Inequality in the family is the most damaging of all forces in women’s lives. It is overtly preserved by religious, customary, and state laws that formally enshrine discrimination against women and is perpetuated by de facto lack of access to nominally protective systems and remedies. International law and its implementation mechanisms provide an arena for confronting resistance to gender equality in the family, calling states to account at the highest level as well as providing a platform for domestic advocacy. CEDAW (...) and the jurisprudence of its monitoring body, the Committee on the Elimination of Discrimination against Women, clearly state the paramount value of protecting the individual human rights of family members rather than maintaining family “protection” and privacy at the expense of the women within it. By ratifying, States theoretically commit themselves to this progressive position. However, the politics of state and community identity make for a more complex picture that includes multiple, sometimes overlapping, levels of acceptance and rejection. Taking as a case study the current initiative to adopt a new General Recommendation to address the economic consequences of family relations and their dissolution, this Article draws on the CEDAW Convention and the CEDAW Committee’s work to suggest a practical application of international standards to address the tangle of legal systems and identity that have disadvantaged women for centuries. Placing this initiative within the context of multiple family law regimes and the multicultural debate, the right to exit and the concept of freedom to associate and to disassociate are emphasized as crucial in confronting the phenomenon of discriminatory identitybased family legal regimes. The Article concludes with an illustration of the harmonization process required by the CEDAW Convention, taking the new General Recommendation as a model approach for meeting the international equality norms while preserving community or State identity. Hope is a positive emotion that plays a pivotal role in intractable conflicts and conflict resolution processes by inducing conciliatory attitudes for peace. As a catalyser for conflict resolution, it is important to further understand hope in such contexts. In this article we present a novel framework for understanding hope in contexts of intergroup conflict. Utilizing appraisal theory of emotions and heavily relying on the implicit theories framework, we describe three targets upon which hope appraisals focus in intractable conflict—the conflict, (...) the outgroup, and the ingroup. Next, we describe the importance of developing ways to experimentally induce hope, and utilize the appraisal-target framework to describe and classify existing and potential interventions for inducing hope in intractable conflict resolution. David M. Halperin's Saint Foucault is an uncompromising and impassioned defense of the late French philosopher and historian as a galvanizing thinker whose career as a theorist and activist will continue to serve as a model for other gay intellectuals, activists, and scholars. A close reading of both Foucault and the increasing attacks on his life and work, it explains why straight liberals so often find in Foucault only counsels of despair on the subject of politics, whereas gay activists look to him not only for intellectual inspiration but also for a compelling example of political resistance. Halperin rescues Foucault from the endless nature-versus-nurture debate over the origins of homosexuality and argues that Foucault's decision to treat sexuality not as a biological or psychological drive but as an effect of discourse, as the product of modern systems of knowledge and power represents a crucial political breakthrough for lesbians and gay men. ABSTRACTA careful look at societies facing threat reveals a unique phenomenon in which liberals and conservatives react emotionally and attitudinally in a similar manner, rallying around the conservative flag. Previous research suggests that this rally effect is the result of liberals shifting in their attitudes and emotional responses toward the conservative end. Whereas theories of motivated social cognition provide a motivation-based account of cognitive processes, it remains unclear whether emotional shifts are, in fact, also a motivation-based process. Herein, we propose (...) that under threat, liberals are motivated to feel existential concern about their group’s future vitality to the same extent as conservatives, because this group-based emotion elicits support for ingroup protective action. We offer a functional perspective on hate, showing that hate has a unique pattern of appraisals and action tendencies. Hate is based on perceptions of a stable, negative disposition of persons or groups. We hate persons and groups more because of who they are, than because of what they do. Hate has the goal to eliminate its target. Hate is especially significant at the intergroup level, where it turns already devalued groups into victims of hate. When shared among group members, (...) hate can spread fast in conflict zones where people are exposed to hate-based violence, which further feeds their hate. Hate can be reassuring and self-protective, because its message is simple and helps confirming people’s belief in a just world. (shrink)

Sexuality is a cultural production: it represents the appropriation of the human body and of its physiological capacities by an ideological discourse. Foucault made sexuality into a field of historical investigation. The next project is to fill in the outlines of the picture he has sketched. The study of classical antiquity has a special role to play in this historical enterprise, in that it exposes sexuality, as a domain of knowledge, power, and personal experience, as a uniquely modern production. Neither (...) the isolation of sexuality as an autonomous entity nor the use of sexuality to individuate human beings can be exampled in Greek antiquity. The history of sexuality therefore cannot posit "sexuality" as a stable object of historical knowledge but must inquire into the various ways that sexual experience is constituted in society. As research into identity in the information society gets into its stride, with contributions from many scholarly disciplines such as technology, social sciences, the humanities and the law, a moment of intellectual stocktaking seems appropriate. This article seeks to provide a roadmap of research currently undertaken in the field of identity and identity management showing how the area is developing and how disparate contributions relate to each other. Five different perspectives are proposed through which work in the identity field can (...) be seen: tensions, themes, application areas, research focus and disciplinary approaches and taken together they provide a comprehensive overview of the intellectual territory currently being tilled by academia on this subject. This attempt at a coherent overview is offered in the spirit of debate and discussion, and the authors invite criticism, development and improvement. Another purpose of this paper is to provide an introduction to the range and type of research that the new journal Identity in the Information Society will publish, giving researchers working in the field a clearer idea of the scope of multidisciplinary study that is envisaged. The argument of this Article is based on positivist postulates defining law as the union of primary rules and secondary rules. Taking the presence of rules of change to be decisive for the appearance of legal orders, the author first looks for their origins in the Western world. Romans were the first, in the Western world, to develop a legal system with a clear rule of change, the possibility of a new statute abrogating an old one. This Western concept of (...) law has been exported by Western colonialism to America, Asia, and Africa, transforming social rules into laws thanks to the use of a Roman frame. While Jewish, Chinese and Islamic legal systems also fit this definition, their rules of change were not identical to the Roman ones. However, these other systems were not as successful as Roman law, which was linked historically with imperialism and colonialism. (shrink)

The central role played by emotions in conflict has long been recognized by many of the scholars who study ethnic conflicts and conflict resolution. Yet recent developments in the psychological study of discrete emotions and of emotion regulation have yet to receive adequate attention by those who study and seek to promote conflict resolution. At the same time, scholars of emotion and emotion regulation have only rarely tested their core theories in the context of long-term conflicts, which constitute a unique (...) and highly emotional environment. I argue that building bridges between these two communities would help us to form a better understanding of core processes in emotion and emotion regulation as well as greatly advance theory and practice in conflict resolution. To address that goal, a theoretical, appraisal-based model elucidating the way emotions operate in the context of conflict resolution processes is presented, followed by a review of recent empirical developments in the study of discrete emotions in conflict resolution processes. Next, I discuss various avenues of influence and provide preliminary data regarding the potential role of two types of emotion regulation processes in conflict resolution efforts. Finally, I describe the future challenges in integrating these two bodies of knowledge, at both the theoretical and the applied levels. (shrink)

The answer to this question is simple, but it requires elaborate argumentation. Epicureanism in The First Circle stands for the ethics of Stalinist society and furnished Solzhenitsyn with the vehicle for a destructive critique of Stalinist moral theory. But Stalinism has tended to be viewed in the West chiefly as a vicious form of political opportunism, its implicit ethical structure has escaped due recognition. But Stalinism was more than one man's strategy for the seizure and consolidation of power, more even (...) than the collective aims, policies, and methods of the Soviet bureaucracy. The ideological component of Stalinism must not be neglected. Howsoever the integrity of its doctrines was subordinated to political exigencies of the moment, Stalinist ideology could lay claim to a coherent and distinguished intellectual ancestry: it was heir to the materialist philosophy of the so-called Left Hegelians , a philosophy militantly reinterpreted by the architects of the Russian Revolution. Stalinist ideology expected a profound influence on the popular notions of obligation and moral value during the period of its ascendancy, smoothing the way of acquiescence and cooperation for the reluctant, the dubious, and the conscience-stricken. One need not therefore subscribe to an idealist interpretation of history in order to agree with Solzhenitsyn that Stalin's creation of an univers concentrationnaire would have been impossible without an accessory code of official ethics. David M. Halperin, an assistant professor of literature at the Massachusetts Institute of Technology, is the author of articles on Solzhenitsyn, Conrad, Augustine, Virgil, and ancient bucolic poetry. Participants in Northern Brazilian Tambor de Mina dance and spirit possession rituals demonstrate three principal discourses concerning memory and states of consciousness during possession. Most dancers claim, as "unconscious" mediums, to remember essentially nothing of their trance experiences. Many, however, speak of "faked" or incomplete forms of possession. In fact, my research eventually revealed that some experienced mediums and religious leaders regard, if secretly, "conscious" possession to be a more—not less—advanced form of mediumship. I consider some potential implications of the (...) apparent growth, particularly due to the influence of European origin Kardecist and other spiritist movements, of conscious mediumship in this Afro-Brazilian tradition. The study of biological altruism is a cornerstone of modern evolutionary biology. Associated with foundational issues about natural selection, it is often supposed that explaining altruism is key to understanding social behavior more generally. Typically, biological altruism is defined in purely effects-based, behavioral terms – as an interaction in which one organism contributes fitness to another, at its own expense. Crucially, such a definition isn’t meant to rest on psychological or intentional assumptions. We show that, appearances and official definitions notwithstanding, (...) the notion biological altruism carries a vestige of the psychological, intentional concept familiar to us from the human domain. In particular, definitions of altruism from Hamilton onwards presuppose an actor\recipient distinction – a distinction, so we argue, that has questionable biological grounding. We arrive at this conclusion step-by-step, first looking at several simple, “austere” definitions and their problems, and then critiquing the actor\recipient distinction directly. If successful, our arguments suggest that the category of biological altruism requires a significant rethink. (shrink)

In the past two decades there has been a high-profile debate between two frameworks for exploring biodiversity in ecology: the niche-based framework and the neutral framework. This paper discusses contrasting approaches to forge a causal relationship between the niche theory and the neutral theory. The first approach suggests that evolution for niche _differentiation_ may lead to neutrality, and the second suggests that evolution for niche _convergence_ may do so. Although counterintuitive and rarely considered, here I argue that the differentiation hypothesis (...) is more promising. As will be demonstrated, adopting this hypothesis has notable implications for how the neutral theory is received. (shrink)

The nationally embedded and relatively broad-based economies characteristic of developed industrial countries are usually seen as the incarnation of a modern economy. These economies are largely internally oriented and are based, to a relatively great extent, on production and services based on local and national needs. Their provenance is generally assumed to have been processes of development that began in the sixteenth century and that, in the nineteenth century, accelerated with the expansion of industrial production and the growth of global (...) trade. This article challenges that assumption. It argues that today’s modern economies represent, not the culmination of long-term processes, but a recurring phenomenon within capitalism. It argues that, in the history of capitalism, there have been phases of nationally embedded and global free market capitalism – periods when capital is relatively more, and relatively less, free from the regulation of nation state. Today’s nationally embedded economies represent, not a further point along a unilinear developmental trajectory, but a return to features of the moral economies that characterized both European and non-European societies before the nineteenth century. This contribution argues, first, that pre-national forms of state were not displaced or supplanted by a new, national form. What we call the nation-state was not the successor to imperial or city-states but was itself a form of the European imperial city-states that had driven the expansion of capitalism in previous centuries. It argues, second, that national states emerged only after 1945 and only in a handful of states where, through welfare reforms and market and industry regulation, investment and production (...) were made to serve the expansion and integration of national markets. Third, with the dismantling of Keynesian policies in these states, pre-national (pre-Keynesian) structures are resurfacing. What scholars describe as the emergence of ‘post-national spatialities’ and of ‘global cities’ and city regions represents the resurgence of a durable and historically dominant form of state: the imperial city-state form. The ‘re-scaling’ of nation-states and growing prominence of ‘global cities’ and ‘city regions’ are heralding the end of the brief history of actually existing nation-states and the re-deployment of the imperial city-state model. To succeed in self-regulation, people need to believe that it is possible to change behaviour and they also need to use effective means to enable such a change. We propose that this also applies to emotion regulation. In two studies, we found that people were most successful in emotion regulation, the more they believed emotions can be controlled and the more they used an effective emotion regulation strategy – namely, cognitive reappraisal. Cognitive reappraisal moderated the link between beliefs about the (...) controllability of emotion and success in emotion regulation, when reappraisal was measured as a trait or manipulated. Such moderation was found when examining the regulation of disgust elicited by emotion-inducing films, and the regulation of anger elicited by real political events. We discuss the implications of our findings for research and practice in emotion regulation. (shrink)

Soon after the coronavirus disease 2019 (COVID‐19) pandemic outbreak, it became clear that vaccination will be the most useful tool to combat the disease. Despite the apparent safety and efficacy of the developed anti‐COVID‐19 vaccines, relatively high percentages of the population worldwide refused to get vaccinated, including many health workers and health students. The present cross‐sectional study examined the motives, attitudes, and personal characteristics of those who did not get vaccinated against COVID‐19 or vaccinated without complete willingness among nursing students (...) and nursing faculty members in Israel (n = 472). Results show that the vast majority of the study participants (97%) received at least one dose of the anti‐COVID‐19 vaccine. Nearly 37% of the participants indicated that they received the vaccine without complete willingness. As compared to faculty members, nursing students reported lower trust in the efficacy of the vaccine, perceived the COVID‐19 pandemic as a health threat to a lesser extent, exhibited lower institutional and personal trust, and had higher levels of posttraumatic stress disorder symptoms. Non‐Jewish participants were at risk of vaccinating without complete willingness. These findings underscore the need for developing evidence‐based strategies to promote the safety and efficacy of the anti‐COVID‐19 vaccines in nursing schools. (shrink)

Research on intergroup emotions has largely focused on the experience of emotions and surprisingly little attention has been given to the expression of emotions. Drawing on the social-functional approach to emotions, we argue that in the context of intergroup conflicts, outgroup members’ expression of disappointment with one’s ingroup induces the complementary emotion of collective guilt and correspondingly a collective action protesting ingroup actions against the outgroup. In Study 1 conducted immediately after the 2014 Gaza war, Jewish-Israeli participants received information about (...) outgroup’s expression of emotions. As predicted, outgroup’s expression of disappointment increased collective guilt and willingness to participate in collective action, but only among those who saw the intergroup situation as illegitimate. Moreover, collective guilt mediated the relationship between disappointment expression and collective action, moderated, again, by legitimacy perception. In Study 2, we replicated these results in the context of racial tension between Black and White Americans in the US. We discuss the theoretical and applied implications of the findings. (shrink)

Johnson and Stricker published an opinion piece in the Journal of Medical Ethics presenting their perspective on the 2008 agreement between the Infectious Diseases Society of America (IDSA) and the Connecticut Attorney General with regard to the 2006 IDSA treatment guideline for Lyme disease. Their writings indicate that these authors hold unconventional views of a relatively common tick-transmitted bacterial infection caused by the spirochete Borrelia burgdorferi. Therefore, it should come as no surprise that their opinions would clash with the IDSA's (...) evidence-based guidelines for the diagnosis and treatment of Lyme disease. Their allegations of conflict of interest against the IDSA resemble those made against the National Institutes of Health, the Food and Drug Administration and the Centers for Disease Control and Prevention in 2000, which were found to be baseless. It is the responsibility of all physicians and medical scientists to stand up to antiscientific, baseless and unethical attacks on those who support an evidence-based approach to caring for patients. This article considers a range of responses to Plato's Symposium, paying particular attention to Diotima's speech on eros and philosophy. It argues that Diotima's teachings contain resources for a relational pedagogy, but that these resources come more sharply into focus when Plato's text is read through the lens of contemporary (20th and 21st century) thinkers. The article therefore draws on the work of David Halperin, Hannah Arendt, Jean-François Lyotard and Luce Irigaray to argue that Diotima points us towards the (...) value of educative encounters as reciprocal and unpredictable events of initiation and becoming. Diotima's rhetorical emphasis on birth is shown to be especially important for refiguring pedagogical relations in terms of natality, understood as a capacity for new beginnings, and hence for reclaiming education as a potentially generative encounter, rather than one governed by the logic of reproduction. The final section of the article turns to work by Christine Battersby, bell hooks, Richard Smith and Morwenna Griffiths to resituate the discussion in relation to questions of autonomy. As a corrective to the modern bias towards the value of the autonomous individual, it argues that dependencies and unequal power relations can be a constitutive and enabling aspect of the educative process. For many in these all-women spaces, JEB’s slides were the first images of women like them they’d ever seen. It’s Ariel who has arranged today’s interview, doing research for the book they’re writing about the influence of the twentieth century’s LGBTQ photographers on contemporary mainstream image culture. Ariel Goldberg is a photographer and poet who crisscrosses New York City working as an adjunct on different college campuses. The more they tell me about JEB in the weeks leading up to this meeting, the more I sense something genealogical afoot. Each representing the white, Jewish, middle -class,antiracist-lesbian-grassroots activism of their respective eras, both JEB and Ariel are self-taught, collaborative, and accountable to their circles of activist/artist friends. They pursue projects with or without (usually without) institutional support and brim with interests that hover between marginal and hot. As for me, I’m a historian, tagging along for the ride. I know little about photography, its practitioners, or its technologies, but I’m dipping into a new research project about the impact of social-movement participation on activist lives.
