Authorising euthanasia and assisted suicide with advance euthanasia directives is permitted, yet debated, in the Netherlands. We focus on a recent controversial case in which a Dutch woman with Alzheimer’s disease was euthanised based on her AED. A Dutch euthanasia review committee found that the physician performing the euthanasia failed to follow due care requirements for euthanasia and assisted suicide. This case is notable because it is the first case to trigger a criminal investigation since the 2002 Dutch euthanasia law (...) was enacted. Thus far, only brief descriptions of the case have been reported in English language journals and media. We provide a detailed description of the case, review the main challenges of preparing and applying AEDs for persons with dementia and briefly assess the adequacy of the current oversight system governing AEDs. BackgroundResearchers worry that patients in early-phase research experience unrealistic optimism about benefits and risks of participation. The standard measure of unrealistic optimism is the Comparative Risk/Benefit Assessment questionnaire, which asks people to estimate their chances of an outcome relative to others in similar situations. Such a comparative framework may not be a natural way for research participants to think about their chances.ObjectiveTo examine how people interpret questions measuring unrealistic optimism and how their interpretations are associated with their responses.MethodsUsing an early-phase (...) cancer trial vignette, we administered the CRBA to 297 adults from the general public. They estimated their comparative chances of risk and benefit, then provided rationales for their estimates.ResultsFor both CRBA benefit and risk questions, about 50% of respondents chose 0, and 50% chose a non-0 response. Respondents’ rationales for their estimates showed that overall only about 40%–44% gave comparative rationales, indicating that they interpreted the CRBA as intended. 68.7% of respondents who gave the ‘correct’ 0 rating gave comparative rationales, whereas only 11.6% of respondents who gave non-0 ratings did so. A similar trend was seen for chances of risk.ConclusionResearch participants may not understand comparative benefit and risk questions as intended; attributions of unrealistic optimism may require additional evidence that the respondents’ estimates are intended to be comparative. We are grateful to Jongsma et al 1 for their interest in our article analysing the case of ‘Mrs A’, a Dutch woman with Alzheimer’s disease who received euthanasia based on her advance euthanasia directive.2 Their commentary criticises two elements of our analysis. First, the authors believe our reasons for doubting that Mrs A had the capacity to write and revise an AED rely on ‘partial’ empirical data and rest on normative errors. Second, they use two of our statements to (...) suggest we must endorse some implausible claims, for example, that ‘… in all situations and for all people, current well-being should always take precedence over all other values’. Jongsma et al assert: ‘Miller et al argue that people with dementia are impaired to make decisions.’ This casts our probabilistic claim about Mrs A’s capacity as an absolute claim about persons with dementia in general. It also implies we are using an outdated diagnosis-based view of capacity. The accusation then becomes explicit : > … several empirical studies have shown that patients with dementia are able to actively participate in qualitative studies and can respond to open questions in a meaningful way,[2-8] as well that they are able to complete an advance directive in the early phases of dementia.[9, 10] One can therefore not simply conclude on the basis of the diagnosis of dementia …. Is the world internally connected by a web of necessary connections or is everything loose and independent? Followers of David Hume accept the latter by upholding Hume’s Dictum, according to which there are no necessary connections between distinct existences. Roughly put, anything can coexist with anything else, and anything can fail to coexist with anything else. Hume put it like this: “There is no object which implies the existence of any other if we consider these objects in themselves.” Since (...) Hume’s day, Hume’s Dictum has played a major role in philosophy, especially in contemporary metaphysics. In ruling out necessary connections, Hume’s Dictum implies that causal relations and the laws of nature are contingent. It makes other demands on our metaphysics of science as well; for example, it places restrictions on our metaphysics of counterfactuals, dispositions, and explanation. The principle has applications in other areas too. Hume’s Dictum places constraints on our theories of abstract objects and moral properties. For example, Hume’s Dictum rules out the view that moral properties are distinct from, but necessarily connected to, non-moral properties. While Hume’s Dictum is a prominent principle in metaphysics, few Humeans have defended the principle at length. It is assumed more often than it is argued for. As a result, Hume’s Dictum no longer enjoys the reputation it once did. It’s common to hear complaints about the lack of arguments in support of Hume’s Dictum. Moreover, philosophers are increasingly willing to defend views that are at odds with Hume’s Dictum. A striking example of this is the recent explosion of interest in views that take causal relations and the laws of nature to be necessary. Humeans can no longer afford to be complacent. An extended defense of Hume’s Dictum is called for, and that’s what this dissertation aims to offer. This dissertation has three parts. In the first part, I lay out some preliminaries and offer a precise formulation of Hume’s Dictum. In the second part, I develop three arguments in favor of Hume’s Dictum. We propose an "explanation scheme" for why the Gibbs phase average technique in classical equilibrium statistical mechanics works. Our account emphasizes the importance of the Khinchin-Lanford dispersion theorems. We suggest that ergodicity does play a role, but not the one usually assigned to it.

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. The Boltzmann and Gibbs approaches to statistical mechanics have very different definitions of equilibrium and entropy. The problems associated with this are discussed and it is suggested that they can be resolved, to produce a version of statistical mechanics incorporating both approaches, by redefining equilibrium not as a binary property but as a continuous property measured by the Boltzmann entropy and by introducing the idea of thermodynamic-like behaviour for the Boltzmann entropy. This paper examines the discourses and practices of pedigree livestock breeding, focusing on beef cattle and sheep in the UK, concentrating on an under-examined aspect of this—the deselection and rejection of some animals from future breeding populations. In the context of exploring how animals are valued and represented in different ways in relation to particular agricultural knowledge-practices, it focuses on deselecting particular animals from breeding populations, drawing attention to shifts in such knowledge-practices related to the emergence of “genetic” techniques in (...) livestock breeding which are arguably displacing “traditional” visual and experiential knowledge’s of livestock animals. The paper situates this discussion in the analytical framework provided by Foucault’s conception of “biopower,” exploring how interventions in livestock populations aimed at the fostering of domestic animal life are necessarily also associated with the imperative that certain animals must die and not contribute to the future reproduction of their breed. The “geneticization” of livestock breeding produces new articulations of this process associated with different understandings of animal life and the possibilities of different modes of intervention in livestock populations. Genetic techniques increasingly quantify and rationalize processes of selection and deselection, and affect how animals are perceived and valued both as groups and as individuals. The paper concludes by emphasizing that the valuation of livestock animals is contested, and that the entanglement of “traditional” and “genetic” modes of valuation means that there are multiple layers of valuation and (de)selection involved in breeding knowledge-practices. The conservation laws do not establish the central premise within the argument from causal overdetermination – the causal completeness of the physical domain. Contrary to David Papineau, this is true even if there is no non-physical energy. The combination of the conservation laws with the claim that there is no non-physical energy would establish the causal completeness principle only if, at the very least, two further causal claims were accepted. First, the claim that the only way that something non-physical (...) could affect a physical system is by affecting the amount of energy or momentum within it, or redistributing the energy and momentum within it. Second, the claim that redistribution of energy and momentum cannot be brought about without supplying energy or momentum. Both of these claims, however, are exceedingly difficult to defend in the context of the argument. (shrink)

The osmotic activity produced by internal, non‐permeable, anionic nucleic acids and metabolites causes a persistent and life‐threatening cell swelling, or cellular edema, produced by the Gibbs‐Donnan effect. This evolutionary‐critical osmotic challenge must have been resolved by LUCA or its ancestors, but we lack a cell‐physiology look into the biophysical constraints to the solutions. Like mycoplasma, early cells conceivably preserved their volume with Cl−, Na+, and K+‐channels, Na+/H+‐exchangers, and a light‐dependent bacteriorhodopsin‐like H+‐pump. Here, I simulated protocells having these ionic‐permeabilities and (...) inhabiting an oceanic pond before the Great‐Oxygenation‐Event. Protocells showed better volume control and stable resting potentials at lower external pH and higher temperatures, favoring a certain type of extremophile life. Prevention of Na+‐influx at night, with low bacteriorhodopsin activity, required deep shutdown of highly voltage‐sensitive Na+‐channels and extremely selective K+‐channels, two conserved features essential for modern neuronal encoding. The Gibbs‐Donnan effect universality implies that extraterrestrial cells, if they exist, may reveal similar volume‐controlling mechanisms. (shrink)

We show that both positive and negative absolute temperatures and monotonically increasing and decreasing entropy in adiabatic processes are consistent with Carathéodory's version of the second law and we explore the modifications of the Kelvin–Planck and Clausius versions which are needed to accommodate these possibilities. We show, in part by using the equivalence of distributions and the canonical distribution, that the correct microcanonical entropy, is the surface (Boltzmann) form rather than the bulk (Gibbs) form thereby providing for the possibility (...) of negative temperatures and we counter the contention on the part of a number of authors that the surface entropy fails to satisfy fundamental thermodynamic relationships. This paper introduces a suite of articles devoted to Philip Kitcher’s The Main Enterprise of the World: Rethinking Education (Oxford University Press, 2021). The suite opens with a paper by Kitcher, which presents the central themes of his important book. This is followed by an assessment of the work as whole by John White, and four commentaries discussing in detail various aspects of Kitcher’s position by Ben Kotzee (on science education), Alexis Gibbs (on arts education), Sheron Fraser-Burgess (on deliberative (...) democracy and inclusivity), and Nigel Tubbs (on Kitcher’s ‘Deweyan Society’). The Mind in Nature has two central aims. First, that of defending a ‘basic ontology’. Second, having advanced a plausible ontological framework, to appeal to it to cast light on the status of intentionality and the nature of consciousness, paying particular attention to the question of what distinguishes conscious systems from those that are vegetative.Central to Martin's basic ontology is his acceptance of a realist conception of dispositionality. Contrary to the view of David Lewis and others, talk about a (...) thing's dispositions cannot be analysed as talk about a thing's behaviour in a set of counterfactual circumstances . The account of dispositions that emerges from Martin's discussion is one according to which a specific disposition is either actual or it is not. To be actual a disposition need not be manifesting any manifestation. Unmanifesting dispositions are not, therefore, unactualized possibilia – a description which, he observes, is more fitting of unmanifested manifestations . Conceptual integration theory (Fauconnier & Turner, 1998, 2002) is re-examined in the light of recent criticisms (e.g., Gibbs, 2000, 2001). It is argued that the assumption of four independent "cognitive spaces" enters the model primarily as an entailment of the "space," "blending," and "construction" metaphors, leads to unnecessary ambiguity, and works against statement of the theory in a form that supports derivation of testable hypotheses. Several examples from Fauconnier and Turner (2002) are analyzed to show that they can be (...) interpreted more simply, without need of four separate "spaces." In their paper "Why Gibbs Phase Averages Work--The Role of Ergodic Theory" (1980), David Malament and Sandy Zabell attempt to explain why phase averaging over the microcanonical ensemble gives correct predictions for the values of thermodynamic observables, for an ergodic system at equilibrium. Their idea is to bypass the traditional use of limit theorems, by relying on a uniqueness result about the microcanonical measure--namely, that it is uniquely stationary translation-continuous. I argue that their explanation begs questions about the (...) relationship between thermodynamic equilibrium and statistical equilibrium; I argue in addition that any account which supports their view of the relationship between these two notions of equilibrium will likely use the limit theorems in traditional ways, and thereby bypass the explanation they offer. In this essay I argue that Shelley's "A Defense of Poetry" is best understood as a defense of poetic language, which is in turn best understood as a defense of metaphorical language. According to Shelley, the metaphors of the poets reveal (extra-linguistic) reality, and have a truth value – they are true insofar as they capture reality. The literal language of "mere reasoners" of science and philosophy, by contrast, only reveals relations between ideas already known, and their statements are true (...) in virtue of the meanings of the words. Shelley's essays has been misunderstood because writers on metaphor such as David Cooper and Richard Rorty have assumed that metaphors are neither true nor false, and that defenders of metaphorical language such as Shelley are defending non-truth-apt language. Even those writers on metaphor who believe that metaphors are truth-apt, such as Raymond Gibbs, fail to understand that Shelley should be included in their number. (shrink)

Infectious diseases figure prominently as (counter)examples in debates on how to conceptualize “disease.” But crucial epidemiological distinctions are often not heeded in the debate, and pathological and clinical perspectives focusing on individual patients are favored at the expense of perspectives from epidemiology focusing on populations. In clarifying epidemiological concepts, this paper highlights the distinct contributions infectious disease epidemiology can make to the conception of “disease,” and the fact that this is at least tacitly recognized by medical personnel and philosophers. Crucially, (...) infectious disease epidemiology can help elucidate how carrying and transmitting infectious, communicable entities is a disease, even if the carriers themselves are not directly affected by symptoms detrimental to them. An analysis of the sources of Wittgenstein’s picture theory — which include not only his moment of insight on reading a magazine story about the use of models in a traffic court, but also the work of Russell, Hertz, and Boltzmann — provides the basis for an exploration of Wittgenstein’s articulation of a pictorial conception of representation in his wartime notebooks and its crystallization in the Tractatus. A discussion of Wittgenstein’s later criticism of the picture theory and his notion of (...) a “philosophical picture” illustrates the fundamental reversal in his transition to his later conception of philosophy: instead of taking literal pictures as a guide to the nature of meaning, he came to regard philosophical theories as akin to expressing an aesthetic preference for a certain style of representation. Wittgenstein’s treatment of factual language in the picture theory is related to his Tractarian approach to logical form, and the role of the show/say distinction in his early conception of logic and language. Particular attention is given to the difficulties generated by the idea that the conditions for the possibility of a given domain of discourse cannot be described in language, but must be shown by the form of words in question. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. This paper develops a theory of belief and belief ascription which retains the core of the received Propositionalist theory but which, unlike the Propositionalist theory, is compatible with both Direct Reference and Individualism about belief. The focus is on developing an alternative analysis of belief ascriptions, drawing out its implications, and applying it to some standard problems. On that analysis, ascriptions involving directly referential embedded terms are seen as roughly characterizing, but not specifying, the contents of beliefs. Psychologists debate whether mental attributes can be quantified or whether they admit only qualitative comparisons of more and less. Their disagreement is not merely terminological, for it bears upon the permissibility of various statistical techniques. This article contributes to the discussion in two stages. First it explains how temperature, which was originally a qualitative concept, came to occupy its position as an unquestionably quantitative concept (§§1–4). Specifically, it lays out the circumstances in which thermometers, which register quantitative (or cardinal) differences, (...) became distinguishable from thermoscopes, which register merely qualitative (or ordinal) differences. I argue that this distinction became possible thanks to the work of Joseph Black, ca. 1760. Second, the article contends that the model implicit in temperature’s quantitative status offers a better way for thinking about the quantitative status of mental attributes than models from measurement theory (§§5–6). Various scientists and philosophers have heavily criticized what they see as problematic forms of ‘nutritional reductionism’ or ‘nutritionism’ whereby studying food–health interactions at the level of isolated food components produces largely misguided science and misleading interpretations. However, the exact target of these diverse criticisms remains elusive, and its implications are overstated, which may hinder scientific understanding. To better identify the types of flaws supposedly hindering reductionist research, we disentangle three types of reductionist claims to better determine what the debate is (...) about and to propose ways to move it forward. We then present a qualified defence of the reductionist programme that hinges on the ability to identify nutritional causes that make a difference, which we illustrate through central examples in the history of nutrition. This defence is taken further by using insights from the philosophy of mechanisms to analyse how the field of nutritional ecology offers a synthetic framework to explain, generate, and test predictions about nutrient–organism interactions, which is premised on the biological mechanisms of nutrient-specific appetite regulation. The result, which we call ‘synthetic reductionism’, avoids many, though perhaps not all, of the challenges raised by anti-reductionists, and also highlights the potential of reductionism to identify nutritional difference makers. A key philosophical feature of Peter Jackson’s film interpretation of J.R.R. Tolkien’s The Lord of the Rings is its use of fantasy to inspire a “recovery” of the actual or, in other words, a reawakening to the beauty of nature and the many possible ways of living in healthier ecological relation to the world. Though none of these ways is perfectly achieved, this pluralistic view is demonstrated in the various lifeways of Hobbits, Elves, Men, and Ents. All of the positive (...) relationships embodied in the films—to trees, mountains, horses, and vegetable gardens—involve loving care and attention, receiving nourishment and livelihood without instrumentalization, or reducing nature to mere resource. The films also vividly display a variety of ugly and destructive ways of using the land to accrue power and wealth. These noxious ways, specifically because they actively destroy the lands that they use, always need more. They will thus eventually annihilate the beautiful ways of being if they are not actively resisted. Some of those who would rather be tending their own trees, gardens, or horses or even wandering in the wild forests must therefore turn their attention to struggle and resistance instead. This is a struggle full of grief, and at times even verging on despair, but it is marked by the refusal to give up hope. Indeed, what Jackson and Tolkien have to say about hope is as important in responding to the ecological crisis as anything they have to say about nature, inasmuch as they help to remind us that even in our own times, “there is still hope.”. The economist Paul Samuelson acknowledged that he was a disciple of Edwin Bidwell Wilson (1879–1964), an American polymath who was a protégé of Josiah Willard Gibbs. Wilson’s influence on the development of sciences in America has been relatively neglected, as he mostly acted behind the scenes of academia at the organizational and pedagogical fronts. At the basis of his activism were original ideas about the foundations of mathematics and science. This essay reconstructs Wilson’s career and foundational discussions, which evolved (...) as he reacted to David Hilbert’s mathematics, Bertrand Russell’s logic, Henri Poincaré’s conventionalism, Karl Pearson’s statistics, Charles Sanders Peirce’s inference theory, and Lawrence Henderson’s work in social sciences. In brief, after having started his professional life as a mathematician at Yale University (1902–1907), Wilson marginalized himself from mathematics and joined other academic communities and fields, working in mathematical physics at MIT (1907–1922) and in statistics, social science, and economics at Harvard University (1922–retirement). He defined mathematics as a language, meaning by this that mathematics and science were reciprocally indispensable, with the former providing structure and the latter meaning. In an American exceptionalist spirit, Wilson also meant to suggest that homegrown mathematical and scientific traditions should prevail over European ones. (shrink)

The growing interest in Africa as well as concerns about negative deviant behaviors and ethnic structures necessitates examination of the effect of ethnic expectations on behavior of employees. In this study we leverage insight from ethnos oblige theory to propose that centralization of ethnic norms moderates the relationship between benevolence expectations and negative deviant behavior. Using a cross-sectional design and data from two countries as well as moderation and cross-cultural analytic techniques, we find support for three-way interactions where the relationship (...) between benevolence and negative deviant behavior is moderated by centralization and culture. We discuss the implications of the findings which support the dynamic perspective of management in Africa. (shrink)

In particular, it often seems that atomic actions cannot be the result of cooperative activity between God and creatures since there is no apparent way to divide the labor between the two. However, the actions that are atomic in one model of divine action may not be (...) atomic on another. On fine-grained models there may be unexpected prospects for nonredundant divine action. Nothing can kill a promising research program in ethics more quickly than a plausible argument to the effect that it is committed to a morally repellent consequence. It is especially troubling when a theory one favors is jeopardized in this way. I have this worry about Harry Frankfurt's theory of free will, autonomous agency and moral responsibility, for there is a very plausible argument to the effect that aspects of his view commit him to a version of the late Stoic (...) thesis that acting freely is a matter of ‘making do,’ that is, of bringing oneself to be motivated to act in accordance with the feasible, so that personal liberation can be achieved by resigning and adapting oneself to necessity. In this paper I try to determine whether the theory does in fact commit Frankfurt (and adherents like me) to this result and, if so, what can be done to prevent it. (shrink)

There has been considerable recent interest in the “collective moral autonomy” thesis (CMA), that is, the notion that we can predicate moral successes, failures, and duties of collectives even if there are no comparable successes, failures, and duties among members. One reason why this position looks appealing is because the opposing individualist position seems to have what we might call an accounting problem. Individualists maintain that only individuals can be subjects of moral success, failure, or duty; however, many reasonable judgments (...) about collective actions include moral information on a scale and of a stringency that it does not seem possible to predicate even of the duties of members who have steering power in the actions of the collective. Here I offer a paradigm for thinking about responsibility judgments in organized collective cases to help individualism solve its accounting problem, and allow us to account within a strict individualist perspective for moral information that ostensibly favors CMA.
