The representation of knowledge in the law has basically followed a rule-based logical-symbolic paradigm. This paper aims to show how the modeling of legal knowledge can be re-examined using connectionist models, from the perspective of the theory of the dynamics of unstable systems and chaos. We begin by showing the nature of the paradigm shift from a rule-based approach to one based on dynamic structures and by discussing how this would translate into the field of theory of law. In order (...) to show the full potential of this new approach, we start from an experiment with NEUROLEX, in which a neural network was used to model a corpus of French Council of State decisions. We examine the implications of this experiment, especially those concerning the limits of the model used, and show that other connectionist models might correspond more adequately to the nature of legal knowledge. Finally, we propose another neural model which could show not only the rules which emerge from legal qualification (NEUROLEX's goal), but also the way in which a legal qualification process evolves from one concept to another. La philosophie et les outils pratiques de Science Commons seront décrits comme constitutifs d’une approche résolument ouverte de la connaissance scientifique, dans la lignée de la déclaration de Berlin .Rapid advances in the digital technologies have profoundly changed and improved the way in which data, information and tools can be disseminated, managed, used and re-used in research, and have created new opportunities to speed up progress in science and innovation. These developments are mainly due to an emerging broader movement in support of formal and informal « peer production » and global dissemination of information drawing on the cooperation of distributed science and knowledge communities working in open networked environments. Initiatives like the Science Commons rely on an economic model where science evolves in a digital environment, and more specifically on sharing and exchanges between peer communities as a basis for production. Many other initiatives of this kind are under way . We have chosen the Science Commons, whose objective, over and above scientific communication, is to speed up the translation of data into discovery by removing all barriers, including legal obstacles, that prevent society from enjoying the benefits of scientific results as quickly as possible. The philosophy and practical tools of the Science Commons are described as making up a resolutely open approach to scientific knowledge, as recommended by the Berlin Declaration. (shrink)

Unlike usual real graphs which have a low number of edges, we study here a dense network constructed from legal citations. This study is achieved on the simple graph and on the multiple graph associated to this legal network, this allows exploring the behavior of the network structural properties and communities by considering the weighted graph and see which additional information are provided by the weights. We propose new measures to assess the role of the weights in the network structure (...) and to appreciate the weights repartition. Then we compare the communities obtained on the simple graph and on the weighted graph. We also extend to weighted networks the amphitheater-like representation of this legal network. Finally we evaluate the robustness of our measures and methods thus taking into account potential errors which may occur by getting data or building the network. Our methodology may open new perspectives in the analysis of weighted networks. (shrink)

We explore one aspect of the structure of a codified legal system at the national level using a new type of representation to understand the strong or weak dependencies between the various fields of law. In Part I of this study, we analyze the graph associated with the network in which each French legal code is a vertex and an edge is produced between two vertices when a code cites another code at least one time. We show that this network (...) distinguishes from many other real networks from a high density, giving it a particular structure that we call concentrated world and that differentiates a national legal system (as considered with a resolution at the code level) from small-world graphs identified in many social networks. Our analysis then shows that a few communities (groups of highly wired vertices) of codes covering large domains of regulation are structuring the whole system. Indeed we mainly find a central group of influent codes, a group of codes related to social issues and a group of codes dealing with territories and natural resources. The study of this codified legal system is also of interest in the field of the analysis of real networks. In particular we examine the impact of the high density on the structural characteristics of the graph and on the ways communities are searched for. Finally we provide an original visualization of this graph on an hemicyle-like plot, this representation being based on a statistical reduction of dissimilarity measures between vertices. In Part II (a following paper) we show how the consideration of the weights attributed to each edge in the network in proportion to the number of citations between two vertices (codes) allows deepening the analysis of the French legal system. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. Charlotte Witt covers a remarkable amount of ground in this concise and elegantly written book. Coming in at under 150 pages, she artfully weaves together Aristotle’s theory of functions with contemporary work on cultural transmission and apprenticeship, ideas about self-creation with theories of aspiration and transformative experience, and reflections on the relationships among social norms and games with thoughts about social roles and the nature of hierarchy. At the heart of it is an elaboration and defense of a thoroughly externalist (...) account of social normativity. Witt takes skilled experts, especially artisans like chefs and carpenters, as paradigm cases for theorizing about social normativity. She uses them to argue that the ultimate source of many normative obligations is found not in the acquiescence, attitudes, or any other features internal to those on whom those obligations fall. Rather, the demands are rooted in the world itself, and flow from specific circumstances, especially from the constraints those circumstances impose on different actors in virtue of the tasks they need to perform. The result is a view that depicts social normativity not just as external to individuals but also unavoidably role specific; what is right for a chef is not necessarily right for a carpenter, and what makes for a good nurse might make for a poor drill sergeant. Witt’s presentation of this package of ideas is both careful and austere, and it makes for a wonderfully thought provoking read. Social Goodness: On the Ontology of Social Norms will reward the careful attention of anyone interested in social ontology, especially the metaphysical foundations of normativity, the nature of social norms, and the relationship between social roles and the self. Weinandy had set out to write a fully orbed systematic theology. While in the process of giving a "respectful nod to Scripture" as a prelude to his systematic study, he found himself caught up and engrossed in the biblical text—and never managed to extricate himself. Changing course, he decided to write "a theological or doctrinal interpretation of the New Testament." Volume 1 of this effort covers the Synoptic Gospels (2018). In this second volume, Weinandy turns his attention to the Fourth Gospel, his aim being "to discern the theological and doctrinal content of John's Gospel" (x).Perhaps the most unusual quality of this study is the complete absence of any secondary literature. Though the author has read commentaries on the Gospels, both ancient and modern, he chose not to consult any other scholars (or ecclesiastical writers) in composing this doctrinal commentary. Given his focused aim—a theological and doctrinal study of the Gospels—he wanted to avoid getting caught up in contemporary scholarly exegetical debates. And so there are no footnotes to secondary sources (a thing probably welcome to many readers).Weinandy alerts the reader at the start concerning his particular approach to this study of the Gospels. Fascinated throughout his career as a systematic theologian with the notion of "act" (and especially with God as "pure act"), he approaches the Gospel narratives primarily from the perspective of Jesus's actions. Specifically, he intends to explore how Jesus "enacts" [End Page 738] his name, "YHWH-Saves," through the saving mysteries revealed in the narrative of the Gospels. Thus the title of his multi-volume work, "Jesus Becoming Jesus," serves as the overarching theological theme of the entire effort. This is how he explains his methodology of "act" and "enactment" in his first volume: "Jesus more and more becomes Jesus in act through his saving acts; he becomes more and more the Savior. He definitively becomes Jesus-in-act with the actions of his saving death and resurrection, which will find completion when Jesus comes in glory at the end of time" (xix). With such attention given to Jesus's actions, Weinandy admits that Jesus's teaching does not receive the same attention. It is not that he ignores Jesus's words, but they function primarily as pointers to Jesus's acts.And yet in another sense, the endpoint of this commentary is to show the Trinity-in-act. "The Father is fatherhood fully in act; the Son is sonship fully in act; and the Holy Spirit is love fully in act. This threefold perichoretic act is the one God fully in act" (xiv). As Jesus progressively enacts his name and identity, so too are the Father and the Spirit revealed according to the "acts" that reflect their hypostatic identities. A consistent feature of this commentary is the sustained attention given to how the Father and the Spirit are involved in the saving actions of Jesus, the Word made flesh. Congruent with this view of the Trinity's perichoretic act, Weinandy often adopts what might be called a "perichoretic syntax," whereby he presents a single reality from the distinct perspectives of the divine persons, restating the same truth in mutually enhancing ways. This grammatical-syntactical style of the commentary is admirably suited to its theme.If we are looking for parallels to this theological-doctrinal approach in the Christian tradition, the commentaries on the Gospel of John by Cyril of Alexandria and Thomas Aquinas come to mind. Communication plays an important role in promoting sustainable consumption. Yet how the academic literature conceptualizes and relates communication and sustainable consumption remains poorly understood, despite growing research on communication in the context of sustainable consumption. This article presents the first comprehensive review of sustainable consumption communication (SCC) research as a young and evolving field of scholarly work. Through a systematic review and narrative synthesis of N = 67 peer-reviewed journal articles, we consolidated the research conducted in this field into four (...) distinct types: communication as an approach to (1) behavior change, (2) self-empowerment, (3) systems change, and (4) reflection on current discourses and practices around sustainable consumption. Our findings reveal that most journal articles focus on incremental changes in individual consumer behavior (“weak” sustainable consumption) and employ communication as an intervention tool with little reference to communication science and theory. They also reveal integration challenges arising from the disciplinary diversity and fragmentation characteristic of the research field. Future research should develop shared frameworks and terminology, diversify its foci, synthesize relevant evidence, and innovate critical perspectives that go beyond one-way business-to-consumer communication. The results of our review can serve researchers engaged in sustainable consumption communication to better systematize their efforts and contribute more effectively to changing systems of consumption in the future. Similar to those other volumes, On Inception does not follow a linear train of thought but offers short and often fragmentary notes and musings that, nonetheless, build on one another. There is a considerable thematic overlap with the other writings on the event. Many of the themes found here, such as the role of technology in exposing contemporary understanding of being, Hölderlin as the poet of the saying of beyng, or the notion of another beginning of the unconcealment of beyng, can be found in Contributions to Philosophy, Mindfulness, and The Event as well.What sets On Inception apart from these other volumes is the focus on the inceptual aspect of the thinking of beyng. In this regard, the first and longest of the six sections comprising the book (entitled "The Incipience of Inception") offers the most extended original contribution Heidegger makes here. It concerns the question of how one can think from out of the unconcealment of beyng. Exploring this topic throws more light on many of the questions that the reading of the other volumes raises, such as whether the event should be thought of as a one-time historical occurrence; how one can think from out of the event, that is, how it constitutes the possibility of thinking it; and the relationship between beings, being (referring to the truth of the presence of beings), and beyng (referring to the truth of the presencing of being). All of these issues concern the inceptual character of the event, whose understanding affords a better sense of paradigmatic change in thinking and dwelling associated with it. To understand the inceptual character of the event gives the reader a clue as to where to begin thinking (about) it. This does not remove the considerable and intentional obscurity surrounding these ideas, but it shows Heidegger as constantly altering and refining how to think of the history of the concealment and unconcealment of beyng. One of the biggest disagreements among interpreters has been whether to read this in transcendental or realist terms, that is, whether we should take the unconcealment of beyng as the proffering of a real, mind-independent totality or as a cipher for our transcendental ability to understand and make sense of the appearance of being. In this regard, the question of incipience goes toward elucidating who or what is thought to begin this unconcealment.What, then, does an inceptive thinking of beyng amount to? Put negatively, it can concern neither beyng as some sort of cause of beings, nor beings themselves as what appear as a consequence of beyng's unconcealment: "[I]nception is not the inception of something other than what it itself is; equally, inception is not the inception of itself, as if what were being thought of were a producing and causing." To think beyng as inception puts emphasis on the emergent nature of the opening of the clearing in which beings can come to presence for someone. Kohl and Nimmerfall, two legal scholars from the Faculty of Law at the University of Vienna, have put forth an edited volume dealing with ‘law and language in practice’. In this article, I present a critical evaluation of the work, taking into consideration its structure and organisation, the range and depth of the work, and the construction of and perspectivation on legal language in use and the legal language user. I do so from the interdisciplinary view of legal linguistics and (...) social semiotics, two areas of critical intellectual inquiry that are doubtlessly underrepresented in this volume. While legal linguists in Austria have anticipated the work as a hopeful bridge-builder across the domains of law and language, Kohl and Nimmerfall display a lack of awareness towards ongoing controversies in legal linguistics on the national and international level that seriously jeopardise the aim of the work. Currently the volume is being used in a course held by the authors entitled “Legal Literacy: Contract drafting, legislation and other areas of law”. Despite the work’s breadth of legal contexts touched upon and its undisputed worth for the community of practice, the work gives a sometimes disconcerting impression of authority in the field. While the authors’ openness to embracing language issues in legal contexts ought to be welcomed, the nearly complete lack of references made to the ever-growing body of research in legal linguistics, not only in Austria but around the globe, is surprising and concerning. The transition from primary to secondary education is one of the most stressful events in a young person’s life (Zeedyk et al., 2003) and can have a negative impact on psychological wellbeing and academic achievement. One explanation for these negative impacts is that the transition coincides with early adolescence, a period during which certain psychological disorders (i.e., anxiety disorders) become more salient (Kessler et al., 2005) and marked social, biological, and psychological development occurs (Anderson, Jacobs, Schramm, & Splittgerber, 2000). This (...) review evaluates the existing literature on the psychological and academic impacts of the transition to secondary education on young adolescents. We examine the factors that plausibly increase or mitigate the risk of developing mental health issues and/or a decline in academic performance during the transition to secondary education. We also review the interplay between psychological health and academic achievement across and beyond the transition. We conclude with a summary of what schools and parents can learn from these findings to support children in a successful transition into secondary education. (shrink)

ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can be (...) present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

Stakeholder engagement has grown into a widely used yet often unclear construct in business and society research. The literature lacks a unified understanding of the essentials of stakeholder engagement, and the fragmented use of the stakeholder engagement construct challenges its development and legitimacy. The purpose of this article is to clarify the construct of stakeholder engagement to unfold the full potential of stakeholder engagement research. We conduct a literature review on 90 articles in leading academic journals focusing on stakeholder engagement (...) in the business and society, management and strategy, and environmental management and environmental policy literatures. We present a descriptive analysis of stakeholder engagement research for a 15-year period, and we identify the moral, strategic, and pragmatic components of stakeholder engagement as well as its aims, activities, and impacts. Moreover, we offer an inclusive stakeholder engagement definition and provide a guide to organizing the research. Finally, we complement the current understanding with a largely overlooked dark side of stakeholder engagement. We conclude with future research avenues for stakeholder engagement research. (shrink)

Cognitive science has much to contribute to the general scientific body of knowledge, but it is also a field rife with possibilities for providing background research that can be leveraged by artificial intelligence (AI) developers. In this introduction, we briefly explore the history of AI. We particularly focus on the relationship between AI and cognitive science and introduce this special issue that promotes the method of inspiring AI development with the results of cognitive science research.

Christian Miller's book makes extensive use of the data on human behavior and motivation from psychological studies in the last 50-60 years and applies that information to the analysis of character. The book begins with helping behavior and the analysis is then generalized to other character traits. Miller argues that an analysis of human character as having Mixed Character Traits is superior to the analysis of character using the traditional virtues. The review highlights the great value of combining the research (...) into one place for the purposes of ethics and Miller's initial analysis of the data on helping. But the review questions the usefulness of Mixed Character Traits as a descriptor of human character and its value as a heuristic device in ethics. (shrink)

Boston: Wipf & Stock, 2022. xvi + 152 pp. $25.00 paperback; $22.00 eBook; $40.00 hardcover.The number of scholars who would call themselves Christian naturalists and the number of books that think through what it means to be both Christian and (...) naturalist are quite small. Karl E. Peters has been an outstanding figure in this small group for many years. He is a leader in the science and religion dialogue in the United States and has been thinking theologically for a long time about what it means to be a Christian in an age of science. For these reasons, I was eager to read Peters’s Christian Naturalism as it promised to be a concise and systematic summary of his thinking about Christian Naturalist theology. What I found was a book that may have its uses but is not always successful in both its approach and its argumentation.Peters states in the Introduction that the book is “intentionally written for a general audience” (xi), and he maintains an accessible style and vocabulary throughout. Often, the book has an autobiographical quality as Peters weaves in reflection on his own educational journey in both science and theology. Chapters 1 and 3 helpfully lay out a brief comparison of ancient cosmologies and a contemporary scientific cosmology. Chapter 3 is a good example of some of the interesting heuristics that Peters uses throughout as he tells the story of the beginnings of the universe and the emergence of life on Earth in a first-person narrative. The rest of the book proceeds in brief and accessible treatments of categories one would typically find in theology primers: God, Jesus, evil and sin, salvation, ethics, and after death. The remainder of this review will take up two of these categories: 1) evil, sin, and ethics and 2) after death. The former will serve as an example of the book’s relative weaknesses and the latter as an example of the book’s promise and usefulness.“Human Evil,” chapter 4, begins promisingly. Peters builds on an earlier introduction to the idea that we can associate “God” with the creative processes at work in the universe or with creativity itself. Here, Peters argues that being faithful to creativity becomes the norm for Christian faith and morality. “So, being moral means sustaining the well-being of already created dynamic systems and at the same time being open to creativity (God) and the emergence of new systems” (42). Perhaps these arguments would be better positioned at the [End Page 97] beginning of a chapter on morality and ethics rather than the chapter on evil and sin, though, especially since the corollary definition of sin doesn’t come for another twenty-four pages. There, Peters explains that “sin (the Christian term for human evil) is the attempt to limit the work of creativity (God) and to limit what is included in the family of life that arises from the work of creativity (God)” (66). These two definitions taken together offer one of the most theologically pregnant ideas in the book. Unfortunately, they are not pursued and applied in a systematic way throughout the remainder of this chapter and into chapters 7 and 8 on ethics and Christian practice. What we get, instead, is a collection of reflections on various ethical topics including: racism, xenophobia, sexism, and climate change.Perhaps if these sections were retitled “Karl’s Reflections on Wrestling with White, Male Privilege,” the reader would have the right expectation and their usefulness would reemerge. But as they stand they often lose the thread of their connections to his theological definitions and sometimes slip into problematic assumptions. The latter is exhibited when Peters employs the first-person again, this time in reference to certain social histories, as when “you and I” migrated from north Africa to the Caucasus Mountains (47), or when “you and I arrived in America from England in 1630” (58). The well-known metaphor on the banality of evil, used by Arendt on the trial of the Nazi hierarch Eichmann in Jerusalem, can also be reviewed in the light of the so-called "affective turn" in the social sciences. Eichmann's tragic obedience to the creators of the Holocaust does not only derive from the renunciation to implement an autonomous thought, in the context of the Nazi system, but also from a deep inability to feel emotions and to develop empathic relationships. This allows (...) a process of identification with the manipulation of emotions and feelings put into practice by the regime and at the same time a process of pathological detachment towards the politically persecuted by the regime itself. Colin McGinn's The Meaning of Disgust numbers among several scholarly books on disgust that have been published in the last couple of years (including, in the interest of full and up front disclosure, one by the writer of this review). McGinn's book argues for a coherent, if incredible, account of the essence of disgustingness and of the emotion of disgust, and reflects on the potential significance of that account for different areas of human concern. It also bears many of the (...) characteristics that readers of McGinn will have come to expect. The overall structure is tidy; the prose is flowery but lucid, though due to the subject matter here, often cloying; and for most part the discussion avoids technical jargon, with a brief discussion of encapsulation (59-60) and persistent use of the term "Sosein" being notable exceptions. These are exciting times for research on disgust, in large part because insightful contributions are being made from researchers whose approaches and disciplinary backgrounds differ, but whose interests have led them to converge on this puzzling emotion. Until recently, psychologists have conceptualised and studied trust in God (TIG) largely in isolation from contemporary work in theology, philosophy, history, and biblical studies that has examined the topic with increasing clarity. In this article, we first review the primary ways that psychologists have conceptualised and measured TIG. Then, we draw on conceptualizations of TIG outside the psychology of religion to provide a conceptual map for how TIG might be related to theorised predictors and outcomes.
