We investigated the contributions of familiarity of setting, self-relevance and self-projection in time to episodic future thinking. The role of familiarity of setting was assessed, in Experiment 1, by comparing episodic future thoughts to autobiographical future events supposed to occur in unfamiliar settings. The role of self-relevance was assessed, in Experiment 2, by comparing episodic future thoughts to future events involving familiar others. The role of self-projection in time was assessed, in both Experiments, by comparing episodic future thoughts to autobiographical (...) events that were not temporal in nature. Results indicated that episodic future thoughts were more clearly represented than autobiographical future events occurring in unfamiliar setting and future events involving familiar others. Our results also revealed that episodic future thoughts were indistinguishable from autobiographical atemporal events with respect to both subjective and objective detail ratings. These results suggest that future and atemporal events are mentally represented in a similar way. (shrink)

Lack of understanding about the relationship between federal and state educational institutions brings confusion into discussions of democracy, equity and equality in schools. The 'right to education' continues to be espoused by American society as a birthright, yet it does not figure in federal documentation. This matter has repeatedly come to the attention of legislative courts, who have insisted that the question of education as a fundamental right be addressed. Numerous court cases have attempted to bring closure on this issue, (...) on the basis of such abstractions as national rights, equal access, opportunity and economic disparity among the petitions. However, legal judgments remain inconclusive, reiterating that education remains a state legislative issue. This paper explores the implications of a fundamental right to education through an examination of federal and state legal litigation, discussing the philosophical and ideological roots of discussion of rights and democratic values, and evaluating how federal and judicial participation contributes to overall misunderstanding regarding public schooling. Using a recent result of Busch and Gudder, we reconsider a theorem of Ludwig which allows one to identify a class of effect automorphisms as the symmetry transformations in quantum mechanics.

This paper discusses, within the context of analytical theory, some of the implications when rape is subsumed within the international crime of genocide and concludes that this type of enquiry is essential for creating a clearer framework to address and understand this violation. From the analysis undertaken, two critical questions become apparent: a) Does compatibility exist when rape is subsumed within the category of a group violation (genocide), if rape is constructed as a violation of an individual’s sexual autonomy? i (...) b) Is the link between rape and genocide necessarily problematic within this notion of autonomy for the individual victim of rape? The process unfolds within an analytical theoretical approach that touches upon the current concept of human rights with its focus on the individual. Although the key element is the individual, the concept of human rights also creates a space, albeit limited and at times controversial, for the group. As such, this paper identifies some of the theoretical implications that emerge once rape is subsumed within the international crime of genocide, which is defined as a violation committed against particular groups. The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. In this paper, we will survey the different uses of the term algorithm in contemporary legal practice. We will argue that the concept of algorithm currently exhibits a substantial degree of open texture, co-determined by the open texture of the concept of algorithm itself and by the open texture inherent to legal discourse. We will substantiate our argument by virtue of a case study, in which we analyze a recent jurisprudential case where the first and second-degree judges have carved-out contrasting (...) notions of algorithm. We will see that, thanks to our analysis of the open texture of the notion of algorithm in legal language, we can make sense of the different decisions taken by the judges as different contextually-determined sharpenings of the concept of algorithm. Finally, we will draw some general conclusions concerning the use of technical terms in legal instruments that address new technologies, such as the EU AI Act. (shrink)

The philosophical literature that tackles foundational questions about normativity often appeals to normative reasons—or considerations that count in favor of or against actions—and their interaction. The interaction between normative reasons is usually made sense of by appealing to the metaphor of (normative) weight scales. This paper substitutes an argumentation-theoretic model for this metaphor. The upshot is a general and precise model that is faithful to the philosophical ideas.

In this article we explore the ethical issues raised by permitting patients to pay for participation (P4) in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. We conclude that such trials could be ethical under certain strict conditions, but only if other potential sources of funding have first been (...) explored or are unavailable. (shrink)

No menos importante es presentar el tema de su sexualidad, su postura filosófica ante el dolor humano y su ataque a los convencionalismos. Se consideraron médicos del alma, permaneciendo (...) como una escuela inclasificable a lo largo de la historia de la filosofía. Presentamos su concepción del cuido de sí en tanto un apartarse de los demás, es decir, estableciendo un cuido contra los demás, sin obviar al otro sino enfrentándolo a su ignorancia. Por meio dessa teoria ele pensa os diversos níveis da existência, indo desde elementos ínfimos e simples até estruturas complexas, com elevado grau de refinamento. Tudo não passa, segundo esse filósofo, do desenrolar de forças em jogo agonístico por um algo a mais de poder. Neste artigo nós analisamos alguns aspectos da teoria da vontade de poder para mostrar como (...) Nietzsche faz uso de um mesmo arranjo conceitual para qualificar toda a existência. This contribution addresses some bioethical and medico-legal issues of the opinion formulated by the Italian National Bioethics Committee (CNB) in response to the dilemma between the State’s duty to protect the life and health of the prisoner entrusted to its care and the prisoner’s right to exercise his freedom of expression. The prisoner hunger strike is a form of protest frequently encountered in prison and it is a form of communication but also a language used by the prisoner in order (...) to provoke changes in the prison condition. There are no rules in the prison regulations, nor in the laws governing the legal status of prisoners, that allow the conscious will of the capable and informed subject to be opposed and forced nutrition to be carried out. However, this can in no manner make therapeutic abandonment legitimate: the medical doctor should promote every action to support the patient. In the recent opinion formulated by the CNB it was remarked how self-determination is a central concept in human rights and refers to an individual’s ability to make autonomous and free decisions about his or her life and body. Ethics review committees have become a common institution in English-speaking research communities, and are now increasingly being adopted in a variety of research environments. In light of existing debates on the aptness of ethics review boards for assessing research work in the social sciences, this article investigates the ways in which researchers navigate issues of research ethics in the absence of a formal review procedure or of an ethics review board. Through the analysis of qualitative and quantitative data, the article (...) questions the overall utility of ethics review boards. Highlighting the importance of space for sharing, the authors argue for the development of a new type of structure that takes into account researchers’ ‘ethos of responsibility’ as an adequate ethical compass for research in the social sciences. ArgumentSince the linguistic turn, the role of rhetoric in the circulation and the popular representation of knowledge has been widely accepted in science studies. This article aims to analyze not a textual form of scientific rhetoric, but the crucial role of materiality in scientific debates. It introduces the concept ofmaterial rhetoricto understand the promotional regimes in which material objects play an essential argumentative role. It analyzes the phenomenon by looking at two students of prehistory from nineteenth-century Belgium.In the study of (...) human prehistory and evolution, material data are either fairly abundant stone tools or very scarce fossil bones. These two types of material data stand for two different strategies in material rhetoric. In this article, the first strategy is exemplified by Aimé Rutot, who gathered great masses of eoliths. The second strategy is typified by the example of Julien Fraipont, who based his scientific career on only two Neanderthal skeletons. Rutot sent his “artifacts” to a very wide audience, while Fraipont showed his skeletons to only a few selected scholars. Unlike Rutot, however, Fraipont was able to monitor his audience's interpretation of the finds by means of personal contacts. What an archaeologist gains in reach, he or she apparently loses in control. In this article we argue that only those scholars who find the right balance between the extremes of reach and control will prove to be successful. (shrink)

The issue of trust has increasingly attracted attention in the business ethics literature. Our aim is to contribute further to this literature by examining how the use of the carbon copy function in email communication influences felt trust. We develop the argument that the use of cc enhances transparency—representing an important characteristic of workplace ethics—and hence promotes trust. We further argue that a downside of the cc option may be that it can also be experienced as a control mechanism, which (...) may therefore negatively affect trust. The results of our first study showed that the use of cc indeed enhances perceived transparency, but at the same time also leads to the experience of increased control. Building upon this insight, the findings of five subsequent studies consistently revealed that the use of cc negatively influences felt trust. More precisely, employees felt trusted the least when the supervisor was always included in cc. This effect on felt trust also negatively influenced how trustworthy the organizational climate was perceived. We further replicated these results in two field surveys, which showed that the negative effect of cc on felt trust lowered perceptions of psychological safety and contributed to a culture of fear. Taken together, our findings suggest that when transparency in email communications is experienced as a control mechanism, its use is perceived as unethical, rather than as ethical. Implications and recommendations for future business ethics research are discussed. (shrink)

Ethical questions about information and communications technologies have been debated since World War II. Western democracies have had more than 50 years of experience in addressing and organising the ethical, social and legal aspects of scientific and technological developments. However, this expertise, tradition and experience are not enough to manage the most urgent ethical and social issues and contemporary challenges involving ICT. A systematic and institutional organisation of social values in the context of modern ICT tools is needed.This paper focuses (...) on four major areas: developing a specific approach to ethical issues raised by ICT; describing in more detail the age-related digital divide in Europe; identifying technology trends and emerging challenges; and defining the legal framework for inclusion of senior citizens in the digital society. The paper then concludes with a summary of its key points on the basis of which it makes three proposals as a contribution to efforts aimed at overcoming the exclusion of senior citizens from today's Information Society. Cultural diversity between residents and staff is significant in aged care homes in many developed nations in the context of international migration. This diversity can be a challenge to achieving effective cross‐cultural communication. The aim of this study was to critically examine how staff and residents initiated effective cross‐cultural communication and social cohesion that enabled positive changes to occur. A critical hermeneutic analysis underpinned by Giddens’ Structuration Theory was applied to the study. Data were collected by interviews with residents or (...) their family and by focus groups with staff in four aged care homes in Australia. Findings reveal that residents and staff are capable of restructuring communication via a partnership approach. They can also work in collaboration to develop communication resources. When staff demonstrate cultural humility, they empower residents from culturally and linguistically diverse backgrounds to engage in effective communication. Findings also suggest that workforce interventions are required to improve residents’ experiences in cross‐cultural care. This study challenges aged care homes to establish policies, criteria and procedures in cross‐cultural communication. There is also the challenge to provide ongoing education and training for staff to improve their cross‐cultural communication capabilities. (shrink)

Pretendo debater, neste trabalho, três pressupostos que subjazem o desenvolvimento argumentativo do ensaio: I) a ideia presente no Tratado de que os homens se guiam pelos seus afetos ou, grosso modo, que a sociabilidade é permeada por paixões que se chocam, todo o tempo, com a vontade e interesse alheios (Hume também entende, como parece ter sido o caso de Maquiavel e Shaftesbury, que a sociedade, como um corpo, expressa um humor espelhado e forjado no jogo e conflito dos afetos (...) humanos); II) a compreensão de que o onflito, as disputas, o dissenso são constitutivos do mundo político, não devendo ser encarados como males a ser extirpados; III) a tese de que a estabilidade dos governos não requer a negação e supressão das disputas, mas antes se constituinum fino equilíbrio entre polos conflitantes, equilíbrio esse que é resultante de certos artifícios humanos (a saber, da invenção, instituição e controle das leis, de um sistema jurídico capaz de mediar as disputas políticas e sociais). Esta investigación analiza la presencia del discurso eurocéntrico en los manuales de Historia del Arte de Bachillerato desde una dimensión sociogenética. La muestra se compone de ejemplares pertenecientes a editoriales españolas de alcance nacional (Anaya, ECIR, Ediciones Ruiz, SM, Teide y Vicens Vives) en una cronología que comprende los distintos periodos por los que ha atravesado la materia entre 1953 y 2006. El estudio deriva de la aplicación de un guion de análisis documental que contempla, entre sus variables, la construcción (...) de identidades. Los resultados muestran la presencia y resistencia sociohistórica del discurso eurocéntrico en los manuales de Historia del Arte analizados, tendiéndose con ello a la construcción, reproducción y esencialización de identidades etnocéntricas. De este modo, para ahondar en la formación de una ciudadanía crítica, se hace necesario replantear los enfoques y las finalidades que fundamentan el relato de la Historia del Arte escolar en recursos como el que nos ocupa en este trabajo. Este trabajo presenta los resultados preliminares obtenidos en la conformación del Atlas Iberoamericano en Bioética que ha desarrollado el Centro Anáhuac de Desarrollo Estratégico en Bioética (CADEBI) respecto a la identificación y análisis de las instituciones de Bioética existentes en la Región. Se realizó una revisión documental a través de motores de búsqueda, bases de datos, redes sociales y otras fuentes. La información obtenida se agrupó en seis diferentes categorías de acuerdo con la estructura, objetivos y actividades que desarrollan. De (...) esta manera, se realizó un diagnóstico inicial con base en las fuentes documentales disponibles en la Web. Como parte de los resultados, se identificaron 157 instituciones en 25 países; así como la variación en la densidad institucional, concentrándose principalmente en España (29 instituciones), México (26 instituciones), Argentina (17 instituciones), Brasil (13 instituciones), Chile (11 instituciones) y Colombia (8 instituciones). Además, se resalta la importancia de las comisiones nacionales de bioética en el desarrollo institucional, señalando la relación entre el avance científico y tecnológico de los países y el desarrollo de la bioética. El texto concluye con la propuesta de crear un Observatorio de la Red Iberoamericana de Bioética para documentar y promover el intercambio institucional y científico en la Región, así como algunas recomendaciones derivadas del desarrollo de este trabajo. This article deals with the historical position of Domingo Báñez in the De Auxiliis Controversy. He was a protagonist of the beginning of the dispute and his name was used by the defenders of Luis de Molina to describe the traditional Thomist account on divine providence and free will; even today, many Thomists use the name of Báñez to designate their own position. This article tries to determine his personal opinion regarding the ontology of physical premotion without presupposing the later (...) development of Bañecian doctrine. Most Thomists conceive it as a kind of entity inherent in the creature, but Báñez did not interpret it this way in his own account. According to him, God moves the created will so that the free human act is the first new entity in the creature, and it is produced by both God and created free will. (shrink)

Previous research has found that news coverage on immigration is often biased in negative ways and that it inspires the formation of negative attitudes towards immigrants. However, academic research about this link between news consumption and attitudes towards immigrants among adolescents remains limited. The current study aims to test this association from a media-exposure and intergroup-contact perspective using survey data from 875 adolescents in Flanders, Belgium. The findings show that only television news consumption, thus no other types of news consumption, (...) was associated with adolescents’ attitudes towards immigrants. Intergroup contact within the friend group, outside the school context, was linked to more positive attitudes. This study nuances earlier findings that news consumption predicts attitudes towards immigrants. Implications for future research are discussed. (shrink)

This book stems from an examination of how Western philosophy has accounted for the foundations of law. In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the (...) question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. The aim of this book is to approach the foundations of law from a series of different angles so that we can begin to see that those foundations are always in question and open to the possibility of dialogue. In Olivi´s division of the sciences, which can be found in his treatise De perlegendis philosophorum libris, c. 9, there seems to be a twofold place for metaphysics: one as part of the theoretical sciences and another as part of the practical, alongside medicine and ethics. This view is based on a misreading of the manuscripts. For the second appearance of metaphysics one should read “mechanica” instead. Thus, this paper shows that the thesis of an unconventional approach to metaphysics in (...) Olivi cannot be sustained by De perlegendis philosophorum libris. (shrink)

This article discusses the fortune of Geoffrey de Ste. Croix’s famous article ‘The Character of the Athenian Empire’, and reassesses its basic thesis that the Athenian Empire was popular among the lower classes of the allied cities in the light of recent developments in the field. After surveying the article’s immediate and more recent reception, and discussing its relation with The Origins of the Peloponnesian War and The Class Struggle in the Ancient Greek World, it isolates four key new trends (...) in Greek history that, while going against some of Ste. Croix’s basic convictions, end up reinforcing his overall case. These are: a renewed attention to the mass and elite dichotomy, with recent work interpreting Greek oligarchy as a fundamentally reactive and anti-demotic regime; the recognition of the continued relevance of Persian meddling in the later fifth-century; a sea-change in Attic epigraphy which has led to the post-dating of several ‘imperial’ decrees; the new recognition of the dynamism of the Greek economy, and of the economic function of the Athenian Empire itself. Finally, the article addresses the paradigm of class struggle and stresses how democracy and economic dynamism, to which the Athenian Empire contributed, fostered the growth of slave markets and worsened the exploitation of ‘marginal’ regions as slave suppliers.
