C'est pourquoi cet ouvrage questionne la philosophie, le droit et l'éthique jusque dans leurs fondements avant d'aborder les problèmes les plus brûlants de notre actualité médicale. Dans une perspective à la fois interdisciplinaire (...) et fondamentale, nous présentons ici trois approches - philosophique, juridique et médicale qui constituent autant d'entrées possibles. Ainsi regroupées et articulées, les différences qui existent entre les rationalités, les pratiques et les discours peuvent devenir des facteurs d'enrichissement réciproque au lieu de constituer des obstacles. Si, depuis quelques dizaines d'années, la médecine de la reproduction s'est considérablement développée pour venir en aide aux couples confrontés à l'impossibilité de concevoir naturellement un enfant, c'est généralement avec l'objectif initial de favoriser une conception avec les gamètes du couple. Le développement successif de l' " Insémination Artificielle " et de la " Fécondation in Vitro " a néanmoins permis dans le même temps de faire émerger différentes possibilités alternatives de conception, en transgressant notamment le principe de la filiation (...) biologique. Un couple peut aujourd'hui concevoir un enfant avec d'autres gamètes que les siens et même envisager l'accueil d'un embryon conçu par un autre couple. Dans ces situations, la question de la conciliation des intérêts des différents acteurs se pose. En optant pour la règle de l'anonymat des dons qui prive l'enfant de toute information sur le donneur, certaines législations semblent considérer que ce principe allie au mieux ces intérêts. Pourtant non seulement la demande croissante de levée de l'anonymat formulée par les enfants issus de l'assistance médicale à la procréation fragilise ce choix de société mais certains pays ont devancé ce voeu en choisissant la transparence génétique. Cet ouvrage est le fruit de riches débats et réflexions échangés entre juristes, médecins, psychanalystes et sociologues, lors du premier Workshop du Réseau Universitaire International de Bioéthique. Adoptant une approche comparative, les articles rassemblés examinent la manière dont sont organisées, dans seize pays de cultures différentes, les pratiques et les conséquences d'un anonymat absolu, relatif, voire inexistant. En dépit d'une diversité de systèmes, un constat unanime ressort : la question de la levée de l'anonymat se pose partout avec acuité. La réponse, elle, réunit ou divise. Mais peut-il en être autrement sur un sujet qui touche aux perceptions sociales de l'identité de la personne, de la filiation ou de la " parentalité "? Créé en 2007, le Réseau Universitaire International de Bioéthique a pour objectif de promouvoir la recherche universitaire en rapprochant des chercheurs, de pays et, de cultures différents, spécialistes des questions liées aux pratiques biomédicales. Partant d'une approche croisée des différents systèmes juridiques, les travaux de ce réseau analysent les choix sociaux en matière biomédicale à travers les prismes de l'éthique, de l'anthropologie, la philosophie ou la sociologie. Ils veulent ainsi contribuer à la réflexion internationale sur la régulation des pratiques biomédicales et, incidemment, sur la conciliation entre les diversités culturelles et un certain universalisme, terreau d'une harmonisation du droit. Cette nouvelle collection sera donc un outil indispensable pour toute personne en quête d'une compréhension des enjeux sociaux de la bioéthique. (shrink)

Currently, affect and emotions are a widely discussed political topic. At least since the early 1990s, different disciplines—from the social sciences and humanities to science and technoscience—have increasingly engaged in studying and conceptualizing affect, emotion, feeling, and sensation, evoking yet another turn that is frequently framed as the “affective turn.” Within queer feminist affect theory, two positions have emerged: following Eve Kosofsky Sedgwick's well-known critique, there are either more “paranoid” or more “reparative” approaches toward affect. Whereas the latter emphasize the (...) potentialities of affect, the former argue that one should question the mere idea of affect as liberation and promise. Here, I suggest moving beyond a critique or celebration of affect by embracing the political ambivalence of affect. For this queer feminist theorizing of affective politics, I adapt Jacques Rancière's theory of the political and particularly his understanding of emancipation. Rancière takes emancipation into account without, however, uncritically endorsing or celebrating a politics of liberation. I draw on his famous idea of the “distribution of the sensible” and reframe it as the “distribution of emotions,” by which I develop a multilayered approach toward a nonidentitarian, nondichotomous, and emancipatory queer feminist theory of affective politics. Brigitte Bourgeois and Philippe Jockey Gold and Marble: the Gilded Hellenistic Sculptures of Delos p. 331-349 The investigation we are conducting on the polychromy of the Hellenistic sculptures of Delos has enabled us to add to the corpus of gilded marble works and to refine the typology. A visual examination of the sculptures through a video-microscope, combined with an analysis of the remains isolated by this means under X-fluorescence, has revealed the existence of three large types of gold leaf (...) gilding on marble at Delos in around 100 BC: totally gilded statues, works on which the gilding forms only an added colouring to the general polychromy, and works that we propose to call "chrysochromes", which present a singularity not hitherto recognised of a very bright polychromy on the clothed parts associated with gold on the nude parts. Among the number of important results of this enquiry may be counted the revelation of the overall gilding on the Delian copy in the National Museum at Athens of the Polyclitus Diadumenus, carved and gilded in imitation of a gilt bronze or even a gold statue. Such a use of gold leaf gilding on the Delos marbles calls in any case for a reconsideration of the question of the reception in antiquity of such works, as well as of such a success of gold at Delos and no doubt elsewhere in the Greek world in the same period. The physics of condensed matter, in contrast to quantum physics or cosmology, is not traditionally associated with deep philosophical questions. However, as science - largely thanks to more powerful computers - becomes capable of analysing and modelling ever more complex many-body systems, basic questions of philosophical relevance arise. Questions about the emergence of structure, the nature of cooperative behaviour, the implications of the second law, the quantum-classical transition and many other issues. The ethics of Du Pont's CFC strategy from 1975 to 1995 are analyzed using a Potter's Box framework. This approach includes an examination of relevant facts, prioritization of stakeholder loyalties, selection of a mode of ethical reasoning, and a world view. Du Pont's approach to ethical reasoning reflects changing facts and changing interpretation of the facts, a focus on shareholders as the primary and most important stakeholder, and ends-based reasoning, which views creating shareholder value as the primary end. This paper aims to determine whether we can locate temporal passage in a non-dynamical (block universe) world. In particular, we seek to determine both whether temporal passage can be located somewhere in our world if it is non-dynamical, and also to home in on where in such a world temporal passage can be located, if it can be located anywhere. We investigate this question by seeking to determine, across three experiments, whether the folk concept of temporal passage can be satisfied (...) in our world if it is non-dynamical, and, if it can, what sort of thing in our world satisfies that concept. In particular, we focus on the question of whether that concept (if satisfied) is satisfied by something mind-dependent or something mind-independent. In other words, we ask, is temporal passage something that is at least partially in the mind, or is it entirely external to the mind? We find, contrary to what is often assumed by dynamists and non-dynamists alike, that the folk concept of temporal passage is satisfied in our world conditional on it being non-dynamical, and that the concept is satisfied by something mind-independent. This provides further ammunition for recent deflationary accounts of temporal passage that attempt to locate passage somewhere in our non-dynamical world. (shrink)

In this paper, I will explore the concept that healing activities shape the objects of therapy and seek to construct those objects through therapeutic activities. Objects of therapy are the persons, patients, human bodies, diseases, physiological processes and personal suffering—that which clinical medicine constructs through its distinctive formative processes, practices and knowledge. The rationale for choice of philosophical sources namely, Cassirer, Foucault, the anthropological perspective of Good and the sociological account of Frank will be discussed. The claim articulated by Good (...) will be examined and its relationship to culture, illness, medical knowledge, practice, truth, and science. I then focus on Frank's concepts of the patient and the body and how medical knowledge and practices affects it. The concept that the medicalization of the illness narrative silences the patient's voice requiring an ethic of listening will be emphasized, described and further supported by Charon's (2006, Narrative medicine: Honoring the stories of illness. New York, NY: Oxford University Press) and Cassell's (2015, The nature of suffering and the goals of medicine. New York, NY: Oxford University Press) thoughts on narrative of illness in clinical medicine. My position concludes that healing activities construct the objects of therapy: as the medical culture's way of seeking truth; as medicine's way of mediating and organizing forms of reality through culture and symbolic forms; and, as medicine's way of entering the body and constructing the disease. Lastly, I suggest that in spite of the remarkable progress in the control of disease, the failure to address the interpretation of illness meanings is a fundamental flaw in the work of “doctoring.” The experience and meanings of illness are at the centre of clinical practice and is a moral, political, ethical and professional obligation. The person is a cultural construct, a complex and culturally shaped way of experiencing self and other, and cultural “work” is required to constitute the person who is the object of medical attention and it also necessitates the ethic of listening. Il s'agit d'étudier les conditions d'appropriation techniques et cognitives faites aux lecteurs-utilisateurs confrontés à des environnements sophistiqués et à des interfaces hypermédias de lecture-écriture. La « culture de l'information » est utilisée pour identifier un modèle informationnel du sujet, induit par les évolutions de la technique et par les dispositifs de communication qui sont (...) proposés.This contribution focuses on the analysis of an editorial practice, illustrated by the recent approach of the Encyclopaedia Universalis to computerized systems of knowledge dissemination. The purpose is to study the conditions of technical and cognitive appropriation created for readers/users in their confrontation with sophisticated systems and hypermedia reading/writing interfaces. Information literacy is used to identify an informational model of the individual concerned, induced by the technical evolutions and the communication systems that are presented. (shrink)

Depending on different positions in the debate on scientific realism, there are various accounts of the phenomena of physics. For scientific realists like Bogen and Woodward, phenomena are matters of fact in nature, i.e., the effects explained and predicted by physical theories. For empiricists like van Fraassen, the phenomena of physics are the appearances observed or perceived by sensory experience. Constructivists, however, regard the phenomena of physics as artificial structures generated by experimental and mathematical methods. My paper investigates the historical (...) background of these different meanings of phenomenon in the traditions of physics and philosophy. In particular, I discuss Newton’s account of the phenomena and Bohr’s view of quantum phenomena, their relation to the philosophical discussion, and to data and evidence in current particle physics and quantum optics. Grace de Laguna was a philosopher working in the first part of the twentieth century on analytic and speculative philosophy, as well as on the psychology and philosophy of language, especially the social function of language. Joel Katzav’s lead essay focuses mainly on the former part of her work, while my commentary focuses mostly on the latter. Katzav shows how her work played a role in the development of analytic philosophy, I try to show how her work played a role (...) in the development of pragmatic linguistics, whose development overlapped with some aspects of analytic philosophy. I situate it in the context of an emerging ‘pragmatic Weltanschauung’ that was embraced by many working in linguistics, philology, philosophy, psychology, anthropology and what would later be called linguistic pragmatics. This paper deals with some structural properties of the sequent calculus and describes strong symmetries between cut-free derivations and derivations, which do not make use of identity axioms. Both of them are discussed from a semantic and syntactic point of view. Identity axioms and cuts are closely related to the treatment of negation in the sequent calculus, so the results of this article explain some nice symmetries of negation.

The concept of self is imbedded in the psychoanalytic theory of object relations. The theory of object relations poses the question of the constitution of the person’s inner life or ‘representational world’. It will be discussed, in what respect the concept of self serves the description of dependency relations, in which the psychic relations of the person to the social and cultural reality are expressed. After the UN Guiding Principles on Business and Human Rights were adopted in 2011, an international treaty has been being negotiated since 2014. The two instruments reveal similarities and also conflicts regarding the adequate organization of the global economy based on human rights. The focus in this article will be on the processes leading to these instruments, because they themselves mirror different understandings of governance in the field of business and human rights as well as the struggle over the power (...) of definition and legitimacy. The UNGPs were developed on the basis of global multi-stakeholder consultations, underlining legitimacy through broad inclusion. There are varying judgements as to the success of this approach. The process towards the treaty follows the traditional path of negotiations at UN level. These negotiations reveal a struggle for recognition of the legitimacy of the process itself. Both procedures have shortcomings with regard to legitimacy and show the need for a revision concerning the inclusion of stakeholders. The complementarity of a soft and hard law instrument may enhance the creation of a level playing field in the global economy, thereby strengthening human rights. (shrink)

This book, first published in 2000, offers translations of the initial critical reactions to Kant's philosophy. Also included is a selection of writings by Kant's contemporaries who took on the task of defending the critical philosophy against early attacks. The first aim of this collection is to show in detail how Kant was understood and misunderstood by his contemporaries. The second aim is to reveal the sorts of arguments that Kant and his first disciples mounted in their defense of the (...) theoretical philosophy. The third aim of the book is to contribute to an understanding of the development of Kant's critical philosophy after its initial formulation in the Critique of Pure Reason, and in particular why Kant made the changes he did in the second edition of the work in 1787. This collection, which includes a glossary of key terms and biographical sketches of the critics on both sides of the debate, is a major addition to Kant scholarship and should be seen as a companion volume to the Cambridge Edition of the Works of Immanuel Kant. This book provides a comprehensive account of Kant’s development from the 1755/56 metaphysics to the cosmological antinomy of 1781. With the Theory of the Heavens (1755) and the Physical Monadology (1756), the young Kant had presented an ambitious approach to physical cosmology based on an atomistic theory of matter, which contributed to the foundations of an all-encompassing system of metaphysics. Why did he abandon this system in favor of his critical view that cosmology runs into an antinomy, according to the (...) Critique of Pure Reason (CPR)? This book answers this question by focusing on Kant’s methodology and the internal problems of his 1755/56 theory of nature. A decisive role for Kant’s critical turn plays the argument from incongruent counterparts (1768), which drew much attention among philosophers of science, though not sufficiently in Kant research. Furthermore, the book analyses the genesis of the cosmological antinomy in the 1770s, the logical structure of the antinomy in the CPR, its relation to transcendental idealism, as explained in the “experiment of pure reason” (1787), and its role for the teleology of human reason. Pléthon a conçu le modèle d'une constitution qui permettrait à tous les peuples de coexister en paix. Au temps où l'Occident latin est largement aristotélicien, il plaide pour le retour à Platon, l'idéalisme, la théologie affirmative.

Rapprocher Facebook du Kula mélanésien, un système archaïque d’échanges intertribaux décrit par Marcel Mauss, permet de souligner la capacité de la plateforme phare du Web 2.0 à répondre à des besoins socioculturels anthropologiquement attestés. Tous deux obéissent à une contrainte implicite de réciprocité qui, au-delà du contenu matériel des échanges, possède une fonction symbolique : les interactions mises en œuvre et la recherche de partenaires traduisent une quête de prestige, de mana selon le fameux terme chinook. Le Kula et les (...) murs de Facebook offrent une immense vitrine où chacun valorise son mana et scrute celui d’autrui tout en cherchant de nouveaux partenaires. Mobiliser le Kula tel un modèle de Simmel – un schème d’intelligibilité – indique l’ancienneté de ces traits culturels : la combinaison des dimensions matérielle et symbolique dans les échanges entre pairs et, en l’absence d’instance régulatrice, le risque lié à l’emballement de ce processus inévitablement concurrentiel.Our comparison between Facebook and Melanesia’s Kula, an archaic system of inter-tribal exchanges described by Marcel Mauss, has highlighted the ability of the flagship Web 2.0 platform to respond to anthropologically verified socio-cultural needs. Both systems obey an implicit demand for reciprocity, which, over and above the actual content of exchanges, has a symbolic function: the interactions at play and the search for partners reflect a quest for prestige, or mana as it is famously known in Chinook. Kula and Facebook’s walls are a gigantic shop window where anyone can show off their mana and look at other people’s, while also seeking out other partners. The use of the Kula as described by Simmel – as a model of intelligibility – suggests the ancient roots of these cultural traits: the combination of material and symbolic dimensions in exchanges between peers and, if there is no regulating authority, the risk that this inevitably competitive process may run out of control. The paper presents a logical treatment of actions based on dynamic logic. This approach makes it possible to reflect clearly the differences between static and dynamic elements of the world, a distinction which seems crucial to us for a representation of actions.Starting from propositional dynamic logic a formal system (DLA) is developed, the programs of which are used to model action types. Some special features of this system are: Basic aspects of time are incorporated in DLA as far as they (...) are needed for our purpose. Names for states and for instants are simulated by formulas. It is possible to express formally that a formula is satisfiable or valid. A special program is introduced to reflect developments which are not caused by an official agent but by external influences. (shrink)
