Liability of Experts and the Boundary between Tort and Contract.Hans Bernd-Schäfer - 2002 - Theoretical Inquiries in Law 3 (2).
This paper offers an economic analysis of one aspect of the possible liability for incorrect information traded on information markets: expert liability for incorrect asset valuation. The article does not address the questions of whether and under what circumstances an expert should bear contractual liability for an incorrect valuation. Rather, it assumes such contractual liability towards the person who has solicited the opinion and focuses instead on analyzing the circumstances under which the expert’s liability should be extended to third parties (...)

Motivational Reasons for Biased Decisions: The Sunk-Cost Effect’s Instrumental Rationality.Markus Domeier, Pierre Sachse & Bernd Schäfer - 2018 - Frontiers in Psychology 9:320037.
The present study describes the mechanism of need regulation, which accompanies the so-called “biased” decisions. We hypothesized an unconscious urge for psychological need satisfaction as the trigger for cognitive biases. In an experimental study (N = 106), participants had the opportunity to win money in a functionality test. In the test, they could either use the solution they had developed (sunk cost) or an alternative solution that offered a higher probability of winning. The selection of the sunk-cost option was the (...)

Biomedical conflicts of interest: a defence of the sequestration thesis--learning from the cases of Nancy Olivieri and David Healy.A. Schafer - 2004 - Journal of Medical Ethics 30 (1):8-24.
No discussion of academic freedom, research integrity, and patient safety could begin with a more disquieting pair of case studies than those of Nancy Olivieri and David Healy. The cumulative impact of the Olivieri and Healy affairs has caused serious self examination within the biomedical research community. The first part of the essay analyses these recent academic scandals. The two case studies are then placed in their historical context—that context being the transformation of the norms of science through increasingly close (...)

    On models with variable universe.Bernd Ingo Dahn - 1975 - Studia Logica 34 (1):11 - 23.
In this paper some parts of the model theory for logics based on generalised Kripke semantics are developed. Löwenheim-Skolem theorems and some applications of ultraproduct constructions for generalised Kripke models with variable universe are investigated using similar theorems of the model theory for classical logic. The results are generalizations of the theorems of [4].

    Constructions of classical models by means of Kripke models (survey).Bernd I. Dahn - 1979 - Studia Logica 38 (4):401 - 405.
It is demonstrated how Kripke models for intuitionistic predicate logic can be applied in order to prove classical theorems. As examples proofs of the independence of the axiom of constructibility, of the omitting types theorem and of Shelah's ultrapower theorem are sketched.

  16. Religious Diversity: A Philosophical Defense of Religious Inclusivism.Bernd Irlenborn - 2010 - European Journal for Philosophy of Religion 2 (2):127 - 140.
Faced by the challenge of religious plurality, most philosophers of religion view pluralism and exclusivism as the most accepted and fully developed positions. The third alternative, the model of inclusivism, held especially within the Catholic tradition, has not received adequate attention in the debates in philosophy of religion, perhaps as it is based solely on theological grounds. In this essay I offer a philosophical defense of the position of religious inclusivism and give reasons why this position represents the most appropriate (...)

Motivated by accounts of concept use in autistic spectrum disorder and a computational model of weak central coherence we examined comprehension and production vocabulary in typically‐developing children and those with ASD and Down syndrome. Controlling for frequency, familiarity, length and imageability, Colorado Meaningfulness played a hitherto unremarked role in the vocabularies of children with ASD. High Colorado Meaningful words were underrepresented in the comprehension vocabularies of 2‐ to 12‐year‐olds with ASD. The Colorado Meaningfulness of a word is a measure of (...)

Robert Brandom on Communication, Reference, and Objectivity.Bernd Prien - 2010 - International Journal of Philosophical Studies 18 (3):433-458.
The two main challenges of the theory of conceptual content presented by Robert Brandom in Making It Explicit are to account for a referential dimension of conceptual content and to account for the objectivity of conceptual norms. Brandom tries to meet both these challenges in chapter 8 of his book. I argue that the accounts presented there can only be understood if seen against the background of Brandom's theory of communication developed in chapter 7. This theory is motivated by the (...)

The contributors to _Constructing the Pluriverse_ critique the hegemony of the postcolonial Western tradition and its claims to universality by offering a set of “pluriversal” approaches to understanding the coexisting epistemologies and practices of the different worlds and problems we inhabit and encounter. Moving beyond critiques of colonialism, the contributors rethink the relationship between knowledge and power, offering new perspectives on development, democracy, and ideology while providing diverse methodologies for non-Western thought and practice that range from feminist approaches to scientific (...)

This series of images forms part of the ongoing project Soft Ground, Hard Light, which speculates on a multiscalar spatial ontology of photography emanating from the Arditurri silver mine complex in the Basque Country. Evoking the mountainous massif around Arditurri where silver ore and galena have been extracted since Roman presence in the area, the depicted topographies are, in fact, data transcriptions from atomic force microscopy (AFM) probing the analogue film stock of an early 1930s experiment in 3D cinema, Cine (...)

We are living in an algorithmic age where mathematics and computer science are coming together in powerful new ways to influence, shape and guide our behaviour and the governance of our societies. As these algorithmic governance structures proliferate, it is vital that we ensure their effectiveness and legitimacy. That is, we need to ensure that they are an effective means for achieving a legitimate policy goal that are also procedurally fair, open and unbiased. But how can we ensure that algorithmic (...)

    The divisive moment.Bernd Behr - 2019 - Philosophy of Photography 10 (1):7-10.
This article discusses the 2019 Event Horizon Telescope image of a black hole as an ontological question for photography, contrasting its spatially distributed operations as a planetary apparatus against its temporal inscriptions of successive histories of scientific realisms following Lorraine Daston and Peter Galison. The 'becoming photographic' of this image, this text argues, hinges on the distance it traverses from its scientific milieu to its vernacular reception, making visible the cultural calibrations that produce a consensually legible image.

Organisational responses to the ethical issues of artificial intelligence.Bernd Carsten Stahl, Josephina Antoniou, Mark Ryan, Kevin Macnish & Tilimbe Jiya - 2022 - AI and Society 37 (1):23-37.
The ethics of artificial intelligence is a widely discussed topic. There are numerous initiatives that aim to develop the principles and guidance to ensure that the development, deployment and use of AI are ethically acceptable. What is generally unclear is how organisations that make use of AI understand and address these ethical issues in practice. While there is an abundance of conceptual work on AI ethics, empirical insights are rare and often anecdotal. This paper fills the gap in our current (...)

    Naturalistic Descriptions and Normative-Intentional Interpretations.Bernd Prien - 2007 - Human Affairs 17 (1):22-32.
Naturalistic Descriptions and Normative-Intentional Interpretations Normative pragmatists about linguistic meaning such as Sellars and Brandom have to explain how norms can be implicit in practices described in purely naturalistic terms. The explanation of implicit norms usually offered in the literature commits pragmatists to equate actions with naturalistic events. Since this is an unacceptable consequence, I propose an alternative explanation of implicit norms that avoids this identification. To do so, one has to treat the normative-intentional concepts such as "norm", "action", "sanction", (...)

    Nomothetic and idiographic methodology in psychiatry—A historical-philosophical analysis.Michael Schäfer - 1999 - Medicine, Health Care and Philosophy 2 (3):265-274.
The purpose of this article is to demonstrate the epistemic position of psychiatry between the science of general laws in relation to frequently encountered generality and the science of specific events which is directed towards the particular. In this respect the development of the dichotomy of nomothetic and idiographic methodology from its generally forgotten neo-Kantian origins is delineated within the context of a historical-philosophical analysis and then its incorporation into psychology and psychopathology is reconstructed. In the course of this analysis (...)

Contingency, novelty and choice. Cultural evolution as internal selection.Bernd Baldus - 2015 - Journal for the Theory of Social Behaviour 45 (2):214-237.
Sociological, economic and evolutionary paradigms of human agency have often seen social agents either as the rational controllers of their fate or as marionettes on the strings of historical, functional or adaptive necessity. They found it therefore difficult to account for the variability, intentionality and creativity of human behaviour and for its frequently redundant or harmful results. This paper argues that human agency is a product of evolution, but that genetic variation and inheritance can only provide a limited explanation of (...)

This paper argues that next to ethical analysis, classic technology assessment, and philosophical speculation we need forms of reflection, dialogue, and experiment that come, quite literally, much closer to innovation practices and contexts of use. The authors discuss a number of ways how to achieve that. Informed by their experience with “embedded” ethics in technical projects and with various tools and methods of responsible (...)
