hineingebaut wurde, so sind nun schon vorbereitende Hotelbauarbeiten im Auftrage (...) einer weiteren europäischen Hotelkette mitten im spätantiken Ruinengebiet der Ala-Kilise-Bucht (Anastasioúpolis?) in Karien im vollen Gange, nun soll hier in der Nähe noch eine Appartmenthaussiedlung entstehen. Ein Hilferuf des Verfassers bei der UNESCO Suborganisation ICOMOS verhallte bisher ungehört. Das Ruinengebiet von Sarigerme befindet sich südwestlich von Dalaman und südöstlich der Polis Kaunos. Auf der Kauniōn Panormos (Prepia) unmittelbar vorgelagerten Papas-Insel (Baba Adasi) befindet sich die Ruine eines antiken Mausoleums oder eines Leuchtturms und genauso wie Kaunos verfügte das Bistum (Kaunion) Panormos über ein in der Spätantike allerdings wohl noch intaktes, heute versumpftes, Hafenbecken. Offenbar im Zuge von Bauarbeiten in der Hotelanlage von Sarigerme wurden zwei im Ruinengebiet gefundene Kapitelle vor die Lobby des Hotels verschleppt. Es handelt sich hierbei zum einen um ein größeres korinthisches Normalkapitell aus Marmor mit einer durch ein Profil zweigeteilten Abakusleiste (vgl. Abb. 1), das möglicherweise ursprünglich aus einer der beiden großen Basiliken – von denen eine die Bischofskirche gewesen sein wird – des Ortes stammt und welches dem 5./6. Jh. zugeordnet werden kann, zum anderen um ein byzantinisches Kleinkapitell aus feinkristallinem weißen Marmor (vgl. Abb. 2–4). Das größere korinthische Kapitell gehört zu einem weit verbreiteten Standardtypus und soll deswegen hier nicht weiter besprochen werden. Das Kleinkapitell zeigt jedoch ein einzigartig gestaltetes Dekor, für das dem Verfasser bisher kein direktes Vergleichsbeispiel bekannt ist und das, durch diese kurze Vorlage, sicherlich eine Bereicherung des provinziellen byzantinischen Bauplastik-Katalogs sein wird. There is a relationship between time and technology which has been obvious since the classical philosophies of time. Even telling the time necessitates technologies relating to measuring and counting. Technological developments have changed the temporal state of our reality. Key terms such as deceleration, synchronisation, prevention and de-temporalisation point to relevant problem areas in this respect. Introducing the sixth and final installment of the Common Knowledge symposium “Apology for Quietism,” Allen looks at the symposium retrospectively and concludes that it has mainly concerned “sage knowledge,” defined as foresight into the development of situations. The sagacious knower sees the disposition of things in an early, incipient form and knows how to intervene with nearly effortless and undetectable (quiet) effectiveness. Whatever the circumstance, the sage handles it with finesse, never doing too much but also never leaving anything undone (...) that must be accomplished. Quiet, when it is knowingly and effectively quiet (not pusillanimous or poor in spirit), is about what not to do, how not to approach a problem, what not to decide, what is not known, what will not work. Allen explains these principles in terms of traditional Chinese thought, Daoist and Confucian: wei we wei, or “doing-not-doing,” means effective inaction. What makes such wisdom possible is not mystical insight, he argues, but discipline in a certain kind of art. The sage has no need of reasons (let alone doctrines), only effectiveness; and he does not need truth or justice, only subtlety. The detachment of a quietist has little, if anything, to do with transcending perspectives. Detachment is good as a means to flexibility, and instead of transcending perspectives, a sage is skilled in the quiet art of never getting stuck in one. To be effectively quiet is not so much to be silent as to be inaudible, invisible; the sage “vanishes into things.”. (shrink)

Do the sciences aim to uncover the structure of nature, or are they ultimately a practical means of controlling our environment? In Instrumental Biology, or the Disunity of Science, Alexander Rosenberg argues that while physics and chemistry can develop laws that reveal the structure of natural phenomena, biology is fated to be a practical, instrumental discipline. Because of the complexity produced by natural selection, and because of the limits on human cognition, scientists are prevented from uncovering the basic structure (...) of biological phenomena. Consequently, biology and all of the disciplines that rest upon it--psychology and the other human sciences--must aim at most to provide practical tools for coping with the natural world rather than a complete theoretical understanding of it. Global reproductive landscapes and with them cross-border routes are rapidly changing. This paper examines the reproductive routes and choices of fertility travellers from China to Russia as reported by medical professionals and fertility service providers. Providing new empirical data, it raises new ethical questions on the facilitation of cross-border reproductive travel and the commercialisation of reproductive treatment. The relaxation of the one-child policy in 2014 in China, the increasing demand for ART exceeding the capacity of national fertility clinics and the (...) difficulty of accessing treatment with donor eggs concomitant with a growing economic power of the upper–middle class are shaping the ART industry in Asia in new ways. A new development is Chinese citizens increasingly seeking ART treatment in Russia, which has a long-standing practice of ART governed by a liberal legislation. Furthermore, as China prohibits the export of gametes, Chinese fertility travellers rely on acquiring donor gametes once starting treatment abroad. Clinicians in Russia report three strategies amongst their Chinese patients: One group is using donor eggs of women of Asian appearance living in Russia or is hiring women of resembling appearance from third-party countries to donate their eggs in Russia to create resemblance in their offspring. Another group is buying white donor gametes to create Eurasian mixed children and thus ‘enhance’ their offspring. Providing novel empirical data, this article informs ethical deliberation and raises imminent questions for further research in this understudied geographic region and on cross-border reproductive treatment. This article documents a moment in history when poor and working-class white boys and men are struggling in their schools, communities, and workplaces against the “Other” as a means of framing identities. Drawing on two independent qualitative studies, the authors investigate distinct locations where poor and working-class boys and men invent, relate to, and distance from marginalized groups in an effort to create self. First the authors look at an ethnography of “the Freeway boys,” a community of urban white working-class (...) high school boys who must deal with the economic ravagement of their neighborhood and their insecure place in a world different than that of their fathers. Next, the authors draw from a large-scale survey of young adults to hear how a combined sample of urban poor and working-class white men narrate identities that are carved explicitly out of territory bordered by white women and African American men. Across sites, the authors theorize how high schools and workplaces both, in part, create white masculinities and interrupt them, at a time when white working-class boys and men feel under siege. This review essay examines the contribution of Legislated Rights (Webber et al, Cambridge 2018) to a central issue in constitutional theory: namely, how the institutional division of labour between the legislature and the judiciary with respect to the task of giving effect to constitutional rights is best understood and conceived. In doing so, the essay situates the work within contemporary scholarship and adopts a broadly comparative lens — a perspective that is mindful of key developments in constitutional law and theory (...) over the past several decades. Ultimately, it is suggested that a critical weakness of the capacity of Legislated Rights to contribute to contemporary debates about judicial review is its lack of engagement with these developments. As a result, the work’s intervention largely misses its mark. It speaks to an outdated view that does not reflect contemporary constitutional practice or scholarship. (shrink)

Philosophical discussions often involve appeals to verdicts about particular cases, sometimes actual, more often hypothetical, and usually with little or no substantive argument in their defense. Philosophers — on both sides of debates over the standing of this practice — have often called the basis for such appeals ‘intuitions’. But, what might such ‘intuitions’ be, such that they could legitimately serve these purposes? Answers vary, ranging from ‘thin’ conceptions that identify intuitions as merely instances of some fairly generic and epistemologically (...) uncontroversial category of mental states or episodes to ‘thick’ conceptions that add to this thin base certain semantic, phenomenological, etiological, or methodological conditions. As this chapter discusses, thick conceptions turn out to have their own methodological problems; some may even leave philosophers in the methodologically untenable position of being unable to determine when anyone is doing philosophy correctly. Instructors, according to the author, should take into account various factors in grading assignment like the student's individual efforts, improvement throughout the course, the student’s general psychological state, and potential disadvantaged starting points in the educational process. Instead of basing grade assignments on judgments from arbitrary criteria or letting them be an expression of power, (...) the author suggests incorporating the variability model into the practice of grade assignment. When incorporating the environment into mental processing (cf., cognitive offloading), one creates novel cognitive strategies that have the potential to improve task performance. Improved performance can, for example, mean faster problem solving, more accurate solutions, or even higher grades at university.1 Although cognitive offloading has frequently been associated with improved performance, it is yet unclear how flexible problem solvers are at matching their offloading habits with their current performance goals (can people improve goal‐related instead of generic performance, e.g., when being (...) in a hurry and aiming for a “quick and dirty” solution?). Here, we asked participants to solve a cognitive task, provided them with different goals—maximizing speed (SPD) or accuracy (ACC), respectively—and measured how frequently (Experiment 1) and how proficiently (Experiment 2) they made use of a novel external resource to support their cognitive processing. Experiment 1 showed that offloading behavior varied with goals: Participants offloaded less in the SPD than in the ACC condition. Experiment 2 showed that this differential offloading behavior was associated with high goal‐related performance: fast answers in the SPD, accurate answers in the ACC condition. Simultaneously, goal‐unrelated performance was sacrificed: inaccurate answers in the SPD, slow answers in the ACC condition. The findings support the notion of humans as canny offloaders who are able to successfully incorporate their environment in pursuit of their current cognitive goals. Future efforts should be focused on the finding's generalizability, for example, to settings without feedback or with high mental workload. (shrink)

This article utilises feminist technoscience studies’ notions of bodily ‘materialisation’ and ‘ontological choreographies’, offering a cyborg feminist account of ‘bioavailability’ as embodied becomings, rather than a fixed ontological state of being. Drawn from 2 years’ ethnographic study in in vitro fertilisation clinics in Spain with migrant women who provided eggs to the cross-border in vitro fertilisation industry, this work explores how global understandings of race and inequalities, clinical practices and women’s own emotional and physical labours collectively produce bioavailability. Through examples (...) from observations and interviews in in vitro fertilisation clinics, we examined women’s embodied stories to understand the ways in which bioavailability becomes. The article demonstrates a novel way in which to think about ‘bioavailability’, a concept which has already been of enormous use to the social sciences since its introduction by Lawrence Cohen. We examine recent configurations of bodily extraction in the reproduction–migration nexus that help us rethink the concept of bioavailability. (shrink)
